    Beschreibung: Die Testierfreiheit zählt zu den Grundprinzipien westlicher Erbrechtsordnungen. Gleichwohl halten die Gerichte manche letztwillige Verfügung für derart anstößig, dass sie dem letzten Willen eines Erblassers die rechtliche Anerkennung versagen. In welchen Fällen wird die Testierfreiheit mit Blick auf Sitte, Moral oder grundlegende Wertvorstellungen beschränkt? Worin liegt die jeweilige Haltung der Gerichte begründet? Andreas Humm beantwortet diese Fragen aus rechtsvergleichender Perspektive und betrachtet deutsches, englisches und südafrikanisches Recht. Er analysiert, welche Faktoren dafür verantwortlich sind, dass die drei Rechtsordnungen einen unterschiedlichen Umgang mit ähnlichen Fallkonstellationen pflegen, und unterzieht die deutschen Ansichten und Standpunkte zur Sittenwidrigkeit letztwilliger Verfügungen einer kritischen Würdigung.

    Beschreibung: Die Corona-Pandemie hat die Frage nach dem staatlichen Auftrag zur Prävention von Krankheiten und zur Förderung der Gesundheit der Bevölkerung stark in den Vordergrund gerückt. Ob der Staat "zu viel" oder "zu wenig" unternimmt, kann aber auch in anderen Fällen diskutiert werden, beispielsweise bei der Regulierung der Ernährung und anderen "Lebensstilrisiken" wie dem Tabakkonsum. Da das individuelle Verhalten aber nicht immer eigenverantwortlich gewählt, sondern auch von den umgebenden Strukturen geprägt wird, kann man die Frage nach der Verantwortung des Staates noch ausdehnen, etwa für das gesunde Aufwachsen von Kindern. Ausgehend von den Erkenntnissen der Public-Health-Forschung analysiert Andrea Kießling zunächst die verfassungsrechtlichen Rahmenbedingungen für das staatliche Tätigwerden und vertieft anschließend ihre Untersuchung anhand von drei Referenzgesundheitsrisiken. Auf diese Weise leistet sie einen grundlegenden Beitrag zur Systematisierung des Rechts der öffentlichen Gesundheit.

Oftmals sind sie für Betroffene nicht sichtbar, in ihrem Handeln kaum kontrollierbar. Gleichzeitig stellen mächtige Plattformen meist die Infrastruktur für Verarbeitungen. Diese Entwicklung stellt die Angemessenheit des privaten Datenschutzrechts und seiner Zuschreibung von Verantwortlichkeit auf die Probe. In diesem Spannungsfeld nutzt Florian Wittner interdisziplinäre Erkenntnisse, um die wichtigsten Akteursrollen und ihre Kontroll- und Einflusssphären aufzuzeigen und mit dem Verantwortlichkeitskonzept der DSGVO unter Berücksichtigung der EuGH-Entscheidungen Wirtschaftsakademie und Fashion ID abzugleichen. So werden Defizite aufgezeigt und Vorschläge für eine Weiterentwicklung des Regulierungskonzepts der DSGVO auf Basis einer neuartigen datenschutzrechtlichen Plattformverantwortlichkeit gemacht.

This book contains the papers presented at an international conference held at the Max Planck Institute for Comparative and International Private Law in 2014. The authors look, from a comparative perspective, at current developments in the fields of collective bargaining and employee participation in several European countries and in China. They analyse the extent to which differences between the national legal systems still prevail and whether common features are about to emerge.

Gerade dieser Grundsatz ist es, der von einer zunehmenden Zahl ökonomisch geprägter Rechtswissenschaftlerinnen und Rechtswissenschaftler aus den USA in Frage gestellt wird. Neue Informationstechnologien ermöglichen es, Werbung und Preise zu personalisieren und so Gewinne zu maximieren. Warum sollten dann nicht auch die Rechtsnormen unter Zuhilfenahme von Big Data personalisiert werden, sofern sich damit Wohlstandsgewinne erzielen lassen? Philip Maximilian Bender tritt diesem Personalisierungsprojekt entgegen. Sein Ziel ist es, Bewusstsein für den Wert generellen Rechts zu schaffen, um einem schleichenden Systemwandel vorzubeugen. Eine auf Algorithmen aufbauende, allein an ökonomischen Erwägungen ausgerichtete Rechtssetzung würde - so die zentrale These - die Grundlagen einer liberalen Gesellschaftsordnung angreifen und in ein System mikrosozialistischer Fremdsteuerung münden.

Vor diesem Hintergrund wendet sich Lukas Huthmann der Aufgabe zu, einen konzeptionellen Ansatz für die europäische Integration des Straf- und Strafverfahrensrechts zu entwickeln. Mit dem "EU-Strafverfassungsrecht" entwirft er in Grundzügen eine spezifische Perspektive, die dabei helfen soll, eine legitime weitere Entwicklung des Strafrechts in der EU sicherzustellen.

