    Description: La décontamination des sols pollués, phénomène longtemps occulté, est devenu une préoccupation majeure des pouvoirs publics et des industries. Les Pays-Bas et la Région flamande ont déjà légiféré dans ce domaine. La République fédérale d'Allemagne est sur le point de le faire. En revanche, l'absence de réglementations spécifiques aux sols contaminés tant en Région bruxelloise qu'en Région wallonne soulève bon nombre d'interrogations. Le 19 mai 1995, le Centre d'étude du droit de l'environnement (CEDRE) et le Séminaire de Recherches en Urbanisme et en Environnement (SERES) ont organisé une conférence aux Facultés universitaires Saint-Louis à Bruxelles sur ce thème. Différents spécialistes ont analysé à la fois la pertinence des instruments juridiques disponibles (polices administratives, responsabilités contractuelle et extra-contractuelle, droit des assurances) et les développements récents en Région flamande et en Région wallonne. Ces rapports sont rassemblés dans le présent ouvrage.

    Description: Die vorliegende Arbeit beschäftigt sich mit der Validierung eines neuen Tests zur Messung von Experimentierfähigkeit in Large-Scale-Assessments. Die Testaufgaben erfordern die Planung, Durchführung und Auswertung typischer physikalischer Schülerexperimente der Sekundarstufe I. Anstelle von Realexperimenten werden interaktive Simulationen zum Aufbau von Experimenten und zur Durchführung von Messungen eingesetzt. Die Bearbeitung der Testaufgaben erfolgt vollständig am Computerbildschirm. Diesen Bearbeitungen werden in der Auswertung Punkte (Testwerte) zugewiesen. In der heute gültigen Vorstellung ist Validierung im Wesentlichen als ein theorie- und evidenzbasierter Argumentationsprozess aufzufassen. Nach der Nennung und Begründung notwendiger Validierungsschritte erfolgt eine schlüssige Validitätsargumentation. Ein Validierungsschritt kann z. B. darin bestehen, zu überprüfen, in wieweit zur erfolgreichen Bearbeitung der Testaufgaben Experimentierfähigkeiten eingesetzt werden. Die Ergebnisse der Validierungsschritte lassen sich wie folgt zusammenfassen: die Aufgabeninhalte und -anforderungen des Tests passen zum Physikunterricht der Sekundarstufe I; die Schüler denken und handeln bei der Bearbeitung der Testaufgaben experimentell; der verwendete Bewertungsmaßstab misst Experimentierfähigkeit; die erreichten Testwerte korrelieren mit den Testwerten, die bei inhaltlich identischen Realexperimenten erreicht werden. Zusammenfassend ist festzuhalten, dass der computerbasierte Test das Spektrum der in Large-Scale Assessments erfassbaren Experimentierfähigkeiten erweitert.

    Description: This study provides a quantitative and qualitative status report on the implementation of school-based management (SBM) in Indonesia, identifies factors associated with the successful practices of SBM, and assesses SBM effects on student achievement eight years after inception. They found that the implementation so far has produced limited success and provide recommendations to strengthen the nation’s SBM practices.

    Description: Die Frage nach der Verbindlichkeit des Rechts, die Frage also, ob dem Recht über seine äußere Zwangsgewalt hinaus eine verpflichtende Kraft zukomme, versteht sich nicht von selbst. Hat der aus der Trennung von Recht und Moral entspringende Rechtspositivismus doch zu der These geführt, daß das Recht – rein rechtlich betrachtet – zu nichts verpflichte. Das widerspricht allerdings den vorherrschenden sozialen Anschauungen. Sie verlangen folglich nach einer Begründung für den dem Recht zugeschriebenen Anspruch verbindlicher Maßgeblichkeit. Demgemäß ranken sich um die Idee solcher Normativität des Rechts Vorstellungen, Bilder und Begriffe, die eine innere Bindung durch Recht plausibel zu machen suchen. Es wird gezeigt, daß sich diese Konnotationen der Idee der Rechtsverbindlichkeit auf drei Grundfiguren zurückführen lassen, die der Grammatik der persönlichen Fürwörter korrespondieren.Der Autor ist Professor für Öffentliches Recht, Rechts- und Staatsphilosophie an der Humboldt-Universität zu Berlin.

