    Description: This article explains how it came to be, how it was, and what we expect from academic Criminology at the Professional Law School of the Universidad Nacional del Altiplano de Puno after the bicentennial of Peru, and we conclude that academic criminology was developed in the Faculty of Jurisprudence of the National University of San Carlos de Puno, it was formally created as a course in the Faculty of Legal and Political Sciences of the National University of the Altiplano of Puno, it was a traditional content course dedicated to etiology, progressively it developed a biospisosocial criminology of the crime and we hope that Criminology after the bicentennial of Peru, has a critical and precautionary content that allows the construction of a regional criminological knowledge capable of understanding the reality of Peru and Puno, for the prevention of genocide and massacres, and the containment of punitive power.

    Description: Worldwide, the demand for digital services is concentrated on a few, extremely powerful companies. An international competition policy debate has been initiated as to the extent to which ex-post abuse control under competition law needs to be supplemented by ex-ante regulatory measures. Various studies have been published that deal with the design of possible regulatory measures and the prediction of the regulatory consequences to be expected. Findings from comparable sectors that have been the subject of comparable regulation for decades were ignored. The necessity of sector-specific ex-ante regulation in the digital economy is analyzed based on findings from the regulation of the telecommunications sector in Germany and Switzerland (2004-2020).
    Description: Weltweit konzentriert sich die Nachfrage nach digitalen Diensten auf wenige, überaus marktmächtige Unternehmen. International wurde eine wettbewerbspolitische Debatte darüber angestoßen, inwieweit die wettbewerbsrechtliche ex-post Missbrauchskontrolle einer Ergänzung durch regulatorische ex-ante Maßnahmen bedarf. Verschiedene Studien wurden veröffentlicht, die sich der Ausgestaltung möglicher regulatorischer Maßnahmen und der Prognose von zu erwartenden Regulierungsfolgen widmen. Unbeachtet blieben Erkenntnisse aus vergleichbaren Sektoren, die bereits seit Jahrzehnten den Gegenstand vergleichbarer Regulierung bilden. Analysiert wird die Erforderlichkeit sektorspezifischer ex-ante Regulierung in der digitalen Ökonomie anhand von Erkenntnissen aus der Regulierung des Telekommunikationssektors in Deutschland und der Schweiz (2004-2020).

    Description: If the journalistic media are to be able to effectively perform their essential democratic tasks of forming public opinion and controlling state power, they must be independent of the state. At the same time, this state has to guarantee a diverse range of media and to inform the public about its activities. This tension is intensifying in the internet age, in which the expensive production of journalistic content is less and less taken for granted. This updates the state's duty to ensure media pluralism, for example by organizing a public service system or other promotional measures, and to carry out active public relations work. This in turn increases the risk that the state will influence media activity or become the media provider itself. The limits that the state has to observe in this context are worked out in this book on the basis of a cross-media, constitutional and international law analysis of the principle of the media's independence from the state.
    Description: Sollen die journalistischen Medien ihre demokratiewesentlichen Aufgaben der öffentlichen Meinungsbildung und der Kontrolle staatlicher Macht wirksam wahrnehmen können, müssen sie vom Staat unabhängig sein. Gleichzeitig hat ebendieser Staat ein vielfältiges Medienangebot zu gewährleisten und die Öffentlichkeit über seine Tätigkeiten zu informieren. Dieses Spannungsverhältnis verschärft sich im Internetzeitalter, in welchem die teure journalistische Inhaltsproduktion immer weniger als gesichert gilt. So aktualisiert sich dadurch die staatliche Pflicht, den Medienpluralismus etwa durch die Organisation eines Service public-Systems oder anderweitiger Fördermassnahmen zu sichern und eine aktive Öffentlichkeitsarbeit wahrzunehmen. Dies erhöht wiederum die Gefahr, dass der Staat die Medientätigkeit beeinflusst oder selber zum Medienanbieter wird. Welche Grenzen der Staat in diesem Kontext zu beachten hat, wird in diesem Buch anhand einer mediengattungsübergreifenden verfassungs- und völkerrechtlichen Analyse des Prinzips der Staatsunabhängigkeit der Medien herausgearbeitet.

