    Description: "Hegels Rechtsphilosophie ist eine Art Logik der bürgerlichen Person im Sinne eines begrifflichen Kommentars zur Institution rechtsstaatlicher Gesetze. Sie analysiert methodische Stufen in der Ordnung explizit geregelter Praxisformen und kritisiert das klassische Naturrecht in seinem Intuitionismus und Kants Ethik in ihrem Formalismus. Das Institut des Eigentums rekonstruiert sie als erfahrungsgesättigte sittliche Form bürgerlicher Freiheit, auch wenn es im reinen Kapitalismus seinen Sinn verfehlen kann. Dabei sind übliche Fehldeutungen etwa von Idee und Begriff, Geist und Natur, Wille und Freiheit, dem Staat und einer der Form nach immer auch monarchischen Regierung zu vermeiden. Es geht damit um die Wiederentdeckung von Hegel als dem sozialliberalen Philosophen der Freiheit und um die Abwehr des Geredes von einem Staatsphilosophen. Die Neuerscheinung richtet sich an Lehrende und Studierende der Rechts-, Sozial- und Staatswissenschaften und der Philosophie. Der Autor ist philosophischer Logiker und Universitätsprofessor mit besonderem Forschungsschwerpunkt in der sprachanalytischen und in der klassischen deutschen Philosophie."

    Description: Die Frage nach der Verbindlichkeit des Rechts, die Frage also, ob dem Recht über seine äußere Zwangsgewalt hinaus eine verpflichtende Kraft zukomme, versteht sich nicht von selbst. Hat der aus der Trennung von Recht und Moral entspringende Rechtspositivismus doch zu der These geführt, daß das Recht – rein rechtlich betrachtet – zu nichts verpflichte. Das widerspricht allerdings den vorherrschenden sozialen Anschauungen. Sie verlangen folglich nach einer Begründung für den dem Recht zugeschriebenen Anspruch verbindlicher Maßgeblichkeit. Demgemäß ranken sich um die Idee solcher Normativität des Rechts Vorstellungen, Bilder und Begriffe, die eine innere Bindung durch Recht plausibel zu machen suchen. Es wird gezeigt, daß sich diese Konnotationen der Idee der Rechtsverbindlichkeit auf drei Grundfiguren zurückführen lassen, die der Grammatik der persönlichen Fürwörter korrespondieren.Der Autor ist Professor für Öffentliches Recht, Rechts- und Staatsphilosophie an der Humboldt-Universität zu Berlin.

The first part contains a thick chronological description of the case-law of the Court of Justice of the European Union on free movement of persons and services, including the hitherto largely neglected coordination of social security. In this sizeable body of case-law including roughly 1400 decisions the book then traces the evolution and spin of certain interpretive formulas. A number of legal experts and governments have felt that the WTO, in particular the TRIPS Agreement, forces countries to favour patents over public health. The WTO sought to settle this dispute by concluding the Public Health Declaration. This book closely analyses the legal situation within the WTO prior to the Declaration and the consequences that resulted from it. It discusses the value of the changes, nationally and internationally, and the extent to which it makes the access to medicines more affordable. This review addresses not only the mere assessment of the positions of pro-patent countries but also takes a look at the obligations that developing countries have internationally and to their citizens.     Description: In an increasingly harmonized global patent landscape, few issues still distinguish the US patent system as much as its strict–and often criticized–duty of candor and its inequitable conduct doctrine. The EPO and most other countries around the world impose less burdensome disclosure duties upon patent applicants. What is there to learn from the experience in the US? Have these tools resulted in any benefit worth considering? Yet regardless of the disclosure duties imposed upon patent applicants, a deceptive conduct before the Patent Office could lead to unwarranted exclusive rights and have a negative impact on competition. Should antitrust law intervene? Is it a case of sham litigation? This work attempts to answer those questions through a comparative analysis, examining the law and case law in the US and in the EU from both a patent and a competition law perspective and seeking a workable theory of harm.

    Description: The Spanish colonization dramatically interrupted the autonomous development of ancient Mesoamerican culture. Nevertheless, indigenous societies learnt to live with the conquest. It was not only a time of crisis, but also an extraordinarily creative time period in which material culture reflected indigenous peoples’ varied responses and adaptations to the changing circumstances. This work presents insights into the process of cultural continuity and change in the indigenous world by focusing on pottery technology in the Nahua (Aztec) region of Central Mexico. The late pre-colonial, early colonial and present-day characteristics of this industry are explored in order to come to a renewed understanding of its long-term development.

The present special edition investigates which opportunities open access to scientific publications offers to legal studies and which challenges it poses. Nine reports from legal-scientific open access periodicals show that open access is possible with as well as without traditional publishers. Other contributions explain the role of academic infrastructure, especially of libraries and promoters of research. The publication is rounded off by an opinion analysis from a transnational conference on the subject which took place in October 2018 (www.jurOA.de).

