One contributor from each of the previous volumes has been asked to update the state of scholarship in the field addressed in the respective volume. The title Austrian Studies Today, then, attempts to reflect the state of the art of historical and social science related studies of Austria over the past century, without claiming to be comprehensive. The volume thus covers many important themes of Austrian contemporary history and politics since the collapse of the Habsburg Monarchy in 1918―from World War I and its legacies, to the rise of authoritarian regimes in the 1930s and 1940s, to the reconstruction of republican Austria after World War II, the years of Grand Coalition governments and the Kreisky era, all the way to Austria joining the European Union in 1995 and its impact on Austria's international status and domestic politics.

    Description: Constitutional considerations of protective laws for women were the analytical battlefield on which the legal community reworked the balance between private liberty and the state's authority to regulate. Julie Novkov focuses on the importance of gender as an analytical category for the legal system. During the Progressive Era and New Deal, courts often invalidated generalized protective legislation, but frequently upheld measures that limited women's terms and conditions of labor. The book explores the reasoning in such cases that were decided between 1873 and 1937. By analyzing all reported opinion on the state and federal level, as well as materials from the women's movement and briefs filed in the U.S. Supreme Court, the study demonstrates that considerations of cases involving women's measures ultimately came to drive the development of doctrine. The study combines historical institutionalism and feminism to address constitutional interpretation, showing that an analysis of conflict over the meaning of legal categories provides a deeper understanding of constitutional development. In doing so, it rejects purely political interpretations of the so-called Lochner era, in which the courts invalidated many legislative efforts to ameliorate the worst effects of capitalism. By addressing the dynamic interactions among interested laypersons, attorneys, and judges, it demonstrates that no individuals or institutions have complete control over the generation of constitutional meaning.     Description: Disruptions as Opportunities: Governing Chinese Society with Interactive Authoritarianism addresses the long-standing puzzle of why China outlived other one-party authoritarian regimes with particular attention to how the state manages an emerging civil society. Drawing upon over 1,200 survey responses conducted in 126 villages in the Sichuan province, as well as 70 interviews conducted with Civil Society Organization (CSO) leaders and government officials, participant observation, and online research, the book proposes a new theory of interactive authoritarianism to explain how an adaptive authoritarian state manages nascent civil society. Sun argues that when new phenomena and forces are introduced into Chinese society, the Chinese state adopts a three-stage interactive approach toward societal actors: toleration, differentiation, and legalization without institutionalization. Sun looks to three disruptions—earthquakes, internet censorship, and social-media-based guerilla resistance to the ride-sharing industry—to test his theory about the three-stage interactive authoritarian approach and argues that the Chinese government evolves and consolidates its power in moments of crisis.

    Description: What does federalism do to welfare states? This question arises in scholarly debates about policy design as well as in discussions about the right political institutions for a country. It has frustrated many, with federalism seeming to matter in all sorts of combinations with all sorts of issues, from nationalism to racism to intergovernmental competition. The diffuse federalism literature has not come to compelling answers for very basic questions. Scott L. Greer, Daniel Béland, André Lecours, and Kenneth A. Dubin argue for a new approach—one methodologically focused on configurations of variables within cases rather than a fruitless attempt to isolate “the” effect of federalism; and one that is substantively engaged with identifying key elements in configurations as well as with when and how their interactions matter. Born out of their work on a multi-year, eleven-country project (published as Federalism and Social Policy: Patterns of Redistribution in Eleven Countries, University of Michigan Press, 2019), this book comprises a methodological and substantive agenda. Methodologically, the authors shift to studies that embraced and understood the complexity within which federal political institutions operate. Substantively, they make an argument for the importance of plurinationalism, changing economic interests, and institutional legacies.

    Description: With its ambiguous mix of weak federalist and strong centralist elements, the Austrian constitutional architecture has been subject to conflicting interpretations and claims from its very beginning. The written 1920 constitution has been paralleled by informal rules and forces making up for the imbalance of power between national and subnational authorities. Understanding these inherent weaknesses, virtually all political actors involved are well aware that reforming the allocation of rights and duties between the different levels in the federal state is urgently needed. In recent years, several initiatives of recalibrating the system of power-sharing between the different levels of government have been initiated. So far progress is still underway. The contributions to this volume shine a light on history, presence, and future aspects of the Austrian federal system from historical, juridical, economic, and political science perspective. The volume is also the first book in English ever devoted to the Austrian version of federalism.