    Description: This dissertation examines intelligence surveillance of private telecommunications and its compatibility with the international human right to privacy in Art. 17 ICCPR and in Art. 8 ECHR. These articles provide comprehensive protection against the most modern forms of surveillance including bulk interception. Several criteria apply in terms of the foreseeability of the surveillance laws. Telecommunication’s interception should be subject to authorisation and supervision by independent authorities and effective remedies should be available. Moreover, the study analyzes the extent to which the surveilling state and the state of residence violate their human rights obligations in cases of cross-border surveillance. The main question is whether the established definitions of "jurisdiction" are applicable to this extraterritorial scenario. The extraterritorial exercise of jurisdiction can also be based on effective control over specific objects relevant to human rights. According to this approach, telecommunications data are objects relevant to individual’s right to correspondence and data protection.

This Compendium contains documents on human rights adopted under the auspices of the African Union (AU) and its predecessor, the Organization of African Unity (OAU), including documents adopted by the African Commission on Human and Peoples’ Rights, the African Court on Human and Peoples’ Rights and those relating to the African Peer Review Mechanism (APRM) of the New Partnership for Africa’s Development (NEPAD). The earlier editions of the Compendium have been used widely by judges, lawyers, civil servants, NGOs and academics alike, in Africa and abroad, who have an interest in the African human rights system. Many of the documents reprinted here are also available in the reference work Human Rights Law in Africa (2004), edited by Christof Heyns and Morné van der Linde, and the African Human Rights Law Reports. These two publications contain many more sources than are reprinted here. For comprehensive coverage of human rights law in Africa and for updates on this material, see www.chr.up.ac.za. The titles of documents used in the table of contents have in many cases been abbreviated; the full titles are used as headings in the text.     Description: It is rare for a physician to be disbarred; it is even rarer for the disbarment to have a retroactive effect back to the time of granting. The prerequisite for this effect is that the license to practice medicine should not have been granted in the first place, either because the requirements for the training of the future physician were not met or because character defects (unworthiness, unreliability) prevented the person concerned from working as a physician. Although practically rare, the revocation of a license to practice medicine is of particular academic interest because it ultimately results in the entire medical activity of the person affected being subsequently deprived of its legal basis. Strictly speaking, in consequence, each medical intervention becomes unlawful, thus (under certain circumstances) constituting a bodily injury under criminal law as well as giving rise to liability for damages under civil law. However, neither the criminal nor the civil law consequences of such retroactivity have yet been examined in a scientifically sound manner, even to a rudimentary degree. The present dissertation is intended to close this gap, at least in the area of civil law.

    Description: This book is centred on the proposal of a new organic criminal discipline for sexual offences in Italy. The Foreword introduces innovative concepts and 'general' breakdowns relating to sexual criminal law. Chapter 1 then addresses a critical analysis of the current discipline, pursuant to articles 609-bis and following of the Criminal Code and the related case law. Chapter 2 tables an in-depth comparative analysis of the legislation governing sexual offences in Germany, Portugal, France and England, which is also extended to legal theory and practice. Chapter 3 then presents, complete with detailed commentary, an organic project of reform for Italian legislation, characterised by a total discontinuity with the current discipline, where the principal incriminations hinge upon the mere 'sexual dissent' of the victim, breaking down different types of sexually relevant behaviour that are at present all lumped in together in the melting-pot of "sexual assault" into three different offences, while also introducing other incisive innovations.

    Description: In German literature, the doctrine of objective attribution has long since established itself as the prevailing opinion. In Switzerland, it has found its way into the literature and has already been included in the case law of the Federal Supreme Court on negligence offences. However, critical voices point out that the current status of the discussion is characterized by a large number of different approaches, some of which differ only marginally. A look at the literature actually shows that many essential questions, such as the raison d'être of individual aspects of attribution, are still disputed today. In this dissertation, Nicolas Leu therefore subjects objective attribution to a comprehensive and critical review that also takes into account the criminal offense system in which objective attribution is embedded.

In der Schweiz hat sie Eingang in die Literatur gefunden und ist bereits in die Rechtsprechung des Bundesgerichts zum Fahrlässigkeitsdelikt eingeflossen. Kritische Stimmen weisen jedoch darauf hin, dass der Diskussionsstand durch eine Vielzahl verschiedener, teilweise nur marginal abweichender Lösungsansätzen geprägt sei. Ein Blick in die Literatur zeigt tatsächlich, dass viele wesentliche Fragen, wie etwa die Existenzberechtigung einzelner Zurechnungsgesichtspunkte, auch heute noch umstritten sind. In der vorliegenden Dissertation unterzieht Nicolas Leu die objektive Zurechnung daher einer umfassenden und kritischen Überprüfung, die auch das Straftatsystem mitberücksichtigt, in das die objektive Zurechnung eingebettet ist.

