    Description: The present work starts from the problem when investigating how the same penalty for the crime of Fraudulent Embezzlement affects the principle of proportionality, so it is necessary to refer to Article 387 of the Penal Code, which reads as follows: The public official or servant who appropriates or uses, in any form, for himself or for another, funds or effects whose collection, administration or custody are entrusted to him by reason of his position, shall be punished with deprivation of liberty for not less than two nor more than eight years. It is an aggravating circumstance if the funds or effects were destined for welfare purposes or social support programs. In these cases, the prison sentence shall be not less than four nor more than ten years. According to the Plenary Agreement No. 4-2005/CJ-116, Plenary Jurisdiction of the Permanent and Transitory Criminal Chambers of the Supreme Court of Justice, the elements of the criminal offense of embezzlement are (i) the existence of a functional relationship, (ii) the collection, administration or custody, (iii) appropriation or use, (iv) the recipient: for himself or for a third party, (v) funds and effects. The result was that when punishing with the same penalty in the crime of Fraudulent Misappropriation in its modality of appropriation and use, despite the differences if we appreciate them from a patrimonial perspective or from the perspective of safeguarding the right of property of the public entity, in the modality of use there is an excess in the penalization, affecting the principle of proportionality, reason for which it should have a different treatment.

    Description: El presente trabajo se inicia del problema cuando se investiga de qué manera al sancionar con una misma pena en el delito de Peculado Doloso afecta el principio de proporcionalidad, por lo que es necesario remitirnos al artículo 387 del Código Penal, cuyo tenor es como sigue: El funcionario o servidor público que se apropia o utiliza, en cualquier forma, para sí o para otro, caudales o efectos cuya percepción, administración o custodia le estén confiados por razón de su cargo, será reprimido con pena privativa de la libertad no menor de dos ni mayor de ocho años. Constituye circunstancia agravante si los caudales o efectos estuvieran destinados a fines asistenciales o a programas de apoyo social. En estos casos, la pena privativa de la libertad será no menor de cuatro ni mayor de diez años. Según lo establecido por el Acuerdo Plenario N.° 4-2005/CJ-116, Pleno jurisdiccional de las Salas Penales Permanentes y Transitoria de la Corte Suprema de Justicia, los elementos del tipo penal de peculado son (i) la existencia de una relación funcional, (ii) la percepción, administración o custodia, (iii) apropiación o utilización, (iv) el destinatario: para sí o para un tercero, (v) caudales y efectos. El resultado fue que al sancionar con una misma pena en el delito de Peculado Doloso en su modalidad de apropiación y utilización visten de igual contenido de ilicitud, pese a las diferencias si las apreciamos desde una perspectiva patrimonialista o de salvaguarda del derecho de propiedad del ente público, en la modalidad de utilizar existe un exceso en la penalización afectándose el principio de proporcionalidad, razón por la cual debe tener un tratamiento distinto.

Aber gilt der Zusammenhang von Krieg, Revolution und Nationalismus auch an den Rändern Europas und über Europa hinaus? Wie steht es um den asiatischen Teil der Sowjetunion, um Mexiko, die Türkei? Angelehnt an die grundlegenden Forschungen Dieter Langewiesches hinterfragen zehn Experten eine der wirkmächtigsten Meistererzählungen der Geschichtswissenschaft. Dabei gehen sie weit über den traditionellen mitteleuropäischen Forschungsrahmen hinaus und untersuchen Beispiele revolutionärer Erhebungen in Süd- und Osteuropa ebenso wie die Entwicklungen auf dem amerikanischen Kontinent. Zwei Zeiträume stehen im Mittelpunkt: Die Jahrzehnte um 1800 als dem klassischen Revolutionszeitalter und die Jahre um den ersten Weltkrieg, in dessen Umfeld erneut territoriale und politische Ordnungen in Frage gestellt und neu gestaltet wurden.

    Description: Feminicide has become a problem of general interest due to its high impact on the Colombian population; in this sense, this phenomenon was studied to characterize it in the departments of Huila and Tolima, which is why for the researchers it is essential to make this problem visible, pointing out the conditions framing violence against women from this macho culture that prevails in the region and country. The topic is of special interest since a review of press articles, epidemiological reports, local statements, and research on femicide in the two departments was carried out, seeking to make this phenomenon more visible to show the country’s reality so that it can be reported on. The results show that there is no research on the subject, which makes it possible to initiate a database with studies on femicide. Similarly, the National Institute of Legal Medicine and Forensic Sciences (2016) considers that the data described on homicide in 2015 and in previous years have decreased in magnitude over the years. The analysis of the variables realizes that the risk factors triggering the violent events that determine homicide have not been neutralized, reduced, or controlled, considering that public policy on security and citizen coexistence has been insufficient.

    Description: El Feminicidio se ha convertido en un problema de interés general por su alta afectación a la población colombiana, en tal sentido se estudió este fenómeno para caracterizarlo en los departamentos del Huila y Tolima, es por esta razón que para las investigadoras resulta fundamental visibilizar esta problemática, señalando las condiciones que enmarcan la violencia contra la mujer desde esta cultura machista que impera en la región y en el país. El tema reviste especial interés toda vez que se realizó una revisión de artículos de prensa, informes epidemiológicos, pronunciamientos locales e investigaciones frente al feminicio en los dos departamentos, buscando visibilizar con mayor fuerza este fenómeno a fin de mostrar la realidad al país para que se informe sobre éste. Los resultados evidencian la no existencia de investigaciones al respecto, lo que permite iniciar una base de datos con estudios acerca del feminicidio. De igual forma, el Instituto Nacional de Medicina Legal (2016) considera que los datos descritos sobre el homicidio en el año 2015 y en años anteriores han disminuido en magnitud año tras año, el análisis de las variables da cuenta que los factores de riesgo que desencadenan los hechos violentos que determinan el homicidio no han sido neutralizados, reducidos o controlados, considerando que política pública de seguridad y convivencia ciudadana ha sido insuficiente.

    Description: Voltaire is one of the few European authors of the 18th century to have dealt with Korea. In this study, we first propose to highlight, through an analysis of all of his work, the texts in which he mentioned Korea and how this country is represented there. We will then try to identify his documentary sources, and we will focus mainly on how the author created stories from historical elements. Our survey also aims to understand Voltaire’s attitude to the historical-philosophical and dramatic genres, and to better understand his conception of these two genres.