Straf-, Arbeits- und Markenrecht bilden ebenso Schauplätze von Emoji-Rechtsprechung wie Schuld-, Familien- und Äußerungsrecht. Vor dem Hintergrund der rechtsvergleichenden Bestandsaufnahme bereitet Matthias Pendl die technischen und (psycho-)linguistischen Hintergründe von Emojis auf. Anschließend analysiert er bislang kaum beachtete privatrechtliche Implikationen der Verwendung von Emojis. Dabei berücksichtigt er die Lehren von der Auslegung von Willenserklärungen sowie von der Auflösung von Übermittlungsfehlern und widmet sich überdies Verletzungen des Persönlichkeitsrechts durch den Einsatz von Emojis. Nach der herkömmlichen Konzeption der beiden Rechtsgebiete soll das Regulierungsrecht den Rahmen zur Verhinderung oder Beseitigung von strukturellem Marktversagen setzen, während das Kartellrecht als Antwort auf das Fehlverhalten individueller Marktteilnehmer dient. Dennoch beeinflussen die beiden Materien sich gegenseitig. Aus Überschneidungen im Anwendungsbereich im Einzelfall können Zielkonflikte resultieren. Gegenstand der Arbeit ist daher die Ermittlung und Bewertung dieser Interdependenzen zwischen Finanzmarktregulierung und Kartellrecht. Daran anschließend werden Vorschläge für eine klarere Aufgaben- und Kompetenzverteilung sowie verbesserte Kooperationsmechanismen zwischen Kartellbehörden und Gesetzgeber ermittelt und bewertet.

In einer vergleichenden Gegenüberstellung von Verwaltungs- und Verfassungsrecht zeigt Jochen Rauber, dass die Vorstellung, Schwächen des materiellen Rechts ließen sich durch ergänzende Verfahrensanforderungen ausgleichen, zwar weit verbreitet ist, doch auf Voraussetzungen beruht, die zu selten hinterfragt werden. Weder bedarf es eines solchen Ausgleichs durch Verfahren stets, wenn das materielle Recht den Inhalt einer Entscheidung nur vage vorzeichnet. Noch können die Verfahrensanforderungen durchweg leisten, was sich die Dogmatik von ihnen verspricht. Und auch wenn sie es könnten, lässt es das Grundgesetz keinesfalls immer zu, auf materiellrechtliche Direktiven zu verzichten, sofern nur das Verfahren ausreichend dicht geregelt ist.

Für die Ressortforschung insgesamt wird die Spannung zwischen staatlicher bzw. supranationaler Einbindung und Forschungsfreiheit rechtlich neu konturiert und gleichzeitig ein Beitrag zur objektiv-rechtlichen Funktion der Grundrechte geleistet. Dabei zeigt die Autorin die Geltung eines verfassungsrechtlichen und unionsrechtlichen Verbots der Legitimationsforschung auf und untermauert dieses argumentativ. Ressortforschung dient dem Rationalitätsgewinn nur, solange der Charakter freier Forschung nicht überformt wird.

Urs Saxer analysiert die Möglichkeiten und Grenzen des nationalen Rechts beim Schutz von Grundrechten sowie von Rechtsgütern des Einzelnen und der Allgemeinheit sowie die Rolle der Plattformen als globale Kommunikationsinfrastrukturen. Des Weiteren untersucht er die komplexen Grundrechtsverhältnisse im Verhältnis zwischen Staat, Plattformen und individuellen Nutzern sowie den Einfluss der europäischen und globalen Regelungsebene. Das traditionelle Medienrecht erweist sich als Auslaufmodell. Es wird von einem mehrdimensionalen Neben- und teilweise auch Durcheinander diverser Normen und Regeln auf verschiedenen Ebenen mit unterschiedlicher normativer Qualität abgelöst. In deren Zentrum stehen die Plattformen.

    Beschreibung: ste libro es expresión de las investigaciones realizadas por seis integrantes de la Línea Contextos, Prácticas Políticas y Políticas Públicas como parte del Programa Posdoctoral en Ciencias Sociales, Niñez y Juventud. Los trabajos que componen el segundo libro colectivo de esta línea fueron producidos entre el 2014 y el 2017 y abordan diferentes dimensiones de las vidas de niñas, niños y jóvenes de América Latina desde una perspectiva situada que, siendo rigurosa, asume el compromiso intelectual y político de aportar a la transformación de las condiciones en las que producen sus existencias. Si bien cada uno de los seis capítulos corresponde a investigaciones singulares llevadas a cabo por cada uno de los posdoctores en tres países de América Latina (Argentina, Brasil y Colombia), estos se alimentaron de los intercambios colectivos sostenidos en el espacio de trabajo que compartimos en la Línea del Posdoctorado. De esta manera, el libro puede leerse como el encuentro de seis textos con unidad y lógica en sí mismos, pero también como obra única en la que reverberan los diálogos sostenidos en el espacio común de trabajo que construimos en estos años. En este sentido, este texto es resultado de un proceso que demandó casi dos años de debates y reelaboraciones y que pasó por diversos momentos y circunstancias antes de que se hiciera posible su publicación. Agradecemos entonces la paciencia y la dedicación de las autoras —el azar o los procesos de igualdad de género quisieron que todas las autoras fueran mujeres— así como los comentarios y aportes de los otros colegas que integran la línea, cuyos trabajos ya han sido publicados o se editarán pronto. Asimismo, queremos agradecer al equipo de trabajo del posdoctorado que radica en el Centro de Estudios de Niñez y Juventudes (Cenju) del Cinde y la Universidad de Manizales (Sandra, Daniela, Julián), a los coordinadores de las otras líneas del programa (Toya, Patricia, Karina, Silvinha, José Manuel, Héctor Fabio, Fernanda, Myriam), a Sara Victoria Alvarado, a María Camila Ospina por aceptar con generosidad hacer el prólogo, a las instituciones coeditoras y, especialmente, a Lucía Rangel, quien compartió la coordinación de la línea junto a Pablo Vommaro hasta fines del 2016, momento en el que se incorporó Alejandra Barcala a este espacio. Los invitamos a compartir las páginas que siguen y a recorrer las experiencias de investigación y práctica intelectual que contienen. Esperamos que esta sea una manera de integrarse, al menos por algunos momentos, a la comunidad que constituimos en el Posdoctorado desde el 2010, que se potencia día a día con la publicación de obras como esta y con los ecos y debates que pueda generar.     Beschreibung: Este libro permite, entre otras cosas, acercarse a la mayor parte de los desarrollos, las tendencias y los intereses teóricos que ocupan actualmente a los cientistas sociales en América Latina. Es un mapa capaz de mostrar mucho de lo que se está haciendo en el campo de la teoría social, y capaz también de mostrar mucho de lo que queda por hacer. Uno de los rasgos más notables de este mapa es su pluralidad. Se constata aquí que las más diversas tradiciones de pensamiento transitan por nuestro continente, y que son reelaboradas por nuevas lecturas de un modo tan vital como riguroso y consistente. Queda por saber si este pluralismo existente se irá todavía ampliando, si llegará a albergar más cabalmente tradiciones no tradicionales de pensamiento. Es decir, si podrá abrirse con más fuerza a un diálogo con puntos de vista sobre lo social, lo político y lo cultural provenientes de las epistemes no occidentales, o no completamente occidentales, que habitan el sur global.