    Description: The phenomenon of proliferation of international organizations has urged focus on the responsibility of international organizations under international law as the effect of their activities is witnessed everywhere in our daily life. The main purpose of the present book is to examine and review some specific aspects relevant to the question of international legal responsibility of international organizations, mainly, with a view to assessing the International Law Commission’s work on the codification of the international legal rules applicable on international organizations in this area. At the same time, the intention is to address the major challenge to the codification of general rules for international organizations, namely, their wide-varying nature and their differences from each other. Furthermore, the perspective has been enlarged by elaborating on the broader concept of accountability of international organizations.

    Description: About the publication All the chapters in this volume in one way or another reflect on change and transformation and how these changes/ transformations affect our sexed and gendered lives. The continuance of binaries, and objectifications and the maintenance of patriarchy notwithstanding these changes are teased out in various themes by the different authors. The contributions expose also how new approaches to how we live sex and gender do not necessarily manage to break or even radically challenge the old. From new technologies that can 'transform' gender, to new forms of pornography, freedom of sexual orientation, the creation of shopping malls, attempts to understand reproductive choices, restorative justice as response to sexual violence, women's testimonies, and women's mobility - all attempts are still hindered by conventional frameworks, structures and thought. A central call that emerges from all the contributions is one for more theory and more gender sensitive research and more listening to previously silenced voices.     Description: Approximation of Turkish Law with European Union Law maintains its importance and actuality apart from the context of full membership goal as well. Global trade requires interplay between all world countries with regard to the development and formation of public and private law. Private law regulations in Continental Europe, that constitute models for Turkish law, have been developing under the influence of European Union Law. In any field of law, the authority of the European Union to intervene in national laws is limited to the competences provided by the Treaties. Therefore, acts of the European Union in the field of private law aims the improvement of the internal market and enhanced cooperation between the Member States both by harmonization of national laws and their implementation. Studies and proposals carried out by the European Union for the harmonization of laws should be/are closely followed by our country. Establishment of Customs Union between Turkey and European Union in 1995 with the 1/95 numbered Community Council Decision and initiation of accession negotiations in October 2005 have accelerated the harmonization process of Turkish law with the European Union law. In the heat of these events, it can be observed that the preamble of most of the main codifications and secondary regulations in the field of company law, banking and capital markets law, intellectual and commercial property law, competition law, consumer law and protection of personal data law; reflects the aim of approximation with European Union legislation. Turkey’s geographical location, parallelly the fact that majority of the states, which Turkey has economical, cultural and sociological relations with, are members of the European Union following the impact of European Union on the model laws of Turkish laws, including Swiss law which keep tab on European Union law, necessitates the harmonization of European Union law to remain on Turkish lawyers’ agenda in the future as well. Hence, this Book Project has been prepared by the first documentation center acknowledged by European Union’s competent publishing and distribution bodies, Istanbul University Faculty of Law European Law Application and Research Center, with the object of providing a source for publications and conferences of Turkish lawyers who are keen to work in this field. This Project is an academic study and reflects the evaluation of the authors on harmonization of Turkish law with European Union law and their opinions for the methodology for an approximation of Turkish legislation. Although it is not either an official report or an action plan, it has been prepared with the view of providing a reference to public authorities, especially Ministry of Foreign Affairs Directorate for European Union Affairs and European Union harmonization offices in other relevant ministries. The preparation phase of this Project includes determination of the subdisciplines of Turkish private law, in which harmonization with European Union law, has been taken in regard. The specification of a certain topic is left to the authors. As a matter of course, it was not possible for us to cover all the subdisciplines of private law likewise to examine the entire European Union acquis in the included fields. Our perspective is to provide an insight into European law, its comparison with European Union law and evaluation of alignment. With this regard, every contributor examined the regulation which includes the most general rules on that topic. Although the examined regulations have been enacted on the legal basis of the Treaties, the relevant articles have been explained under the “Remarks” title. In this way, with the exception of topics under “Competition Law” chapter, only the masthead of the acts of European Union organs are shown under the “Legislation” title. Besides, all the examined European Union legislation and their legal basis are shown in the European Union legislation list and index at the end of this book. Subdisciplines of private law to be studied has been designated taking into account several factors, such as the necessity of reevaluation and updating with the current acquis, despite the fact that Turkey’s remarkable progress in the past according to the European Commission country reports; Ministry of European Union’s Action Plan covering the years of 2016-2019; 11th development plan of Turkish Presidency. Thus, the Project touches on Company Law, Financial Services, Consumer and Health Protection, Intellectual Property chapters which have been opened for negotiations, and Competition Policy chapter that has not yet been opened for negotiation alongside the Protection Of Personal Data which is not itself a negotiation chapter but concerns several chapters of negotiation. Regulations in the aforementioned fields have been analyzed under the Company Law, Banking and Capital Markets Law, Intellectual and Commercial Property Law, Competition Law, Consumer Law and Protection of Personal Data Law main titles. Within the scope of the Project, contributors were expected to prepare their work according to the following outline: I. Legislation A. European Union Legislation B. Turkish Legislation; II. Remarks A. European Union Law, B. Turkish Law; III. Assessments and Suggestions. By this means, the necessity of the readers to get conveniently informed solely on the European Union Law or Turkish law related to that subject is considered. Assessments and suggestions have been provided under a separate title with the view of improving on the perception of approximation with European Union which only focuses on the translation of legislation and relation of European Union law with Turkish law can be put forward in an integrated mindset. Under this title, the conclusions reached by evaluating Turkish law and European Union law have been placed in numerical order. In other respects, contributors were provided flexibility in terms of methodology to be used for their remarks and assessments and freedom to include the Turkish translation of the relevant European Union legislation and place article proposals for Turkish legislation. Editorial Board elaborated on determining the main subjects and, alongside the review of all studies with respect to the fundamental aim of this book, providing for systematical coherence thereof.