    Description: Sieben Kunstschulen in Niedersachsen führten in den Jahren 2005 und 2006 Projekte entlang der Schnittstelle von Kunstproduktion und Bildungsarbeit durch. Dabei setzten sie sich mit Strategien der Gegenwartskunst auseinander, die auf Prozess, Kooperation und Intervention basieren. Das Buch bietet eine Reflexion und Theoretisierung dieser Projekterfahrungen und zeigt sowohl die Probleme als auch die Potenziale der Arbeit im Zwischenraum von Kunst und Bildung auf. Es möchte neue Impulse für die Kunstvermittlung geben, zu eigenen Experimenten und zum Weiterdenken anregen. Der partizipativ angelegte Forschungsprozess belegt, dass es möglich ist, die Komplexität der Prozesse in solchen Projekten zu analysieren und zu beschreiben und dabei die Beteiligung der Akteure und Akteurinnen als konstitutiv für den Erkenntnisprozess zu verstehen.

    Description: If parents are critical and reflective about the media, they can pass this ability on to their children. But what is this ability? How can it be recorded? In her dissertation, the author developed a test procedure and collected basic data to analyze the media criticism of parents of young children. Before that, she defined the term "media criticism", placed it in the theoretical context and used it to examine her results. The study shows that the social situation influences both media education and critical media dealings. Habitualized patterns of media use are also passed on within the family. This study opens a new field of research in media education, in which the role model function of parents in dealing with media is in focus. The relevance of the topic is obvious: parents shape the media criticism of their children, i.e. the adults of tomorrow. The author uses current examples to classify the social effects of a lack of reflection and criticism in dealing with the media.

The first part contains a thick chronological description of the case-law of the Court of Justice of the European Union on free movement of persons and services, including the hitherto largely neglected coordination of social security. In this sizeable body of case-law including roughly 1400 decisions the book then traces the evolution and spin of certain interpretive formulas. The WTO sought to settle this dispute by concluding the Public Health Declaration.     Description: L'essor du recours au crédit n'est plus à démontrer : le crédit est devenu un mode de paiement courant pour une grande majorité de consommateurs. La loi du 12 juin 1991 relative au crédit à la consommation avait notamment pour objectif de cadenasser l'octroi d'emprunts, dans le souci d'améliorer la protection des consommateurs. Elle fut révisée à diverses reprises. La multiplicité des types de crédit ainsi que les nouvelles réglementations imposées par le contexte européen ont amené le législateur à prendre de nouvelles dispositions visant essentiellement à protéger le consommateur. Au cours de la dernière législature, on peut notamment relever la loi du 7 janvier 2001 modifiant la loi du 12 juin 1991 relative au crédit à la consommation et la loi du 10 août 2001 relative à la Centrale des crédits aux particuliers. Le présent ouvrage analyse ces modifications récentes et procède à un examen actualisé de la jurisprudence.

    Description: Die "Assistierte Ausbildung" (AsA) soll als ein Arbeitsmarktinstrument benachteiligten Jugendlichen den Weg in Berufsausbildung und Beruf erleichtern, ihre Chancen auf den Abschluss einer Berufsausbildung erhöhen und Ausbildungsabbrüche vermeiden. Der Band dokumentiert die Ergebnisse der explorativ angelegten Begleitforschung. Grundlage der Studie sind qualitative Interviews zu Erwartungen, Verlauf und Ergebnissen der AsA mit Auszubildenden, Ausbildungsbetrieben sowie Fachkräften der Arbeitsagenturen und Bildungsdienstleister. Die Ergebnisse zeigen, dass die Assistierte Ausbildung einen wertvollen Beitrag zur Integration benachteiligter Jugendlicher in den Arbeitsmarkt leistet. Die Studie identifiziert jedoch auch Optimierungsbedarf, wie z. B. eine stärkere Flexibilisierung und Modularisierung, um noch besser auf die Bedürfnisse aller Akteure eingehen zu können.

    Description: In an increasingly harmonized global patent landscape, few issues still distinguish the US patent system as much as its strict–and often criticized–duty of candor and its inequitable conduct doctrine. The EPO and most other countries around the world impose less burdensome disclosure duties upon patent applicants. What is there to learn from the experience in the US? Have these tools resulted in any benefit worth considering? Yet regardless of the disclosure duties imposed upon patent applicants, a deceptive conduct before the Patent Office could lead to unwarranted exclusive rights and have a negative impact on competition. Should antitrust law intervene? Is it a case of sham litigation? This work attempts to answer those questions through a comparative analysis, examining the law and case law in the US and in the EU from both a patent and a competition law perspective and seeking a workable theory of harm.