Podríamos haber establecido muchas más relaciones entre ellos y articular otras tesis interpretativas, pero con ello escaparíamos los confines de un ensayo introductorio. Le dejamos a los amigos y amigas lectores el culminar una tarea que siempre permanecerá inconclusa. En todo caso, encontrarán a continuación una serie de relatos críticos a nuestra oficialidad y a los intereses que esta ha salvaguardado. Damos fe que la historia reciente, en buena medida, les ha dado la razón a estos pensadores. En Puerto Rico hemos gozado de una ventaja epistemológica que nos asigna un inusual grado de responsabilidad. Las causas de nuestra crisis no solo eran anticipables —mucho más previsibles que las azarosas rutas de los huracanes— sino que algunas nos fueron anunciadas desde hace medio siglo. Los que tuvimos el privilegio de ir a la universidad del estado —ahora, como todo, bajo asedio— pudimos leer y escuchar en sus aulas a algunos de estos autores, y a muchos otros que merecerían estar aquí.     Beschreibung: Los estudios sociales en ciencia y tecnología en América Latina cuentan ya con medio siglo de desarrollo en la región. El origen del campo en los años sesenta dotó de características propias que permanecieron, a lo largo de las décadas con diferentes niveles de intensidad, en el marco de nuevos modelos y formas de pensar el desarrollo y de afrontar las condiciones de pobreza y exclusión de nuestras sociedades. Una vez recorrida la etapa de profesionalización del campo –y en diálogo con la dinámica de construcción de estos estudios en los países del norte– se retomaron desde nuevas preguntas y perspectivas aquellas reflexiones iniciadas en los años sesenta, al tiempo que se generaron esfuerzos por construir miradas originales sobre los significados sociales, económicos y políticos de la ciencia y la tecnología. Así se construyeron enfoques y perspectivas analíticas que aprovechan los aportes del campo a nivel internacional y los alimentan con perspectivas regionales. Ciencia, tecnología y sociedad en América Latina está organizado en cinco secciones variadas y heterogéneas, referidas todas ellas a América Latina, en las que se discuten problemas sociales muy diversos. El rico caudal de estas investigaciones sostiene como objetivo común la superación del atraso y de la dependencia de nuestros países, y la búsqueda de estrategias adecuadas en pos de mejorar las condiciones de vida en la región.     Beschreibung: More than 20 years have passed since the downfall of socialist systems. To accelerate transformation processes utmost priority was given to the recognition of property rights, an indispensable requirement for free market economies. Regulators soon came to realize that the success of transformation was conditioned on a more systematic approach towards codified civil law and business law. Numerous comparative law studies on individual Eastern European states have been undertaken, but they fail to portray the dynamic in its full scope. Studies adopting long-term perspectives and offering multi-nation comparisons are particularly rare. In March 2009, a symposium was held at the Hamburg Max Planck Institute for Comparative and International Law to address these shortcomings. In this conference volume Christa Jessel-Holst, Rainer Kulms, and Alexander Trunk assemble the contributions by international policy advisors and scholars from Eastern and South Eastern Europe (Bosnia and Herzegovina, Bulgaria, Croatia, Hungary, Poland, Romania, Russia, Serbia, Slovenia and Ukraine) assessing codification processes in classic civil law fields and company and capital market laws. In spite of comparable transformation problems, the individual processes are moving forward quite disparately, oscillating between 'old' socialist codifications, legislative projects faithful to the acquis communautaire and new codifications with a distinctly autonomous approach. Nonetheless, most transformation states are united in their effort to establish efficient court systems which can handle the acquis without being positivistic. Jahrhundert n. Chr. blühte. Ihr namengebender Lehrer ist Hermes Trismegistos. Im Asclepius belehrt er seinen Schüler Asclepius über die Natur Gottes und seiner Schöpfung und über die Stellung des Menschen in der Welt. Eingebunden ist ein apokalyptischer Passus, der den Untergang Ägyptens voraussagt. Der vorliegende Band enthält den lateinischen Text, eine Übersetzung mit Kommentar und sechs Aufsätze, die den Asclepius und den Hermetismus im Blick auf die ägyptisch-griechische Misch-Kultur ihrer Entstehungszeit, die platonische Philosophie, die Tradition apokalyptischer Literatur und die Nachwirkung in Mittelalter und Renaissance untersuchen. Text und Übersetzung einer fragmentarisch überlieferten koptischen Parallelversion sind beigefügt.

