    Description: This edited volume explores a variety of aspects of associative governance, providing detailed case studies of associations and associational governance in Scandinavia. Theoretically developing a concept and approach of associative governance, the book sheds light on a dynamic way of perceiving associative aspects of community and commercial life that has been hitherto underexplored and undertheorized. It shows how governance by associations may be conducted not only bottom‑up by self‑organized and voluntary participation, but also top‑down by authoritative incorporation through government, and – not least – in multifarious interstices in between.     Design of a Worker Cooperatives Society (2024)

    Description: What would an alternative to contemporary capitalism look like? In this book, Geert Reuten sets out a detailed design of a democratic society organised in worker cooperatives, followed by an equally detailed democratic transition to it, thereby making a convincing case. In Reuten’s design, Workers constitute the single economic class. However, unlike in capitalism, there is no class that owns the means of production. The legal structure of worker cooperatives is such that workers have full rights to the fruits of the cooperative without owning it, and yet the state does not own the cooperatives either. Interestingly, worker councils in the economic and state domains vote on all economically relevant matters. In Reuten’s work, the free choice of occupation and of specific consumer goods is even larger than in capitalism.

    Description: Images of diamonds appear everywhere in American culture. And everyone who has a diamond has a story to tell about it. Our stories about diamonds not only reveal what we do with these tiny stones, but also suggest how we create value, meaning, and identity through our interactions with material culture in general. Things become meaningful through our interactions with them, but how do people go about making meaning? What can we learn from an ethnography about the production of identity, creation of kinship, and use of diamonds in understanding selves and social relationships? By what means do people positioned within a globalized political-economy and a compelling universe of advertising interact locally with these tiny polished rocks? This book draws on 12 months of fieldwork with diamond consumers in New York City as well as an analysis of the iconic De Beers campaign that promised romance, status, and glamour to anyone who bought a diamond to show that this thematic pool is just one resource among many that diamond owners draw upon to engage with their own stones. The volume highlights the important roles that memory, context, and circumstance also play in shaping how people interpret and then use objects in making personal worlds. It shows that besides operating as subjects in an ad-burdened universe, consumers are highly creative, idiosyncratic, and theatrical agents.

    Description: The present work starts from the problem when investigating how the same penalty for the crime of Fraudulent Embezzlement affects the principle of proportionality, so it is necessary to refer to Article 387 of the Penal Code, which reads as follows: The public official or servant who appropriates or uses, in any form, for himself or for another, funds or effects whose collection, administration or custody are entrusted to him by reason of his position, shall be punished with deprivation of liberty for not less than two nor more than eight years. It is an aggravating circumstance if the funds or effects were destined for welfare purposes or social support programs. In these cases, the prison sentence shall be not less than four nor more than ten years. According to the Plenary Agreement No. 4-2005/CJ-116, Plenary Jurisdiction of the Permanent and Transitory Criminal Chambers of the Supreme Court of Justice, the elements of the criminal offense of embezzlement are (i) the existence of a functional relationship, (ii) the collection, administration or custody, (iii) appropriation or use, (iv) the recipient: for himself or for a third party, (v) funds and effects. The result was that when punishing with the same penalty in the crime of Fraudulent Misappropriation in its modality of appropriation and use, despite the differences if we appreciate them from a patrimonial perspective or from the perspective of safeguarding the right of property of the public entity, in the modality of use there is an excess in the penalization, affecting the principle of proportionality, reason for which it should have a different treatment.

    Description: El presente trabajo se inicia del problema cuando se investiga de qué manera al sancionar con una misma pena en el delito de Peculado Doloso afecta el principio de proporcionalidad, por lo que es necesario remitirnos al artículo 387 del Código Penal, cuyo tenor es como sigue: El funcionario o servidor público que se apropia o utiliza, en cualquier forma, para sí o para otro, caudales o efectos cuya percepción, administración o custodia le estén confiados por razón de su cargo, será reprimido con pena privativa de la libertad no menor de dos ni mayor de ocho años. Constituye circunstancia agravante si los caudales o efectos estuvieran destinados a fines asistenciales o a programas de apoyo social. En estos casos, la pena privativa de la libertad será no menor de cuatro ni mayor de diez años. Según lo establecido por el Acuerdo Plenario N.° 4-2005/CJ-116, Pleno jurisdiccional de las Salas Penales Permanentes y Transitoria de la Corte Suprema de Justicia, los elementos del tipo penal de peculado son (i) la existencia de una relación funcional, (ii) la percepción, administración o custodia, (iii) apropiación o utilización, (iv) el destinatario: para sí o para un tercero, (v) caudales y efectos. El resultado fue que al sancionar con una misma pena en el delito de Peculado Doloso en su modalidad de apropiación y utilización visten de igual contenido de ilicitud, pese a las diferencias si las apreciamos desde una perspectiva patrimonialista o de salvaguarda del derecho de propiedad del ente público, en la modalidad de utilizar existe un exceso en la penalización afectándose el principio de proporcionalidad, razón por la cual debe tener un tratamiento distinto.