    Description: There is increasing evidence that the first few years after birth are particularly important in child development and present opportunities for enrichment but also vulnerabilities do to poverty and other social stressors. Elected officials have begun proposing potentially costly programs to intervene early in the lives of disadvantaged children. Have such interventions been demonstrated to yield substantial benefits? To what extent might they pay for themselves through lower welfare and criminal justice costs incurred by participating children as they grow into adults? This study synthesizes the results of a number of previous evaluations in an effort to answer those questions. Conclusions are that under carefully controlled conditions, early childhood interventions can yield substantial advantages to recipients in terms of emotional and cognitive development, education, economic well-being, and health. (The latter two benefits apply to the children's families as well.) If these interventions can be duplicated on a large scale, the costs of the programs could be exceeded by subsequent savings to the government. However, the more carefully the interventions are targeted to children most likely to benefit, the more likely it is that savings will exceed costs. Unfortunately, these conclusions rest on only a few methodologically sound studies. The authors argue for broader demonstrations accompanied by rigorous evaluations to resolve several important unknowns. These include the most efficient ways to design and target programs, the extent to which effectiveness is lost on scale-up, and the implications of welfare reform and other safety net changes.

This book is the first scholarly attempt to address this implementation paradox. The authors ask: What is the current level of implementation? How can we explain any gap in perceived performance? Can we improve our measurement of children’s rights? With the use of quantitative and qualitative methods, the volume examines a wide range of areas relevant to children’s rights. These include child protection and sexual violence, detention and policing, poverty and custody proceedings, asylum and disability, sexual orientation and gender identity, and childcare and human rights education. In addition, the book offers a proposal for an alternative statistical approach to measuring Norway’s performance. The book’s editors conclude by pointing towards the complex set of factors that complicate full realisation and the need for the Government to engage in proper measurement of implementation.

    Description: Eine lernendenorientierte und adaptive Gestaltung von Unterricht erfordert von den Lehrkräften, dass sie vorhandene Kompetenzen und Lernprozesse der Schülerinnen und Schüler diagnostizieren. Außerdem müssen sie die Anforderungen von Aufgaben mit Blick auf deren Passung zu den Lernprozessen der Schülerinnen und Schüler analysieren können. Eine derart verstandene "diagnostische Kompetenz" wird als zentrales Professionalisierungsziel von Lehrkräften angesehen. Vor diesem Hintergrund wurden die diagnostischen Prozesse von acht Studierenden mit den Fächern Physik und Mathematik in zwei aufeinander folgenden Lehrveranstaltungen zur Diagnostik untersucht, um Potentiale und Lernhindernisse im Kompetenzaufbau zu identifizieren. In beiden Veranstaltungen bildeten Vignetten von Lernprozessen den Ausgangspunkt für studentische Diagnosen. Forschungsgegenstand waren u.a. schriftliche Diagnosen der Studierenden im Prä-Post-Vergleich sowie auf Video aufgezeichnete studentische Diskurse bei der Diagnose von Lernprozessen der Schülerinnen und Schüler. Die Analysen erfassen u.a., auf welche Komponenten eines Diagnoseprozesses die Studierenden in welcher Weise Bezug nehmen und welche (fach-) didaktischen überlegungen bzw. Theoriebezüge sie in ihren Diagnosen als Referenzpunkte nutzen. Die Ergebnisse zeigen, dass auf struktureller Ebene zwar alle Komponenten thematisiert, aber inhaltlich nicht entlang einer typischen Abfolge miteinander verbunden werden. Trotz inhaltlicher Prompts wird nur selten explizit auf Theoriebezüge zurückgegriffen.

Dieses bisher unveröffentlichte Material von insgesamt 176 Briefen gewährt einen fesselnden Einblick in das wissenschaftliche Leben einer Zeit, in der Deutschland auf dem Gebiet der Altertumswissenschaft in der Welt führend war. Dabei entstehen die Charakterbilder zweier Vertreter ihrer Fächer, der Archäologie und der Alten Geschichte, was sie verband und was sie trennte. Die nahezu 1000 Anmerkungen vermitteln ein umfassendes Bild der damaligen Wissenschaftsgemeinschaft, in der die beiden mächtigen, aber höchst eigenwilligen Persönlichkeiten mit Entschiedenheit und Diplomatie über Jahrzehnte agierten. Nicht zuletzt wird man Zeuge dessen, wie mit dem aufkommenden Nationalismus auf beiden Seiten die ehemalige Internationalität der Forschung in die Brüche ging.

