    Description: Die EU strebt einen Multilateralen Investitionsgerichtshof (MIC) an, der das bestehende System der Investitionsschiedsgerichtsbarkeit ersetzen soll. Basierend auf den aktuellen Debatten in UNCITRAL und anderen Foren zeigt dieser Entwurf eines Statuts für einen MIC, dass ein neues System der Streitbeilegung möglich ist. Zum ersten Mal wird ein vollständiger Vertragsentwurf für die Ausgestaltung eines solchen MIC als neue internationale Organisation vorgelegt, der strenge rechtsstaatliche Anforderungen an die Streitbeilegung umsetzt. Eckpunkte sind neben Rule of Law-Überlegungen Kostenreduzierung, eine ständige Richterbank mit einem Berufungsgremium, Transparenz, mehr Konsistenz in der Rechtsprechung sowie die effektive Vollstreckbarkeit von MIC-Entscheidungen. Abstract The EU is aiming for a Multilateral Investment Court (MIC) to replace the existing investment arbitration system. Based on the current debates in UNCITRAL and other fora this Draft Statute of an MIC demonstrates that it is possible to have a new system of dispute settlement. For the first time, a complete draft agreement is presented for the design of such an MIC as a new international organization, implementing strict rule of law-requirements for dispute settlement. Besides rule of law-considerations, cornerstones are reduced costs, a permanent bench of judges with an appellate system, transparency, more consistency in case law as well as the effective enforceability of MIC decisions.

    Description: This study is the first to analyse the manifold interrelations between armed conflicts and the human and natural environments both historically and sociologically. While most research to date has dealt with this topic primarily with regard to environmental destruction caused by acts of war or armament in peacetime, this publication goes one step further by highlighting the historical changes to this complex interrelationship with concrete examples: from the Second World War in Europe and Asia via the classic proxy war in Vietnam to the current asymmetric wars in South Asia.     Description: Asylum and refugees in Europe – who can fix a broken system? In times of increasing waves of migration, collective bodies and their cooperation networks are of particular importance to the European asylum system. But who are those actors and what is their contribution to effecting a change in the situation of those seeking refuge in Europe? While the Common European Asylum System introduced standardised regulations for all EU-member states, the real situation in each country differs greatly from those official declarations, even leading to a humanitarian crisis at times. Using the theory of neo-institutionalism, current data from expert interviews, and website and document analyses from Italy, Spain, Greece, Cyprus, Malta and Germany, this study answers those questions.     Description: Based on analyses of the essays written by Max Weber on China, India, ancient Judaism and also on the dispersed material about Islam, Eastern Christianity and Occidental Christianity, this book examines the economic ethics of Asian and Christian traditions and their corresponding legal systems. Drawing also on Weber's methodology (particularly the concept of adequate causation), the author reveals that the nature of Asian religions as well as the nature of customary and other not formally rational laws in Asian cultures could not lead to modern capitalism out of their own sources, although capitalism could be adopted from the outside. The culture of the Occident, upon which capitalism is based, is revealed to consist of a double rationalisation: the formal rationality of the exterior circumstances of life (administrative and legal) and the innerworldly practical rationality of the inner motivations of the Protestants, supported by a goal-oriented rational technology.

    Description: Popular uprisings in the Middle East and North Africa (MENA) have had a deep impact, not only on the societies and political structures in the respective countries there, but also on different academic disciplines. The events that started in 2010 in Tunisia have altered academic terminology, contributed to a shift in study focus and sometimes challenged dominant theoretical approaches.     Description: With the benefit of hindsight, presenting the Treaty of Versailles as an example of ‘peace through law’ might seem like a provocation. And yet, the extreme variety and innovativeness of international procedural and substantial ‘experiments’ attempted as a result of the Treaty of Versailles and the other Paris Peace Treaties of 1919–1920 remain striking even today. While many of these ‘experiments’ had a lasting impact on international law and dispute settlement after the Second World War, and considerably broadened the very idea of ‘peace through law’, they have often disappeared from collective memories. Relying on both legal and historical research, this book provides a global overview of how the Paris Peace Treaties impacted on dispute resolution in the interwar period, both substantially and procedurally. The book’s accounts of several all-but-forgotten international tribunals and their case law include references to archival records and photographic illustrations.

    Description: Not so long ago, the only respectable question for philosophical, legal, and political scholars to ask about torture was how to ensure its effective legal prohibition.