    Beschreibung: Los textos aquí publicados apoyaron las discusiones del seminario La defensa del territorio, la cultura y la vida de las comunidades campesinas e indígenas de América Latina y el Caribe ante el avance del capital extractivista, realizado del 12 al 16 de septiembre de 2019, en Asunción y que congregó a líderes de movimientos sociales campesinos e indígenas, organizaciones urbanas que luchan por el derecho a la tierra y a la ciudad, académicos de Argentina, Brasil, Colombia, México y Paraguay. La actividad pública se construyó en el marco de la XIX Reunión Anual del GT CLACSO Estudios Críticos del Desarrollo Rural, resultado de una alianza con la Facultad de Ciencias Sociales (FACSO) de la Universidad Nacional de Asunción (UNA), a través de su Dirección de Extensión Universitaria (DEU) y el Centro de Estudios Rurales Interdisciplinarios de Paraguay (CERI).

    Beschreibung: O tium ist einer der schillerndsten Begriffe der lateinischen Sprache. Sein Bedeutungsspektrum umfasst zahlreiche ambivalente Komponenten, die es erschweren, seine Bedeutung zu fassen. Häufig wird otium im Deutschen mit "Muße" übersetzt, doch gleichbedeutend sind die beiden Begriffe keineswegs. Hiervon ausgehend werden als Ergebnisse einer semantischen Studie die grundlegenden Bedeutungskomponenten von otium herausgearbeitet und sein Bedeutungsspektrum strukturiert beschrieben. Dabei nimmt Franziska C. Eickhoff das gesamte semantische Feld von otium in den Blick und arbeitet die Bedeutungskomponenten heraus, die allen Verwendungsmöglichkeiten als Kernbedeutungen gemeinsam sind. So skizziert sie mit Ansätzen der kognitiven Semantik das mentale Konzept von otium und vergleicht es mit dem Konzept von Muße.

    Beschreibung: La lucha por la implementación del Acuerdo de Paz transcurre de manera simultánea en dos sentidos. Por una parte, como necesidad de superar y derrotar en forma definitiva las resistencias de sectores que liderados por las expresiones más extremistas de la derecha política buscan desconocer la realidad histórica y concreta del Acuerdo de Paz, en cuanto posibilidad de tramitar el conflicto social y d clase por la vía exclusivamente política. Pero, al mismo tiempo, por la otra, como necesidad también de una implementación integral, de construir la legitimidad de una concepción de la paz que trascienda la visión meramente pacificadora o gatopardista, es decir, que apunte a una paz que efectivamente posea los contenidos propios de la democracia verdadera y la justicia social en camino hacias las transformaciones más profundas de la sociedad colombiana. Y, por qué no decirlo, que se encauce hacia la superación definitiva del orden social vigente; aspiración que también se encontraba tanto en los orígenes como en la larga historia de la lucha guerrillera en Colombia.

Aunque, como alerta Camus en La caída, si estuviesemos en una democracia seríamos todos culpados. No es el caso. No hay como transigir frente al descalabro de la supuesta cooperacion internacional, la connivencia criminal de la elite haitiana y el sufrimiento sin fin de la mayoría de su poblacion. Se trata de un testimonio comprometido, escrito por alguien imbuido de la tenue esperanza de que puede contribuir a reducir el tiempo que falta para que el mundo y Haití encuentren otro camino, distinto al que recorrieron hasta ahora, en sus relaciones recíprocas.

    Beschreibung: En este libro se abordan algunas de las formas en las que la desigualdad social y la estigmatización, racialización e invisibilización de la pobreza se legitiman a través de la prensa hegemónica. Reúne artículos que presentan parte de los resultados de las investigaciones llevadas a cabo en Argentina, Brasil y Colombia en el marco del proyecto POLAME (Poverty, Language and Media –Pobreza, Lenguaje y Medios–) financiado por la cooperación noruega. Los autores pertenecen al equipo de este proyecto salvo el caso de Marcela Toro, articulista invitada. El objetivo del proyecto POLAME fue detectar las expresiones lingüísticas usadas en la prensa de cuatro países indo/latinoamericanos (Brasil, Argentina, Colombia y México), palabras, vocabulario, nociones, conceptos, atributos sobre la pobreza y sus representaciones, partiendo del supuesto de que, como formadora de opinión, la prensa hegemónica reproduce concepciones, creencias e ideologías sobre la pobreza.

Lo hace munido de una concepción de la historia que no mira con nostalgia el pasado y cree en la necesidad de reinventar siempre el camino, en al menos dos direcciones. Por un lado, buscando profundizar la integración latinoamericana en una tarea permanente de rearticulación de sus objetivos e instituciones, conformada tanto de visiones y agendas convergentes como de pragmatismo y eficacia. Por el otro, avanzando en un modelo de gobernabilidad que sepa ampliar las bases del Estado sin coaptar el poder popular, en una dinámica que no es sencilla de alcanzar pero sobre la que se podrá sostener un programa de gobierno progresista que no traicione la voluntad y la capacidad de movilización de las bases.