    Description: The Lebanese are the largest group of Middle Eastern immigrants in the United States, and Lebanese immigrants are also prominent across Europe and the Americas. Based on over eighty interviews with first-generation Lebanese immigrants in the global cities of New York, Montreal and Paris, this book shows that the Lebanese diaspora – like all diasporas – constructs global relations connecting and transforming their new societies, previous homeland and world-wide communities. Taking Lebanese immigrants’ forms of identification, community attachments and cultural expression as manifestations of diaspora experiences, Dalia Abdelhady delves into the ways members of Lebanese diasporic communities move beyond nationality, ethnicity and religion, giving rise to global solidarities and negotiating their social and cultural spaces.     Description: This book uses sustainability to explore the interfaces between translation studies, the cultural history of knowledge, and Science and Technology studies (STS). The volume examines various material, cultural and epistemic translation practices where sustainability serves as a boundary object between natural and cultural inquiry. By turning to the intellectual traditions that influenced but were left behind by STS and actor-network theory (ANT), we aim to challenge and expand the Sociology of Translation developed in ANT. Concepts such as ‘inscription’ (Derrida), ‘actant’, ‘narrative’ (Greimas), and ‘world/worlding’ (Heidegger, Spivak) were reemployed – translated – in the canonical STS-texts. What networks of meaning were left behind in this reemployment? The book showcases a combination of cultural and knowledge historical perspectives on the construction of the Sociology of Translation and practical experiments across the registers of nature and culture is novel. There have been brilliant individual attempts to realign the Sociology of Translation with narratives and modes of enunciation, but none has related the Sociology of Translation to the networks and traditions which enabled it but to which it erased its relations and debts. This innovative work will appeal to scholars in translation studies, cultural studies, environmental humanities, medical humanities, and Science and Technology studies.     Description: This book examines the politics of Banking Union and EMU reform in the EU, and draws lessons for what it means for international politics, both in Europe, and for international relations more broadly. It demonstrates that most of the reforms in Europe to break free of the Eurozone and banking crises in which Europe continues to find itself focus on building up the capacities of national authorities rather than European ones. The result is that national authorities remain largely in control of the decisions and funds that are to be deployed to prevent economic disaster if a single EU bank fails. The likely outcome is an accelerated balkanization of the European market for the foreseeable future. The book also contends that power politics, and realism in particular, is a defining feature of European politics with coercion and enforced national responsibility at the demand of Germany; the dominant form of institution-building that established the responsible sovereignty model, and shut down the possibility of alternatives. In making this case, the book demonstrates that the dominant view in international relations, that power politics best explains the behaviour of states, also apply to the EU. This text will be of key interest to scholars and students of the Eurozone crisis, EU politics, economic policy, and more broadly to political economy, public policy and international relations.

    Description: Agency, Security and Governance of Small States examines what seems to be a defining paradox of Small-State Studies: the simultaneous coexistence (and possible co-dependence) of vulnerability and opportunity related to small-state size. This book analyses small states within the framework of this apparent paradox. Traditionally, Small-State Studies has focused on three guiding questions: what constitutes a ‘small state’? What explains small-state influence in global affairs? Are small states truly vulnerable to security threats given the expansion of multilateralism and regionalism throughout the world? This book contends that new questions should be asked which recognise the important shifts in twenty-first century security paradigms, to better understand how some states deploy their smallness as a resource for agency in supranational contexts. By varying historical, geographical, security, and governance contexts, the book embraces a most-different-cases approach. The historical perspective is often neglected in Small-State Studies but contributes to understanding how small states have often, over time, transformed perceived insecurity into agency. By focusing on different world regions, the authors enable the comparative analysis of collective actions, and the creation and implementation of institutions for ‘common sense purposes’ within a geographical region. Of particular contemporary importance, the book includes contributions which contend with hard-security issues alongside other soft-security challenges. The comparison of case studies confirms that hard-security vulnerability and soft-security opportunities seem to be two sides of the same coin, which reinforces the book’s focus on small-state paradoxes, and raises the question of whether smallness can be considered the defining characteristic of governance in these countries. This book will have a broad appeal because of the different world regions it analyses. It will be of interest to postgraduate students, scholars, and researchers of international relations, security, sustainability, governance, development, and political economy, as well as Small-State Studies.

