    Description: This book aims to study the history of the University of Tortosa from its canonical erection in 1600 to 1717, when it was transferred to Cervera. Through four chapters the place of the University of Tortosa in the set of the Universities of the Crown of Aragon is studied, through the proposopography of rectors, lecturers and graduates. It was a Convent-University run by the Order of Preachers that exclusively taught Philosophy and Theology. The documentary appendix includes the Statutes of the Colegio de San Matías and San Jaime, the Statutes of the University, as well as the list of graduates that has been preserved for the periods 1600-1623 and 1659-1717. Among them, there are numerous regular and secular clergymen from Valencia, Catalonia, Aragon and Mallorca.---Este libro pretende estudiar la historia de la Universidad de Tortosa desde su erección canónica en 1600 hasta 1717, año en el que fue transferida a Cervera. A través de cuatro capítulos, se estudia el lugar de la Universidad de Tortosa en el conjunto de las Universidades de la Corona de Aragón, mediante la proposopografía de rectores, lectores y graduados. Era un Convento-Universidad que estaba en manos de la Orden de Predicadores, y en el que se enseñaba exclusivamente Filosofía y Teología. El apéndice documental incluye los Estatutos del Colegio de San Matías y San Jaime, los Estatutos de la Universidad, así como la relación de los graduados que se ha conservado para los períodos 1600-1623 y 1659-1717. Entre ellos, se encuentran numerosos clérigos regulares y seculares de Valencia, Cataluña, Aragón y Mallorca.

    Description: "Ecclesiastical institutions and actors were essential for the formation of normative orders in early modern Ibero-America. However, both legal historiography, due to its strong legalistic, state-centred imprint, and general historiography on colonial times, more inclined towards secular law, have only rarely discussed the contribution of ecclesiastical normativity to the formation of that normative texture which, in the historiographical tradition, has been called ‘derecho indiano’. In light of this situation, the Max Planck Institute for European Legal History has organised a series of seminars in different Latin American cities in order to offer an interdisciplinary forum dedicated to the research of ‘ecclesiastical normativities and institutions in Ibero-America’ between the 16th and 19th centuries. The present volume is the first in a series of publications that document the results of this cycle of seminars celebrated in Mexico City, Lima, Bogotá and São Paulo. The book, focusing on New Spain, is divided into five thematic parts. The first section presents investigations on canon law and moral theology that deal with characteristic aspects of multinormativity and the teaching of those disciplines in early modern times. The second section examines diocesan governance and ecclesiastical power in Mexico City and Puebla via statutes of the cathedral chapter, members of the ‘curia arzobispal’ and pertinent legal opinions. In the third section, the contributors reflect on the normativity and administration of sacraments, drawing on conciliar norms, treatises, pragmatic literature but as well on registers of baptisms and confessions. The fourth section deals with ethnic groups in courts of justice, both civil and ecclesiastic ones: indigenous people accused of ‘hechicería’ in a tribunal of Tlaxcala and Afro-Mexicans who started litigation in the archiepiscopal court of Mexico. The articles of the fifth section cover the topics of beatification, devotion and cultural expressions (music, images) from a normative perspective and extend the period of investigation to the 19th century. The articles on ecclesiastical institutions and normativities in New Spain collected in this volume propose new research fields for legal history and the history of the Church, which at the same time are relevant for social and cultural history. The editors’ purpose has been to present approaches that explore the relationship between different types of normativities, their local adaptations, the ties with global debates, the forms of solving conflicts, as well as the role of jurists, theologians and other actors. The topics discussed by the authors represented in this volume – who cultivate the disciplines of history, legal history, church history, ethnohistory, art history and the history of music – contribute to a better understanding of the normative religious universe in Spanish America."

    Description: The purpose of this book is to explain the process of establishing the seven Spanish grand colleges where a large part of the State and the Church elite servants were educated in the 16th and 17th centuries. To this end those colleges are considered, first, in the framework of the European collegiate movement, before placing them in the Spanish one. A study of the institutional system of those foundations follows and, in the process, several given truths are challenged. The book closes with an analysis of the careers of the individuals educated in those ‘schools’ for high bureaucrats – labelled as ‘schools of empire’ – which, with the time, became a power within the State thus causing its disappearance.---El propósito de esta obra es explicar el proceso de creación de los siete colegios mayores, en los que se formó gran parte de la elite que gestionó las principales instituciones del Estado y de la Iglesia en la España de los siglos XVI y XVII. Para ello, se sitúan primero los colegios en el contexto general del movimiento colegial europeo, antes de considerar específicamente el movimiento colegial español. Se describe después el sistema institucional de esas fundaciones, consideradas como un todo, y se cuestionan algunos planteamientos generalmente aceptados en torno a las mismas. En la tercera parte se analiza la proyección profesional de los colegiales formados en esas “escuelas” de formación de altos burócratas –a las que se denomina “escuelas de imperio”– los cuales, con el tiempo, acabarán convirtiéndose en una potencia dentro del Estado, provocando así su desaparición.

