    Description: This volume is based on updated presentations delivered at a symposium held in 2017 at Seoul National University. It follows two earlier conference volumes and shares their goal to stimulate the scholarly exchange between company law academics in Germany, China, Japan and South Korea which can be traced back to the late nineteenth century. Contributions from all four jurisdictions include papers on shareholder activism and the disclosure of substantial shareholdings as well as studies on takeover law addressing key questions such as the mandatory bid rule, control premiums, hostile takeovers and pre- and post-bid defences.

    Description: Collective labour law is, for the most part, national law. It is often the result of social struggle and political compromise occurring in the national context. Unlike other fields of private law, it has not been the object of legal harmonisation, at either international or European levels. However, as national frontiers progressively open up for goods and services, collective labour law has become increasingly exposed to international and supranational law. This book contains the papers presented at an international conference held at the Max Planck Institute for Comparative and International Private Law in 2014. The authors look, from a comparative perspective, at current developments in the fields of collective bargaining and employee participation in several European countries and in China. They analyse the extent to which differences between the national legal systems still prevail and whether common features are about to emerge.

    Description: In recent decades, the technical handling of custody business in the OHADA region has undergone a lasting change. There has been a shift from a direct to an indirect holding system, in which the interests of an investor in respect of the underlying securities are recorded in the books of an intermediary (such as a bank or a securities firm). Under the law of all states within the OHADA region, the traditional conflict of laws rule for determining the enforceability of a securities pledge that occurs in the indirect holding system is the lex rei sitae (or the lex cartae sitae or the lex situs ) rule. However, the traditional lex rei sitae rule cannot be appropriately applied to a system where the dematerialised securities are held through multiple layers of intermediaries located in different jurisdictions. Yet, until the intermediated system and the collateralisation of intermediated securities in the OHADA region will continue to operate in somewhat legally murky waters, leading to more instability in the financial markets.     Description: More than 20 years have passed since the downfall of socialist systems. To accelerate transformation processes utmost priority was given to the recognition of property rights, an indispensable requirement for free market economies. Regulators soon came to realize that the success of transformation was conditioned on a more systematic approach towards codified civil law and business law. Numerous comparative law studies on individual Eastern European states have been undertaken, but they fail to portray the dynamic in its full scope. Studies adopting long-term perspectives and offering multi-nation comparisons are particularly rare. In March 2009, a symposium was held at the Hamburg Max Planck Institute for Comparative and International Law to address these shortcomings. In this conference volume Christa Jessel-Holst, Rainer Kulms, and Alexander Trunk assemble the contributions by international policy advisors and scholars from Eastern and South Eastern Europe (Bosnia and Herzegovina, Bulgaria, Croatia, Hungary, Poland, Romania, Russia, Serbia, Slovenia and Ukraine) assessing codification processes in classic civil law fields and company and capital market laws. In spite of comparable transformation problems, the individual processes are moving forward quite disparately, oscillating between 'old' socialist codifications, legislative projects faithful to the acquis communautaire and new codifications with a distinctly autonomous approach. Nonetheless, most transformation states are united in their effort to establish efficient court systems which can handle the acquis without being positivistic.     Description: The present collection of essays addresses the development of Ukrainian private law in the course of its ongoing Europeanization. This process is determined by the Association Agreement between the EU and Ukraine, which was concluded in 2014 and obliges Ukraine to implement a diverse number of European legal acts in its national legal system, aiming to achieve the economic integration of Ukraine into the EU internal market. Nevertheless, it would be inaccurate to describe the process of integrating Ukrainian private law into the European Area of Justice as solely the implementation of the Community acquis. Rather, the Europeanization of Ukrainian private law is part of a value-based Europeanization of the entire Ukrainian society.

    Description: The Qur'ān, emphasizing ritual purity and the role of Jesus as giver of God's positive law, preserves aspects of an earlier Jesus movement that most Christian groups diluted or rejected. The Didascalia Apostolorum, a late ancient church order, records a significant number of the laws promulgated in the Qur'ān, but does not fully endorse them when it comes to purity. Likewise, the Didascalia' legal narratives about the Israelites and about Jesus, as well as the legal and theological vocabulary of the Syriac (Eastern Christian Aramaic) version of the Didascalia, recurrently show kinship with the Arabic Qur'ān, amplifying the apparent affinities between the two texts. The Qur'ān, however, is not "based" on the Didascalia in any direct way; detailed comparison of the two documents illustrates the absence of textual influence in either direction. Both texts should rather be read against the background of the practices and the oral discourse shared by their respective audiences: a common legal culture. In this volume, Holger M. Zellentin offers new insights into Late Antique Judaism and Christianity, into the continuity of Judaeo-Christian law and narrative within Jewish and Christian mainstream communities past the fourth century, and into the community that the Qur'ān first addressed. Understanding how the Qur'ān parts ways with contemporaneous forms of Christianity and Judaism, both in the initial and in subsequent phases of the internal development of its legal culture, allows for a more precise appreciation of its message.

    Description: Over the last decades, private international law has become the target of intense codification efforts. Inspired by the stimulating initiatives taken by some European countries, by the Brussels Convention and the Rome Convention, numerous countries in other regions of the world started to enact comprehensive legislation in the field. Among them are Taiwan and mainland China. Both adopted statutes on private international law in 2010. In light of the rising significance of the mutual economic and societal relations between the jurisdictions involved and of the legal innovations laid down in the new instruments, the Max Planck Institute for Comparative and International Private Law convened scholars to present the conflict rules adopted in Europe, in mainland China and in Taiwan across a whole range of private law subjects. This book collects the papers of the conference and presents them to the public, together with English translations of the acts of Taiwan and mainland China.

    Description: The Calvin year 2009 began on October 31, 2008 with a conference organized by the Institute for Reformation Research (Apeldoorn) on the topic »Calvin: Saint or Sinner?« A number of scholars dealt with the question of whether and how Calvin brought a renewal to theology, the church and society. This volume contains the papers held at this conference, which demonstrate the detailed and growing research on the reformer of Geneva. Since the contributions reflect the latest research in Calvin studies, the conclusions reached in many of the papers are surprising. Calvin was not a reformer in all respects in the original sense, as some would have wanted him to be. However on other subjects he definitely distanced himself from tradition and from his fellow reformers. All in all, this volume gives an overview of the many facets of John Calvin and his theology.

    Description: Uzi Leibner aims to provide the most accurate picture possible of the nature and history of the rural settlement in the Lower Galilee during Hellenistic, Roman and Byzantine periods when this region played an important role in the development of both Judaism and Christianity. In an attempt to draw a historical reconstruction based on systematic data, a test case area in the »heart« of ancient Galilee was chosen for this research. Uzi Leibner used two distinct disciplines: the study of the relevant historical sources and the advanced archaeological field survey. Greek, Latin, Hebrew and Aramaic sources concerning settlements in the region were translated and discussed. Some fifty archaeological sites from the periods under discussion were identified and surveyed. The analysis of the finds enabled the author to draw a detailed portrait of settlement – including periods of construction, abandonment, prosperity and decline in each site and in the region as a whole. This book sheds new light on major historical issues such as the origins of the Galilean Jewry in the Second Temple Period, the First Jewish Revolt and its outcomes, the Jews of Galilee under Christian regime, demography, economy, continuity and decline.