    Description: Dès lors qu’elle renvoie à la possibilité de « se fier », à quelqu’un ou à quelque chose, la confiance est au cœur et au fondement des relations sociales, intéressant ce faisant la plupart des sciences sociales. Dans un contexte dominé par le constat partagé d’une « crise » de confiance / ou de défiance – dans la société, dans la démocratie, dans les hommes et les institutions politiques, dans le progrès, dans l’économie, etc. –, une interrogation croisant les analyses de différentes disciplines prend tout son sens. Si le juriste est interpellé par la problématique de la confiance en tant que « juriste dans la cité », il peut également y trouver un concept invitant à renouveler certains cadres classiques des droits constitutionnels, de l’environnement, de l’économie ou encore des finances. L’organisation d’une « journée d’étude interdisciplinaire » tendait à poursuivre ce questionnement, en invitant des spécialistes de disciplines non juridiques à dialoguer avec des juristes. Les points de vue de la philosophie, de l’histoire, de la science politique et de l’économie ont ainsi été mobilisés pour questionner la thématique commune de la confiance. Il s’est agi notamment, d’une part, de se demander si la réflexion sur la confiance était en mesure de développer des outils aptes à renouveler certains cadres théoriques classiques ; d’autre part de s’interroger sur l’impact de ces réflexions théoriques sur le lien social, eu égard aux enjeux actuels.

    Description: Seit 2004 gibt es in Deutschland den zweijährigen Ausbildungsberuf "Kfz-Servicemechaniker". Seine Einführung war umstritten, wurde aber auch als Chance für Bewerber mit schwachem Schulabschluss gesehen. Aus diesem Grund wurde die Erprobung von 2005 bis 2007 wissenschaftlich begleitet. Der Beruf gehört dadurch zu einem der am besten untersuchten Ausbildungsberufen. Befragt wurden Ausbilder, Auszubildende und Lehrende. Die Autoren stellen ergänzend Entwicklungen im Kfz-Service-Sektor und zum Ablauf der Ausbildung dar. Die allgemeine Diskussion von Vor- und Nachteilen der zweijährigen Ausbildung macht es möglich, die Ergebnisse auch auf andere Bereiche zu übertragen.

Among the many topics worthy of attention, the Scientific Committee has decided to put the accent on the theme of the relationship between universities and economic and social development. In response to the transformations and the dramatic downsizing of the higher education system, how is it possible to affirm the centrality of the education of the “human capital”, aimed at the growth and cohesion of society? The essays gathered in the volume offer, each one from its own point of view, interesting insights and points of discussion on how, at the present time, universities can contribute to the economic and social development of a country in which territorial and social inequalities are deepening, despite reduced public resources, limited degree of autonomy and uncertain relations with other national and local actors.

    Description: In the United States, preschool education is characterized by the dominance of a variegated private sector and patchy, uncoordinated oversight of the public sector. Tracing the history of the American debate over preschool education, Andrew Karch argues that the current state of decentralization and fragmentation is the consequence of a chain of reactions and counterreactions to policy decisions dating from the late 1960s and early 1970s, when preschool advocates did not achieve their vision for a comprehensive national program but did manage to foster initiatives at both the state and national levels. Over time, beneficiaries of these initiatives and officials with jurisdiction over preschool education have become ardent defenders of the status quo. Today, advocates of greater government involvement must take on a diverse and entrenched set of constituencies resistant to policy change.

    Description: For about two decades, say Johnson and Pace, the discussion of how to address prose style in teaching college writing has been stuck, with style standing in as a proxy for other stakes in the theory wars. The traditional argument is evidently still quite persuasive to some-that teaching style is mostly a matter of teaching generic conventions through repetition and practice. Such a position usually presumes the traditional view of composition as essentially a service course, one without content of its own. On the other side, the shortcomings of this argument have been much discussed-that it neglects invention, revision, context, meaning, even truth; that it is not congruent with research; that it ignores 100 years of scholarship establishing composition's intellectual territory beyond "service." The discussion is stuck there, and all sides have been giving it a rest in recent scholarship. Yet style remains of vital practical interest to the field, because everyone has to teach it one way or another. A consequence of the impasse is that a theory of style itself has not been well articulated. Johnson and Pace suggest that moving the field toward a better consensus will require establishing style as a clearer subject of inquiry. Accordingly, this collection takes up a comprehensive study of the subject. Part I explores the recent history of composition studies, the ways it has figured and all but effaced the whole question of prose style. Part II takes to heart Elbow's suggestion that composition and literature, particularly as conceptualized in the context of creative writing courses, have something to learn from each other. Part III sketches practical classroom procedures for heightening students' abilities to engage style, and part IV explores new theoretical frameworks for defining this vital and much neglected territory. The hope of the essays here-focusing as they do on historical, aesthetic, practical, and theoretical issues-is to awaken composition studies to the possibilities of style, and, in turn, to rejuvenate a great many classrooms.