    Beschreibung: Esta edición se realiza en el contexto del Centenario de la Reforma Universitaria cordobesa de 1918 y del cincuentenario de los hechos de 1968: el Mayo Francés, el ’68 uruguayo, la passeata dos cen mil brasileña y la masacre de Tlatelolco. El año elegido constituye un ícono, donde el sentido común ha condensado toscamente la gran cantidad de movilizaciones estudiantiles inmediatamente anteriores y posteriores, como las ocurridas en Alemania Federal, Bélgica, Checoslovaquia, China, Corea, Egipto, España, Gran Bretaña, Estados Unidos, Italia, Japón, Polonia, la Unión Soviética y Yugoslavia. En nuestro continente, además de los casos mencionados, también hubo grandes luchas estudiantiles en Argentina, Colombia y Chile, que aparecen en este volumen, y en Bolivia, Cuba, Nicaragua, Perú y Venezuela, que lamentablemente no cuentan con capítulos específicos en nuestro libro. Se trata de un libro verdaderamente colectivo, porque reunimos investigaciones con perspectivas teóricas y metodológicas diversas, sobre varios de los ciclos de movilización estudiantil más trascendentes de seis países latinoamericanos hacia fines de los ’60 y principios de los ’70, procesos a los que llamamos “los ‘68". Compartimos artículos realizados con el marco conceptual del marxismo y otros escritos desde las teorías de la acción colectiva; investigaciones que utilizaron como fuente principal los testimonios orales y otras que privilegiaron el registro hemerográfico, escritos de una densidad descriptiva notable y reflexiones conceptuales originales. En todos los casos textos metódicamente construidos, que brindan nueva información o nuevos enfoques sobre la política, la cultura y la universidad latinoamericana en los años ’60 y ’70.     Beschreibung: La meta principal de este estudio es averiguar –siguiendo la teoría de Frantz Fanon a través de su pedagogía obrera– los "mecanismos" conceptuales que podrán servir para una "relectura" de los Movimientos Sociales, observando al proceso pedagógico de Haití, con vistas a su transformación social y económica. De esa forma, ante el cuadro de emergencias en el que se encuentra Haití, surgieron preguntas respecto de cuáles serían las tareas más osadas de un educador que acepta el desafío como su responsabilidad. Preguntas como ésta, entre otras, nos han acompañado en el día-a-día, a lo largo de la escritura de este libro. Sin duda, el repensar a Haití y sus procesos educativos, consiste en un gran desafío que no puede ser asumido de forma aislada, sino de forma colectiva.

    Beschreibung: In der zweiten Hälfte des 4. Jahrhunderts erfand ein unbekannter Autor einen Briefwechsel zwischen Seneca und Paulus. Die vierzehn kurzen Briefe, acht vom Philosophen, sechs vom Apostel, sind in sehr schlechtem spätantikem Latein geschrieben und weitgehend inhaltslos. Ihr Ziel ist es, mittels eines Austauschs von freundschaftlichen Billetts, wie er unter den Intellektuellen der Spätantike üblich war, Seneca zum Freund des Paulus zu machen und so das hohe Ansehen Senecas in der spätantiken lateinischen Theologie apostolisch zu sanktionieren. Diese Fiktion war sehr erfolgreich und regte im Laufe der Geschichte immer wieder zu Spekulationen über das Verhältnis zwischen Stoa und Christentum an. Dieser Band bietet eine neue Übersetzung des Briefwechsels auf der Basis der neuesten kritischen Edition, versehen mit einer Einleitung, Erläuterungen und Testimonien. Ferner werden zwei wenig bekannte Texte aus dem Umfeld des Briefwechsels abgedruckt, erstmals übersetzt und erläutert: ein angeblicher Brief des Mordechai an Alexander den Großen aus einer Fassung des Alexanderromans und ein Brief Senecas über Hochmut und Götterbilder, eine christliche Apologie aus dem 5. Jahrhundert. Die Essays behandeln zentrale Probleme des Verhältnisses zwischen Stoa und Christentum (Gottesbild und Ethik) sowie die Seneca-Rezeption vom Mittelalter bis in die frühe Neuzeit.

Auch die Antike und frühe Neuzeit kennen Räume, die so "funktionieren". Zudem geben literarische Quellen Aufschluss darüber, wie sie als Mußeräume erfahren wurden. Die Autoren dieses Bandes widmen sich ausgewählten Räumen der Antike und frühen Neuzeit und gehen der Frage nach, ob und warum wir von ihnen als Mußeräumen sprechen können. Dabei nehmen sie architektonische und funktionale Eigenschaften dieser Räume in den Blick, die diese als Mußeräume prädestinieren könnten, und arbeiten in literarischen Darstellungen die sprachlichen Mittel heraus, mit denen die Inszenierung als Mußeräume gelingt. An Werke der neulateinischen Literatur wird zudem die Frage gerichtet, wie die Antike selbst einen Mußeraum eröffnet, wenn sie in späteren Texten rezipiert wird. Im Fokus stehen das griechische Theater, die Bibliothek, die römische Villa, der locus amoenus, der Garten und die Landschaft.

    Beschreibung: En el marco de intensos cambios políticos y económicos, el salto de siglo trajo a Latinoamérica nuevas orientaciones en la gestión y negociación de las políticas sociales, además de consensos y conflictos en torno a las mismas. Sin abandonar del todo las medidas de corte liberal recomendadas por el Consenso de Washington, buena parte de los gobiernos de la región incluyeron en sus agendas objetivos de corte universalista, junto con la implementación de un conjunto de transformaciones (heterogéneas) que mantienen, consolidan o modifican procesos iniciados en los años ochenta del siglo pasado. Partiendo de este contexto, la presente obra colectiva del Grupo de Trabajo sobre Pobreza y Políticas Sociales de CLACSO, condensa sus preocupaciones sobre los retos que enfrenta América Latina para enfrentar los niveles de exclusión social que la caracterizan, a la vez que ensaya explicaciones sobre la incidencia de los ciclos económicos y políticos que afectan permanentemente su patrón de distribución de la riqueza, e instituyen una lógica de avance y retroceso que bloquea la instalación de adecuadas estrategias de bienestar, con capacidad para atender los principales riesgos sociales y reducir la desigualdad. El análisis de esta compleja e histórica problemática, contextualizada en los primeros quince años del siglo XXI, ofrece la oportunidad de identificar las distintas orientaciones políticas de los gobiernos de turno y sus dilemas.