    Description: Alternatives to the restored 1812 Spanish Constitution preceded the second constitutional period. The Doctrinairism, professed by a relevant part of the deputies in the Cortes, and by most of the governments, was the most important influence. All of them defended a model similar to the French Charte constitutionnelle of June 4, 1814; consequently, they vehemently opposed the single-chambered system, the suspensive veto and the preeminence of the Legislative branch, among other characteristics of the 1812 Constitution. This book aims to confront the ideas of the Constitution and the constitutional types of the two main ramifications of Spanish liberalism through the analysis of General and deputy Rafael del Riego cases, an eloquent expression of that political struggle.

    Description: La instauración del segundo periodo constitucional en 1820 venía precedida por alternativas a la Constitución restaurada, las más importantes de las cuales estaban influidas por el moderantismo y doctrinarismo que profesaban una parte relevante de diputados en las Cortes inauguradas en junio de ese año y la mayoría de los Gobiernos del periodo. Todos ellos defendieron un modelo similar a la Charte constitutionnelle francesa de 4 de junio de 1814 y, en consecuencia, se opusieron con vehemencia al sistema monocameral, al veto suspensivo y a la preeminencia del Legislativo entre otras características que ofrecía la de 1812. Este libro tiene por objeto la confrontación de las ideas de constitución y los tipos constitucionales de las dos principales ramas del liberalismo a través del análisis de los casos que afectaron al general y diputado exaltado Rafael del Riego. En ellos, esa lucha, a través de una de sus expresiones más elocuentes -el enfrentamiento entre el Ejecutivo y el Legislativo y el surgimiento de prácticas espurias-, se manifiesta de una manera elocuente.

    Description: This book, written by Rafael Ramis-Barceló, brings together three studies on the University of Lleida (1561-1717). The first is a description of the Studium of Lleida during the pontificate of Antonio Agustín. It was a Golden Age, with great professors, although with frequent conflicts. The second is an analysis of the Faculty of Civil and Canon Law from the death of Felipe V until the transfer of the University to Cervera. The third deals with the Faculties of Arts and Theology for the same period. These two final chapters study the decline of the University and its problems during the Baroque Age. The book –with new sources, from different Catalan archives– aims to offer an overview of the last period of the Studium of Lleida and its intricate transfer to Cervera.----------Este libro, escrito por Rafael Ramis-Barceló, reúne tres estudios sobre la Universidad de Lérida (1561-1717). El primero es una descripción del Estudio de Lérida durante el pontificado de Antonio Agustín. Fue una época dorada, con grandes maestros, aunque con frecuentes conflictos.     Description: Beacons and swamps is a proposal for dialogue with the historiography of Argentine prisons, which saw provincial prisons as "swamps": immobile, grey, unchanging spaces. Although it is true that the pace of change in the provinces differed enormously from that of the capital, the work of the local prison reformers was to build "beacons" of modernity, in the style of the one installed in Buenos Aires: the famous National Penitentiary. Much has been discussed about the "panopticon", that institutional model of the society of control, but little is known about those "swamps" that constituted "the grey punishment of the majority". The aim of this book is to explore what is hidden in those provincial confinement spaces, where most of the national prison population was punished. It is based on the hypothesis that it is precisely there, under those swamps, that the original Argentine prison is hidden, because it was forged in those grey places of transition rather than in the "modernising beacons" of Buenos Aires or Ushuaia. Far from the "model", and from the punitive "should be", the embryos of the contemporary prison are hidden in the marshes. Delving into the mud and unearthing these vestiges, investigating the logic of the functioning of provincial prisons, will allow a better understanding of the emergence and consolidation of the punitive devices that characterise Argentine prisons today.