    Description: This open access report explores the nature and extent of students’ misconceptions and misunderstandings related to core concepts in physics and mathematics and physics across grades four, eight and 12. Twenty years of data from the IEA’s Trends in International Mathematics and Science Study (TIMSS) and TIMSS Advanced assessments are analyzed, specifically for five countries (Italy, Norway, Russian Federation, Slovenia, and the United States) who participated in all or almost all TIMSS and TIMSS Advanced assessments between 1995 and 2015. The report focuses on students’ understandings related to gravitational force in physics and linear equations in mathematics. It identifies some specific misconceptions, errors, and misunderstandings demonstrated by the TIMSS Advanced grade 12 students for these core concepts, and shows how these can be traced back to poor foundational development of these concepts in earlier grades. Patterns in misconceptions and misunderstandings are reported by grade, country, and gender. In addition, specific misconceptions and misunderstandings are tracked over time, using trend items administered in multiple assessment cycles. The study and associated methodology may enable education systems to help identify specific needs in the curriculum, improve inform instruction across grades and also raise possibilities for future TIMSS assessment design and reporting that may provide more diagnostic outcomes.

Without the right to life, other rights cannot be implemented. The Commission adopted General Comment No.3 on the African Charter on Human and Peoples' Rights on the right to life (Article 4) during its 57th Ordinary Session, held in Banjul, The Gambia, in November 2015. It is designed to guide the interpretation and application of the right to life under the Charter and to ensure its coherent application to a range of situations, including its implementation at the domestic level. The General Comment does not put in place new standards or highlight best practices but rather sets out the Commission’s perspective on dimensions of this universally recognised right.     Description: This open access book provides insight into what it takes to actively involve teachers in the curriculum design process. It examines different aspects of teacher involvement in collaborative curriculum design, with specific attention to its implications for sustainable curriculum innovation and teacher learning. Divided into six sections, the book starts out by introducing the notion of collaborative curriculum design and discusses its historical and theoretical foundations. It describes various approaches commonly adopted to actively involve teachers in the (co-)design of curriculum materials. Sections two and three provide examples of what key phases in the curriculum design process - such as needs analysis, design and development, and implementation - look like across various collaborative curriculum design projects. Section four reports on the impact of collaborative curriculum design on student learning, teacher practices, teacher professional growth, and institutional change.     Description: Le décret de la Communauté française du 24 juillet 1997 définissant les missions prioritaires de l'enseignement est original à plus d'un titre. Quant à la procédure suivie pour son élaboration, tout d'abord : il fait suite aux Assises de l'enseignement et aux travaux du Conseil de l'Éducation et de la Formation qui ont assuré une large participation aux acteurs de la communauté éducative. On s'interroge aujourd'hui sur les rapports entre démocratie représentative et démocratie participative. Le décret « missions » mérite l'attention à cet égard. Quant à son contenu et ses enjeux ensuite. L'exposé des motifs les présente comme suit : « Ce décret aurait dû être le premier de tous les textes législatifs organisant renseignement obligatoire. Définissant les missions de l'Éducation, il est le texte fondateur de tous les autres ». Il a déjà produit plusieurs changements considérables dans le fonctionnement et la vie des écoles, notamment la mise sur pied de « conseils de participation », des règles nouvelles au sujet de l'inscription, de l'évaluation et de l'exclusion des élèves, ou encore à propos de la gratuité de l'enseignement. Les questions que soulève pareille législation sont nombreuses. Peut-on formuler en règles de droit des objectifs généraux ? Quelles sont la valeur et la pertinence de ceux- ci ? Comment les normes décrétales doivent-elles être interprétées ? Que reste-t-il de la liberté d'enseignement garantie par la Constitution ? C'est pour traiter ces questions que le Centre de droit de la culture des Facultés universitaires Saint-Louis a organisé le vendredi 25 septembre 1998 une journée d'études interdisciplinaire. Le présent ouvrage livre une version revue et approfondie des exposés présentés à cette occasion.

