    Description: Drawing on a range of expert contributions, this book explores how the European Green Deal is being deployed in practice and observes how the EU tries to promote the protection of the environment in third countries. This book begins by assessing the state of the art in terms of the key conceptual issues and analyses sectoral initiatives that are particularly relevant for the deployment of the European Green Deal external dimensions. These include the Carbon Border Adjustment Mechanism, the EU’s regulatory action in the control of maritime emissions, the 2030 Biodiversity Strategy, the Deforestation Initiative, the Zero Pollution Initiative, the From Farm to Fork Initiative, and the Climate Neutrality and Clean Energy Initiative in the context of the Energy Charter Treaty. Next, the authors deal with horizontal aspects of the European Green Deal that also have external dimensions, such as the Green Deal Diplomacy, the Green Public Procurement, funding measures, initiatives related to corporate sustainability and due diligence, and the implementation and enforcement of EU environmental law. This volume concludes with a cross-cutting analysis, focusing on how the EU can strengthen the impact of its normative power on international environmental governance, while also noting its limitations. Deploying the European Green Deal will be of great interest to students and scholars of international and EU environmental law and environmental policy and governance.

    Description: This chapter argues that to fulfil the interests of both the spouses and their original family, Maria projected herself as a Castilian infanta while Leonor built up the image of an Aragonese princess. The construction of the political identity of queens consort was a long and complex process, paramount to the subsequent performance and relevance in the configuration of monarchical power. In May 1428 Leonor of Aragon, while en route to Portugal to meet her husband, travelled to Valladolid to visit the king of Castile. In his last will and testament, he had entrusted her with the guardianship of their children and the regency of the realm. While the circumstances of their marriages were quite different and led them to assume distinctive identities from the very outset of their reigns, during their life as consorts Maria and Leonor adhered to a similar model of queenship, one they had learned from their mother.

    Description: Cosmopolitical Ecologies Across Asia offers a unique insight into the non-human and spiritual dimensions of environmental management in a changing world. This volume presents a comparative, place-based exploration of landscapes across Asia and the entities, practices and knowledges that inhabit them. Rather than treating sacred mountains, terrains and water sources as self-contained, esoteric religious phenomena, the authors consider them within critical 'cosmopolitical ecologies' framings in which non-human entities are engaged as actors in the socio-political arena. The chapters include case studies of healing springs recognized by governments, and sacred mountains that are addressed by heads of states and Communist Party cadres, or that speak to the faithful through spirit mediums in a politics of re-enchantment. Contributors explore the diverse ways in which non-human entities such as forest spirits, reindeer, mountains and Buddhist Masters of the Land are engaged by humans to navigate environmental change and address a range of ecological threats from large-scale mining to climate change. Cosmopolitical ecologies approaches encompass the healing power of topography as well as transformative intimacies with other-than-human beings such as sparrows within an Islamic eco-theological poetic setting. In this light the book observes dynamic and creative processes of cosmological innovation including the repurposing of ritual to address challenges such as the Covid-19 epidemic.     Description: This book provides a systematic analysis of the Russian-Ukraine war, using the concept of resilient fighting power to assess the operational performance of both sides during the first year of the full-scale invasion. The Russian war in Ukraine began in 2014 and continued for eight years, before the full-scale invasion of 24 February 2022. It is not a new war, but the intensity of the warfighting revived many discussions about the conduct of inter-state warfare, which has not been seen in Europe for decades. This book does not aim to offer an exhaustive operational analysis of the war, but rather provides a preliminary systematic analysis across various domains of warfare using the concept of fighting power to assess the operational performance of both sides. First, the book discusses the conceptual component and the post-Cold War adaptations of the Soviet strategic tradition by both the Ukrainian and the Russian Armed Forces. Following that, it gives an evaluation of the various aspects of warfighting in the land, air, maritime and cyber domains. Then, the book examines the role of international allied assistance, sanctions and weapons delivery in strengthening the resilience of the Ukrainian Armed Forces. The book concludes with some comments on the role of inter-state warfare in the current strategic environment and future warfare.     Description: This book provides an overall picture of East Asian international politics during the early interwar period and examines the various foreign policy trends of the major powers involved, including Japan, China, Britain, the United States, and the Soviet Union. Based on extensive original research, it posits that East Asia experienced four waves of international change during the interwar period: the transition to the post-World War I international order; the appearance of Nationalist China and the Soviet Union as actors in East Asian international politics; the Japanese invasion of Manchuria; and Japanese implementation of the North China Buffer State Strategy. It considers the new challenges brought about by each of these waves, how the powers – particularly Japan, Britain, and the United States – were able to meet these challenges by working together, and how this became more difficult as time went on. It argues that the Washington System – the international order established at the 1921–1922 Washington Naval Conference – was not a break with the past, as is frequently argued, on account of new forms of foreign policy, including the ideological approaches of the United States and the Soviet Union, but that rather spheres of influence diplomacy continued as before. In addition, in discussing Japanese foreign policy, the book provides a comprehensive picture of the diversity of views towards China among Japanese actors and the ways these shifted over time.     Description: This chapter explores how the revision of national myths in Early Modern Britain and France reflects conflicts and contradictions between the perspectives of the dominant nations, England and France, and those of two subordinate nations, Wales and Brittany, formally annexed by their larger neighbours in the 16th century, and how the national myths in turn impinged on the status of the vernacular languages of the subordinate nations, Welsh and Breton. In order to legitimise the new Church of England, English protestant apologists claimed that its protestant faith was the continuation of the pure faith of the Early Church, which the ancient Britons, ancestors of the Welsh, had acquired directly from a disciple of Christ. Richard Davies’ preface to the 1567 Welsh New Testament, however, re-appropriated the narrative as specifically Welsh. Davies’ narrative was influential in Wales and contributed to a cultural context, together with the Welsh Bible translation, in which the Welsh language could flourish despite the increasing dominance of English. In the case of Brittany and France, the paper explores the contradiction between the antiquarian prestige conferred upon Breton by contemporary language antiquity myths and its actual subordinate sociolinguistic status vis-a-vis French.