    Description: In Swiss administrative law, the nullity of (state) acts that have legal effects has so far been decided on the basis of the evidence theory. This work contrasts the theory of evidence with the constitutional concept of nullity, which dogmatically repositions the concept of nullity and anchors it constitutionally in the principle of legality. The concept of cognizance of nullity is introduced for the power of an authority applying the law to determine the nullity of a legal act. The work discusses the procedural channels in which the cognizance of nullity can be exercised. In addition to the new dogmatic foundation of nullity, it provides a review scheme that is intended to contribute to more predictable decisions and thus to legal certainty.
    Description: Über die Nichtigkeit von (Staats-)Akten, die auf Rechtswirkungen gerichtet sind, wurde im schweizerischen Verwaltungsrecht bislang anhand der Evidenztheorie entschieden. Diese Arbeit stellt der Evidenztheorie den verfassungsunmittelbaren Nichtigkeitsbegriff entgegen, der das Konzept der Nichtigkeit dogmatisch neu verortet und im Legalitätsprinzip verfassungsrechtlich verankert. Für die Befugnis einer rechtsanwendenden Behörde, die Nichtigkeit eines Rechtsakts festzustellen, wird der Begriff der Nichtigkeitskognition eingeführt. Die Arbeit bespricht die verfahrensrechtlichen Bahnen, in denen die Nichtigkeitskognition ausgeübt werden kann. Nebst dem neuen dogmatischen Fundament der Nichtigkeit stellt sie ein Prüfschema zur Verfügung, das zu voraussehbareren Entscheiden und damit zur Rechtssicherheit beitragen soll.

    Description: The Faculty of Philosophy and Letters in Madrid commissioned Marcelino Menéndez Pelayo and Nicolás Salmerón to write a report on the royal decrees that reduced university staffing levels, given by virtue of the authorisations granted by the Budget Law of 30 June 1892. The text of the opinion is reproduced together with some extracts from a well-known book by the professor from the Central University (Historia de los heterodoxos españoles) which help to understand the context of the message. It thus serves to document the extent of an opinion, which is not confined to a single group - the Krausist group - but is shared by other sectors that conceive of the university as something more than an administrative office. The key ideas are: the immobility of the teaching staff; an ideal of family life geared towards scientific research; the demand for autonomy - freedom of action - for the university body; the conception of the university as the representative of national culture; the promotion of scientific and not only professional faculties; the intervention of the university in the choice of its staff; the elimination of course exams... In short, it rejected "the trampling importation of the French centralist regime" and called for emancipation from excessive official tutelage.

    Description: La Facultad de Filosofía y Letras de Madrid comisionó a Marcelino Menéndez Pelayo y a Nicolás Salmerón para redactar un informe sobre los reales decretos que reducían las plantillas de las universidades, dados en virtud de las autorizaciones concedidas por la Ley de Presupuestos de 30 de junio de 1892. Se reproduce el texto del dictamen junto a unos fragmentos de un conocido libro del profesor de la Central (Historia de los heterodoxos españoles) que ayudan a comprender el contexto del mensaje. Sirve así para documentar la extensión de una opinión, que no se circunscribe a un solo grupo –el krausista– sino que es compartida por otros sectores que conciben la universidad como algo más que una oficina administrativa. Las ideas clave son: la inamovilidad profesoral; un ideal de vida familiar encaminada a la indagación científica; la exigencia de autonomía –libertad de acción– para el cuerpo universitario; la concepción de la universidad como representante de la cultura nacional; el fomento de las facultades científicas y no solo profesionales; la intervención de la universidad en la elección de su personal; la eliminación de los exámenes de curso... En definitiva, se rechaza “la atropellada importación del régimen centralista francés” y se reclama la emancipación de la excesiva tutela oficial.

    Description: Engativá is one of the 21 political-administrative divisions of the Capital District of Bogotá (Colombia), and is distinguished by its urban composition, a high population density and its soils dedicated mainly to residential, commercial and industrial use. However, this territory is also characterized by the presence of ecosystems rich in biodiversity that are threatened by factors associated with urbanization and the effects of climate change. In this locality there are three urban wetlands of RAMSAR category: Juan Amarillo, Jaboque and Santa María del Lago, in addition, in terms of water management, by the administrative jurisdiction of Engativá is a portion of land of the basins of the Bogotá River and the Salitre River. On the other hand, among the green areas that make up the urban fabric, such as neighborhood parks, complementary conservation areas such as the botanical garden and La Florida Regional Park stand out. In relation to these urban ecosystems, which are part of the Main Ecological Structure of the Capital District and its environmental region, this book contains an analysis of each of these components, highlighting elements of their historical trajectory, specialized legal regulations and a description of specific challenges. One of the purposes of the systematization of information collected here is to make evident the nuances of the environmental urban planning managed in the administrative jurisdiction of Engativá: a place where urban vitality and nature converge in a fragile balance, marked by a complex trajectory of environmental degradation and adoption of the inhabitants to the territory.

    Description: Engativá es una de las 21 divisiones político – administrativas del Distrito Capital de Bogotá (Colombia), y se distingue por su composición urbana, una alta densidad poblacional y sus suelos dedicados principalmente al uso residencial, comercial e industrial. No obstante, este territorio también es caracterizable por la presencia de ecosistemas ricos en biodiversidad que se encuentran amenazados por factores asociados a la urbanización y los efectos del cambio climático. En esta localidad se encuentran tres humedales urbanos de categoría RAMSAR: Juan Amarillo, Jaboque y Santa María del Lago, además, en materia de ordenamiento hídrico, por la jurisdicción administrativa de Engativá se encuentra una porción de terreno de las cuencas del río Bogotá y del río salitre. Por otra parte, entre las áreas verdes constitutivas del tejido urbano como los parques de carácter vecinal, sobresalen las áreas complementarias para la conservación como el jardín botánico y el Parque regional La Florida. En relación con estos ecosistemas urbanos, que hacen parte de la Estructura Ecológica Principal del Distrito Capital y su región ambiental, el presente libro contiene un análisis de cada uno de estos componentes, resaltando elementos de su trayectoria histórica, las regulaciones jurídicas especializadas y una descripción de los desafíos específicos. Uno de los propósitos de la sistematización de información aquí recogida es hacer evidentes los matices del ordenamiento urbano ambiental gestionado en la jurisdicción administrativa de Engativá: un lugar donde convergen la vitalidad urbana y la naturaleza en un equilibrio frágil, marcado por una trayectoria compleja de degradación ambiental y adoptación de los habitantes al territorio.

    Description: Despite the opposition of two parties - first the Whigs and the Tories, then the Liberals and the Conservatives - 19th century Britain was characterized by a political culture of moderation. The bearers of this political culture were a group of politicians who always sought the middle way between the extremes and were known as Liberal Tories or Liberal Conservatives. This book fills a research gap by examining the development of this British Liberal Conservatism in the period from 1750 to 1850, first looking at Edmund Burke's political philosophy and then showing how the Liberal Tories and Liberal Conservatives who followed him drew on his thinking. It shows how politicians such as George Canning and Sir Robert Peel, based on Burke and the political philosophy of the "Old Whigs", pursued a centrist policy that was always oriented towards the virtues of moderation and prudence. The book thus sheds light on the conservative variant of liberalism that characterized Great Britain throughout the 19th century.

