    Description: This report contains a summary of the international deep sea mining expert workshop „A benefit sharing mechanism appropriate for the Common Heritage of Mankind”. The overall objective was to stimulate debate on the Common Heritage of Mankind and its benefit sharing element by discussing first ideas how the benefit sharing required by Article 140 paragraph 2 UNCLOS could be appropriately conceptualized in order to meet with the spirit and the requirements of the Common Heritage of Mankind principle. The participants discussed the legal framework of the common heritage of mankind, in particular its benefit sharing provision and the option of a full economic assessment of deep seabed mining operations.
    Description: Der vorliegende Bericht reflektiert die Präsentationen und Diskussionen der Teilnehmer des internationalen Experten-Workshops „A benefit sharing mechanism appropriate for the Common Heritage of Mankind“. Das Umweltbundesamt in Kooperation mit dem Institut for Advanced Sustainability Studies führte den Workshop vom 26. bis 29. November 2018 in Potsdam durch. Übergeordnetes Ziel des Workshops war es, die Debatte darüber anzuregen wie das Gemeinsame Erbe und der im Seerechtsübereinkommen Artikel 140 Absatz 2 angelegte gerechte Vorteilsausgleich („benefit sharing“) angemessen konzeptioniert und umgesetzt werden kann.

    Description: The marine environment, subject to multiple pressures, is transboundary by nature. For ocean management and conservation, there is a need of enhanced collaboration and cross-sectoral solutions. This project aimed to develop a participatory dialogue platform that strengthens cooperation within and between marine regions in line with the 2030 Agenda. The “Marine Regions Forum” brings together stakeholders for joint learning and exchange of good practices, developing recommendations or building of partnerships across sectoral and territorial boundaries. The report shows that the informal format of the "Marine Regions Forum" can complement global discussions and regional efforts alike and thus support processes of ocean governance.

    Description: Die arktische Umwelt ist vielen Einflüssen ausgesetzt, die ihren Fortbestand bedrohen: Der Klimawandel und seine Folgen stellen bereits jetzt viele Ökosysteme vor große Herausforderungen. Wirtschaftliche Aktivitäten in der Region, wie Fischerei, Schifffahrt, Abbau und Transport von Rohstoffen sowie Tourismus, erhöhen den Druck auf die Umwelt zusätzlich. Die Anstrengungen für einen ambitionierten Umweltschutz in der Arktis müssen weltweit – und auch von nicht-arktischen Staaten – gesteigert werden, um sie zu erhalten. Dieser Forschungsbericht führt Ergebnisse des UBA-Vorhabens zu „Umweltleitlinien deutscher Arktispolitik“ zusammen. Er zeigt mögliche Ansatzpunkte des deutschen Umweltressorts auf, den Umweltschutz in der Arktis auch aus der Position eines nicht-arktischen Staats zu fördern. Der Bericht beschreibt zudem die Aktivitäten des Vorhabens, die das Bewusstsein in der Öffentlichkeit dafür steigern sollten, dass wichtige Verbindungen zwischen Deutschland und der Arktis bestehen. Dazu zählen unter anderem ein Erklärfilm und eine öffentliche Veranstaltung.
    Description: The Arctic environment faces many influences that threaten its very existence: climate change and its impacts already present challenges for many ecosystems. Economic activities within the region, as fisheries, shipping, mining and transport of resources as well as tourism, add to the pressures on the environment. All states – including non-Arctic states – need to raise their ambitions for environmental protection in the Arctic to maintain its current situation. This research report contains the results of the UBA-project “Environmental guidelines of a Geman Arctic policy”. It highlights several starting points for the German environmental department to foster environmental protection in the Arctic, even from a non-Arctic state’s point of view. The report also describes the activities undertaken within the project to raise awareness with the general public on existing links between Germany and the Arctic. Those activities include inter alia an explanatory video and a public event.

    Description: Increasingly abundant big data and artificial intelligence applications are restructuring economic activities and daily life. This is epitomized in the notion of the smart city, and especially visible on our streets, where e-scooters or pool-riding services are added every month and reshape our mobility. It’s a time of experimentation and that may be a good thing. Yet, there are also signs of discontent, raising the question of how big data can be managed and organized in a way that reduces congestion and improves the daily travel routines of millions of citizens, supports the wider public good while also leveraging Israel’s potential as a start-up nation. Here, we take the example of smart mobility in Israel to investigate how integrated data management can multiply the benefits of big data applications, while effectively managing risks. We find that integrated data platforms offer an opportunity to leverage benefits if three key design principles are followed: 1) open (but not necessarily free) data access; 2) maintaining the privacy, agency and participation of individuals, users, and the public; and 3) tailoring mobility services to meet well-defined goals of public policy.