    Description: This book is a biography of Eisaku Satō (1901-75), who served as prime minister of Japan from 1964 to 1972, before Prime Minister Abe the longest uninterrupted premiership in Japanese history. The book focuses on Satō’s management of Japan’s relations with the United States and Japan’s neighbours in East Asia, where Satō worked to normalize relations with South Korea and China. It also covers domestic Japanese politics, particularly factional politics within the ruling Liberal Democratic Party (LDP), where Satō, as the founder of what would become the largest LDP faction, was at the centre of LDP politics for decades. The book highlights Satō’s greatest achievement – the return of Okinawa from United States occupation - for which, together with the establishment of the non-nuclear principles, he was awarded the Nobel Peace Prize, the only Japanese to receive the Prize.

    Description: The Faculty of Philosophy and Letters in Madrid commissioned Marcelino Menéndez Pelayo and Nicolás Salmerón to write a report on the royal decrees that reduced university staffing levels, given by virtue of the authorisations granted by the Budget Law of 30 June 1892. The text of the opinion is reproduced together with some extracts from a well-known book by the professor from the Central University (Historia de los heterodoxos españoles) which help to understand the context of the message. It thus serves to document the extent of an opinion, which is not confined to a single group - the Krausist group - but is shared by other sectors that conceive of the university as something more than an administrative office. The key ideas are: the immobility of the teaching staff; an ideal of family life geared towards scientific research; the demand for autonomy - freedom of action - for the university body; the conception of the university as the representative of national culture; the promotion of scientific and not only professional faculties; the intervention of the university in the choice of its staff; the elimination of course exams... In short, it rejected "the trampling importation of the French centralist regime" and called for emancipation from excessive official tutelage.

    Description: Challenging the posthumanist canon that celebrates the preeminence of matter, Ruth Miller, in Flourishing Thought contends that what nonhuman systems contribute to democracy is thought. Drawing on recent feminist theories of nonhuman life and politics, Miller shows that reproduction and flourishing are not antithetical to contemplation and sensitivity. After demonstrating that processes of life and processes of thought are indistinguishable, Miller finds that four menacing accumulations of matter and information—global surveillance, stored embryos, human clones, and reproductive trash—are politically productive rather than threats to democratic politics. As a consequence, she questions the usefulness of individual rights such as privacy and dignity, contests the value of the rational metaphysics underlying human-centered political participation, and reevaluates the gender relations that derive from this type of participation. Ultimately, in place of these human-centered structures, Miller posits a more meditative mode of democratic engagement. Miller’s argument has shattering implications for the debates over the proper use and disposal of embryonic tissue, alarms about data gathering by the state and corporations, and other major ethical, social, and security issues.

    Description: Engativá is one of the 21 political-administrative divisions of the Capital District of Bogotá (Colombia), and is distinguished by its urban composition, a high population density and its soils dedicated mainly to residential, commercial and industrial use. However, this territory is also characterized by the presence of ecosystems rich in biodiversity that are threatened by factors associated with urbanization and the effects of climate change. In this locality there are three urban wetlands of RAMSAR category: Juan Amarillo, Jaboque and Santa María del Lago, in addition, in terms of water management, by the administrative jurisdiction of Engativá is a portion of land of the basins of the Bogotá River and the Salitre River. On the other hand, among the green areas that make up the urban fabric, such as neighborhood parks, complementary conservation areas such as the botanical garden and La Florida Regional Park stand out. In relation to these urban ecosystems, which are part of the Main Ecological Structure of the Capital District and its environmental region, this book contains an analysis of each of these components, highlighting elements of their historical trajectory, specialized legal regulations and a description of specific challenges. One of the purposes of the systematization of information collected here is to make evident the nuances of the environmental urban planning managed in the administrative jurisdiction of Engativá: a place where urban vitality and nature converge in a fragile balance, marked by a complex trajectory of environmental degradation and adoption of the inhabitants to the territory.