Avrupa Birliği organlarının herhangi bir hukuk alanında düzenleme yapma yetkisi kurucu anlaşmalarla üye devletlerin Birliğe bırakmış olduğu yetkiler ile sınırlıdır. Özel hukuk alanındaki Avrupa Birliği tasarrufları, temel olarak iç pazarın geliştirilmesi/ güçlendirilmesi ve tüm üye devletlerin hukuk düzenlemeleri ile uygulamalarının uyumlaştırılması hedefine yönelir. Bu sayede her bir konuyla alakalı yalnızca Avrupa Birliği hukuku veya yalnızca Türk hukuku hakkında bilgi edinmek isteyen okuyucuların da çalışmadan rahatça istifade edilebilmesi gözetilmiştir. Değerlendirme ve önerilerin ayrı bir başlık altında sıralanmasıyla, Avrupa Birliği mevzuatıyla uyum anlayışının Avrupa Birliği mevzuatının tercüme edilmesinin ötesinde ve hukukumuzla ilişkisinin bütüncül bir yaklaşım ile ele alınarak ortaya konulması hedeflenmektedir. Bu başlık altında Türk hukuku ile Avrupa Birliği hukuku birlikte değerlendirilerek varılan sonuçlara numara sırası ile yer verilmiştir. Bununla birlikte katılımcılara değerlendirmelerinde izleyecekleri yol konusunda esneklik sağlanmış, katılımcılar Avrupa Birliği mevzuatının çevirisini çalışmalarına ekleme, madde önerisinde bulunma konularında serbest bırakılmıştır. Editörler Kurulu, bu noktada ana konu başlıklarının belirlenmesi ve tüm çalışmaların işbu Kitabın yöneldiği temel amaç doğrultusunda incelenmesi yanında, bunlar arasında sistematik bir ahengin sağlanmasına da özen göstermiştir.

    Description: The book aims to reconstruct, with a interdisciplinary approach in a comparative methodology, the evolution of Bolivian institutions, from independence to the present days, in the light of the indigenous element as a legal interpretative parameter. After a first denial and a forced assimilation, the indigenous element was integrated into the institutions until it became central to the construction of an alternative constitutionalism to the Western model. The dissertation outlines three Latin American constitutional cycles. For each constitutional cycle, the common lines and the differences with Western constitutionalism are analysed, referring to the importance attributed to the indigenous element, since to a detailed analysis of intercultural and multinational constitutionalism of the 2009 Bolivian constitution. The indigenous element is fundamental because it becomes a source of national law, thus giving rise to a plural juridical model that starts from the community, and the traditional and ancestral culture of the indigenous people. It also challenges the Western individual constitutionalism, only founded on the supremacy of human rights.