    Description: Administering Justice examines the leadership role of chief justices in the American states, including how those duties require chief justices to be part of the broader state political environment. Vining and Wilhelm focus extensively on the power of chief justices as public spokespersons, legislative liaisons, and reform leaders. In contrast to much existing research on chief justices in the states, this study weighs their extrajudicial responsibilities rather than intracourt leadership. By assessing the content of State of the Judiciary remarks delivered over a period of sixty years, Vining and Wilhelm are able to analyze the reform agendas advanced by chief justices and determine what factors influence the likelihood of success. These analyses confirm that chief justices engage with state politics in meaningful ways and that reactions to their proposals are influenced by ideological congruence with other political elites and the scope of their requests. Administering Justice also examines the chief justice position as an institution, provides a collective profile of its occupants, and surveys growing diversity among court leaders.

    Description: After the dissolution of the Austro-Hungarian Monarchy, Austria transformed itself from an empire to a small Central European country. Formerly an important player in international affairs, the new republic was quickly sidelined by the European concert of powers. Austria's post-Habsburg state suffered from enormous losses of territory and population. However, these losses did not hamper the country's innovative spirit. The essays in this twentieth anniversary volume of Contemporary Austrian Studies argue that Austria found its place in the global arena of the twentieth century, making its mark on both Europe and the world. From Freudian psychoanalysis to Auto-Marxist thought and the Austrian School of Economics, Austrian ideas continued to be vital to the intellectual community at large. Vienna remained the Austrian capital and reasserted its strong position in Central European and international business and finance. This volume also examines how increasing globalization in the 20th century impacted Austrian demography, society, and political life.     Description: Warping Time shows how narratives of the past influence what people believe about the present and future state of the world. In Benjamin Ginsberg and Jennifer Bachner’s simple experiments, in which the authors measured the impact of different stories their subjects heard about the past, these “history lessons” moved contemporary policy preferences by an average of 16 percentage points; forecasts of the future moved contemporary policy preferences by an average of 12 percentage points; the two together moved preferences an average of 21 percentage points. And, in an Orwellian twist, the authors estimate that the “history lessons” had an average “erasure effect” of 8.5 percentage points—the difference between those with long-held preferences and those who did not recall that they previously held other opinions before participating in the experiment. The fact that the past, present, and future are subject to human manipulation suggests that history is not simply the product of impersonal forces, material conditions, or past choices. Humans are the architects of history, not its captives. Political reality is tenuous. Changes in our understanding of the past or future can substantially alter perceptions of and action in the present. Finally, the manipulation of time, especially the relationship between past and future, is a powerful political tool.

    Description: Listing every right that a constitution should protect is hard. American constitution drafters often list a few famous rights such as freedom of speech, protection against unreasonable searches and seizures, and free exercise of religion, plus a handful of others. However, we do not need to enumerate every liberty because there is another way to protect them: an ""etcetera clause."" It states that there are other rights beyond those specifically listed: ""The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people."" Yet scholars are divided on whether the Ninth Amendment itself actually does protect unenumerated rights, and the Supreme Court has almost entirely ignored it. Regardless of what the Ninth Amendment means, two-thirds of state constitutions have equivalent provisions, or ""Baby Ninth Amendments,"" worded similarly to the Ninth Amendment. This book is the story of how the ""Baby Ninths"" came to be and what they mean. Unlike the controversy surrounding the Ninth Amendment, the meaning of the Baby Ninths is straightforward: they protect individual rights that are not otherwise enumerated. They are an ""etcetera, etcetera"" at the end of a bill of rights. This book argues that state judges should do their duty and live up to their own constitutions to protect the rights ""retained by the people"" that these ""etcetera clauses"" are designed to guarantee. The fact that Americans have adopted these provisions so many times in so many states demonstrates that unenumerated rights are not only protected by state constitutions, but that they are popular. Unenumerated rights are not a weird exception to American constitutional law. They are at the center of it. We should start treating constitutions accordingly.

    Description: In recent years, the federal government’s increasing inability to address major societal challenges has arguably hampered America’s commitment to renewable energy initiatives. Individual U.S. states have stepped into this void and adopted their own policies, leading some to believe that the states can propel America’s renewable energy industry forward. However, we know little about how legislative and regulatory dynamics within America’s states might accelerate or hinder renewable energy policy creation. In Following in Footsteps or Marching Alone?, Srinivas Parinandi explores how states have devised their own novel policies, and how the political workings of legislatures and public utilities commissions have impacted state renewable energy policy design. Through the meticulous study of nearly three decades of state-level renewable energy policy-making, he finds that their creation is primarily driven by legislatures, and that ideologically liberal legislatures largely push the envelope. The book suggests that having a predominantly state-driven renewable energy effort can lead to uneven and patchwork-based policy development outcomes, and a possible solution is to try to more successfully federalize these issues. Parinandi urges readers, scholars, and policy practitioners to consider whether a state-led effort is adequate enough to handle the task of building momentum for renewable energy in one of the world’s largest electricity markets.