En esta localidad se encuentran tres humedales urbanos de categoría RAMSAR: Juan Amarillo, Jaboque y Santa María del Lago, además, en materia de ordenamiento hídrico, por la jurisdicción administrativa de Engativá se encuentra una porción de terreno de las cuencas del río Bogotá y del río salitre. Por otra parte, entre las áreas verdes constitutivas del tejido urbano como los parques de carácter vecinal, sobresalen las áreas complementarias para la conservación como el jardín botánico y el Parque regional La Florida. En relación con estos ecosistemas urbanos, que hacen parte de la Estructura Ecológica Principal del Distrito Capital y su región ambiental, el presente libro contiene un análisis de cada uno de estos componentes, resaltando elementos de su trayectoria histórica, las regulaciones jurídicas especializadas y una descripción de los desafíos específicos. The alternative strategy pursued in this volume is to pay as much analytical attention to the study of democratic politics as STS has previously offered to familiar topics of science and technology. This timely collection of empirical stories and conceptual inventions leads the way by showing how the making and doing of democracy can be placed at the centre of relational research. The book turns the well-known sites of contemporary Euro-American participatory democracy, such as elections, bureaucracies, public debate and citizen participation, into fluctuating democratic situations where supposedly untouchable democratic ideals are shaped, contested and warped in practice. The fact that Euro-American participatory democracy is often upheld as an ideal for the rest of the world makes it all the more important to study how it is a situated, distributed, material, emergent, heterogenous, fragile and at times faltering figure and project. Through situated analyses, the authors demonstrate that democracy cannot be reduced to theoretical ideals and schemes of conflict, institutions, or deliberation. Instead, the volume offers an urgently needed empirically driven renewal of our understanding of democratic politics in a time when conventional ideas increasingly fail to capture current events such as Brexit, Trump and Covid19. The twelve chapters are organised into three sections. The first part, entitled Interfaces of technodemocracy, focuses on how democratic politics is co-shaped by its interfaces with more or less rigid institutions and bureaucracies. The second section, Technosciences, democracy and situated enactments of participation, emphasises the relationships between science and public participation. The third part called Reconfigurations of democratic politics with new nonhuman actors focuses on the role of material objects, especially new digital technologies, in democratic politics.

The wall manifested a level of security that is increasingly commonplace at meetings regarding the global economy. The authors of Shutting Down the Streets have directly observed and participated in more than 20 mass actions against global in North America and Europe, beginning with the watershed 1999 WTO meetings in Seattle and including the 2007 G8 protests in Heiligendamm. Shutting Down the Streets is the first book to conceptualize the social control of dissent in the era of alterglobalization. Based on direct observation of more than 20 global summits, the book demonstrates that social control is not only global, but also preemptive, and that it relegates dissent to the realm of criminality. The charge is insurrection, but the accused have no weapons. The authors document in detail how social control forecloses the spaces through which social movements nurture the development of dissent and effect disruptive challenges.

    Description: Over the last two decades, it has become clear that Russia insists on its great power status, even at considerable cost. Chasing Greatness provides an interpretive explanation of the tacit rules that shape Russia's great power identity today. Anatoly Reshetnikov argues that this never-ending chase for greatness is a result of how Russia and its predecessors—including the USSR, Russian Empire, Muscovy, and Kievan Rus’—historically interacted with its neighbors to the east, the south, and particularly the west. By analyzing an extensive amount of original source material, including primary sources that have not been previously translated into English, he is able to reconstruct a millennial history of the Russian concepts that express political greatness. He also traces numerous encounters between Russia and the West, as well as Russia’s troubled integration into the European society of states in the eighteenth and nineteenth centuries, to show how these concepts have affected Russia’s interaction with international society. Despite its substantive historical depth, Chasing Greatness is not a book of history. Rather, it is a synthesizing social science work inspired by the continental tradition of the critical history of modernity. As such, the book is more about the present than about the past. Its main aim is to expose and explain the rich conceptual baggage behind Russia’s unceasing great power rhetoric (domestic and international) and how this rhetoric drives the current international crises involving Russia.

    Description: The Capital District, as a territorial entity located in the center of the Bogota Savanna, has the political and administrative responsibility to lead environmental sustainability and articulate with the Corporación Autónoma Regional de Cundinamarca (CAR) in order to preserve the ecological structure of the territory and promote sustainable land uses (urban and rural). To this end, there is a set of administrative tools and instruments contemplated in the Land Use Plan (POT) of the Capital District that all citizens should know and use to protect the ecosystems of the savanna of Bogota and the human rights associated with environmental sustainability. The objective of this publication is to contribute to the dissemination of these tools, through conceptualization and synthesis of relevant legal information on the subject. To achieve this purpose, this book is structured in two parts, the first one presents a theoretical contextualization and history of land use planning in Bogota and the second part presents the main concepts of the main ecological structure following the articles of the POT of Bogota - District Decree 555 of 2021.