Lo que llamamos pasado no es más que una ilusión y un ajuste de cuentas entre fuerzas sociales rivales que luchan por el poder. Si bien el pasado es el de los ganadores, existe un pasado-presente, el de aquellos para quienes la lucha continúa y para quienes existen aún posibilidades de resistencia. La colección Epistemologías del Sur fue concebida en un formato de libros pequeños y ágiles, que más que conformar un gran edificio del conocimiento al que accedan unos pocos, se presentan como pequeñas artesanías a descubrir y como potentes brújulas para cruzar la línea abisal que separa las formas de sociabilidad metropolitanas de las experiencias coloniales.

    Beschreibung: The present collection of essays addresses the development of Ukrainian private law in the course of its ongoing Europeanization. This process is determined by the Association Agreement between the EU and Ukraine, which was concluded in 2014 and obliges Ukraine to implement a diverse number of European legal acts in its national legal system, aiming to achieve the economic integration of Ukraine into the EU internal market. Nevertheless, it would be inaccurate to describe the process of integrating Ukrainian private law into the European Area of Justice as solely the implementation of the Community acquis. Rather, the Europeanization of Ukrainian private law is part of a value-based Europeanization of the entire Ukrainian society.

    Beschreibung: Hace años que México atraviesa por una crisis de largo aliento, combinada con sucesivos estallidos de indignación y reclamos populares. Este texto propone ubicar y pensar la crisis de México a nivel específico del estado, considerándolo en su doble faz de instrumento de dominación y promesa no inocua de bienestar y evitando salidas sencillas. Este tipo de crisis no es nuevo en la región latinoamericana, por lo que recurrimos a otras experiencias (Argentina, Bolivia, Colombia, Ecuador y Venezuela) con ánimos de analizar qué podemos recuperar. El factor que nos permite la comparación con estos casos es la instancia de renovación constituyente: la convocatoria a renovar los acuerdos más básicos que nos ligan como pueblo. Pensamos la renovación constituyente no como simple recambio legal o técnico, sino como la convocatoria amplia a re-construir la nación a partir de acuerdos sociales básicos. ¿La figura del Congreso Constituyente es útil para estos fines? ¿cuál ha sido la experiencia al respecto en América Latina en el último movimiento constituyente? ¿Cómo se ven las perspectivas de México a la luz de esas experiencias? Estas son las preguntas que guían el texto.

    Beschreibung: Esta antología del pensamiento crítico brasileño, cuyo recorte temporal abarca desde mediados del siglo pasado hasta el presente, supone un esfuerzo por presentar algunos de los principales ejes y autores/as que organizaron la reflexión sobre la sociedad brasileña desde entonces. No se trata de agotar los temas y las cuestiones que fueron emergiendo a lo largo de este tiempo, tampoco los/las autores/as más importantes o representativos/as. Semejante tarea sería siempre frustrante e incompleta. Más bien, se busca ofrecer un panorama general respecto de cómo el pensamiento crítico fue ganando, desde la década de 1950, una relativa organización e incluso cierta acumulación intelectual en el país. La variedad de períodos, autores/as y perspectivas aquí presentes no borra un rasgo relativamente común al pensamiento crítico brasileño: se trata de una reflexión históricamente orientada, que entiende que el proceso de formación de una sociedad de origen colonial y estructurada a partir de la esclavitud y de la gran propiedad rural genera efectos de larga duración en la dinámica social, haciéndose sentir hasta el presente. Presente duro, con fuertes retrocesos sociales y políticos, que hace más urgente que nunca la tarea de rescatar y actualizar el pensamiento crítico. Como decía Francisco de Oliveira en “La tarea de la crítica", “la excepción obliga a pensar excepcionalmente".     Beschreibung: Demokratien weisen überall in der Welt Krisensymptome auf: Wahlbeteiligung, Akzeptanz politischer Entscheidungen und Vertrauen in die politischen Institutionen sinken stetig. Doch der Verdruss gilt nicht Demokratie und Politik, sondern Parteien und Politikern. Hier setzt Emanuel V. Towfigh an und geht der Frage nach, in welchem Verhältnis die grundgesetzliche Konzeption von Demokratie zu ihrer institutionellen Umsetzung steht. Zunächst rekonstruiert er das vorherrschende Leitbild der demokratischen Ordnung, demzufolge der politische Wettbewerb widerstreitende Interessen zu gemeinwohldienlichen Entscheidungen aggregiert. Aber auch negative Wirkungen der politischen Parteien lassen sich, gleichsam spiegelbildlich, auf das überkommene Leitbild zurückführen. Politische Parteien haben also eine paradoxe Wirkung: Demokratische Entscheidungen lassen sich heute nicht ohne sie legitimieren, aber sie bescheren gleichzeitig dramatische Legitimationsprobleme. Will man die negativen Wirkungen der Parteien reduzieren, bedarf es einer Neuausrichtung des Leitbildes von Demokratie, für die die Arbeit erste Fluchtpunkte formuliert.