This volume combines a detailed treatment of post-war cultural reconstruction in Finnish Lapland – a region on the geographical and historical margins of its nation-state – with comparative case studies of silent post-war memory from other European countries The contributors shed light on key aspects of cultural reconstruction generally: disruptions of national narratives, difficulties of post-war cultural demobilisation, sites of memory, visual narratives of post-war reconstruction, and manifestations of trans-generational experiences of cultural reconstruction.     Description: Critical mapping—a problematizing, reflective approach—is the process of compiling and analyzing existing design outcomes (DOs) that address a wicked problem (e.g., food insecurity) in a way that creates a synthesis between equity, justice, and environmental responsibility. Critical mapping begins with identification and operationalization of the wicked problem leading to an integrative literature review of multidisciplinary scholarly sources to identify peer-reviewed DOs that contribute to addressing the wicked problem sustainably. Next, it progresses to charting the sustainable DOs affinitively with four quadrants—top-down and local, top-down and memetic (i.e., widespread), bottom-up and memetic, bottom-up, and local. The resulting visualization, introduced as a wicked solution, facilitates analysis to identify places to intervene in the system, where one can synthesize the impact of existing sustainable DOs to understand where gaps exist for future design innovation or appropriation that has the potential to cumulatively solve the wicked problem over time.

    Description: This chapter presents a transdisciplinary, justice-centered pedagogy for cryospheric climes, examining and developing the notion of a clime through a focus on the Alaskan Arctic and the diminishing sea ice. Through stories from the Arctic region and a scientific invocation of sea ice, I argue for the usefulness of a teaching approach where the climate itself becomes teacher, allowing a for natural entanglement of the scientific and the social. Through this radical reorientation, certain key lessons emerge when we listen to the sea ice. These emerge as three interconnected meta-concepts that, along with justice, form the framework of this pedagogy. I explore how these meta-concepts transcend apparent dichotomies of clime and climate, local and global, Indigenous and mainstream, as well as scientific and social. Stories play a key role in facilitating this travel across boundaries. I illustrate this with stories that begin in the human realm and allow us to travel to the scientific, as well as stories that begin with science and reach toward the human. By considering clime as an enactment with multiple players—humans, non-human animals, and elements of weather and landscape—a more-than-human understanding of the climate problem becomes possible.

This book analyses how dynasties were ‘made’ by the people belonging to them. It uses a social institutionalist framework to analyse how family dynamics gave rise to practices and roles. The kings of Spain only had limited power to control the construction of their dynasty, since births and deaths, processes of dynastic centralisation, pressure from subjects, relatives’ individual agency, rivalry among relatives and the institutionalisation of roles limited their power. Including several genealogical tables to support students new to the Spanish Habsburgs, this book is essential reading for all students of early modern Europe and the history of monarchy.

