    Description: Das niedersächsische Nordhorn war historisch lange eine Hochburg der Kommunistischen Partei Deutschlands (KPD) sowie später der Deutschen Kommunistischen Partei (DKP), bis in die 1990er-Jahre hinein konnten sie hier lokalpolitische Ämter erringen. Von welchen Kontextbedingungen hing der lokale Erfolg der Nordhorner DKP ab? Wie fügte sich die Partei historisch in die Protestgeschichte ein und welches sind die zentralen Charakteristika der örtlichen gegenkulturellen Szene? Diesen Fragen geht die vorliegende FoDEx-Studie nach. Sie skizziert die zentralen Charakteristika und langfristigen Entwicklungstendenzen der linksradikalen bzw. linken Szene vor Ort und setzt diese in Bezug zum stadtpolitischen Erbe der Textilindustrie Nordhorns und der andauernden materialistischen Konfliktlinie. In einer mehrschrittigen Analyse werden wichtige Resonanz- und Verständigungsräume ebenso beleuchtet wie das individuelle Akteurshandeln vor Ort.

    Description: This study treats ecotourism in National Protected Areas of Lao PDR as a “recreational frontier” which instrumentalizes the recreation of human natures in capitalism’s centers for that of nonhuman natures at capitalism’s (closing) frontiers. This world-ecological practice of ecorational instrumentality – i.e. of nature domination in the name of “Nature” – presents a remedy for capitalism’s crisis that is itself crisis-ridden, enacting a central tension of ecocapitalism: that between “conservation” and “development”. This epistemic-institutional tension is traced through the preconditions, modes and effects of ecotourism in Laos by gradually zooming from the most general scale of societal nature relations into the most detailed intricacies of ecotouristic practice. The combination of Bourdieu, Marx and Critical Theory enables a systematic analysis of the recreational frontier as enactment of various contradictions deriving from the “false-and-real” Nature/Society dualism.

    Description: The liberal professions are subject to an ever changing legal basis and thus constantly undergo minor or major amendments. A fundamental innovation in the current law governing the liberal professions of tax consultants is the authorization to work as in-house tax consultants. Since 2008, the Tax Consultancy Act has made possible to pursue the profession of in-house tax advisor, while lawyers were allowed to work in-house for decades already, with the last amendment of the legal regulations from 2016. This paper deals with the various legal and practical implications of the interactions between the freelance activity as a tax consultant and the activity of in-house tax consultants in an employment relationship. A detailed comparison of the legal basis for tax consultants with that of in-house lawyers is of special interest in light of the current ambiguous legal situation. Special focus is a thorough analysis of the legal question whether or not an in-house tax adviser can be exempted from the obligatory pension insurance.

    Description: The increased detection of doping in professional sports has led to a strengthening of the discussion on the legal aspects of doping. So far criminal and/ or verbandsrechtliche questions were the focus. For example the question of whether and how sponsorship contracts may be terminated in cases of misconduct of the sponsored. First, it examines how appropriate cancellation clauses could be like. Second, consider the conditions under which, even without explicit rules for doping a termination in accordance with general principles of contract law is concerned. It also discusses the legal consequences of termination, and in particular its relationship to other contractual consequences of doping, such as claims for damages or penalties.

    Description: This study analyses legal barriers to data sharing in the context of the Open Research Data Pilot, which the European Commission is running within its research framework programme Horizon2020. In the first part of the study, data protection issues are analysed. The main focus is on the Data Protection Directive (95/46/EC) and its implementation in selected EU Member States. Additionally, the upcoming General Data Protection Regulation (2016/679/EU) and relevant changes are described. Special focus is placed on leading data protection principles. Next, the study describes the use of research data in the Open Research Data Pilot and how data protection principles influence such use. The experiences of the European Commission in running the Open Research Data Pilot so far, as well as basic examples of repository use forms, are considered. The second part of the study analyses the extent to which legislation on public sector information (PSI) influences access to and re-use of research data. The PSI Directive (2003/98/EC) and the impact of its revision in 2013 (2013/37/EU) are described. There is a special focus on the application of PSI legislation to public libraries, including university and research libraries, and its practical implications. In the final part of the study the results are critically evaluated and core recommendations are made to improve the legal situation in relation to research data.