Such strategies are sometimes referred to by generic drug companies as “evergreening”. The analysis focuses on two of these strategies, namely product improvements and product line extensions. In particular, an evaluation of the patents that follow the basic one and that accompany the development of a drug from research to market is attempted. Two “blockbuster” drugs, Taxotere and Xalatan, were randomly chosen to carry out such analysis. As the war fades from living memory, this study is the first to systematically analyze how Second World War museums allow prototypical visitors to comprehend and experience the past. It analyzes twelve permanent exhibitions in Europe and North America – including the Bundeswehr Military History Museum in Dresden, the Museum of the Second World War in Gdańsk, the House of European History in Brussels, the Imperial War Museums in London and Manchester, and the National WWII Museum in New Orleans – in order to show how museums reflect and shape cultural memory, as well as their cognitive, ethical, emotional, and aesthetic potential and effects. This includes a discussion of representations of events such as the Holocaust and air warfare. In relation to narrative, memory, and experience, the study develops the concept of experientiality (on a sliding scale between mimetic and structural forms), which provides a new textual-spatial method for reading exhibitions and understanding the experiences of historical individuals and collectives. It is supplemented by concepts like transnational memory, empathy, and encouraging critical thinking through difficult knowledge.

Der Autor kommt zu dem Ergebnis, dass die unterschiedliche Verantwortungszuschreibung im Arbeitsförderungsrecht der Länder in deren Verfassungsrecht grundgelegt ist. Zugleich identifiziert er trotz aller Unterschiede eine in den Vergleichsländern voranschreitende rechtliche Verknüpfung zwischen Leistungen des Arbeitsförderungsrechts und Anreizen zu „normaler“ Erwerbsarbeit (USA).

    Description: The period 1200-1600 CE saw a radical transformation from simple chiefdoms to kingdoms (in archaeological terminology, complex chiefdoms) across lowland South Sulawesi, a region that lay outside the ‘classical’ Indicized parts of Southeast Asia. The rise of these kingdoms was stimulated and economically supported by trade in prestige goods with other parts of island Southeast Asia, yet the development of these kingdoms was determined by indigenous, rather than imported, political and cultural precepts. Starting in the thirteenth century, the region experienced a transition from swidden cultivation to wet-rice agriculture; rice was the major product that the lowland kingdoms of South Sulawesi exchanged with archipelagic traders. Stephen Druce demonstrates this progression to political complexity by combining a range of sources and methods, including oral, textual, archaeological, linguistic and geographical information and analysis as he explores the rise and development of five South Sulawesi kingdoms, known collectively as Ajattappareng (the Lands West of the Lakes). The author also presents an inquiry into oral traditions of a historical nature in South Sulawesi. He examines their functions, their processes of transmission and transformation, their uses in writing history and their relationship to written texts. He shows that any distinction between oral and written traditions of a historical nature is largely irrelevant, and that the South Sulawesi chronicles, which can be found only for a small number of kingdoms, are not characteristic (as historians have argued) but exceptional in the corpus of indigenous South Sulawesi historical sources. The book will be of primary interest to scholars of pre-European-contact Southeast Asia, including historians, archaeologists, anthropologists, linguists and geographers, and scholars with a broader interest in oral tradition and the relationship between the oral and written registers Stephen Druce obtained his PhD from the Centre for South-East Asian Studies, University of Hull. He has published on South Sulawesi history and archaeology in English and Indonesian language journals.

    Description: Although the U.S. Patent System has been essential to spurring innovation, it has wavered in its efficiency and effectiveness at doing so. This research first makes historical comparison and analysis of the Apple and Wright landmark patent war cases to illustrate that, irrespective of timing, benefits of a patent system rest heavily on how well it defines and maintains “patent quality.” Much of the challenge in maintaining such quality relates to the subjective and often uncertain nature of invention criteria such as “non-obviousness.” As shown by recent trends, decreased patent quality leads to greater uncertainty about patent validity, which in turn invites more litigation. This work proposes that, in order to improve constancy on patent quality, the U.S. patent office should consider returning to original strategies envisioned by the Founders of the United States as described by a patent-registration system that emphasizes utility and public review in governing the patent granting process. Modern information technology can now be applied to effectively restore this original framework envisioned for patent quality control systems.

    Description: Biopatents frequently disclose sequences of polypeptides and nucleic acids in the written description. The claims often cover a homology range surrounding the disclosed sequence to get a broader protection. However, homology claims face a hurdle that they may lack support by the written description. The Supreme Court of China ruled that homology claims lack support, but a further limitation by species of origin satisfies this requirement. This study explains that homology per se should have formed the essence of such disputes. Homology dictates the skilled person’s confidence on the functionality of unknown sequences, and is involved in multiple patentability requirements. Thus, the assessment of support is not an isolated matter. Disparity of different requirements creates an unclaimable gap, and constitutes a discrimination to biotechnology. An appropriate test for the support requirement is thus furnished to confer a scope of protection commensurating to the technical contribution.