    Description: With the globalization in which we find ourselves, violence against women or members of the family nucleus has been increasing as it develops in each of the homes and this occurs when there are violent acts by the aggressor towards the victims of this particular most of the cases are brought to the attention of the competent authorities. It must be understood that in Latin America, where the countries are less developed, violence occurs against women and this does not have a real index, because most of them do not make it known that they are victims of violence. In the Ecuadorian State there are several types of violence that are known by the Public Prosecutor's Office, the cases of physical violence and psychological violence are the ones that are related to each other, that is to say, physical and psychological aggression. In Ecuador with the reform of the Organic Integral Penal Code in 2019 and its subsequent validity and application in June 2020, the implementation of new legal mechanisms to suspend the substantiation of the process in matters of violence against women or members of the family nucleus, as special procedures to solve the problems of this matter is given, considering that the constitutional norm establishes that the State will guarantee the victim the punishment of the aggressor through special procedures in relation to violence.

    Description: Con la globalización en la que nos encontramos la violencia contra la mujer o miembros del núcleo familiar ha ido en aumento ya que se desarrolla en cada uno de los hogares y esta ocurre cuando existe actos violentos por parte del agresor hacia las víctimas de este particular la mayoría de los casos son puestos en conocimiento de las autoridades competente. Hay que entender que América Latina donde los países son menos desarrollados, la violencia ocurre contra la mujer y ésta no tiene un índice real, debido a que la mayoría no pone en conocimiento de qué son víctimas de violencia. En el Estado ecuatoriano existen diversos tipos de violencia que son conocidos por fiscalía de mayor forma se dan los casos de violencia física y violencia psicológica estos tipos de violencia son los que se relacionan entre sí, es decir, la agresión física y psicológica. En el Ecuador con la reforma del Código Orgánico Integral Penal en el año 2019 y su posterior vigencia y aplicación en mes en el mes de junio del 2020, se da la implementación de nuevos mecanismos legales para suspender la sustanciación del proceso en materia de violencia contra la mujer o miembros del núcleo familiar, como procedimientos especiales para solucionar los problemas de esta materia considerando que la norma constitucional establece que el Estado garantizará a la víctima la sanción del agresor mediante procedimientos especiales en relación a la violencia.

The memoirs in which, throughout most of his life, he recorded these and other public and private events, remained unpublished as a whole until now. Beyond the editorial history of this code, to which they have contributed, their possibilities remained untapped for knowledge of the mechanics of access and promotion within the judicial machinery or of the social customs of his privileged estate, among other inquisitive aspects.

    Description: Valentín Ortigosa, born in 1784 in Arriate (Málaga), emigrated to Mexico in 1803, where he was ordained a priest. He returned to Spain in 1810. His biography will reflect the events that took place in those years of the 19th century in which he lived, especially the problems that arose in the relations between Rome and Madrid as the representative system was being established. Although he would never occupy a relevant public position, Ortigosa moved in the circle of Agustín Argüelles, or José María de Calatrava; he enjoyed the favor of the queen governor María Cristina and his political opinions, especially in relation to the independence of the American countries, found echo in the press. Presented by the Regent to be bishop of Malaga in 1836, being suspended in fact the relations between the crown of Spain and Rome, his designation was not confirmed, but he was named capitular vicar and this allowed him to rule the Diocese without having been consecrated bishop; he became one of the "intrusive bishops". Due to denunciations of the Chapter of Malaga, a case was opened against him before the Tribunal of the Archbishopric of Seville. Later the appeal of force that Ortigosa raised before the Audience of Seville, and its execution by the Supreme Court ended up giving rise to the rupture of the relationship with the Holy See with the closing of the Nunciature of Madrid in January of 1841. This case and its repercussions are studied in detail in this book, both from the juridical, civil and canonical point of view, as well as from the political point of view. The documentation collected from newspaper archives and from numerous archives, both Spanish and Roman, has made it possible to analyze the consequences of the question of the so-called "intruders" starting from the case of Valentín Ortigosa, a character whose notoriety in these years contrasts with the oblivion of his name after disappearing from public life in 1843.

Esta causa y sus repercusiones son estudiadas con detenimiento en este libro, tanto desde el punto de vista jurídico, civil y canónico, como desde la óptica política. La documentación recogida de hemerotecas y de numerosos archivos, españoles y de Roma, ha permitido analizar las consecuencias de la cuestión de los llamados “intrusos” a partir del caso de Valentín Ortigosa, un personaje cuya notoriedad en estos años contrasta con el olvido de su nombre tras desaparecer de la vida pública en 1843.

    Description: At the end of the 19th century, Spain enjoyed a favorable climate for developing true freedom of the press, a right recognized in Article 13 of the Constitution of 1876 and developed through the Printing Police Law of 1883. However, throughout the period of the Bourbon Restoration (1883-1923), the Spanish government, represented by the conservative and liberal parties that peacefully took turns in power, adopted a series of measures that distorted the longed-for freedom of Spanish publications. The political and social events characteristic of this period (especially the terrorism of the end of the 19th century, the colonial conflicts in Cuba and Morocco or the influence of the regionalisms of the 20th century), had a notable influence on the actions of the public authorities. The latter used different legal instruments (the approval of different laws limiting freedom, the frequent declaration of the suspension of constitutional guarantees or the multiple sentences imposed through the ordinary courts), and other indirect mechanisms (the reptile funds or the sending of guidelines to newspapers under the threat of suspension or suppression of the newspapers), which served to establish a regime of information control, especially severe with the press that did not follow the guidelines of the liberal regime in place, and which left the liberal Printing Press Law practically without effect.

Sin embargo, a lo largo del período de la Restauración borbónica (1883-1923), el Gobierno español, representado por el partido conservador y el liberal que se turnaban pacíficamente en el poder, adoptó una serie de medidas que distorsionaron la ansiada libertad de las publicaciones españolas. Los acontecimientos políticos y sociales característicos de esta etapa (especialmente, el terrorismo de finales del siglo XIX, los conflictos coloniales en Cuba y Marruecos o la influencia de los regionalismos del siglo XX), influyeron de forma notable en la actuación del poder público. Este utilizó distintos instrumentos legales (la aprobación de distintas leyes que limitaban la libertad, la frecuente declaración de la suspensión de garantías constitucionales o las múltiples condenas impuestas a través de los tribunales ordinarios), y otros mecanismos indirectos (los fondos de reptiles o el envío de orientaciones a los periódicos bajo la amenaza de la suspensión o la supresión de los periódicos), que les sirvieron para establecer un régimen de control informativo, especialmente severo con la prensa que no seguía las directrices del régimen liberal instaurado, y que dejó prácticamente sin efecto la Ley de Imprenta liberal.

