Description: Das Cloud Computing bietet als IT-Bereitstellungsmodell vielfältige Vorteile und Entwicklungspotentiale, allerdings entstehen auch neuartige Risiken. Herausforderungen stellen sich nicht nur im Datenschutz-, Vertrags- und Haftungsrecht, sondern vor allem im Bereich des Straf- und Ordnungswidrigkeitenrechts. Während Verletzungen der Datenvertraulichkeit durch externe Täter hinreichend erfasst werden können, ist unklar, ob ein ausreichender strafrechtlicher Schutz bei unbefugter Kenntnisnahme und Weitergabe der ausgelagerten Nutzerdaten durch potentielle Innentäter besteht. In diesem Kontext werfen vor allem Tathandlungen durch Administratoren der Cloud-Anbieter und der Cloud-Nutzer bislang ungeklärte Rechtsfragen auf. 1

Description: Aus Anlass des Gesetzentwurfs der Anpassung des Bundesdatenschutzgesetzes an die Datenschutz-Grundverordnung (DS-GVO) nach europäischen Vorgaben stellt der nachfolgende Beitrag die Handhabe von Steuerdaten im Fokus des Datenschutzes heraus. Durch die Umsetzung der DS-GVO treten bestehende Datenschutzbestimmungen im Steuerrecht hinter das allgemeine Datenschutzgesetz zurück. Was sagen die derzeitig gültigen Bestimmungen über die Daten in den Steuererklärungen und wie muss die öffentliche Hand damit umgehen?

Description: Overshadowed in the public debate by the seismic shift in the legal and political landscape that the UK’s decision to leave the European Union brought with it, the Digital Economy Bill is currently quietly making its way through the legislative process. The paper discusses some of the data protection implications of the bill, with a focus on the proposed regulation of online adult content. It will argue that the bill is a paradigmatic example of the way in which data protection, or rather differential denial of data protection, can be leveraged to promote and enforce normative conceptions of sexuality, without having to explicitly commit the government to a “moral agenda”.

Description: The past five years have seen increasing interest by African states to request for accession and subsequently accede to the Council of Europe Convention 108 on automatic processing of personal data and its Additional Protocol. Apart from Uruguay, a Latin American country, the remaining requests and accessions to Convention 108 by non-European states originate from the African continent. This development signifies the maturity of privacy policies in Africa. Overall, it is an important step towards the realisation of a global data privacy treaty as Convention 108 is the only international legally binding instrument that grants individuals the right to the protection of their personal data and is open for accession by any country around the globe. This article discusses this watershed moment for the evolution of African privacy policies.

Can the United States provide a higher standard of personal data protection than the EU? (2017)

Description: The view established in EU Member States assumes that the level of personal data protection in EU Member States (and the EU as such) is much higher than that provided by the US legal system. This assumption will (presumably) find its validation in relation to the US federal law. However, many of the solutions found at the state level in the US are only now being introduced into the EU system (and that of the EU Member States). The article highlights that such established views (or stereotypes) can be unfounded (and may lead to even more unsubstantiated conclusions).