    Description: La monografia si propone di ricostruire, con un taglio interdisciplinare nella metodologia comparata, l’evoluzione delle istituzioni boliviane, a partire dall’indipendenza fino ai giorni nostri, alla luce dell’elemento indigeno come parametro interpretativo-normativo. Dopo una prima negazione e un’assimilazione forzata, l’elemento indigeno è stato integrato nelle istituzioni fino a diventare centrale per la costruzione di un costituzionalismo alternativo al modello occidentale. La trattazione delinea tre cicli costituzionali latino-americani. Per ogni ciclo costituzionale, sono analizzate le linee comuni ai diversi Stati e le differenze con il costituzionalismo occidentale, in riferimento all’importanza attribuita all’elemento indigeno, fino ad un’analisi dettagliata del costituzionalismo interculturale e multinazionale della carta boliviana del 2009. In essa, l’elemento indigeno è fondamentale perché diventa fonte stessa del diritto nazionale, facendo sorgere, così, un modello giuridico plurale che parte dalla comunità, dalla tradizione e dalla cultura ancestrale degli indigeni e contesta il costituzionalismo individuale di matrice occidentale, fondato unicamente sulla supremazia dei diritti umani.

It also recognises the legacy of the great Senegalese jurist Kéba Mbaye. Edited by Frans Viljoen, Humphrey Sipalla and Foluso Adegalu, the volume is divided into five broad thematic parts, and comprises eleven chapters. It covers the following themes: ‘Kéba Mbaye in African approaches to international law’, ‘international legal theory’, ‘international human rights law’, ‘international environmental and criminal law’ and ‘teaching of international law’. This publication finds its origins in the 2017 Roundtable on African approaches to international law, held at the Centre for Human Rights, University of Pretoria. The explorations at the Roundtable on the concept of an ‘African approach’ to international law were taken further at the Kéba Mbaye Conference on African approaches to international law, held at the Senate Hall, University of Pretoria, in December 2018. As Severin Meier demonstrates, the extent of legal determinacy depends neither on some linguistic essence found in the text nor on theories that allegedly stand above practice.     Description: The purchase of additional items in videogames, also called ‘Microtransactions’, has recently grown to become one of the dominating methods of monetization in the games industry. However, many versions of these monetization schemes face severe backlash because it appears that the ways to monetize games are increasingly influencing the contents of the medium and that those games are purposefully designed to bring vulnerable players to spend more money than they meant to. In this thesis, those points of criticism were taken into consideration and as a starting point to explore the legality of these kinds of monetization schemes from a legal standpoint. This was done with regards to the Unfair Competition Law, Youth Protection regulation and general civil law. Also, the chance-based variant of microtransactions, the so called ‘Lootboxes’, have been examined with regard to their legality under gambling regulations.