    Description: Castles and nobility in the Middle Ages are not only considered together in historical research. For the lower nobility in particular, the possession of castles was decisive for the social positioning of the respective noble family. In order to sharpen this connection, the dissertation looks at both together and examines the concrete significance of castles in the formation phase of the lower nobility between 1250 and 1400. The focus of the regional and interdisciplinary study is on noble families and their castles from the area around the Counts of Helfenstein in the region between Geislingen an der Steige and Blaubeuren in the Swabian Alb. It examines aristocratic strategies of homemaking, of positioning themselves in the world. The center of this positioning was the castle. It appears as a spatial and social point of reference, which was important in almost every area of aristocratic life: it was the hub and nucleus of (the exercise of) power, the center of social group affiliations as well as the stage and medium of cultural participation. Castle thus means far more than just the building stock that has possibly survived to this day, but the overall social and spatial phenomenon of a center with many functions. Access to this multifunctional 'castle' phenomenon opened up a wide range of possibilities for the lower nobility and thus opportunities to position themselves in all areas of aristocratic affiliation. In this way, castles can be described as a socio-cultural resource in the sense of the concept of the Collaborative Research Center 1070 RESOURCE CULTURES.

Es wird nachgewiesen, dass Ferdinands Politik als Kaiser sich deutlich von der Karls V. abhebt, obwohl er an einer wesentlichen Zielsetzung des Bruders festgehalten hat, denn er bemühte sich wie jener aus vorreformatorischem Selbstverständnis als weltliches Haupt der Christenheit bis zu seinem Tod um die Wiederherstellung der zerbrochenen Einheit der Christianitas catholica. Die Untersuchung beginnt beim Augsburger Reichstag von 1555, um die grundlegende Bedeutung der dort unter maßgeblicher Beeinflussung durch Ferdinand erzielten Ergebnisse für seine künftige Haltung und Politik als Kaiser darzutun. Sie behandelt in den folgenden Kapiteln neben seiner Reichspolitik und seiner "Außenpolitik", die auf Bewahrung des Friedens angelegt waren, seine Konzilspolitik, die in seinen Initiativen zur Einberufung und seiner kritischen Begleitung der dritten Periode des Trienter Konzils fassbar ist, und seine Auffassung vom Kaisertum. Sie bestätigt, worin schon Ferdinands Zeitgenossen sein Hauptverdienst gesehen haben: dem Reich eine Epoche relativ sicheren Friedens beschert zu haben.

Rothe, who had already written spiritual works and three extensive chronicles ('Eisenacher Stadtchronik', 'Thüringische Landeschronik' and 'Weltchronik'), offers a comprehensive rendition of the chronicle and legendary tradition in the rhyming verse legend of over 4,000 verses, whereby, in addition to the chronicles, he particularly exploits the Latin Vita of Dietrich von Apolda. In the formal connection to the legends of the saints and the orientation towards chronicles in terms of content, Rothe adopts a cross-genre standpoint. Elisabeth's life is integrated into the genealogy of the landgrave's dynasty and thus becomes part of the landgrave's memorial culture. In the history of the text's reception, with numerous copies up to the 18th century, there is evidence of corresponding emphases: the work was used partly as a devotional book and partly as part of the dynastic memoria of the Thuringian dynasty.

    Description: Für Deutschland und viele Industrieländer weltweit wird der Import von grünem Wasserstoff ein zentraler Baustein auf dem Weg zur Klimaneutralität sein. Dabei muss einerseits gewährleistet sein, dass grüner Wasserstoff auch wirklich "grün" im Sinne von klimaneutral ist. Zugleich gibt es immer mehr Forderungen, dass auch andere Nachhaltigkeitskriterien - soziale, ökonomische und ökologische - bei der Produktion und dem Transport von Wasserstoff eingehalten werden. Der politisch getriebene Aufbau einer globalen Wasserstoffwirtschaft bietet von Anfang an die Möglichkeit, diesen Sektor in Einklang mit den bestehenden politischen Zielen zu bringen. Dazu zählen beispielsweise die Pariser Klimaziele oder die Agenda 2030. Die Industrienation Deutschland, die auch in Zukunft auf Energieimporte angewiesen sein wird, kann hier als führende Industrienation als Vorreiter Einfluss nehmen. Damit kann nicht nur sichergestellt werden, dass der nach Deutschland importierte Wasserstoff "grün und nachhaltig" ist, sondern auch die Nachhaltigkeit des globalen Wasserstoffmarktes insgesamt beeinflusst werden. Diese Kurzstudie untersucht, welche bereits existierenden Politikinstrumente geeignet sind, Nachhaltigkeitskriterien für Wasserstoffimporte zu verankern und im Zusammenspiel den Weg zu einem nachhaltigen globalen Wasserstoffmarkt zu unterstützen. Dabei werden ausschließlich Nachhaltigkeitsziele und -kriterien jenseits der Klimawirkung von Wasserstoff analysiert. Es ist unbestritten, dass das zentrale Ziel der Wasserstoffwirtschaft die Reduktion von Treibhausgasen bis hin zur Klimaneutralität ist, was bereits in einer Vielzahl von Studien und Stellungnahmen diskutiert wurde. Daher wird in dieser Studie von der Klimaneutralität des grünen Wasserstoffs ausgegangen, um den Fokus auf die anderen wesentlichen Nachhaltigkeitsaspekte zu lenken, die für den Import von grünem und nachhaltigen Wasserstoff aus dem Globalen Süden von entscheidender Bedeutung sind.

    Description: Die schnelle und umfassende Emissionsminderung in der Energie- und Kreislaufwirtschaft ist der Schlüssel für die Begrenzung der Erderwärmung auf unter 2 °C. In Deutschland werden entsprechende Politiken seit den 1990er-Jahren verfolgt, allerdings erst in jüngster Vergangenheit mit dem notwendigen Nachdruck und der notwendigen Orientierung hin zu mehr Marktmechanismen. Wesentliche Handlungsfelder sind Energieeinsparung und erhöhte Energieeffizienz, Umstieg auf erneuerbare Energien, Bepreisung von Klimagasen sowie eine Reduzierung und Schließung der Stoffkreisläufe. In allen Handlungsfeldern sind Grundlagen geschaffen, es bleibt jedoch der Großteil des Weges noch zu gehen, um Klimaneutralität zu erreichen. Für einen schnellen Fortschritt spielen neben der Überwindung der technischen, ökonomischen und organisatorischen Herausforderungen auch Verteilungsfragen und die Einbettung in internationale Maßnahmen eine zunehmende Rolle.