    Description: Entsendungen und dauerhafte Auslandsbeschäftigung sind inzwischen ein weltweites Phänomen. Grenzüberschreitende Freizügigkeit bedarf aber der Begleitung durch grenzüberschreitende soziale Sicherung. Dies gilt auch für das Risiko von Arbeitsunfall und Berufskrankheit. Eine fehlende Koordinierung der nationalen Sozialrechtsordnungen und des Internationalen Privatrechts birgt hier die Gefahr von Schutzlücken für den Arbeitnehmer und von ungeklärten deliktischen Haftungsrisiken seines Arbeitgebers. Am Beispiel der internationalen Ausrichtung der deutschen gesetzlichen Unfallversicherung und der australischen Workers Compensation untersucht die Autorin diese Risiken umfassend. Mit einem detaillierten Raster praxisnaher Fallbeispiele ermittelt sie Defizite bei Versicherungsschutz, Leistungsrecht und Arbeitgeberhaftung und zeigt konkrete Lösungsmöglichkeiten auf. Bestehende völkerrechtliche Abkommen und das koordinierende Sozialrecht der EG sind als Musterregelungen in die Untersuchung einbezogen.

    Description: The Cross Domain City of the Future Graduation Lab, situated in the Faculty of Architecture and the Built Environment at TU Delft, has been a pioneer in experimenting with a multidisciplinary approach to education on the built environment. Drawing upon this expertise over the past years, this book reflects on multidisciplinarity in the built environment and its implementation in education on the built environment. How should one approach multidisciplinarity in education and practice? What encompasses its core elements, benefits, and challenges? By addressing these questions, the book aims to inform students and practitioners within the realm of the built environment by sharing insights from experiences in multidisciplinary education. It presents eight conclusions regarding the future of multidisciplinary education and, thereby, seeks to contribute to a more humane and sustainable future for cities: 1.Process is central to multidisciplinary collaboration. Negotiating positions, ensuring an environment of respect, balance and open-mindedness, and setting a common vocabulary. 2.Multidisciplinarity can be a way to foster innovation. It triggers complementarity and confrontation. As with any innovation, there is potential for greater outcomes, but, at the same time, extra risks emerge. These need to be managed. 3.Multidisciplinarity could be better integrated into organisational structures. 4.Disciplinarity and multidisciplinarity are in mutual coexistence. They are inseparable. They can complement and contradict each other. 5.Problem precedes solution, not the opposite. Framing the problem, or ‘problematizing’, is a considerable share of the actual solution. This is particularly applicable to multidisciplinarity. 6.Multidisciplinarity is by nature composed of fluid boundaries. Navigating through an enormous diversity of perspectives requires agility, flexibility, independence, spirit of adventure and embracing uncertainty. 7.Professionals should be trained as ‘T-shape’: grounded in their field while able to dialogue with other fields. 8.Both generalists and specialists are needed. Education should provide opportunities for both.

    Description: This open access methodological book summarises existing analysing techniques using data from PIAAC, a study initiated by the OECD that assesses key cognitive and occupational skills of the adult population in more than 40 countries. The approximately 65 PIAAC datasets that has been published worldwide to date has been widely received and used by an interdisciplinary research community. Due to the complex structure of the data, analyses with PIAAC datasets are very challenging. To ensure the quality and significance of these data analyses, it is necessary to instruct users in the correct handling of the data. This methodological book provides a standardised approach to successfully implementing these data analyses. It contains examples of and tools for the analysis of the PIAAC data using different statistical approaches and software, and it offers perspectives from various disciplines. The contributing authors have hands-on experience of using PIAAC data, and/or they have conducted data analysis workshops with these data.

Authors from outside the Netherlands discuss what aspects of RME appeal to them, their criticisms of RME and their past and current RME-based projects. It is clear that a particular approach to mathematics education cannot simply be transplanted to another country. As such, in eighteen chapters the authors describe how they have adapted RME to their individual circumstances and view on mathematics education, and tell their personal stories about how RME has influenced their thinking on mathematics education.

Other contributions explain the role of academic infrastructure, especially of libraries and promoters of research. Für die Auswertung und Analyse ihrer Studie zur Teilnahme an Bildungsurlaubsangeboten im Bundesland Bremen nutzt die Autorin grundlegende Erkenntnisse der Forschung zur Weiterbildungspartizipation. Im Ergebnis identifiziert die Autorin folgende Bedingungsfaktoren für die Teilnahme an Weiterbildung: das Zusammenspiel von Kontextfaktoren und Gelegenheitsstrukturen, Individualfaktoren sowie subjektive Sinn- und Bedeutungszuschreibungen. Die anschließende systematische Zusammenführung mit den Studienbefunden ist die Grundlage für weitere Forschungen zum Bildungsurlaub. Die Dissertation ist ein wichtiger Beitrag zur bildungswissenschaftlichen Grundlagenforschung und rückt den Bildungsurlaub als besonderen Teil der Weiterbildungslandschaft in den Blick.