    Description: In 2020, a group of European researchers got a European Union (EU) grant to do a project called TRANSFORM. The objective of TRANSFORM was to integrate the principle of responsible research and innovation (RRI) into the research and innovation policies of three European regions: Lombardy, Brussels, and Catalonia. This book tells the story of how TRANSFORM translated RRI into practice, all the way from philosophy of technology to EU policy jargon, to the project contract, and finally into the real-life events in these regions. Responsibility was translated in creative ways, with surprising goals and ambiguous outcomes. Armed with these stories, the book analyses the broader context of the desire for better governance of technoscience and draws two lessons: Firstly, that there is more governance than one may see at first sight, and secondly, that there is a need to rethink the borders of technoscience and the spaces in which it resides. The book proposes to think of governance in technoscience, rather than governance of technoscience.

    Description: Within Japan’s contested memories of the Asia-Pacific War (1937-45), the depiction of soldiers, sailors and pilots in leading roles within cinematic/televisual representations of the war usually falls into one of three main patterns: ‘military heroes’ participating in a noble (albeit losing) war; ‘good Japanese’ facing down villainous militarists; and ‘victim-heroes’ suffering amidst the uncontrollable carnage of war. A recurrent trope, particularly within the representation of ‘victim-heroes’, is a focus on the soldier’s life and/or talents away from the military: the soldier as artist, scholar, lover, and athlete. Through a short history of sport in wartime Japan and six case studies of soldier-athletes – two with ‘inconvenient life histories’, two with ‘usable life histories’, and two (semi-)fictionalized characters – this chapter establishes how sport is used to humanize soldier characters and thereby pull the overall narrative of the film towards a pacifist message of the inhumanity of and suffering during war.

    Description: Modern climate science aims to explain and predict climate based on spatio-temporally invariant laws of nature. This physics-based mindset largely displaced a more contingent, historical approach to climate. However, what is being called the “storyline” approach to climate science has recently been gaining traction. Although storylines are well-established vehicles in many scholarly disciplines, their use in physical climate science is radical insofar as they immediately raise questions such as “Who tells the stories?” and “Whose stories get told?” Such a personalization of climate science aligns with the concept of clime. This chapter reflects on various traditions in the hitherto remotely related disciplines of climate science and anthropology, and experiments with integrating different forms of knowledge in the sweetgrass-braiding fashion. Drawing on two illustrations of natural disasters, in Nepal and Alaska, four potential threads for a productive dialogue between climate science and the environmental humanities are identified: (i) time; (ii) agency and intentionality; (iii) chaos, both temporal and spatial; and (iv) dichotomies in ways of knowing, most notably between descriptive and explanatory traditions. Through the device of contingency and by enlivening ethnography, it becomes possible to storyline climes.

This study investigates the conceptual contributions made by Spanish MPs in the course of the constitutional debate of 1931 by assuming, as a research approach, an interdisciplinary stance combining conceptual history, political theory, and parliamentary constitutional history. By doing so, it selects five determining issues: the pervasive discussion about two competing meanings of a democratic state; the rhetorical uses of reform and revolution; conceptual controversies about religious freedom; the disputed idea of property rights; and the functions of parliament and the president of the republic in a semi-presidential regime. The constitutional debate was largely inspired by interwar European constitutionalism which constituent representatives used to update the Spanish constitutional tradition.     Description: Focusing on the experiences of Thailand and Australia, this book examines the impact of trade-restrictive measures as related to the EU’s regulations to prevent Illegal, Unreported and Unregulated (IUU) fishing. It is widely accepted that IUU fishing is harmful, and should be stopped, but there are different approaches to tackling it. Acknowledging this, this book argues that major efforts to fight IUU fishing require careful analyses if the goal is to achieve optimal results and avoid unintended consequences. The book draws on the recent experiences of Thailand and Australia to offer an empirical examination of one increasingly prominent solution, trade-restrictive measures. With Thailand representing direct, active intervention by the EU and Australia a more indirect dispersion of policy narratives and discourses, the book provides a rounded view on how likely it is that different countries in different situations will adapt to the changing policy norms regarding IUU fishing. Understanding the reactions of countries who might be targeted, or otherwise be influenced by the policy, generates new knowledge that helps inform a more effective and scalable implementation of the policy on the part of the EU and a better governance preparedness on the part of non-EU fishing nations. In broader terms, this book exposes a key moment of change in the compatibility between environmental regulations and international trade. The EU IUU policy is a prime example of a policy that uses the mechanisms of international trade to account for environmental and conservation objectives. By way of the unilateral and trade-restrictive stance against IUU fishing, the EU has positioned itself as a major market and normative power, driving its sustainability norms outwards. This book sheds light on the efficacy of this policy setup based on the analysis of country perspectives, which is a key factor influencing its potential spread.     Description: Pribble investigates the barter economies that developed in many of the labor camps established under the Khmer Rouge in Cambodia. When the Khmer Rouge abolished currency and markets in 1975, starving Cambodians created underground exchanges in labor camps throughout the country, bartering luxury items for food and other necessities, while simultaneously undermining the regime’s ideological goals of eliminating any traces of capitalism in Democratic Kampuchea. Pribble asserts three key points about the barter economy in the Khmer Rouge labor camps. First, the underground exchanges in Democratic Kampuchea provided food and medicine for desperate people subsisting under a totalitarian regime, saving the lives of countless Cambodians. Second, bartering was the riskiest way to obtain food because it was dependent upon the discretion of two or more individuals from different social classes under the threat of violent punishment, thereby altering the social dynamics of the camps. Finally, despite the regime’s extreme efforts to eliminate foreign influence from the country and impose communist ideology on millions of citizens, basic forms of market capitalism and a demand for superfluous luxury goods persisted in labor camps throughout the country. A fascinating study of the human consequences of imposing rigid ideology, that will be of particular interest to scholars and students of political history and Southeast Asian history.