    Description: The Batavian Society of Arts and Sciences (Bataviaasch Genootschap van Kunsten en Wetenschappen), was founded in 1778 to become the predecessor of the National Library and National Museum of the Republik Indonesia. It was considered to be the most important cultural and scholarly organization of the Netherlands East Indies in the time of the Dutch East India Company (VOC) and the colonial period. This studie pays attention to the foundation, programme and area of interest of the Society, also to its members, organization, growth, decline and resurrection, but most of all to the relation with the government of a formally private enterprise, that sometimes seemed to become part of the governmental structure. The archives of the Society are kept in the National Archives of the Republik Indonesia. Since 1878, they have only scarcely been available to scholars from outside of the Society. They have, however, proven to be of great importance to historians, linguists, and anthropologists.

In deze studie naar de vroege geschiedenis van deze eerbiedwaardige instelling komen aan de orde: de oprichting, het programma en het werkterrein van het genootschap, het ledenbestand en de leiding, groei, verval en wederopstanding, maar vooral de relatie tot de overheid van deze formeel private onderneming, die soms eerder een overheidsinstelling leek te worden. Het archief van het Genootschap, dat bewaard wordt in het Nationaal Archief van de Republik Indonesia, is hiertoe de belangrijkste bron geweest. Het is sinds 1878 nauwelijks beschikbaar geweest voor onderzoekers buiten de kring van het genootschap. Voor historici, linguïsten, antropologen, archeologen en anderen is het genootschapsarchief en de geschiedenis van het genootschap van groot belang. Hans Groot (1949) studeerde Nederlandse taal en letterkunde en Italiaans in Amsterdam en was werkzaam in het hoger onderwijs (1976-1986), eerst in Amsterdam, daarna in Triëst (Italië). Sinds 1986 is hij werkzaam bij het Erasmus Taalcentrum in Jakarta. Na een bezoek aan het Nationaal Museum aldaar stelde hij zich vragen over de voorgeschiedenis van dat museum. Dat was de start van het onderzoek dat resulteerde in deze studie.

GWB-Novelle, im europäischen Recht unter Einbeziehung der Schadensersatzrichtlinie und der Transparenzverordnung sowie für Aspekte des US-amerikanischen Rechts. Dabei wird erörtert, ob die Regelungen der Schadensersatzrichtlinie und der 9. GWB-Novelle in Konflikt zum Primärrecht der Europäischen Union stehen. In Anlehnung an das amerikanische Recht wird erwogen, die Haftungsprivilegierung der Kronzeugen an Kooperationsleistungen im Schadensersatzprozess zu knüpfen.

In addition, people succumb to harmful temptations and tend towards addictions (e.g. in the form of gambling). Finally, consumers often act more selfishly (or less sustainably) than they claim to. Um die Vergleichbarkeit der Ergebnisse zu gewährleisten verfügen die beiden Hauptteile der Arbeit, also die Darstellung der Sozialen Sicherheit in Portugal und die Analyse der verfassungsrechtlichen Grundlagen, jeweils über einen Grundlagenteil. Im Schlussteil werden die wesentlichen Ergebnisse der Untersuchung in einer quer gelegten Ordnung wiedergegeben. Zu den zentralen Erkenntnissen der Arbeit gehört, dass sich ein verfassungsrechtlicher Einfluss fast ausschließlich auf Ebene der Normenkontrolle erkennen lässt, weshalb eine Einflussnahme der Verfassung auf die soziale Sicherheit ein funktionierendes, mit Unabhängigkeit und entsprechenden Kompetenzen ausgestattetes Verfassungsgericht voraussetzt.

    Description: A Companion to Geoffrey of Monmouth brings together scholars from a range of disciplines to provide an updated scholarly introduction to all aspects of his work. Arguably the most influential secular writer of medieval Britain, Geoffrey (d. 1154) popularized Arthurian literature and left an indelible mark on European romance, history, and genealogy. Despite this outsized influence, Geoffrey’s own life, background, and motivations are little understood. The volume situates his life and works within their immediate historical context, and frames them within current critical discussion across the humanities. By necessity, this volume concentrates primarily on Geoffrey’s own life and times, with the reception of his works covered by a series of short encyclopaedic overviews, organized by language, that serve as guides to further reading.