    Description: Le marché de la photographie est éclaté en de nombreux segments aux fonctionnements très disparates. Cette diversité s’accompagne d’une grande variété dans les statuts et les modes de rémunération, les photographes pouvant être payés, selon les cas, en droits d’auteur, salaires, bénéfices industriels et commerciaux, bénéfices non commerciaux. La restructuration des marchés autour de nouveaux leaders (Getty, Corbis, Jupiter…), suite à la révolution numérique, a fragilisé les agences d’auteurs et réduit le pouvoir de négociation des photographes au sein de la filière. Elle s’est accompagnée du développement de nouvelles pratiques comme la vente de photographies libres de droits. Très rentables pour les diffuseurs, en termes de coûts de transaction comme en termes de prix d’achat, ces pratiques précarisent les photographes et sapent les fondements du droit d’auteur, tant dans son versant patrimonial que moral. Les revenus de la mode et de la publicité et le développement récent d’un marché des tirages photographiques, marchés au demeurant très sélectifs, ne suffisent pas à compenser l’érosion des revenus des photographes. La porosité croissante des marchés favorise en outre des arbitrages entre droits d’auteur et salaires, en raison de taux de cotisations sociales très inégaux, fragilisant les droits sociaux des photographes. Enfin, les revenus issus de la gestion collective demeurent embryonnaires malgré des perspectives de développement prometteuses.

    Description: This book investigates lifecycle management strategies used by pharmaceutical companies attempting to maximize the value of their product portfolio. Such strategies are sometimes referred to by generic drug companies as “evergreening”. The analysis focuses on two of these strategies, namely product improvements and product line extensions. In particular, an evaluation of the patents that follow the basic one and that accompany the development of a drug from research to market is attempted. Two “blockbuster” drugs, Taxotere and Xalatan, were randomly chosen to carry out such analysis. The patent portfolio of the originator companies is outlined and some important patents for each area of research (e.g. formulations, combinations, delivery devices) are shortly described. Patent filing trends for the two drugs, both in regards of the originator and in regards of other competing companies (amongst these also the generics) are schematically shown.

Eingebunden ist ein apokalyptischer Passus, der den Untergang Ägyptens voraussagt. Der vorliegende Band enthält den lateinischen Text, eine Übersetzung mit Kommentar und sechs Aufsätze, die den Asclepius und den Hermetismus im Blick auf die ägyptisch-griechische Misch-Kultur ihrer Entstehungszeit, die platonische Philosophie, die Tradition apokalyptischer Literatur und die Nachwirkung in Mittelalter und Renaissance untersuchen. Text und Übersetzung einer fragmentarisch überlieferten koptischen Parallelversion sind beigefügt.

    Description: Dem Vergleichen wird in der Geschichtswissenschaft die Funktion einer historischen Methode zugesprochen, für den Geschichtsunterricht dient es als Methode zur Förderung historischer Kompetenzen. In den Geschichtslehrwerken der Sekundarstufe II taucht es in der Regel in Form von Aufgaben auf. Doch wie relevant sind Vergleichsaufgaben in Lehrwerken überhaupt und welche Fertigkeiten und Kompetenzen benötigen Lernende in der Sekundarstufe II zur (schriftlichen) Lösung einer historischen Vergleichsaufgabe? Diesen Fragen wird mit Hilfe einer zweiteiligen Untersuchung auf der Grundlage einer umfangreichen Frequenzanalyse von Aufgaben in Geschichtslehrwerken der Sekundarstufe II in NRW sowie einer Korpusanalyse von Lernendentexten zu einer authentischen Vergleichsaufgabe aus einem Geschichtslehrwerk nachgegangen. Die Arbeit verbindet den geschichtsdidaktischen Zugang mit dem linguistischen Ansatz der Funktionalen Pragmatik, um das Vergleichen als Handlungsmuster des Geschichtsunterrichts zu bestimmen und es im Hinblick auf seinen kommunikativen Zweck in Teilhandlungen aufzuschlüsseln. Der Zugang wird ergänzt durch den Bezug zur Schreibdidaktik, der gerade im Hinblick auf wissenschaftspropädeutisches Arbeiten in der Sekundarstufe II eine wichtige Rolle spielt. Aus den Ergebnissen der Untersuchungen wird auf der Grundlage eines Indikatorenmodells ein praxisorientierter Weg zum Umgang mit Vergleichsaufgaben im Geschichtsunterricht vorgeschlagen.