Dann werden die Methoden (Analyse, Interviews, Webcrawling) und der Fahrplan der Evaluation vorgestellt (Kap. 3). Zwei Wirkungsmodelle, ein materielles und ein organisationales ⁠Wirkmodell⁠, bilden die Basis für die verschiedenen Betrachtungsebenen und Foki, die für die Evaluation gewählt wurden. In Kapitel 4 werden schließlich die Erkenntnisse, die durch den Einsatz der verschiedenen Methoden gewonnen wurden, in bewusst kompakter und übersichtlicher Form in Bezug zu den Evaluationskriterien dargestellt und Empfehlungen abgeleitet. Kapitel 5 widmet sich der Gesamtbewertung der Effektivität von ProgRess III und Kapitel 6 bearbeitet abschließend die Frage, welche Entwicklungspotenziale aus den gewonnenen Erkenntnissen abgeleitet werden können.

    Description: Dieser Sammelband setzt sich mit den Deutschlandbildern in Belgien bis zum Beginn der deutschen Okkupation im Jahre 1940 auseinander. Betrachtet werden diese aus Sicht unterschiedlicher Geisteswissenschaften wie Philosophie, Literatur, Geschichte, Kunstgeschichte und Musikwissenschaft. Die traditionellen Topoi der deutschen Imagologie, die überall in Europa eine große Resonanz gefunden haben (das romantische Deutschland, das Land der Dichter und Denker, aber ab dem Krieg von 1870 auch das preußische Feindbild), werden dabei in Betracht gezogen. Konstitutiv für den Prozess der Identitätsbildung in Belgien bis zum Ersten Weltkrieg war die deutsch-germanische Komponente, die in der Metapher der sog. âme belge als Kultursynthese zum Ausdruck kam. Der Ausbruch des Ersten Weltkriegs hat hier besonders traumatisch gewirkt, was zur Folge hatte, dass diese partielle „Zugehörigkeit“ Belgiens zur deutschen Kultursphäre drastisch neuevaluiert wurde, unabhängig von der Schaffung eines deutschsprachigen Gebiets in Belgien durch den Versailler Vertrag.

Beyond building a story, the idea was to allow a moment to think about those experiences that give meaning to existence, as they are loaded with imagination, emotions and sensations, which is an opportunity to develop the process of conceiving themselves as subjects with a story.

    Description: Neben der Biblia pauperum ist das Speculum humanae salvationis das wohl bekannteste typologische Werk des Mittelalters. Vom lateinischen Text sind 328 handschriftliche mittelalterliche Quellen überliefert. Von seiner Popularität zeugen überdies Übersetzungen ins Deutsche, Französische, Niederländische, Englische und Tschechische. Diese Arbeit stellt eine der beiden niederländischen Fassungen des Speculum, und zwar die Prosaübersetzung aus dem Jahre 1464, in den Mittelpunkt. Neben Struktur und Funktion des lateinischen Textes werden in einem chronologisch-thematisch organisierten status quaestionis die Accessusfragen nach Herkunft und Autorschaft des Speculum erörtert. Vom mittelniederländischen Prosa-Spieghel werden eine genaue kodikologische Beschreibung und eine breit angelegte Analyse der Sprache geboten. Auch der literaturhistorische Kontext und die Übersetzungs- und Bearbeitungstechnik werden eingehen behandelt. Die kritische Edition nach der Haarlemer Handschrift erfüllt ein altes Forschungsdesiderat, indem sie sowohl den Vergleich mit der bereits vor mehr als einem halben Jahrhundert herausgegebenen Versübertragung ermöglicht, als auch eine eminent wichtige Schnittstelle zwischen handschriftlicher und gedruckter Tradition in den Niederlanden für die Forschung zugänglich macht.

Una de las premisas que inspira a los autores, es proponer una lectura descentrada de las teorías establecidas, sin desconocer su valor y sin recusar la especificidad necesaria que requieren la elucidación y abordaje de asuntos concretos como los efectos psicológicos, las discusiones jurídicas o las lógicas mediáticas. Por lo anterior, el lector encontrará disertaciones sobre temas cardinales de la vida social, política y cultural que precisan ser reflexionados en los procesos de superación de conflictos armados. Con esta propuesta, se busca deslocalizar, desde el punto de vista teórico y metodológico, la reflexión investigativa y promover un diálogo interdisciplinario entre autores de distintas regiones y países, con el fin de convocar a lectores interesados en comprender, desde distintos puntos de vista, las tensiones, problemas y ambigüedades a los que se enfrenta Colombia en materia de paz.

Ils s’affrontèrent sur des questions majeures : l’articulation entre religion et politique ; les limites de la liberté individuelle, le but de l’existence humaine. Leurs visions du monde paraissaient inconciliables. Comment ont-ils géré leurs différends ? Quelles ont été finalement les voies de la coexistence ?     Description: The court and court society in the Hispanic world (16th-18th centuries): The courtly world has emerged as a propitious intellectual and historiographical space for thinking and writing the history of early modernity. Ever since the renewal of the so-called ‘political history,’ but also after the perspective of cultural studies, the courtly has become the privileged scenario for the study of the political society of the Modern Age, starting from the analysis of the formation of the different social actors’ different political identities in dispute, as well as the tracking of hidden interests in decision-making in order to understand power groups or networks. Similarly, the courtly cannot but be thought of as that singular scenario and/or space of conjunction and indistinction between the political (public) and the economic (private), as well as a locus of identity formation and dispute. In this sense, the study of the Ancien Régime societies cannot ignore the courtly, which is a key element for understanding and analyzing one of the articulating elements of the globality of the European monarchies, particularly the Hispanic monarchy. As this work describes, this global perspective allows us to understand the importance and imprint of the courtly in America. Therefore, the aim is to analyze and understand the court and the courtly world from multiple perspectives. The articles that make up this work problematize the courtly from different geographical spaces, but above all from different intellectual concerns and preoccupations: princely and courtly education, the problem of the King’s favorite, the religious, the nobiliary, the place of the feminine in the court or, also, the materiality of the courtly texts and the materiality of the government of the monarchy from the court.