    Description: Can the rules of the European Union’s E-Commerce Directive, which date back to the year 2000, continue to be valid with regard to the dissemination of content in view of the constantly evolving online environment and the changing role of platforms as a result of new business models? The relevant legal foundations in this respect at EU and national level are complex, and their interplay is often unclear. The resulting uncertainty about who is responsible and therefore liable for certain content requires a critical review of the current legal framework. This study, conducted by the Institute of European Media Law (EMR) on behalf of the State Media Authority NRW, analyses the current legal framework and reveals ways of enforcing the applicable provisions concerning illegal content. It pays special attention to the need for reform of the E-Commerce Directive in light of the changing role of platforms. Können die Regelungen der bereits im Jahr 2000 verabschiedeten europäischen E-Commerce-Richtlinie angesichts der sich stetig weiterentwickelnden Online-Welt und der auf neuen Geschäftsmodellen beruhenden veränderten Rolle von Plattformen bei der Inhalteverbreitung fortbestehen? Die einschlägigen Rechtsgrundlagen auf EU- und nationaler Ebene sind vielschichtig und das Zusammenspiel oftmals unklar. Die daraus resultierende Unsicherheit darüber, wer für einen Inhalt verantwortlich und daher haftbar ist, erfordert die Überprüfung des geltenden Rechtsrahmens. Die vom Institut für Europäisches Medienrecht (EMR) im Auftrag der Landesanstalt für Medien NRW erstellte Studie analysiert den aktuellen Rechtsrahmen und zeigt rechtliche Gestaltungsmöglichkeiten der Rechtsdurchsetzung bei als rechtswidrig einzustufenden Inhalten auf. Besonderes Augenmerk wird dabei auf den Reformbedarf der E-Commerce-Richtlinie vor dem Hintergrund der sich wandelnden Rolle von Plattformen gelegt.

    Description: Interestingly enough, food, being central to every human being, has been excluded from pat-entability in many patent laws. The Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPs) now forces all Members of the World Trade Organization to abolish the exemption. For this reason, this study looks at the Patent Acts of Germany, Brazil, China, and India in a comparative law approach with respect to the exemption to patentability of food-related inventions and the effects of its abolition. Secondly, it describes the food sector of today and particularly its technological developments. Finally, the intellectual property situation of the food sector is analyzed.

    Description: How did the implementation of the EU Enforcement Directive on IP rights, which was adopted just before the expansion of the EU in May 2004, affect new EU Member States? This monograph is focused on three Baltic countries (Lithuania, Latvia and Estonia) and is aimed to present the collected information on the most relevant historic, social, economic and legal factors of those countries and to examine them. The examination leads to certain observations on what impact the listed factors made on the implementation of the Directive in that region, how they changed the “IP enforcement mechanisms”, case practise which existed before the adoption of the Directive, and what IP right holders can expect when litigating in the Baltics. Besides, this monograph gives a bigger picture on what the aims and objectives of the Enforcement Directive were and how they were actually reflected in the current IP enforcement practice of the so-called countries in transit where effective enforcement of IP rights is essential.

    Description: The study makes an analysis of the legal framework which Member States must take into account when designing their policies on citizenship education. The Charter on Education for Democratic Citizenship and Human Rights Education of the Council of Europe and the international right to education are read in conjunction with EU law. Suitable content for the EU dimension in mainstream education is explored. A method for objective, critical and pluralistic EU learning is proposed, based on the Treaties and on case teaching (stories for critical thinking). Member States are invited to take more action to ensure quality education. The EU has the legal competence to support the EU dimension in education. In the present state of EU law, quality education is no longer conceivable without an EU dimension incorporated in various key competences. At present the author works at the implementation of the ideas developed in the book as an Affiliated Senior Researcher at Leuven University (Case4EU-project in Belgium and other EU Member States). Das Werk bringt die Europarats-Charta zur politischen Bildung zusammen mit dem EU-Recht. Es steckt den rechtlichen Gestaltungsrahmen der Mitgliedstaaten im Hinblick demokratische Bildung und Erziehung ab. Auf der Basis konkreter Methoden werden Maßnahmen vorgeschlagen, mit denen die Mitgliedstaaten eine qualitativ höherwertige demokratische Bildung sicherstellen können. Dies ist ohne eine genuin europäische Dimension in verschiedenen Schlüsselkompetenzen nicht mehr denkbar.

Die vom Autor vorgenommene Analyse der gewandelten Rahmenbedingungen macht deutlich, dass es im Interesse einer auf Nachhaltigkeit angelegten Siedlungsflächenentwicklung zur Gewährleistung einer zukunftsfähigen Standortentwicklung für Handwerksbetriebe erforderlich ist, nicht nur die städtebauliche Planung auf die dafür erforderliche Flächenvorsorge auszurichten, sondern auch die städtebaulichen Rahmenbedingungen weiterzuentwickeln. Die Ergebnisse der Monografie dürften für alle mit städtebaulicher Planung und mit der Handwerksentwicklung befassten Personen und letztendlich auch rechtspolitisch für die Weiterentwicklung des Städtebaurechts interessant sein.
