    Description: The study about Youth Services in Criminal Proceedings 2022, a quantitative online institutional survey of youth services in this field, provides empirical data for an important task of youth services in Germany. The following questions, e.g., are answered: How is youth services in criminal proceedings organised? How do they fulfil their tasks? Is the existing structure of youth services in the context of juvenile criminal proceedings sufficient? How are cooperative relationships with other institutions and professions developing? Is there any potential that has not yet been tapped? A special focus lies on the implementations of the reform in the Juvenile Courts Act of 2019, which transposed the EU directive 2016/800 on procedural safeguards for children who are suspects or accused persons in criminal proceedings. A review will be followed by professional consequences and challenges for professionals in the field of youth services in criminal proceedings.

    Description: Soft law and its role in the enforcement of EU law: Apart from the Treaty infringement procedure there are more and more procedures, mostly laid down in secondary law, by which the EU – often using soft law – ensures Member States’ compliance with EU law. This development entails a considerable transforming power. It deserves not only a foundational, mainly competence-oriented analysis of EU soft law, but also a systemic and legal account of these procedures in which it is often EU agencies – instead of the Commission and the European Court of Justice, as provided for in the TFEU – which, largely beyond public attention, interpret EU law and, on this basis, try to enforce it vis-à-vis the Member States.

Diese Entwicklung darf in ihrer transformatorischen Kraft nicht unterschätzt werden. Sie verdient nicht nur eine grundlegende, v.a. kompetenzrechtliche Analyse des EU-Soft Law, sondern auch eine systemische und rechtliche Einordnung der genannten Verfahren, in denen oftmals EU-Agenturen – statt, wie im AEUV vorgesehen, Kommission und EuGH – in öffentlich kaum beachteter Weise Unionsrecht auslegen und auf dieser Grundlage gegenüber den Mitgliedstaaten durchzusetzen versuchen.

    Description: The study examines how lay judges experience the still controversial plea bargains in criminal proceedings. For the purpose, almost 9000 lay judges from all German states were surveyed. The study confirms previously existing findings according to which illegal plea bargaining continues to be a widespread issue. Additionally, it is precarious that lay judges rarely have the influence on the outcome of criminal proceedings that they should have. Instead, they are often reduced to the status of mere extras. Another result of the survey, however, was more encouraging: A clear majority of lay judges consider their office to be important. That said, even though most lay judges are satisfied with their work, they still propose numerous avenues to improve the status quo.

    Description: Die Untersuchung widmet sich der Frage, wie Schöffen die nach wie vor umstrittenen Absprachen im Strafprozess erleben. Dazu wurden knapp 9000 Laienrichter aus allen Bundesländern befragt. Die Studie bestätigt bestehende Befunde, nach denen illegale Absprachen unverändert weit verbreitet sind. Prekär ist zudem, dass die Laienrichter nur selten über den Einfluss auf den Ausgang des Strafverfahrens verfügen, den sie eigentlich haben müssten. Stattdessen sind sie häufig nur Statisten. Erfreulicher fiel dagegen ein anderes Ergebnis der Umfrage aus: So hält eine klare Mehrheit der Schöffen ihr Amt für wichtig. Obwohl die Laienrichter mit ihrer Tätigkeit mehrheitlich zufrieden sind, formulieren sie dennoch zahlreiche Verbesserungsmöglichkeiten.