A tax on final consumption is seen to be an important element of sound public finance policy and the VAT has clearly emerged as the preferred model for consumption taxation. Its rate of take up in Africa is not dissimilar from that in other jurisdictions, but African experience is proving unique in some respects. One of these is the signifi cant variation of VAT legislation in Africa, refl ecting the extent to which jurisdictions, sometimes neighbouring countries, have turned to fundamentally diff erent models as the basis for their own VAT laws. Another special characteristic of African VAT is the extent to which implementation of the VAT has exposed the need for broader institutional reform and modernisation of revenue administrations. And finally, authorities have found that VAT poses unique challenges in African economies in which commercial arrangements range from traditional economies through to globalised and electronic transactions in the same marketplace. Much younger than the VAT, the African Tax Institute also enjoyed a modest start, commencing its program of providing training to African tax administrators in 2002 as the Southern African Tax Institute, as it was then known. It has accomplished much in a short time. To date more than 600 government tax offi cials from 21 African countries have benefi ted from one or more training modules or workshops off ered by ATI and its predecessor body. In addition to its formal training program, ATI is committed to developing opportunities for African administrators to access African and international expertise through specialised conferences and seminars and to make the proceedings of these forums available to wider audiences. A number of the papers in this volume, the inaugural book sponsored by the institute, derive from a VAT in Africa conference sponsored and hosted by the ATI, with support from the Taxation Law and Policy Research.     Description: About the publication Over the years, the African, Inter-American and United Nations human rights systems have forged important partnerships on a wide-range of human rights issues and approaches. Grounded in the universality of human rights, the three systems have collaborated through actions ranging from joint statements to joint meetings and country visits, the exchange of information on country situations, individual cases and thematic issues, as well as relying on each other’s case law, decisions and procedural developments. This collaboration has been anchored in frameworks such as the 1993 Vienna Declaration and Programme of Action, the regular dialogue between global and regional human rights mechanisms mandated by the Human Rights Council, the 2009 Memorandum of Understanding between the Organisation of American States and the African Union, the 2012 Addis Ababa Roadmap between the special procedures of the UN Human Rights Council and those of the African Commission on Human and Peoples’ Rights and the 2010 and 2014 Memorandums of Understanding between the Office of the UN High Commissioner for Human Rights and the African Union Commission and Inter- American Commission on Human Rights, respectively. The joint dialogue held on 3 November 2015 in Banjul was firmly located within these frameworks. This timely dialogue enabled each institution to exchange information and experiences, to review approaches, challenges and good practices within each system, and to reaffirm our common resolve to address the serious human rights violations based on sexual orientation and gender identity that take place in all regions. This report and the accompanying background papers capture the content and outcomes of the joint dialogue. We hope that it can provide a basis for further collaboration in future and that States and other stakeholders will find it useful to inform their efforts to combat violence, discrimination and other human rights violations based on sexual orientation and gender identity. Elle conduit notamment à repenser les modes de communication et de transmission sur la base de nouveaux paradigmes appliqués, à l’instar par exemple de l’externalisation, sans en avoir préalablement mesuré autant les écueils que les bienfaits.     Description: Le renouvellement des sources du droit peut être étudié sous deux aspects : qualitatif et quantitatif. Il y a renouvellement des sources du droit d’un point de vue qualitatif lorsque des sources d’une nouvelle espèce, d’un nouveau genre ou même d’une nouvelle nature apparaissent. Il y a renouvellement des sources du droit d’un point de vue quantitatif lorsque des sources préexistantes mais desquelles jaillissait peu de droit deviennent des fleuves de normes, au point de concurrencer les sources ordinaires de règles juridiques que sont la loi et la jurisprudence. En ce livre, le renouvellement des sources du droit est abordé sous l’un et l’autre angles, cela à l’aune d’une branche du droit particulière : le droit de la communication par internet. Observer cette forme de « droit global » est riche d’enseignements à l’égard de l’actualité et, plus encore, de l’avenir du droit. Ainsi de nouveaux objets normatifs, hier encore inconnus des juristes, peuvent ils être étudiés : codes privés, chartes, usages, conditions générales d’utilisation, contrats-types, normes managériales, normes techniques, mais aussi modes alternatifs de résolution des conflits, labels, standards, protocoles, meilleures pratiques, indicateurs, algorithmes, etc. Ces nouveaux objets normatifs et les phénomènes de « guerre des normes », de plurinormativité et d’internormativité qui les accompagnent interrogent l’orthodoxie juridique moderne mais aussi et plus fondamentalement l’État de droit, la démocratie, certains droits et libertés fondamentaux ou encore l’intérêt général. L’internet a condensé le temps et dilué l’espace. Il a ainsi profondément transformé les sociétés ; et l’univers juridique, dans ses différentes dimensions, est nécessairement affecté. Aussi la fréquentation de son droit invite-t-elle à élaborer de nouveaux outils afin de décrire et expliquer les « faits normatifs » qui le constituent. L’observation du droit de la communication par internet est ici au service d’une réflexion relative aux continuités, aux ruptures et aux mouvements actuels et à venir des sources du droit. Cette branche du droit est révélatrice de ce à quoi le paysage juridique pourrait ressembler demain, lorsque le droit moderne stato-centré aura été débordé par un droit « en réseau » dont les propriétés ressemblent fort à celles du réseau mondial qu’est l’internet. Progressivement, les sources aupcaravant premières deviennent secondaires, celles qui hier demeuraient à l’arrière-plan se retrouvent sur le devant de la scène juridique, tandis que de nouveaux foyers de normes ô combien singuliers apparaissent. L’objet de cet ouvrage est de constituer un témoignage de ce renouvellement des lieux et des modes de production des normes en cours, un renouvellement qui touche les sources privées beaucoup plus que les sources publiques, posant dès lors la question de l’immobilisme préjudiciable de l’État et des organisations internationales.