    Description: Dieser Bericht ist ein Ergebnis des Forschungs- und Entwicklungsprojektes "Ökologische Leitplanken für den Tiefseebergbau", Oktober 2015 bis Dezember 2017, in Auftrag gegeben durch das Umweltbundesamt, UBA. Aufgrund des in den letzten Jahren wiedererwachten Interesses für einen Abbau von Rohstoffen in der Tiefsee, und Anstrengungen, den notwendigen Rechtsrahmen in nationalen und internationalen Gewässern zu schaffen, wird jetzt dringend auch ein Konzept für den effektiven Schutz der Meeresumwelt vor den Folgen des Rohstoffabbaus erforderlich. Im sogenannten "Gebiet", dem Meeresboden jenseits nationaler Grenzen, hat die Internationale Meeresbodenbehörde, ISA, die Aufgabe, den Meeresboden und seine Rohstoffe im Namen von und zum Vorteil der gesamten Menschheit (‘for the benefit of mankind as a whole‘) zu verwalten. Dazu gehört der Erlass von Regeln, Bestimmungen und Verfahren, welche die Auswirkungen der mit der Erkundung und dem Abbau von Rohstoffen im Gebiet zusammenhängenden Tätigkeiten in einem Rahmen hält, welcher die Vorgaben für den "effektiven Schutz der Meeresumwelt vor den Folgen der Tätigkeiten", wie im internationalen Seerecht gefordert, einhält. Der vorliegende Text zeigt Möglichkeiten auf, wie die ISA mit dem Instrumentarium des modernen vorsorgenden und präventiven Umweltmanagements die regulatorische Kontrolle über die Umweltbelastungen durch Tätigkeiten im Gebiet ausüben kann. Angesichts der großen Wissenslücken über die potentiell betroffenen Tiefseeökosysteme und die möglicherweise eingesetzte Technik scheint es allerdings zur Zeit unmöglich, auch mit den besten Verfahren den Grad der zu erwartenden Umweltschäden einzuschätzen. Daher ist schon der Weg das Ziel, indem die ISA sich als moderne, umweltbewusste Organisation präsentiert, welche den Vorsorgeansatz und internationale Verpflichtungen zum Schutz der Meeresumwelt und zur nachhaltigen Entwicklung ernst nimmt und ihr Mandat unter Einbeziehung der derzeitigen und voraussichtlich zukünftigen Veränderungen der Meeresökosysteme bis in die Tiefsee ausübt.
    Description: This report presents findings from the research and development project "Ecological Safeguards for Deep Seabed Mining" commissioned by the German Environment Agency (UBA) to the Institute for Advanced Sustainability Studies (IASS) (October 2015 - December 2017). Interest in seabed mineral mining has renewed in recent years for various reasons and new offshore mining legislation is currently being developed for national and international waters. For this reason, agreement on the meaning of ‘effective protection of the marine environment from adverse effects arising from activities’ related to mining is needed. The International Seabed Authority (ISA) is mandated to manage access to and benefits from the seabed, subsoil and its mineral resources in the Area on behalf of mankind as a whole. This legal mandate comprises the development of rules, regulations and procedures for mining-related activities in the Area, which must prevent, reduce and control harm to the marine environment and ensure that such harm does not breach the standard of ‘effective protection’. The present text provides suggestions for how the ISA could effectively regulate the environmental effects of activities in the Area using a toolkit of modern, precautionary and preventive governance and management instruments and measures. However, due to large gaps in ecological knowledge and technical experience pertaining to the deep sea, it is currently impossible to predict with any certainty the degree of risk mining activities pose to deep sea ecosystems. By developing such a toolkit, the ISA could spearhead a modern, comprehensive approach to precautionary governance of the Area in line with today’s environmental challenges.

    Description: Die Studie Bundesrepublik 3.0 leistet einen Beitrag zur Vitalisierung der parlamentarisch-repräsentativen Demokratie, indem sie ein innovatives Konzept für Partizipation auf Bundesebene entwirft. Das Konzept wurde kokreativ in einem generativen Gestaltungsprozess entworfen,in den sowohl praktische Partizipations- und Prozesskompetenz sowie politikwissenschaftliche und verfassungsrechtliche Expertise eingeflossen sind. Das Ergebnis der Studie, ein Konzeptentwurf für wirksame nationale Beteiligungspraxis, beruht auf einer Gegenüberstellung von (1) offenen Gestaltungsfragen, die sich aus der Analyse von gegenwärtigen gesellschaftspolitischen Herausforderungen, den Schwierigkeiten von nationalstaatlichen Beteiligungsvorhaben und dem potenziellen Wirkvermögen unterschiedlicher Partizipationskonzepten ergeben sowie (2) von Gestaltungsmustern guter Beteiligungspraxis, die auf Grundlage einer Analyse von bestehenden Verfahren und theoretischen Konzepten kommunaler, regionaler und nationalstaatlicher Beteiligung extrahiert und herausgearbeitet werden. Das am Ende der Studie entwickelte innovative und praxistaugliche Modell, die Bundesbeteiligungswerkstatt, reagiert auf die beschriebenen Anforderungen – die offenen Gestaltungsfragen – und integriert die aus den Praxisbeispielen abgeleiteten Gestaltungsmuster. Es beinhaltet eine mögliche Einbettung der Bundesbeteiligungswerkstatt ins parlamentarisch-repräsentative System und lässt einen Gesamtverfahrensablauf erkennbar werden.
    Description: The study Federal Republic of Germany 3.0 contributes to stimulate the representative democracy in Germany by designing an innovative concept for participation on a national level. The concept emerged from a generative design process with experts from the background of designing and facilitating public participation processes as well as from theoretical political sciences and constitutional law. The result of this study, a concept for effective and inclusive national public participation, is based on (1) outstanding design questions, which emerge from actual socio-political challenges as well as difficulties and potential effects on national public participation projects combined with (2) design patterns based on an analysis on tested participation procedures and theoretical concepts of local, regional and national public participation. The result is a conceptual design for a "Bundesbeteiligungswerkstatt" (Federal Participatory Workshop). It is a future institutionalised national body for conducting participatory procedures as part of the overall democratic system of the Federal Republic of Germany. The Federal Participatory Workshop is an answer to the described requirements, design questions, and it integrates the design patterns derived from the examined case examples. The concept includes potential ways of embedding the model into the formal political structures to strengthen and enhance the democratic system by introducing more participation.