    Description: Faros y pantanos, es una propuesta de diálogo con la historiografía de las prisiones argentinas que vio en las cárceles provinciales, “pantanos”: espacios inmóviles, grises y sin cambios. Si bien es cierto que los ritmos de cambio provinciales diferían enormemente con el de la capital, el trabajo de los reformistas penitenciarios locales fue el de construir “faros” de modernidad, al estilo del instalado en Buenos Aires: la célebre Penitenciaría Nacional. Se ha discutido mucho sobre el “panóptico”, aquel modelo institucional de la sociedad de control, sin embargo, poco se conoce de aquellos “pantanos” que constituyeron “el gris castigo de la mayoría”. La apuesta de este libro es explorar lo que esconden aquellos espacios de reclusión provinciales, donde se castigaba a la mayor parte de la población carcelaria nacional. Se parte de la hipótesis de que, precisamente allí, debajo de aquellos pantanos se esconde la prisión argentina primigenia, porque se fraguó en esos grises lugares de transición más que en los “faros modernizadores” de Buenos Aires o Ushuaia. Apartadas del “modelo”, y del “deber ser” punitivo, se esconden en la marisma los embriones de la prisión contemporánea. Adentrarse en el barro y desenterrar esos vestigios, investigar acerca de la lógica de funcionamiento de las cárceles provinciales, permitirá comprender mejor el surgimiento y la consolidación de los dispositivos punitivos que caracterizan a las cárceles argentinas hoy.

    Description: "The Third Mexican Provincial Council, celebrated in 1585, has always been considered a cornerstone of the canonical law of Spanish America, both with regard to its content and the long period and vast territory in which it was in force. New possibilities of research had been made possible due to the publication of the working manuscripts in recent years, enabling a better understanding of the juridical work produced by the bishops. Given these new materials, the author has delved deeper into the drafting processes carried out by the provincial council. Taking a close look at the reports sent to the council, the theological and juridical treaties, and other conciliar and synodal legislation, along with the consultations to jurists and theologians, the author has identified different processes of drafting of the conciliar decrees. The result of this research allows us to relocate the authorship of the conciliar decrees to the Mexican episcopate as well as establish the degree of their originality. Locality of the law and its significance in the legal order in force at that time is one of the characteristics of the body of decrees promulgated at the Third Mexican Provincial Council."

    Description: The book presents the catalogue of Hispanic doctors in Civil and Canon Law graduated at the University of La Sapienza in Rome from 1549 to 1774. It also includes a list of Portuguese graduates. In La Sapienza, contrary to what has been maintained by many scholars, hundreds of foreign students received their doctorate degrees in Civil and Canon Law. The book, after a presentation of the College of Consistorial Lawyers and the Professors of the Faculty of Civil and Canon Law, emphasizes the international character of the doctoral students and focuses on Spaniards. Decisive contributions can be made going through the list of graduates, supervisors, examiners and witnesses, not only to the identification of Hispanic civilists and canonists, but also to the study of the academic, cultural and political networks, woven in Rome during the Modern Era.--------El libro presenta la nómina de doctores hispanos en leyes y cánones en la Universidad de La Sapienza de Roma desde 1549 hasta 1774. Se incluye asimismo una nómina de graduados portugueses. En La Sapienza, contrariamente a lo que se ha sostenido mayoritariamente, se doctoraron en ambos derechos centenares de estudiantes extranjeros. El libro, tras una presentación del Colegio de Abogados Consistoriales y de los profesores de la Facultad de Leyes y Cánones, enfatiza el carácter internacional de los doctorandos y se centra en los hispanos. A través del elenco de graduados, promotores, examinadores y testigos se puede contribuir decisivamente no sólo a la identificación de legistas y canonistas hispanos, sino también al estudio de las redes académicas, culturales y políticas que se tejieron en Roma durante la época moderna.

    Description: The purpose of this book is to make a comparison the books of statutes of the seven Spanish elite colleges – the colegios mayores – and their changes throughout the time. To do so those books have been deconstructed first and reordered later, in accordance with the type of members of the college communities, their internal organization, core values and rules regarding daily life and the protection and control of the colleges. In practical terms this work is a companion book of part II of Escuelas de imperio. La formación de una elite en los Colegios Mayores (siglos XVI-XVII) (2019), where the foundations of the Spanish collegiate system are analyzed. The book includes a transcript of the constitutions and statutes of the College of Santa Cruz in Valladolid, whose last printed edition is from 1786.

    Description: El propósito de este libro es el de comparar los estatutos y constituciones originales de los siete colegios mayores españoles y su evolución a lo largo del tiempo. Se ha procedido para ello a una deconstrucción de sus normas y la reordenación posterior en base a las categorías de miembros de las comunidades colegiales, su organización interna, los principios por los que se regían, las normas que regulaban su vida cotidiana, y las que debían asegurar la protección y el control de las fundaciones. A efectos prácticos, esta obra quiere ser un “libro de acompañamiento” de la parte II de Escuelas de imperio. La formación de una elite en los Colegios Mayores (siglos XVI-XVII) (2019), en la que se analizan los fundamentos del sistema colegial español. El libro se completa con una transcripción de la constituciones y estatutos del Colegio de Santa Cruz de Valladolid, cuya última edición impresa es de 1786.