    Description: Concessions were strictly delimited enclaves within key trading cities in China, ceded to and governed by foreign powers after ‘unequal treaties’ resulting from military campaigns. Within the international concession of Tientsin (today’s Tianjin), a city to the south-east of Beijing, nine nations were present (1860-1946), but the Austro-Hungarian concession (1901-17) fell into oblivion. Filling this scientific gap is the overall goal of this book: its urban and architectural history will be contextualised here for the first time, making use of hitherto unknown archival material.

    Description: About the publication The book explores the implications of the increased interplay between international human rights law (IHRL) and international humanitarian law (IHL) in military operations, sometimes in ways that imply convergence and other times in ways that suggest conflict. These convergences and/ or conflicts are particularly acute in non-international armed conflicts, situations of belligerent occupation and in the area of peace support operations (PSOs). Non-international armed conflicts imply that individuals, including members of organized non-state armed groups and civilians that directly participate in hostilities, are ‘within the jurisdiction’ of the territorial state against whom they are fighting. IHRL and IHL may therefore apply in parallel. In a similar vein, the control exercised by a belligerent occupant regularly entails an exercise of ‘jurisdiction’ and hence triggers the applicability of human rights norms. As far as PSOs are concerned, it becomes increasingly difficult to classify them as taking place in a context of ‘peace’ or ‘armed conflict’. More often than not, the situation implies elements of both. In all of the aforementioned contexts, the interplay between the fields of IHRL and IHL as the areas of law that provide the most pertinent regulatory frameworks for the conduct of pertinent actors – states, international organisations, organised armed groups and individuals – is elevated to great practical significance. This edited volume contains 16 peer-reviewed essays by academics and practitioners. Le droit a son propre langage pour nous parler des lois de l'alimentation. Cependant, il ne livre aucune définition du patrimoine alimentaire, notion partagée par bien d'autres disciplines voisines. Les lois de la table font écho à notre culture, au repas gastronomique des Français, et se manifestent aussi par les nombreux labels de la propriété intellectuelle. Des ingrédients de patrimoine alimentaire se repèrent dans les différents domaines du droit selon des processus de patrimonialisation aux fondements bien différents. Patrimoine joyeux assurément, le patrimoine alimentaire se doit-il d'être un patrimoine vertueux répondant à l'exigence sociétale grandissante d'une qualité patrimoniale par la considération de l'environnement, de la biodiversité, de la santé, des animaux, des préférences collectives, des droits humains ? Dans quelle mesure le patrimoine alimentaire peut-il s'accommoder de la protection des brevets ou des marques ? Le patrimoine alimentaire requiert la protection juridique. Mais la protection ne se fonde pas forcément sur une intention et une finalité patrimoniales. Trop gras, trop salé… trop réglementé ?! Le droit ne doit pas non plus tuer dans l'œuf le patrimoine alimentaire, mais tracer les contours d'un nouveau droit de synthèse, le droit au patrimoine alimentaire, au cœur de la diversité culturelle, elle-même patrimoine commun de l'humanité.

Conviant les Valeureux à partager maints festins plus ou moins transgressifs, le personnage excède les contours de la figure burlesque pour sublimer le prosaïque. C'est par son regard que surgit la vision d'un monde dont la quête est celle d'une sagesse à hauteur d'homme. Refusant les codes d'une bourgeoisie vaudevillesque, Mangeclous élève l'appétit au rang de vertu, prône avec ironie les mérites du mensonge et érige le plaisir de manger en règle de vie. Nouvel avatar des géants rabelaisiens, ce prophète comique ne s'épanouit que dans le paradoxe et l'amour des nourritures.

