    Notes: In March 1954, the Central Committee of the CCP offered for discussion the initial draft of the Constitution which reflected the victories of the people's democracy and socialism. In this draft was systematised the new historical experience of the revolutionary struggle of the Chinese people and the accumulated experience of state building. In the discussion of the draft, which lasted more than two months, took part more than 8,000 representatives of various strata of the population.

    Notes: When the Chinese Communists finally consummated their seizure of power in mainland China, one of the first tasks which faced them was that of elaborating a formal institutional structure for the exercise of regular public authority. Indeed, while the new leadership now undoubtedly enjoyed de facto control over the country and the mass of the people, it found itself quite destitute of those normal channels of state regulation and administrative management which serve to bestow legitimacy on a claimant to the role of national government and to distinguish a duly constituted, relatively stable political order from an altogether fluid interlude of revolutionary action predicated on ad hoc use of organised force under a central direction. The Party soon moved to make up for this grave deficiency by creating, on paper at least, a complex mechanism of state administration to back up its bid for recognition as the official spokesman for the Chinese nation and, concurrently, provide it with the wherewithal to play that role effectively.

    Notes: In considering the organisational evolution and functional development of the office of the people's procuratorate in Communist China from 1951 to 19S4, a clear-cut distinction must be drawn between the two subsidiary stages into which this phase of the institution's history readily breaks down. The first spans the years 1951–52; the second extends through 1953 and 1954. For purposes of analysis, it would be best to keep them separate, for reasons that will soon become apparent.

    Notes: Despite the noticeable progress registered since 1954 in the reorganisation of a civilian administrative structure in North Vietnam, after three years much still remained to be done. In particular, while the régime had, from the very start, repeatedly pledged itself to hold popular elections at the earliest possible opportunity to all organs of government, these promises had never been kept, probably out of a desire not to upset the delicate political balance between North and South engineered by the Geneva agreements and to give the South a convenient pretext for repudiating them. But, when the deadline set at Geneva for a referendum in both halves of the divided land on the question of re-unification had expired and it became apparent to Hanoi that it could no longer hope to gain control of South Vietnam at the polls, the last reason for postponing unilateral action in the North vanished. By 1957, official sources in the D.R.V. were openly acknowledging that the situation with regard to elections had indeed become anomalous and even admitting thatthe state apparatus had not yet become sufficiently strong; in many places organs of people's power had not been re-elected for a long time. In some areas people's Councils have almost not been functioning at all or have functioned only formally. Some administrative committees were being appointed by higher organs, whereas they had to be elected by people's Councils.

    Notes: When the Geneva agreements of July 1954 at Jast brought a measure of peace back to Indo-China, the Viet-Minh régime found itself in legal and recognised possession of that section of the country which lay north of the seventeenth parallel and which is officially known today as the Democratic Republic of Vietnam. By then, part of this area, comprising the Viet-Minh's war-zones I, II, III and most of IV, thirty-three provinces in all, had already long been held by Ho Chi Minh's troops and in much of it a semblance of the new order's system of local government had been in regular operation for some years back. In a good deal of the rest, clandestine and fragmented centres of rebel control had perilously co-existed throughout the war with the old administration maintained at great cost by the French authorities. Finally, in many places, particularly the urban concentrations, no appreciable degree of Viet-Minh influence had managed to last out the conflict.

    Notes: Ever since it first raised the standard of revolt in Japanese-occupied French Indochina, the Viet-Minh régime has devoted an inordinate amount of time and attention to problems of local government and administration. The emphasis was just as apparent in its first Basic Law of 1945 as in the latest organic act of the Democratic Republic of Vietnam, which went into effect in 1960, and in the manifold supplementary statutes promulgated in the interim to implement the constitutional provisions. This obvious concern on the part of Ho Chi Minh's leadership with the instrumentalities of local rule may be explained by reference to two different, though closely related, sets of considerations.
