    Description: In this article we examine how federal agencies use adaptive management. In order for federal agencies to implement adaptive management more successfully, administrative law must adapt to adaptive management, and we propose changes in administrative law that will help to steer the current process out of a dead end. Adaptive management is a form of structured decision making that is widely used in natural resources management. It involves specific steps integrated in an iterative process for adjusting management actions as new information becomes available. Theoretical requirements for adaptive management notwithstanding, federal agency decision making is subject to the requirements of the federal Administrative Procedure Act, and state agencies are subject to the states’ parallel statutes.     Description: Complexity science has spread from its origins in the physical sciences into biological and social sciences (1). Increasingly, the social sciences frame policy problems from the financial system to the food system as complex adaptive systems (CAS) and urge policy-makers to design legal solutions with CAS properties in mind. What is often poorly recognized in these initiatives is that legal systems are also complex adaptive systems (2). Just as it seems unwise to pursue regulatory measures while ignoring known CAS properties of the systems targeted for regulation, so too might failure to appreciate CAS qualities of legal systems yield policies founded upon unrealistic assumptions. Despite a long empirical studies tradition in law, there has been little use of complexity science. With few robust empirical studies of legal systems as CAS, researchers are left to gesture at seemingly evident assertions, with limited scientific support.     Notes: : Ecosystem management has become an important unifying theme for environmental policy in the past decade. Whereas the science of ecosystem dynamics suggests that it will remain difficult to define ecosystem borders and all of the natural and anthropogenic effects that influence them, the politics of ecosystem management require that a national ecosystem delineation standard be adopted. Moreover, a political framework for ecosystem management decision making must be designed in such a way as to complement the hierarchical, interrelated nature of ecosystems generally. This paper advocates that a watershed-based ecosystem delineation standard is the most politically suitable because it will be easily understood by the public and watersheds have a long history as a medium of environmental policy. The paper then proposes that the political framework for watershed-based ecosystem management must depend heavily on state and local autonomy, subject to federally prescribed standards and goals. The Coastal Zone Management Act provides a model for how a national ecosystem management policy can work within state and local watershed cultures and economies.

    Description: Over the past several decades, environmental governance has made substantial progress in addressing environmental change, but emerging environmental problems require new innovations in law, policy, and governance. While expansive legal reform is unlikely to occur soon, there is untapped potential in existing laws to address environmental change, both by leveraging adaptive and transformative capacities within the law itself to enhance social-ecological resilience and by using those laws to allow social-ecological systems to adapt and transform. Legal and policy research to date has largely overlooked this potential, even though it offers a more expedient approach to addressing environmental change than waiting for full-scale environmental law reform. We highlight examples from the United States and the European Union of untapped capacity in existing laws for fostering resilience in social-ecological systems. We show that governments and other governance agents can make substantial advances in addressing environmental change in the short term—without major legal reform—by exploiting those untapped capacities, and we offer principles and strategies to guide such initiatives.