    Description: Since the turn of the century, the approach of the European Court of Human Rights to reviewing individual cases has taken a procedural turn. As well as analysing the substantive claims of individuals, the Court is increasingly building into its analysis a review of the applicable domestic process for protecting human rights. This shift in approach will be referred to as the Court’s current methodology. The greater use of this form of review, and its normative justification, has been discussed elsewhere. Indeed, although the adoption of this methodology may be understood broadly as an implementation of the principle of subsidiarity, it has also been observed to mark a shift away from the orthodox approach to subsidiarity. This book thus seeks to contribute to the understanding of process-based review by conducting a doctrinal analysis of two key aspects of the Court’s process-based methodology. First, the Court’s engagement with the adequacy of balancing in light of the Convention of the relevant interests at issue within domestic processes. Second, the development of a process based approach under the rubric of Article 35 of the Convention, entailing the requirement for the exhaustion of domestic remedies. Specifically, these two methodological aspects of the Court’s review will be understood in relation to their evolution within the Convention jurisprudence. Part II engages with the explicit introduction of the concept of subsidiarity into the Convention system. Part III then turns to consider the development of the Court’s engagement with the adequacy of balancing in domestic processes. This doctrinal analysis reveals that this aspect of the Court’s jurisprudence has three distinct phases, with the most recent phase entailing an emerging rule of law approach. Part IV will then examine the jurisprudential foundations for the Court’s process-based approach towards its assessment under Article 35. This section will also conduct a study of the development of structural guidance for specific domestic processes under Article 35, using the example of domestic individual complaint mechanisms. Finally, the book will explore the recent operation of process-based methodologies across Articles 5, 10, and 8 of the Convention (Part V), revealing the duality between substance and process-based focuses within the Court’s review under different areas of the Convention.

    Description: In Europe’s recent history, there have been several challenges to the strength of the European Union—Brexit, COVID, financial crises, and global tensions—bringing an increased need to understand the ways that the European Union (EU) could successfully stay together or fall apart. In examining how the European Union has changed since 1993, important puzzles have emerged, including how national government functions are transferred to the EU without reforming the EU, how increased transparency is announced while decisions are approved in informal meetings, and how the effects of the polarizing rise of Euroscepticism can be managed to still promote the formation of solidarity and trust among Europeans. To understand these puzzles, Thomas König introduces a new theory of (supra)national partyism to help explain the causes and consequences of choices made by political leaders for Europe. He uses a game-theoretical perspective to look at how conditions for leaders change through accessions of new members, shocks, and crises, and separates institutional choices into two different games played by office- and policy-seeking political leaders—the interstate summit game and the national game of party competition. The Dynamics of European Integration reveals how the reorganization of electoral systems can harness dissensus and polarization among diverse national constituencies to enable the promotion of solidarity and trust in the EU.

    Description: This open access book investigates how representation of Native Americans and Mexican-origin im/migrants takes place in high school history textbooks. Manually analyzing text and images in United States textbooks from the 1950s to 2022, the book documents stories of White victory and domination over Black, Indigenous, and People of Color (BIPOC) groups that disproportionately fill educational curricula. While representation and accurate information of non-White perspectives improves over time, the same limited tropes tend to be recycled from one textbook to the next. Textual analysis is augmented by focus groups and interviews with BIPOC students in California high schools. Together, the data show how misrepresentation and absence of BIPOC perspectives in textbooks impact youth identity. This book argues for an innovative rethinking of US history curricula to consider which stories are told, and which perspectives are represented.

    Description: This chapter explores the role transnational networks and informal ties play for small-state-status seeking in Central and Eastern Europe. Using the example of Slovakia, I argue that since their accession to Western institutions, these states have continuously sought to carve out a place for themselves on the mental map of European and North American policymakers. Major security-policy conferences have become central nodal points for this kind of activity. They allow the foreign-policy establishment of small states to manage and shape existing status hierarchies by forging personal contacts with decision-makers from more powerful states. I illustrate this phenomenon empirically with reference to the Bratislava Global Security Forum (GLOBSEC), which began in 2005 as a student-led initiative and has since become the main outreach platform of Slovak foreign policymaking.