    Description: This chapter addresses the interpretations of the emerging social question in the field of post-revolutionary French liberalism. It focuses on the cholera outbreak of 1832 to describe how it fostered unprecedented and dramatic representations of urban pauperism chiefly marked by feelings of panic and distress with respect to the new “dangerous classes” brought into being by the Industrial Revolution. By analysing the pandemic crisis, the chapter shows that these subjects were initially perceived not merely as a different social class, but also – and especially – as a different “race,” according to a conception exemplified by the metaphor of “new barbarians” invading the manufacturing cities. Hence, the chapter retraces a transformation whereby these initial representations of the subaltern classes based on fear and exclusion gradually gave way to the rise of social research on the subaltern classes aimed at elaborating new welfare policies as risk reduction strategies. These initiatives of social investigation are described as marking the origins of the methods and epistemology of modern social sciences, which are the focus of the following chapter.

The book investigates the shortcomings in environment education, including underqualified teachers, the civil service mentality, the still-pervasive chalk-and-talk pedagogy and the effect of the examination system. It also analyses the role of local government in supporting (or not) environmental education, and the contribution of environmental NGOs. The book establishes that young people are not currently being exposed to effective environmental education, and the authors propose that the best and most culturally appropriate way forward in Indonesia is to frame pro-environment behaviour and responsibility as a form of citizenship, and specifically that environmental education should be taught as a separate subject. This book explores the German and U.S. adoption of the soybean being closely tied to global economic and political changes, such as the two world wars and the Great Depression. The attraction of the soybean to stakeholders on both sides of the Atlantic was linked to a need for cheap alternatives to butter and lard and a desire for greater quantities of meat, which led to the soybean becoming a cheap resource for fat and fodder. Only occasionally was it also used as food. This volume is useful for anyone who is studying or interested in economic history and commodity trading in the twentieth century. It is also connected to the histories of capitalism, globalization, imperialism, and materiality.

    Description: Critical mapping—a problematizing, reflective approach to design inquiry—investigates how existing design outcomes (DOs) can be coupled to form a wicked solution to address a wicked problem. We have found that visual framing married to affinity organization is one of the most important strengths in critical mapping, helping to communicate the concepts to stakeholders, structure our analysis, and identify places to intervene in the system to design a more sustainable future. In this book, we apply critical mapping to the challenge of identifying and compiling food DOs that are equitable, just, and resilient against ecological and economic changes; that is, the wicked solution must entail sustainable design. “Sustainable design” in this context refers to the manifestation of creative problem solving across a range of intangible and tangible design forms of varying degrees of sustainability. Using food insecurity as the wicked problem, this chapter introduces a visual framework for critically mapping a wicked solution, a diagram onto which existing sustainable DOs are charted and analyzed to identify places where designers should intervene to impact the current state of the system—in the specific case of food—and shift it toward a future of sustainable food security within the realm of equity and justice.