    Description: About the publication Adieu, Steve: Tribute to a scholar of African constitutionalism This volume of essays on constitutionalism in Africa is devoted to the memory of Steve Odero Ouma, who spent most of his professional life working on these issues. He was a colleague and friend to many of the contributors to this volume, and no doubt to many of its actual and potential readers. Steve passed away on 23 February 2012. This publication is a collection of essays written mainly by graduates of the Master’s Programme in Human Rights and Democratisation in Africa. (One of the authors, Mwiza Jo Nkatha was one of Steve’s class mates in 2005.) The only exception, Professor Kofi Quashigah, is the Dean of the Faculty of Law, University of Ghana, at Legon, Accra. My sincere thanks and congratulations go to each of these contributors for their pointed and important contributions to this volume. I should mention here that the University of Ghana is one of the twelve partner universities in the programme.     Description: This multi-disciplinary publication focuses on the issue of African sovereign debt management and renegotiation/ restructuring, with a particular concentration on the countries that are members of the Southern Africa Development Community (SADC).     Description: Since 2009 two courts have been shaping human rights of asylum seekers in Europe: the Court of Justice of the EU (CJEU) and the European Court of Human Rights (ECtHR). Side by side, the courts examined who is protected from refoulement, when and how asylum seekers can be detained and what remedies they should have access to. Did they seek convergence in their asylum case-law or paid no attention to each other’s jurisprudence? Did they establish a coherent standard of the asylum seekers’ protection in Europe?     Description: It is common practice for patients in a hospital to be treated by the on-duty physician. If patients want to be treated by a certain physician, then they are subject to additional charges. This is referred to as ‘chief physician treatment’ because it is often chief physicians who are selected to carry out treatment. Commonly, chief physicians are considered to be particularly experienced and competent. But even if a chief physician treatment is contractually agreed with the patient, in many cases it is not the chief physicians who provide the individual treatment services. Sometimes they do not even participate in the treatment at all but nevertheless all the services are billed as chief physician treatment. Whether and the extent to which the law allows this kind of practice, is the subject of this dissertation.

This new moment demands new questions be asked regarding the regime and its effects in this new era for law, health care and justice.     Description: Adhesion proceedings enable civil claims to be assessed in criminal proceedings. Its legal regulation in Art. 122 ff. StPO is, however, very rudimentary and incomplete. Jurisprudence and doctrine have so far hardly addressed the incompleteness of the procedure or the related coordination deficit of criminal and civil procedural law. The thesis shows how legal gaps in adhesion proceedings can be filled and how criminal and civil procedural law can be coordinated, as it were. The thesis shows which guiding principles are decisive for the filling of gaps. It explains how to deal with collisions between criminal and civil procedural law. With the help of the developed method, the work then provides concrete proposals for solutions to specific procedural questions.
    Description: Das Adhäsionsverfahren ermöglicht die Prüfung zivilrechtlicher Ansprüche im Strafverfahren. Seine gesetzliche Regelung in Art. 122 ff. StPO ist jedoch sehr rudimentär und unvollständig. Rechtsprechung und Lehre haben sich bisher kaum mit der Unvollständigkeit des Verfahrens oder dem damit verbundenen Koordinierungsdefizit von Straf- und Zivilprozessrecht auseinandergesetzt. Die Arbeit zeigt, wie Rechtslücken in Adhäsionsverfahren geschlossen und Straf- und Zivilprozessrecht sozusagen aufeinander abgestimmt werden können. Die Arbeit zeigt, welche Leitprinzipien für die Lückenfüllung entscheidend sind. Es erläutert den Umgang mit Kollisionen zwischen Straf- und Zivilprozessrecht. Mit Hilfe der entwickelten Methode liefert die Arbeit dann konkrete Lösungsvorschläge für konkrete Verfahrensfragen.

The repertoire documents the systematic use that authors and printers made of the privileges system to ensure exclusivity in the economic exploitation of a work and thus protect their work and investments. The archival and bibliographic sources collected in this volume testify to the entrepreneurial strategies implemented by authors and printers to innovate and diversify publishing production in order to create products capable of competing on foreign markets. The repertoire also traces the role of the Venetian State in promoting and protecting the local book industry in a context characterized by constant historical and political changes.

    Description: About the publication The aim of this book is to analyse the current status of indigenous intellectual property rights protection in South Africa. The current intellectual property laws and legislations in South Africa do not fully protect indigenous knowledge systems and in some instances the indigenous knowledge is misappropriated, abused without proper recognition and acknowledgement of the custodian of this knowledge. The book suggests that in order for us to fully understand the developments of intellectual property in South Africa, we need to look at similar developments in the United States and Australia. Using conceptual tools dealing with post-colonial, contested culture and legal theories such as the natural-law and the economic model, the book tries to analyse the current predicament: how can one possibly marry indigenous property rights and the western legal frameworks in a practical and ethical way?     Description: About the publication The law on education and educational practices in South Africa would exhaust the capacity of any meaningful monograph. Instead, the authors of this book engage six discrete topics that refl ect the broader currents and conflicts in South African education debates: (a) school choice; (b) school fees; (c) the right to an adequate basic education; (d) single medium public schools; (e) school governing bodies; and (f) independent schools. The book has two further aims. First: To move beyond the debates taking place separately in the education policy community and the legal academy, and to demonstrate how these disciplines, working in concert with each other, can advance our understanding of law and education in South Africa.