    Beschreibung: Se espera que este libro, en primer lugar, nutra la reexión sobre la apremiante necesidad de repensar la formación de los docentes y el desarrollo del pensamiento crítico en los países de origen de los investigadores y en las universidades, las facultades y los centros de enseñanza donde se hallan vinculados. En segundo lugar, construir comunidad académica en el contexto del Grupo de Trabajo de CLACSO “Formación docente y pensamiento crítico", de tal manera que se fortalezca la docencia y la investigación en contextos multisituados de la región latinoamericana, a la vez que se posibilitan proyectos transformadores de realidades en diferentes niveles educativos. La lectura de estas siete obras de Freire ha suscitado reexiones del orden político, social, económico, educativo y cultural que, se aspira, entren en diálogo con otras voces interesadas en la formación de docentes en todo el sentido del concepto. Finalmente, hay que anotar que el método Freire sigue en vía de ser reconocido y puesto en práctica en los escenarios reales y particulares de aquellos docentes interesados en su propia formación y en la de sus estudiantes como pensadores críticos. La autorevisión, la autocrítica, la evaluación y los ajustes al mismo método se constituyen en parte de sus características.

    Beschreibung: La tarea de elaborar una antología del pensamiento social crítico en Guatemala ha supuesto un esfuerzo en varios sentidos. En primer lugar, delimitar qué se entiende por pensamiento crítico, y luego, decidir qué período abarcar, cuáles autoras y autores incluir, y cuáles los textos pertinentes […]. Para acotar la búsqueda se comprendió como pensamiento social crítico al conjunto de ideas elaboradas desde perspectivas divergentes, a contracorriente de los discursos y las historias oficiales, que han sido el resultado de la investigación, análisis, sistematización y reflexión sobre la realidad de la sociedad guatemalteca, con el propósito de desentrañar las estructuras de poder que sostienen un orden desigual, de raíces coloniales, que niega derechos y limita el desarrollo humano de la mayoría de la población, particularmente de las mujeres, y los pueblos indígenas. En la antología que ahora se presenta, se incluye a treinta y cinco autoras y autores, mujeres y hombres, de diversas identidades, y generaciones. Algunos con una producción muy vasta y otros que inician sus reflexiones. Se trató de mostrar una polifonía de voces y perspectivas, y para efectos de una mejor comprensión se establecieron cuatro ejes que dan cuenta de las principales preocupaciones sociales, intelectuales y políticas que han predominado en las décadas de finales del siglo veinte e inicios del veintiuno: “Estado, política, sociedad y economía" (Eje 1); “Violencia política, movimientos sociales, memoria e historia" (Eje 2); “Etnicidad, relaciones interétnicas, racismo" (Eje 3); y, por último, “Cuerpos, género, feminismos, sexualidades, violencia" (Eje 4). […] Considero este texto como un aporte más en el conocimiento de la producción intelectual en Guatemala, una invitación a profundizar en el pensamiento social crítico, a identificar autorías, temas y problemáticas que ahora no fueron incorporadas. Una motivación para continuar indagando y construyendo la historia de los aportes intelectuales en el país, ampliando miradas y ejes de análisis, temporalidades y temáticas. Desde la educación es posible pensar y crear otra vida donde los deseos y la alegría reemplace el dolor, la muerte y la oscuridad de la guerra y que podamos unirnos solidariamente con toda la diversidad del planeta.

    Beschreibung: Este libro pone en diálogo las discusiones del buen vivir con una serie de propuestas que se desplegaron entre mediados de la década de los sesenta y comienzos de la década del ochenta en América Latina. En aquél contexto, Fundación Bariloche, Oscar Varsavsky y, en buena medida la CEPAL, se ocuparon de formular alternativas al patrón de desarrollo centrado en el crecimiento económico, al tiempo que mostraron la factibilidad de esos otros estilos de desarrollo mediante el diseño de modelos matemáticos multivariados. Más recientemente, las propuestas del buen vivir, inspiradas en el Sumak Kawsay, han involucrado una profunda crítica al neoliberalismo y su modelo civilizatorio. La apuesta del libro es desestabilizar el efecto de homogeneidad y evidencia con el que suele presentarse "EL" desarrollo y mostrar que en distintas coyunturas ha sido objeto de impugnaciones y luchas.

    Beschreibung: Suele decirse que la primera víctima de una guerra es la verdad. De hecho, en una guerra en sentido estricto o en una guerra política, el asesinato de la verdad y la ocultación de los hechos ocurren profusamente. En Brasil no es diferente. La primera víctima del golpe parlamentario de 2016 no fue sólo la democracia. Fue también la verdad. Antes del golpe, y para justificarlo, las fuerzas antipopulares y antinacionales difundieron, hasta el cansancio, una serie de mentiras sobre los gobiernos del Partido de los Trabajadores (PT). Las fuerzas golpistas que asaltaron Brasil quieren hacer tábula rasa de este legado, ocultando los hechos a la población y destruyendo las extraordinarias realizaciones de este período histórico virtuoso. Por lo tanto, este trabajo es un esbozo para revelar y analizar este legado. No sólo para mostrar lo que se hizo en el pasado, sino fundamentalmente para revelar lo que puede hacerse en el futuro. Estamos convencidos de que si Brasil supera el golpe, la desestructuración del Estado y del mundo del trabajo, sus medidas extremadamente regresivas y promueve un nuevo ciclo de desarrollo, la base para tal superación debe estar basada en el legado de los gobiernos del PT.     Beschreibung: La democracia es un elemento de disputa discursiva en América Latina porque existen posiciones políticas disímiles que corresponden, por lo menos, a un par de enfoques interpretativos de carácter normativo sobre esta forma de gobierno. Una postura cuestiona la democracia liberal por sus limitaciones representativas y deriva en apelaciones a la democracia participativa como una alternativa que desdeña de las mediaciones partidistas. Una mirada opuesta reclama la vigencia plena de la democracia representativa y el Estado de derecho para establecer límites a la participación popular porque la acción directa de los movimientos sociales debilita los canales institucionales de la política. La primera interpretación es anatemizada como populista, la segunda es cuestionada por socialdemócrata o liberal.