    Description: Examining diversity as a fundamental reality of empire, this book explores European colonial empires, both terrestrial and maritime, to show how they addressed the questions of how to manage diversity. These questions range from the local to the supra-regional, and from the management of people to that of political and judicial systems. Taking an intersectional approach incorporating categories such as race, religion, subjecthood, and social and legal status, the contributions of the volume show how old and new modes of creating social difference took shape in an increasingly globalized early modern world, and what contemporary legacies these ‘diversity formations’ left behind. This volume shows diversity and imperial projects to be both contentious and mutually constitutive: on the one hand, the conditions of empire created divisions between people through official categorizations (such as racial classifications and designations of subjecthood) and through discriminately applied extractive policies, from taxation to slavery. On the other hand, imperial subjects, communities, and polities within and adjacent to the empire asserted themselves through a diverse range of affiliations and identities that challenged any notion of a unilateral, universal imperial authority. This book highlights the multidimensionality and interconnectedness of diversity in imperial settings and will be useful reading to students and scholars of the history of colonial empires, global history, and race.

    Description: This edited volume examines the changes that arise from the entanglement of global interests and narratives with the local struggles that have always existed in the drylands of Africa, the Middle East, and Central Asia/Inner Asia. Changes in drylands are happening in an overwhelming manner. Climate change, growing political instability, and increasing enclosures of large expanses of often common land are some of the changes with far-reaching consequences for those who make their living in the drylands. At the same time, powerful narratives about the drylands as ‘wastelands’ and their ‘backward’ inhabitants continue to hold sway, legitimizing interventions for development, security, and conservation, informing re-emerging frontiers of investment (for agriculture, extraction, infrastructure), and shaping new dryland identities. The chapters in this volume discuss the politics of change triggered by forces as diverse as the global land and resource rush, the expansion of new Information and Communication Technologies, urbanization, the COVID-19 pandemic, and the spread of violent extremism. While recognizing that changes are co-produced by differently positioned actors from within and outside the drylands, this volume presents the dryland’s point of view. It therefore takes the views, experiences, and agencies of dryland dwellers as the point of departure to not only understand the changes that are transforming their lives, livelihoods, and future aspirations, but also to highlight the unexpected spaces of contestation and innovation that have hitherto remained understudied.     Chapter 2 Penal reform in Imperial Germany: Conflict and compromise (2022)

    Description: The reform agenda promoted by the late-nineteenth-century penal reformers variously described as advocates of ‘positivism’, ‘social defense’ or as members of the ‘modern’ or ‘sociological’ school of criminal law threatened to erode the boundary separating criminal justice from extra-judicial forms of social control. Focusing on the German case, this essay investigates the debates between Imperial Germany’s ‘modern’ and ‘classical’ schools of criminal law over two questions that posed particularly stark challenges to the dividing line between criminal justice and extra-judicial forms of state intervention: (1) the implications of determinism for the question of legal responsibility, and (2) the implications that making ‘dangerousness’ the key criterion for punishment had for the nature of criminal justice and the relationship of judicial and extra-judicial measures of intervention. After analyzing these debates, the essay examines the rapprochement between the modern and classical schools of criminal law around 1900, the emergence of compromise proposals at the biennial congresses (Juristentage) of German-speaking jurists from 1900 to 1906, and the draft codes produced by Imperial Germany’s official penal reform commissions from 1906 until 1914. The essay advances two central arguments. First, the classical school’s endorsement of the dual-track system for recidivists and post-prison detention in an asylum for mentally abnormal offenders demonstrates that the classical school had, in fact, accepted the modern school’s claim that mentally ‘habitual criminals’ as well as ‘mentally abnormal’ offenders posed serious threats to the social order that were not being sufficiently addressed by the existing legal system. Second, the conflict between the modern and classical schools was not about the question of whether measures based on an offender’s ‘dangerousness’ (rather than the offense committed) were warranted; the majority of the classical school agreed that such measures, including indefinite detention, were warranted. Instead, the conflict concerned the different, narrower question of whether such measures should be imposed as part of the criminal justice system or whether they should be imposed outside this system, as extra-judicial measures, that is, in the form of administrative, police, welfare or medical measures. Therefore, the debate between the two schools was mostly a debate over what form social defense measures should take. Whereas the modern school called for a broader vision of criminal justice in the service of protecting society against dangerous individuals, the classical school sought to keep criminal justice narrowly focused on offense-based retributive justice and therefore insisted that social-defense measures based on dangerousness be farmed out to non-judicial state agencies.