While he was responsible for large-scale reforms such as trimming the hidebound pension system and giving more autonomy to higher education, in the process he undermined Austria's consensual social partnership. His record of supporting the European Union agenda is ambivalent, and Austrian public opinion in support of the EU declined precipitously during his time in office. In spite of his superb tactical and negotiating skills, he failed to achieve broad popular acceptance for his ambitious reforms. Volume 18 features essays by Peter Gerlich, Fritz Plasser/Peter Ulram, Heinrich Neisser, Reinhard Heinisch, Heinrich Niesser, Johannes Ditz, Josef Leidenfrost, Anton Pelinka et al., as well as a forum on the "disturbing creativity" of Austrian artists, book reviews, and the review of Austrian politics.

    Description: The Port Authority of New York and New Jersey has morphed in ways that would be unrecognizable to its founders. Its mission evolved from improving rail freight to building motor vehicle crossings, airports, office towers, and industrial parks and taking control of a failing commuter rail line. In its early years, the agency was often viewed with admiration; however as it drew up plans, negotiated to take control of airfields and marine terminals, and constructed large bridges and tunnels, the Port Authority became the object of less favorable attention. It was attacked as a “super-government” that must be reined in, while the mayors of New York and Newark argued that it should be broken up with its pieces given to local governments for their own use. Despite its criticisms and travails, for over half a century the Port Authority overcame hurdles that had frustrated other public and private efforts, built the world's longest suspension bridge, and took a leading role in creating an organization to reduce traffic delays in the New York-New Jersey region. How did the Port Authority achieve these successes? And what lessons does its history offer to other cities and regions in the United States and beyond? In a time when public agencies are often condemned as inefficient and corrupt, this history should provide some positive lessons for governmental officials and social reformers. In 2021, the Port Authority marked its 100th birthday. Its history reveals a struggle between the public and private sectors, the challenges of balancing democratic accountability and efficiency, and the tension between regional and local needs. From selected Port Authority successes and failures, Philip Mark Plotch and Jen Nelles produce a significant and engaging account of a powerful governmental entity that offers durable lessons on collaboration, leadership, and the challenge of overcoming complex political challenges in modern America.

    Description: Why did enduring traditions of economic and political liberty emerge in Western Europe and not elsewhere? Representative democracy, constitutionalism, and the rule of law are crucial for establishing a just and prosperous society, which we usually treat as the fruits of the Renaissance and Enlightenment, as Western European societies put the Dark Ages behind them. In The Medieval Constitution of Liberty, Salter and Young point instead to the constitutional order that characterized the High Middle Ages. They provide a historical account of how this constitutional order evolved following the fall of the Western Roman Empire. This account runs from the settlements of militarized Germanic elites within the imperial frontiers, to the host of successor kingdoms in the sixth and seventh centuries, and through the short-lived Carolingian empire of the late eighth and ninth centuries and the so-called “feudal anarchy” that followed its demise. Given this unique historical backdrop, Salter and Young consider the resulting structures of political property rights. They argue that the historical reality approximated a constitutional ideal type, which they term polycentric sovereignty. Salter and Young provide a theoretical analysis of polycentric sovereignty, arguing that bargains between political property rights holders within that sort of constitutional order will lead to improvements in governance.

    Description: When we observe protest marches, striking workers on picket lines, and insurgent movements in the world today, a litany of objects routinely fill our field of vision. Some such objects are ubiquitous the world over, like flags, banners, and placards. Others are situationally unique: Who could have anticipated the historical importance of a flower placed in the barrel of a gun, a flaming torch, a sea of umbrellas, a motorist’s yellow vest, a feather headdress, an AK-47, or a knitted pink hat? This book explores the “stuff” at the heart of protests, revolutions, civil wars, and other contentious political events, with particular focus on those objects that have or acquire symbolic importance. In the context of “contentious politics” (disruptive political episodes where people try to change societies without going through institutions), certain objects can divide and unite social groups, tell stories, make declarations, spark controversy, and even trigger violent upheavals. This book draws together scholars from a variety of fields to discuss symbolic objects in contentious politics: their meanings, uses, functions, and social responses. In bringing these phenomena together, this book offers a serious, distinctive, and cohesive theoretical contribution that draws upon diverse scholarly work in order to form the building blocks for future inquiry in the field. The aim is not merely to “close the gap” in the literature, but to create space in the field for further and more fruitful inquiry.