    Description: El mundo cortesano se ha erigido como un espacio intelectual e historiográfico propicio para pensar y escribir la historia de la primera modernidad. Desde la renovación de la denominada ‘historia política’, pero también desde los estudios culturales, lo cortesano ha devenido en el escenario privilegiado de estudio de la sociedad política de la Edad Moderna, partiendo de análisis de la conformación de las diferentes identidades políticas en disputa de los distintos actores sociales, como también del rastreo de intereses ocultos en las tomas de decisiones para comprender redes o grupos de poder. Asimismo, lo cortesano no puede dejar de pensarse como ese escenario y/o espacio singular de conjunción e indistinción entre lo político (público) y lo económico (privado), así como un locus de conformación y disputa identitaria. En este sentido, el estudio de las sociedades del Antiguo Régimen no puede obviar lo cortesano, máxima para comprender y analizar uno de los elementos articuladores de la globalidad de las monarquías europeas, singularmente de la monarquía hispánica. Esta perspectiva global nos permite comprender, como se realiza en esta obra, la importancia e impronta de lo cortesano en América. Por lo tanto, esta obra busca analizar y comprender la corte y el mundo cortesano desde múltiples perspectivas.     Description: If injured or wounded soldiers suffer permanent physical or psychological limitations, the question of social security arises after leaving active service. This problem has become particularly apparent again with the increasing military use of the Bundeswehr in missions abroad. Since then, the legislature has attempted to adapt the traditional pension system to the new circumstances on several occasions. The reorganization of the social compensation law once again provides an opportunity to fundamentally question the legal concept of the military pension system. Against this background, the study analyzes the constitutional framework of the law on military pensions. In particular, it shows that compensation for physical or psychological losses resulting from military service is not a voluntary benefit of the state, but on the one hand already results from the constitutionally anchored commitment of soldiers to their employer, and on the other hand can be based on fundamental legal considerations.

    Description: This study deals with aspectuality in Resian, a Slovene-based variety of north-eastern Italy, and the probable role of Romance influence on developments in this domain. In part, these findings are compared with the situation found with other non-Romance linguistic varieties spoken in Italy, especially Molise Slavic. The functional-semantic field of aspectuality is considered both in relation to its grammatical centre, viz. verbal aspect, and its lexical periphery. Language contact plays an important role in the almost complete transition of the Resian dual aspect system to a purely derivational opposition “imperfective : perfective”, also absorbing most of its prior morphosyntactic opposition “imperfect : aorist : perfect”. Furthermore, the special aspectual selection properties of phasal verbs and the role of aspect in the functions of modal verbs merit particular mention in this respect. In the case of lexical and periphrastic means of expression, a number of calqued progressive and prospective (imminent) periphrases, mostly calqued from Romance models, are discussed.

    Description: Il n’est pas toujours facile, pour les chercheurs et chercheuses comme pour les étudiant.e.s en Histoire ou Littérature antique, d’avoir accès aux préambules à l’élaboration d’un texte. La frustration qui en résulte est d’autant plus grande dans le cas de l’historiographie, où nous savons qu’un vaste travail de collecte, sélection et réappropriation des sources a présidé à la rédaction des œuvres qui nous sont parvenues. C’est à ces « coulisses » que cet ouvrage essaie d’accéder, par le moyen d’une comparaison originale et systématique de deux historiens romains contemporains, Tacite et Suétone. Abordées sur un pied d’égalité en ce qui concerne la démarche historiographique, leurs œuvres permettent en effet de lever une partie du voile sur ce qui relève, dans leur contenu, de l’influence des auteurs précédents ou de choix personnels, mais aussi des attentes du public du IIe siècle lorsqu’il s’agissait d’écrire sur les premiers empereurs. Sont dès lors étudiés d’un point de vue historiographique des épisodes aussi fameux que le séjour de Tibère à Capri ou l’incendie de Rome en 64, et abordés des thèmes comme la présence visible des deux auteurs dans leur texte, celle de leurs sources, la question des motifs repris et développés ou encore le rapport à la tradition antérieure sur les Julio-Claudiens et les trois « empereurs éphémères » qui succédèrent à Néron. Une meilleure connaissance du rapport des Romains à l’écriture de l’histoire et au passé devient ainsi également possible.

    Description: The World Health Organization -WHO- (2016, p.1) notes that, "Annually, more than 800,000 people take their own lives and many more attempt suicide. Each suicide is a tragedy that affects families, communities, and countries and has lasting effects for those close to the suicidal person." Suicidal behavior ranges from ideation in its different expressions, through threats, gestures and attempts, to the suicide itself. The presence of any of these indicators (ideation, threats, gestures and attempts) should be considered as a sign of high risk in the individual presenting them. The relationship between suicide and mental disorders is quite close, however, it does not mean that those who do not suffer from a mental disorder are exempt from this suicidal behavior, since there have been cases that occur impulsively as a response to a crisis that affects the ability to cope with the difficulties of life, such as economic problems, the breakup of sentimental or family relationships, or chronic pain and illness.

    Description: The first components of developmental psychology can perhaps be traced back to the social recognition of infancy and childhood. Many historians agree that this recognition came late. The French historian Philippe Ariès argues that in medieval society there was no room for childhood or the child as theoretical constructs. They would emerge in the course of the seventeenth and eighteenth centuries. Thus, although a certain sensitivity towards childhood appeared between the 16th and 17th centuries, it would seem that it was only in the 18th century that the child became the object of concern for some thinkers, mostly philosophers and pedagogues. There are several authors who are referents and it is worthwhile to review them, even if only briefly. At the time, Rousseau (1712-1778), in his Emilium, proposes an education centered on the natural evolution of the child, in which he highlights his particularities and differences and places childhood as a necessary and fundamental stage for man. The pedagogue Johann Heinrich Pestalozzi (1746-1827), sympathizes with some of Rousseau's ideas on the education of children and keeps a diary of his son's first two years, which becomes one of the first systematic observations that is assumed to be a precursor of observational methodology in early development. In line with the above, this text can only be understood as a first attempt, unfinished and open, to be continued. It is what the Anglos call a "text in progress", and that the ebook edition will allow us to reopen it without major difficulties. It is also, of course, an incitement to readers to complement it, discuss it or even controvert it. This is intended to be a living text and discussed within the community. It is possible that certain hypotheses about the facts found will give rise to controversy. A colleague warned that lightning will surely strike it as it is a provocative text. Let's hope so: as long as they are illuminating, it will have partially fulfilled its purpose. In any case, there remains a taste for scrutinizing our past more closely with a view to the future and not only to what could not be.

Muchos historiadores coinciden en afirmar que ese reconocimiento fue tardío. El historiador francés Philippe Ariès sostiene que en la sociedad medieval no había espacio para la infancia ni para el niño como constructos teóricos. Ellos emergerían en el transcurrir de los siglos XVII y XVIII. Entonces, aunque entre los siglos XVI y XVII se asoma una cierta sensibilidad respecto de la infancia, parecería que es solo en el siglo XVIII que el niño es objeto de preocupación por parte de algunos pensadores, en su mayoría filósofos y pedagogos. Son varios los autores que se constituyen en referentes y vale la pena revisarlos así sea brevemente. En su momento, Rousseau (1712-1778), en el Emilio propone una educación centrada en la evolución natural del niño, en la que destaca sus particularidades y sus diferencias y sitúa la infancia como una etapa necesaria y fundamental para el hombre. It begins its construction with a team of researchers from the Cognition and Representational Development Group of the Research Center of the Universidad del Valle, which articulates several groups such as the Research Group on Evaluation and Quality of Education (Giece); the Education Group, the Cognitive Development, Learning and Teaching Group, and the Cognition and Education Group. In the first one, the authors were trained and learned that nonlinear dynamical systems can be a conceptual and methodological way to approach the study of cognitive development. The different works that make up the chapters of the book are ascribed to nonlinear dynamical systems, which offer an innovative conceptualization for thinking about developmental psychology in general and cognitive development in particular. This pioneering and committed task of the group materializes in significant advances in the use of methodologies more in line with the conceptual principles assumed.