    Description: The call for a One Health approach that transcends species and disciplinary boundaries assumes that human and veterinary medicine are discrete, distinctive domains whose separation must be overcome to achieve health benefits for all. This paper will problematize this assumption by demonstrating that until relatively recently, their boundaries were extremely fluid. Referring to specific examples over the period 1790-1900, it demonstrates that human medicine was once deeply zoological, and encompassed a host of species, practices and social relations that overlapped with those of veterinary medicine. While One Health today focusses selectively on animals as transmitters of zoonotic diseases or as experimental models of human disease, past animal participants in medicine were far more than that. As victims of naturally occurring diseases, they enabled doctors to think generically and comparatively about medical and biological problems, while as disease subjects they encouraged clinical interventions. Their investigation and management could prompt collaboration between doctors and vets. However, veterinary ambitions also encouraged competition. In time, this led to the hardening of boundaries between the professions and their subjects, and subsequent efforts to transcend them under the banner of One Health.

This book examines Stalin’s covert operations in his hunt for supremacy. By the late 1920s Britain had ceded place to Japan as Stalin’s main enemy in Asia. By seducing Japan deeply into China, Stalin successfully turned Japan’s aggression into a weapon of its own destruction. Covering Norway, Sweden and Finland – three countries with many differences and similarities – this volume examines how reindeer husbandry is affected by and responds to global environmental change and resource extraction in boreal and arctic social-ecological systems. Beginning with an historical overview of reindeer husbandry, the volume analyses the realities of the present from different perspectives and disciplines. Genetics, behavioural ecology of reindeer, other forms of land use, pastoralists’ norms and knowledge, bio-economy and governance structures all set the stage for the complex internal and externally imposed dynamics within reindeer husbandry. In-depth analyses are devoted to particularly urgent challenges, such as land-use conflicts, climate change and predation, identified as having a high potential to shape the future pathways of the pastoral identity and productivity. These futures, with their risks and opportunities, are explored in the final section, offering a synthesis of the comparative approach between the three countries that runs as a recurring theme through the book. With its richness and depth, this volume contributes significantly to the understanding of the substantial impacts on pastoralist communities in northernmost Europe today, while highlighting viable pathways to maintaining reindeer husbandry for the future.     Description: The reform agenda promoted by the late-nineteenth-century penal reformers variously described as advocates of ‘positivism’, ‘social defense’ or as members of the ‘modern’ or ‘sociological’ school of criminal law threatened to erode the boundary separating criminal justice from extra-judicial forms of social control. Focusing on the German case, this essay investigates the debates between Imperial Germany’s ‘modern’ and ‘classical’ schools of criminal law over two questions that posed particularly stark challenges to the dividing line between criminal justice and extra-judicial forms of state intervention: (1) the implications of determinism for the question of legal responsibility, and (2) the implications that making ‘dangerousness’ the key criterion for punishment had for the nature of criminal justice and the relationship of judicial and extra-judicial measures of intervention. After analyzing these debates, the essay examines the rapprochement between the modern and classical schools of criminal law around 1900, the emergence of compromise proposals at the biennial congresses (Juristentage) of German-speaking jurists from 1900 to 1906, and the draft codes produced by Imperial Germany’s official penal reform commissions from 1906 until 1914. The essay advances two central arguments. First, the classical school’s endorsement of the dual-track system for recidivists and post-prison detention in an asylum for mentally abnormal offenders demonstrates that the classical school had, in fact, accepted the modern school’s claim that mentally ‘habitual criminals’ as well as ‘mentally abnormal’ offenders posed serious threats to the social order that were not being sufficiently addressed by the existing legal system. Second, the conflict between the modern and classical schools was not about the question of whether measures based on an offender’s ‘dangerousness’ (rather than the offense committed) were warranted; the majority of the classical school agreed that such measures, including indefinite detention, were warranted. Instead, the conflict concerned the different, narrower question of whether such measures should be imposed as part of the criminal justice system or whether they should be imposed outside this system, as extra-judicial measures, that is, in the form of administrative, police, welfare or medical measures. Therefore, the debate between the two schools was mostly a debate over what form social defense measures should take. Whereas the modern school called for a broader vision of criminal justice in the service of protecting society against dangerous individuals, the classical school sought to keep criminal justice narrowly focused on offense-based retributive justice and therefore insisted that social-defense measures based on dangerousness be farmed out to non-judicial state agencies.