    Description: This dissertation examines intelligence surveillance of private telecommunications and its compatibility with the international human right to privacy in Art. 17 ICCPR and in Art. 8 ECHR. These articles provide comprehensive protection against the most modern forms of surveillance including bulk interception. Several criteria apply in terms of the foreseeability of the surveillance laws. Telecommunication’s interception should be subject to authorisation and supervision by independent authorities and effective remedies should be available. Moreover, the study analyzes the extent to which the surveilling state and the state of residence violate their human rights obligations in cases of cross-border surveillance. The main question is whether the established definitions of "jurisdiction" are applicable to this extraterritorial scenario. The extraterritorial exercise of jurisdiction can also be based on effective control over specific objects relevant to human rights. According to this approach, telecommunications data are objects relevant to individual’s right to correspondence and data protection.

    Description: This research unravels the economic collapse of the Datoga pastoralists of central and northern Tanzania from the 1830s to the beginning of the 21st century. The research builds from the broader literature on continental African pastoralism during the past two centuries. Overall, the literature suggests that African pastoralism is collapsing due to changing political and environmental factors. My dissertation aims to provide a case study adding to the general trends of African pastoralism, while emphasizing the topic of competition as not only physical, but as something that is ethnically negotiated through historical and collective memories. There are two main questions that have guided this project: 1) How is ethnic space defined by the Datoga and their neighbours across different historical times? And 2) what are the origins of the conflicts and violence and how have they been narrated by the state throughout history? Examining archival sources and oral interviews it is clear that the Datoga have struggled through a competitive history of claims on territory against other neighbouring communities. The competitive encounters began with the Maasai entering the Serengeti in the 19th century, and intensified with the introduction of colonialism in Mbulu and Singida in the late 19th and 20th centuries. The fight for control of land and resources resulted in violent clashes with other groups. Often the Datoga were painted as murderers and impediments to development. Policies like the amalgamation measures of the British colonial administration in Mbulu or Ujamaa in post-colonial Tanzania aimed at confronting the “Datoga problem,” but were inadequate in neither addressing the Datoga issues of identity, nor providing a solution to their quest for land ownership and control.

    Description: In the view of the increasingly strong and far-reaching international interdependence of the national legal system, the question as to where the German Basic Law relates concerning the increasing international complexity is becoming ever more important. In response to this, the German Basic Law is said to be a constitution open to international law, which is extracted from the basic principle of ‘Völkerrechtsfreundlichkeit’ (friendliness toward international law). However, it remains vague in which relation such a principle would stand to the rule of law, the principle of democracy or the system of basic rights, if it is inserted into their limitations or constitutes a supreme premise. The focus of this study lays upon the attempt to make the principle of Völkerrechtsfreundlichkeit tangible and to explore its legal content of.
    Description: Angesichts der immer stärkeren und weiterreichenden internationalen Verflechtungen der Rechtsordnung wird auch die Frage immer wichtiger, wie sich das Grundgesetz zu diesen internationalen Bindungen verhält. Dem Grundgesetz wird als Antwort darauf gemeinhin eine Völkerrechtsfreundlichkeit entnommen, welche sich aus den internationalen Bezugnahmen der Grundordnung ergeben soll. Dabei bleibt jedoch regelmäßig offen, wie sich eine solche Völkerrechtsoffenheit des Grundgesetzes zu Prinzipien wie Demokratie und Rechtsstaatlichkeit oder dem Grundrechtsschutz verhält, ob es sich in deren verfassungsrechtlich gewährleistete Grenzen einfügt oder vielmehr als übergeordnete Prämisse dem vorgeht. Im Zentrum der Untersuchung steht daher der Versuch, das Prinzip der Völkerrechtsfreundlichkeit greifbar zu machen und seinen möglichen rechtlichen Gehalt zu umreißen.