Así mismo, en su preparación involucra los tres programas de doctorado en psicología de la región: el de la Universidad del Valle, el de la Universidad de San Buenaventura Cali y el de la Pontificia Universidad Javeriana de Cali. En el primero de ellos se formaron los autores y aprendieron que los sistemas dinámicos no lineales pueden ser un camino conceptual y metodológico para abordar el estudio del desarrollo cognitivo. Los distintos trabajos que conforman los capítulos del libro se adscriben a los sistemas dinámicos no lineales, que ofrecen una conceptualización innovadora para pensar la psicología del desarrollo en general y el desarrollo cognitivo en particular. Esta tarea pionera y comprometida del grupo, se concreta en avances significativos en el uso de metodologías más acordes con los principios conceptuales asumidos.

    Description: De acuerdo a leyendas incaicas, a Inicios de los años 1400 hubo una batalla en las afueras del Cusco que cambió el curso de la historia sudamericana. Los chancas, un poderoso grupo étnico de la región de Andahuaytas, habían comenzado un agresivo plan de expansión. Habiendo ya conquistado pequeñas entidades políticas, su ejército habia penetrado profundamente en el territorio de sus tradicionales rivales, los incas. Mediante una serie de maniobras inusuales, los incas derrotaron a las fuerzas invasores chancas y llegaron a transformarse en el grupo más poderoso de los Andes. Muchos investigadores creen quo la derrota do los chancas representa un momento crítico en la histona de Sudamérica, ya que los incas luego continuaron su expansión, estableciendo el más extenso imperio do América. A pesar de la relevancia que habría tenido para la historia sudamericana, hasta hace unos años, el núcleo territorial Chanca había permanecido inexplorado. Consecuentemente, los procesos culturales conducentes al rápido desarrollo de este grupo y la posterior derrota de los mismos a manos de los incas tampoco habían sido investigados. Entre 2001 y 2004, Brian S. Bauer y su equipo de investigación realizaron una prospección arqueológica en la región de Andahuaylas. Este proyecto constituyó una oportunidad sin precedentes para examinar problemas teóricos relativos a la historia y al desarrollo cultural de las sociedades prehispánicas tardías de esta región de los Andes. El libro derivado de dichos trabajos presenta un análisis arqueológico sobre el desarrollo do los chancas y examina su derrota final frente a los incas.

    Description: Des fêtes estivales aux dessins animés japonais, des séries de fantasy aux manifestations de l’extrême-droite étatsunienne, le Moyen Âge est partout, sans cesse réinventé, transformé, mobilisé pour des usages variés. Il s’agit ici d’étudier cette présence du Moyen Âge dans notre imaginaire que l’on nomme le médiévalisme, en mobilisant de nouvelles méthodes d’analyse et en explorant de nouveaux terrains. Quels sont les rapports entre ces Moyen Âge fantasmés et le Moyen Âge historique étudié par les médiévistes ? Comment les spécialistes de la période médiévale doivent-ils se positionner face à des réinventions contemporaines ? Telles sont les deux principales questions de cet ouvrage tentant un état des lieux de la recherche médiévaliste ainsi qu’une réflexion globale, à la fois méthodologique et heuristique, sur ses défis, ses limites et ses enjeux.

    Description: Im öffentlichen Bewusstsein sind die 1960er Jahre das Jahrzehnt der großen politisch-gesellschaftlichen Umwälzungen der Nachkriegszeit. Die „1968er“ haben dabei den Ruf, eine neue politische Kultur herbeigeführt zu haben, die in vielen westlichen Ländern ähnliche Formen annahm. In dieser Geschichtsbetrachtung wird jedoch übersehen, dass vieles, was mit den 1960er Jahren in Verbindung gebracht wird, sich oft erst in den 1970er Jahren vollzog. Viele Protestbewegungen kamen erst in den 1970er Jahren zur vollen Entfaltung, andere radikalisierten sich und prägten anschließend die öffentlichen Diskussionen. Schaut man auf die gesellschaftlichen Reformen, die mit den 1960er Jahren in Verbindung gebracht werden, dann gilt auch hier, dass die 1970er Jahre das wichtigere Jahrzehnt waren. Es ist vor diesem Hintergrund nicht verwunderlich, dass den 1970er Jahren in der internationalen Geschichtsschreibung immer mehr Aufmerksamkeit geschenkt wird. Dieser Sammelband schließt sich dieser Entwicklung an und thematisiert wichtige politische, wirtschaftliche und gesellschaftliche Entwicklungen in Deutschland und in den Niederlanden im Vergleich.

Historiens, géographes, ethnologues et sociologues reconnus traitent de la portée scientifique, épistémologique et sociale de ces notions à partir de matériaux de première main dans la plupart des cas. Après une préface inédite de Georges Vigarello concernant l’évolution du sport dans ce sens, l’introduction collective précise et pose les bases de ces notions d’héritage sportif et de dynamiques patrimoniales afin de pouvoir les articuler aux quatre parties qui structurent la suite de l’ouvrage : le patrimoine immatériel des jeux traditionnels et des exercices corporels, les dynamiques locales du patrimoine sportif, le patrimoine de l’éducation physique française ainsi que celui ayant trait à la guerre et au passé militaire. Les différents textes sont extraits des communications présentées à Bordeaux du 29 au 31 octobre 2018 à l’occasion d’une manifestation commune organisée par le Comité Européen d’Histoire du Sport (CESH) et la Société Française d’Histoire du Sport (SFHS).

    Description: This article shows that particle verbs in Burgenland Croatian – a notable morphosyntactic phenomenon of language contact – may form aspectual pairs in a typically Slavic manner. Particle-based pairs with an indigenous base verb are formed by means of suffixation, suffix opposition, suppletion or prefixation. In the case of spatial relations, by contrast, preverbs predominate over prefixes, leading to a reduction of the old inventory of verbal compounds. Nevertheless, preverbs are only rarely obligatory in the formation of aspectual pairs. In the case of borrowings, only prefixation is productive, which might be attributed to German (and Hungarian) influence. On a par with other aspectual pairs, particle-based formations may express taxis relations (sequence, simultaneity, incidence). Language contact possibly contributed to the preservation of the Contextually Conditioned Imperfective Past also in imperfective particle verbs.