    Beschreibung: Palestina es una cuestión histórica de gran relevancia pero también una problemática de actualidad, que se renueva y se retuerce día a día. Estuvo y sigue estando en el centro de la agenda mediática internacional, agenda marcada mayoritariamente por una visión epistémica del Norte global. Por eso es necesario, más que nunca, un acercamiento desde el enfoque de las Epistemologías del Sur, para superar las interpretaciones eurocéntricas y contribuir a una visión diversa de la existencia y resistencia del pueblo palestino. La colección Epistemologías del Sur fue concebida en un formato de libros pequeños y ágiles, que más que conformar un gran edificio del conocimiento al que accedan unos pocos, se presentan como pequeñas artesanías a descubrir y como potentes brújulas para cruzar la línea abisal que separa las formas de sociabilidad metropolitanas de las experiencias coloniales.

    Beschreibung: En las páginas y capítulos del libro se camina por los rincones de Bolivia con las voces y luchas indígenas, por un Chile y una Argentina que atraviesan historias, luchas y disputas por lo público en medio de contextos hostiles, por una Centroamérica (El Salvador, Costa Rica y México) que rescata un tremendo legado de procesos organizativos y revolucionarios, y por Colombia, que en su lucha por la paz, recoge las voces de jóvenes organizados. A su vez esta construcción retoma grandes pensadores/as y actores colectivos que han enriquecido los caminos de la Educación Popular y las Pedagogías Críticas. Así, atravesados por nuestra historia latinoamericana, por los angustiantes desafíos y tensiones por los que hoy pasan las democracias en cada uno de nuestros territorios y contextos, por las restauraciones conservadoras que nos condicionan y rodean, las Pedagogías Críticas y la Educación Popular no pueden menos, de acuerdo a lo que venimos viendo, que trabajar en la defensa del derecho a la educación que parece licuarse en varios de nuestros países, no pueden menos que ponerse el atuendo de maestro para resistir desde la escuela pública estatal, el derecho a aprender de niños, niñas y jóvenes y el derecho a ser docente, a enseñar, de miles de maestros y profesores que parecen querer ser sustituidos por “líderes educativos" y programas tecnológicos enlatados, con muy buenos dividendos para sus importadores.     Beschreibung: Rechtsanwälte haben rechtsordnungsübergreifend eine wichtige rechtsstaatliche Funktion. Doch anders als die richterliche Unabhängigkeit, die in den europäischen wie mitgliedstaatlichen Verfassungstexten ausdrücklich erwähnt wird, gilt dies für Rechtsanwälte und die Rechtsanwaltschaft als Institution zumeist nicht. Der berufsfreiheitliche und verfassungsgerichtliche Schutz anwaltlicher Berufsausübung in Deutschland kennt keine Entsprechung in Frankreich, wo dieser bislang der berufsständischen Selbstverwaltung überantwortet ist. Der Autor vermisst die anwaltliche Berufsfreiheit im deutschen Verfassungsrecht neu. Diese stellt sich als dienende Freiheitsgewährleistung dar. Zugleich werden erstmals grundrechtliche Maßstäbe für die Regulierung des Anwaltsberufs in Frankreich aufgezeigt. Der Grundrechtsvergleich lässt als gemeinsame Elemente die Fremdnützigkeit und Normgeprägtheit der anwaltlichen Grundrechte hervortreten. Die Arbeit ist 2023 mit dem Dissertationspreis "Prix des affaires" der Deutsch-Französischen Hochschule und dem Promotionspreis des Vereins der Freunde und Förderer der Rechtswissenschaften an der Universität Passau e.V. ausgezeichnet worden.

Leyendo el conjunto de los estudios, queda claro el vínculo de lo local con lo global y viceversa, para concluir que los problemas referenciados del libro tienen que asociarse a una lectura crítica de la sociedad capitalista contemporánea.

    Beschreibung: Das neue unionale Datenschutzrecht ist, entgegen mancher Befürchtung, kein law of everything. Vielmehr müssen unterschiedliche Rechtsmaterien ineinandergreifen, um eine sachgerechte Regelungsstruktur im Schnittbereich von Datenschutzrecht und Privatrecht aufzubauen. Philipp Hacker bestimmt das Verhältnis dieser Rechtsmaterien, insbesondere von DS-GVO und BGB. Denn die Verschränkung unterschiedlicher Technologieformen fordert mehr denn je ein rechtsbereichsübergreifendes Verständnis von juristischer Dogmatik und ein interdisziplinär fundiertes Konzept von Regulierung. Auf Basis des geltenden Rechts entwirft er ein integriertes Marktordnungsrecht für digitale Austauschverhältnisse. Die Untersuchung schließt mit Reformperspektiven, die aufzeigen, wie die informierte Einwilligung durch eine technologische ersetzt werden kann, um eine privatautonome Gestaltung von Rechtsverhältnissen unter den Bedingungen der digitalen Wirtschaft zu ermöglichen. Die Arbeit wurde mit dem Wissenschaftspreis der Deutschen Stiftung für Recht und Informatik 2020 ausgezeichnet.