They also deal with the complex challenges posed by nation building after a major war, including the ambiguity inherent in the creation of new institutions in politics, economics, social life, and culture. In 1919 the government of the fledgling Republic of Austria was confronting revolutionary turmoil in the streets of Vienna, a near-total collapse of the agricultural and industrial economies, and the fallout of a crushing military defeat. In addition, the government was overburdened by the sheer number of new veterans, including the over 100,000 wounded soldiers returning from the frontlines. The redrawn Austrian borders produced a loss of German ethnics and major demographic shifts. Austrians—no longer dominant in a vast empire—were uncertain of their standing. In spite of ideological conflict between the major political camps, Austria experienced a cultural and educational revival—one that proved essential to forging a new national identity.

Drawing on long-term ethnographic fieldwork with journalists, editors, and executives at a newspaper in Guangzhou, The Currency of Truth brings its readers into the lives of the people who write, publish, and profit from news in this milieu. The book shows that far from working as mere cogs in a Party propaganda machine, these individuals are immersed in fluidly shifting networks of formal and informal relationships, which they carefully navigate to pursue diverse goals. In The Currency of Truth, Emily H. C. Chua argues that news in China works less as a medium of mass communication than as a kind of currency as industry players make and use news articles to create agreements, build connections, and protect and advance their positions against one another. Looking at the ethical and professional principles that well-intentioned and civically minded journalists strive to uphold, and the challenges and doubts that they grapple with in the process, Chua brings her findings into conversation around “post-truth” news and the “crisis” of professional journalism in the West.     Description: Territory is shifting. No longer defined by the dotted line of the border or the national footprint of soil, today’s territories are enacted through data infrastructures. From subsea cables to server halls, these infrastructures underpin new forms of governance, shaping subjects and their everyday lives. Technical Territories moves from masked protestors in Hong Kong to asylum-seekers in Christmas Island and sand miners in Singapore, exploring how these territories are both political and visceral, altering the experience of their inhabitants. Infrastructures have now become geopolitical, strategic investments that advance national visions, extend influence, and trigger trade wars. Yet at the same time, these technologies also challenge sovereignty as a bounded container, enacting a more distributed and decoupled form of governance. Such “technical territories” construct new zones where subjects are assembled, rights are undermined, labor is coordinated, and capital is extracted. On Broadway stages, in Harlem nightclubs and dance halls, and within private homes sponsoring rent parties, African American performers of the 1920s and early 1930s teased the limits of white middle-class morality. Blues-singing lesbians, popularly known as "bulldaggers," performed bawdy songs; cross-dressing men vied for the top prizes in lavish drag balls; and black and white women flaunted their sexuality in scandalous melodramas and musical revues. Race leaders, preachers, and theater critics spoke out against these performances that threatened to undermine social and political progress, but to no avail: mainstream audiences could not get enough of the riotous entertainment.

    Description: The State You See uncovers a racial gap in the way the American government appears in people’s lives. It makes it clear that public policy changes over the last fifty years have driven all Americans to distrust the government that they see in their lives, even though Americans of different races are not seeing the same kind of government. For white people, these policy changes have involved a rising number of generous benefits submerged within America’s tax code, which taken together cost the government more than Social Security and Medicare combined. Political attention focused on this has helped make welfare and taxes more visible representations of government for white Americans. As a result, white people are left with the misperception that government does nothing for them, apart from take their tax money to spend on welfare. Distrust of government is the result. For people of color, distrust is also rampant but for different reasons. Over the last fifty years, America has witnessed increasingly overbearing policing and swelling incarceration numbers. These changes have disproportionately impacted communities of color, helping to make the criminal legal system a unique visible manifestation of government in these communities. While distrust of government emerges in both cases, these different roots lead to different consequences. White people are mobilized into politics by their distrust, feeling that they must speak up in order to reclaim their misspent tax dollars. In contrast, people of color are pushed away from government due to a belief that engaging in American elections will yield the same kind of unresponsiveness and violence that comes from interactions with the police. The result is a perpetuation of the same kind of racial inequality that has always been present in American democracy. The State You See is essential reading for anyone interested in understanding how the American government engages in subtle forms of discrimination and how it continues to uphold racial inequality in the present day.