Aber was lernen Schülerinnen und Schüler in Deutschland über die Europäische Union? Diese Studie verbindet auf innovative Weise zwei Ebenen der empirischen Schulbuchforschung: Zum einen wird die Darstellung der Europäischen Integration in Schulbüchern für allgemeinbildende Schulen untersucht, zum anderen werden die Verwendung und Bewertung der Schulbücher durch Lehrkräfte und Schülerinnen und Schüler an niedersächsischen Gymnasien und Gesamtschulen analysiert. Die Ergebnisse unterstreichen die hohe Relevanz des Schulbuchs für den Politikunterricht und geben Hinweise auf bestehende Probleme und Verbesserungsmöglichkeiten. It is no longer possible to truly understand or shape politics without knowledge of the European Union. But what do German pupils learn about the European Union in school? This study’s innovative approach connects two levels of empiric textbook research: on one level it examines how the European Union is portrayed in secondary school textbooks and on the other level it analyses how textbooks are used and assessed by teachers and pupils at comprehensive and grammar schools in Lower Saxony. The findings emphasise the relevance of textbooks for civics lessons and offer recommendations to solve existing problems.

    Description: Le thème retenu par l'IFR droit « Mutation des normes juridiques » pourrait surprendre car assurément le voyage n'est pas une notion juridique. Mais tout aussi assurément il n'est guère de branches du droit qui ne contiennent de dispositions l'appréhendant. Il serait par ailleurs vraisemblablement vain de chercher une définition universelle et intemporelle du voyage. Pourtant il ne fait aucun doute que depuis ses origines l'histoire de l'humanité n'a cessé d'avoir partie liée avec celle des voyages humains même après la domination des sédentaires sur les nomades. Ces voyages à caractère sacré, commercial, conquérant, savant, initiatique..., ont constitué un défi constamment renouvelé pour le droit des sociétés sédentarisées requis de traduire le délicat équilibre à réaliser entre leur fermeture et leur ouverture à l'inconnu, autrement dit entre une appréhension du voyage et des voyageurs comme une menace pour la préservation de l'ordre social et une appréhension du voyage et des voyageurs comme une promesse du renouveau indispensable de la société. À la faveur de la révolution des transports l'essor du commerce international, l'avènement du voyage de loisirs au XIXe siècle et la massification du tourisme occidental à partir du XXe siècle ont marqué un tournant de l'histoire du voyage et donné naissance à un droit du marché du voyage. Aujourd'hui, alors que toutes les destinations de notre monde semblent connues et que sont menacés de disparition les derniers peuples nomades sous les coups de la globalisation, un fossé se creuse entre le monde des riches néonomades de la mobilité mondiale qui se rient des frontières et le monde des sédentaires ou nomades de misère que les frontières enferment ou menacent. Le défi pour le droit de l'ouverture du monde offerte aux premiers et le défi pour le voyage de la clôture du monde imposée aux seconds invitent à réinventer le voyage et son droit de demain.

Dabei ist neben der Frage der internationalen Zuständigkeit der Gerichte auch das internationalprivatrechtliche Problem des materiell anwendbaren Rechts in den Mittelpunkt der Aufmerksamkeit gerückt. Besonders kontrovers diskutiert wird dieses hinsichtlich der Bestimmung der originären Inhaberschaft am Urheberrecht. Das Werk beschäftigt sich mit der kollisionsrechtlichen Behandlung dieses Aspektes bei Sachverhalten mit grenzüberschreitenden Bezügen. Nach einer wissenschaftlichen Hinterfragung der im internationalen Urheberrecht diskutierten Grundprinzipien der Anknüpfung an die lex loci protectionis einerseits und die lex originis andererseits und einer Darstellung der Rechtslage in Deutschland, Frankreich und den USA wird eine Kollisionsregel entwickelt, welche trotz der unterschiedlichen nationalen Ansätze einen einheitlichen, internationalen Ansatz bilden könnte. Dabei spielen auch die Vorgaben der internationalen Abkommen und des Europäischen Rechts eine Rolle.