    Description: Se trata de mostrar que en los inicios del siglo XX en el sur del Perú, y particularmente en Puno, se gestó una preocupación por el Derecho indígena peruano y ahora a propósito de los 200 años de República que estamos próximos a cumplir, cabe recordar qué motivaciones tuvieron los impulsores de dicha propuesta, qué actividades desarrollaron, qué tipo de resonancia tuvieron sus aportes en el espectro nacional.El presente trabajo, además se enmarca dentro de las deudas históricas que ha tenido el país, en muchos temas que ha dejado de lado, que ha descuidado, o deliberadamente no le han prestado la debida atención. Uno de ellos es justamente el tema del Derecho originario, indígena, ancestral que ahora es abordado como justicia intercultural, o pluralismo jurídico, y que recién empieza a ser tratado como una teoría y tendencia nueva que debe merecer un lugar en la construcción de un nuevo país en los próximos años.

    Description: In der zweiten Hälfte des 4. Jahrhunderts erfand ein unbekannter Autor einen Briefwechsel zwischen Seneca und Paulus. Die vierzehn kurzen Briefe, acht vom Philosophen, sechs vom Apostel, sind in sehr schlechtem spätantikem Latein geschrieben und weitgehend inhaltslos. Ihr Ziel ist es, mittels eines Austauschs von freundschaftlichen Billetts, wie er unter den Intellektuellen der Spätantike üblich war, Seneca zum Freund des Paulus zu machen und so das hohe Ansehen Senecas in der spätantiken lateinischen Theologie apostolisch zu sanktionieren. Diese Fiktion war sehr erfolgreich und regte im Laufe der Geschichte immer wieder zu Spekulationen über das Verhältnis zwischen Stoa und Christentum an. Dieser Band bietet eine neue Übersetzung des Briefwechsels auf der Basis der neuesten kritischen Edition, versehen mit einer Einleitung, Erläuterungen und Testimonien. Ferner werden zwei wenig bekannte Texte aus dem Umfeld des Briefwechsels abgedruckt, erstmals übersetzt und erläutert: ein angeblicher Brief des Mordechai an Alexander den Großen aus einer Fassung des Alexanderromans und ein Brief Senecas über Hochmut und Götterbilder, eine christliche Apologie aus dem 5. Jahrhundert. Die Essays behandeln zentrale Probleme des Verhältnisses zwischen Stoa und Christentum (Gottesbild und Ethik) sowie die Seneca-Rezeption vom Mittelalter bis in die frühe Neuzeit.

    Description: The peasants' struggle to defend their dignity, achieve their freedom and shield their fundamental rights was arduous from the beginning; contradictorily, the marginalization suffered by the Spaniards in the colonial era was minor compared to the bloody exploitation of which they were victims in the republican era, a time where the flags of freedom and autonomy of the country were raised utopianly -ideally for the one who even came in a noble gesture to offer their lives, always first in the battle line of the liberation struggle-. In this context, a generation of Puno intellectuals arose, many of them knowledgeable in law, who from different fronts contributed to the feat of recognition of the rights that the man from the countryside always deserved for his own condition as a human being. This article focuses on the stage from 1821 to 1920, considering the political, legal and constitutional context; as well as in the indigenista movement both in its political, cultural and social sphere, given that its relevance is not exhausted in the temporal or historical aspect, especially if it continues to be part of the reflection on identity as a social group and of general shape as a nation and as a country

    Description: La lucha de los campesinos por defender su dignidad, alcanzar su libertad y escudar sus derechos fundamentales fue ardua desde sus inicios; contradictoriamente, la marginación sufrida por parte de los españoles en la época colonial resultaba siendo menor en comparación con la cruenta explotación de la que fueron víctimas en la época republicana, una época donde utópicamente se enarbolaron las banderas de libertad y autonomía del país -ideal por el que llegaron incluso en noble gesto a ofrendar sus vi-das, siempre primeros en la línea de batalla de la lucha libertadora-. En ese contexto, surge una generación de intelectuales puneños, muchos de ellos entendidos en leyes, quienes desde distintos frentes aportaron en la gesta del reconocimiento de los derechos que el hombre del campo siempre mereció por su propia condición de ser humano. El presente artículo se centra en la etapa comprendida desde 1821 a 1920, considerando el contexto político, jurídico y constitucional; como también en el movimiento indigenista tanto en su ámbito político, cultural y social, dado que la relevancia de éste no se agota en el aspecto temporal o histórico, máxime si continúa formando parte de la reflexión en torno a la identidad como grupo social y de forma general como nación y como país

    Description: Pour Hans Kelsen, la question des conditions de validité d’une norme juridique d’une part, celle des valeurs qui sont censées inspirer et contrôler le droit positif d’autre part, sont deux questions bien distinctes. C’est la première de ces deux questions, objet de ce qu’il nomme la « théorie pure du droit », qui est au cœur de ces études centrées sur le statut des fictions juridiques - et d’abord sur la nature des fictions en général. Cette réflexion se développe ici à travers un débat vivant avec le théoricien des fictions Hans Vaihinger, auteur de la fameuse Philosophie du comme si (1911). Deux questions sont particulièrement stimulantes pour tous ceux qui s’intéressent, de près ou de loin, au droit et à la philosophie du droit : 1) Comment le droit positif comme système de normes existantes peut-il trouver sa justification ultime dans une norme fondamentale fictionnelle, dans une « fiction au sens vaihingerien du terme » ? As Colombians and according to what the profession allows us, we are part of the social fabric in the framework of the repair and comprehensive reconstruction of a nation that urgently seeks options and actions that bring with them the improvement of the quality of life, greater inclusion and social equity. In short, truly democratized development and progress, so that it corresponds to the individual and collective resources and the optimal use we can make of them, within the framework of opportunities.

    Description: La investigación sobre inserción laboral de jóvenes profesionales en psicología se hace pública en un momento crucial para la disciplina y el ejercicio de la profesión en el país, donde la comunidad académica y el gremio de profesionales se enfrentan a la tarea misma de insertar la psicología como cuerpo sólido de conocimientos teóricos y técnicos, en el conjunto de saberes, recursos y dispositivos con los que cuentan los ciudadanos y las instituciones. Como colombianos y según lo que la profesión nos permite, hacemos parte del tejido social en el marco de la reparación y reconstrucción integral de una nación que busca con urgencia opciones y acciones que traigan el mejoramiento de la calidad de vida, una mayor inclusión y equidad social. En suma, el desarrollo y el progreso verdaderamente democratizado, a fin de que este corresponda a los recursos individuales y colectivos y al óptimo uso que de ellos logremos hacer, en el marco de las oportunidades.
