    Future Regulation of Cross-Border Audiovisual Content Dissemination (2023)

    Description: The reality of cross-border dissemination of audiovisual content poses growing threats to the fundamental rights and values of the EU. In an increasingly complex network of sectoral EU legislation, including different institutional systems, the question of an effective reaction is pertinent. This study analyses the current legal framework for the cross-border dissemination of audiovisual content, focusing in particular on the country of origin mechanisms of the AVMS Directive, and identifies challenges in this respect for law enforcement. These are compared with approaches from other legal acts, such as the proposed European Media Freedom Act (EMFA), before possible solutions are presented.
    Description: Die Realität der grenzüberschreitenden Verbreitung audiovisueller Inhalte In Europa birgt steigende Gefahren für Grundrechte und Werte der EU. Es stellt sich die Frage, wie diesen in einem komplexer werdenden Netzwerk sektoraler Rechtsakte der EU mit unterschiedlichen institutionellen Systemen effektiv begegnet werden kann. Die Studie analysiert den geltenden Rechtsrahmen für die grenzüberschreitende Verbreitung audiovisueller Inhalte mit Fokus auf dem Herkunftslandmechanismen der AVMD-Richtlinie und leitet daraus Herausforderungen für die Rechtsdurchsetzung ab. Diese werden mit Ansätzen aus anderen Rechtsakten wie dem vorgeschlagenen European Media Freedom Act (EMFA) verglichen, bevor mögliche Lösungsansätze vorgeschlagen werden.

Die Studie nimmt die sozialen Beziehungen zwischen verschiedenen Gruppen chinesischer Eltern an einer chinesischen Mandarin-Sprachschule in einer Großstadt in Deutschland unter die Lupe. Mit Hilfe eines ethnographischen Ansatzes wird ein lebendiges Bild der elterlichen sozialen Interaktionen innerhalb und außerhalb des chinesischen Schulumfelds gezeichnet. Die Studie zeigt die Bedeutung sozialer Interaktionen auf und erörtert sie im Zusammenhang mit dem sozioökonomischen Hintergrund ihrer Migrationsverläufe; How do parents cooperate with each other, what value do they attach to their interaction and how is the degree of cooperation related to social status? The study takes a close look at the social relationships among various groups of Chinese parents at a Chinese Mandarin language school in a metropolitan city in Germany. Taking an ethnographic approach, it captures a vivid picture of the parental social interactions in and outside the Chinese school setting. The study reveals the significance of social interactions, discussing it in relation to the parents’ socioeconomic backgrounds and individual migrant trajectories.

    Description: Bankenstrukturreformen, die eine Trennung von Investment- und Retailbanking vorsehen und die zusammenfassend als „Ring-Fencing“ bezeichnet werden können, werden seit der Finanzkrise kontrovers diskutiert. Die Arbeit befasst sich mit den rechtlichen Entwicklungen in der Europäischen Union sowie mit Regelungen im Vereinigten Königreich, Deutschland und der Schweiz. Die Arbeit trägt zur Abgrenzung und der Systematik von Ring-Fencing-Regelungen bei und zeichnet ein umfassendes Bild der gegenwärtigen Entwicklungen sowie möglicher Perspektiven auf Ebene des Unionsrechts. Darüber hinaus untersucht sie strukturelle Unterschiede zwischen bestehenden nationalen Regelungen an Europas drei wichtigsten Finanzplätzen und geht dabei insbesondere auf die einzigartigen aber bisher international wenig beachteten Schweizerischen Ring-Fencing-Bestrebungen ein. Die Arbeit wurde unter anderem mit dem Österreichischen Preis für Insolvenzrecht ausgezeichnet. Bank structural reforms that stipulate the separation of retail and investment banking and that can collectively be referred to as ‘ring-fencing’ have been among the most controversial regulations since the financial crisis. This study explores legal developments in the European Union in this regard as well as national legislation in the United Kingdom, Germany and Switzerland. The study contributes to the terminology and classification of existing and future ring-fencing initiatives and paints a comprehensive picture of current developments and prospects on an EU level in this respect. It furthermore highlights structural differences in the national approaches of Europe’s three most important financial centres, and casts light on Switzerland’s unique ring-fencing efforts that have been barely recognised internationally. This study was recognised with the Austrian Award for Insolvency Law.