The chapters in this volume combine philosophical and empirically informed work to show how civic virtues can be informed by larger virtue ethical perspectives. The first two chapters discuss virtues of individuals that have not received significant empirical attention—authenticity and wisdom and psychological resilience. The next two chapters address education and the ways in which civic virtues can help us to better serve schoolchildren who are socially and economically disadvantaged, as well as to broaden students’ horizons with respect to character and sustainability education. The final four chapters explore the roles for virtues within various political and public realms. They offer perspectives on how virtues affect contentious politics in democratic societies, and study virtues in contexts in which democracy has been stifled or torn apart by war. Together, the chapters highlight the ever-widening impact of the virtues on our lives and in society. The Self, Civic Virtue, and Public Life will be of interest to scholars and graduate students working in ethics, political philosophy, psychology, and philosophy of education.     Description: With the globalization in which we find ourselves, violence against women or members of the family nucleus has been increasing as it develops in each of the homes and this occurs when there are violent acts by the aggressor towards the victims of this particular most of the cases are brought to the attention of the competent authorities. It must be understood that in Latin America, where the countries are less developed, violence occurs against women and this does not have a real index, because most of them do not make it known that they are victims of violence. In the Ecuadorian State there are several types of violence that are known by the Public Prosecutor's Office, the cases of physical violence and psychological violence are the ones that are related to each other, that is to say, physical and psychological aggression. In Ecuador with the reform of the Organic Integral Penal Code in 2019 and its subsequent validity and application in June 2020, the implementation of new legal mechanisms to suspend the substantiation of the process in matters of violence against women or members of the family nucleus, as special procedures to solve the problems of this matter is given, considering that the constitutional norm establishes that the State will guarantee the victim the punishment of the aggressor through special procedures in relation to violence.

Hay que entender que América Latina donde los países son menos desarrollados, la violencia ocurre contra la mujer y ésta no tiene un índice real, debido a que la mayoría no pone en conocimiento de qué son víctimas de violencia. En el Estado ecuatoriano existen diversos tipos de violencia que son conocidos por fiscalía de mayor forma se dan los casos de violencia física y violencia psicológica estos tipos de violencia son los que se relacionan entre sí, es decir, la agresión física y psicológica. En el Ecuador con la reforma del Código Orgánico Integral Penal en el año 2019 y su posterior vigencia y aplicación en mes en el mes de junio del 2020, se da la implementación de nuevos mecanismos legales para suspender la sustanciación del proceso en materia de violencia contra la mujer o miembros del núcleo familiar, como procedimientos especiales para solucionar los problemas de esta materia considerando que la norma constitucional establece que el Estado garantizará a la víctima la sanción del agresor mediante procedimientos especiales en relación a la violencia.

The memoirs in which, throughout most of his life, he recorded these and other public and private events, remained unpublished as a whole until now. Beyond the editorial history of this code, to which they have contributed, their possibilities remained untapped for knowledge of the mechanics of access and promotion within the judicial machinery or of the social customs of his privileged estate, among other inquisitive aspects.

    Description: Valentín Ortigosa, born in 1784 in Arriate (Málaga), emigrated to Mexico in 1803, where he was ordained a priest. He returned to Spain in 1810. His biography will reflect the events that took place in those years of the 19th century in which he lived, especially the problems that arose in the relations between Rome and Madrid as the representative system was being established. Although he would never occupy a relevant public position, Ortigosa moved in the circle of Agustín Argüelles, or José María de Calatrava; he enjoyed the favor of the queen governor María Cristina and his political opinions, especially in relation to the independence of the American countries, found echo in the press. Presented by the Regent to be bishop of Malaga in 1836, being suspended in fact the relations between the crown of Spain and Rome, his designation was not confirmed, but he was named capitular vicar and this allowed him to rule the Diocese without having been consecrated bishop; he became one of the "intrusive bishops". Due to denunciations of the Chapter of Malaga, a case was opened against him before the Tribunal of the Archbishopric of Seville. Later the appeal of force that Ortigosa raised before the Audience of Seville, and its execution by the Supreme Court ended up giving rise to the rupture of the relationship with the Holy See with the closing of the Nunciature of Madrid in January of 1841. This case and its repercussions are studied in detail in this book, both from the juridical, civil and canonical point of view, as well as from the political point of view. The documentation collected from newspaper archives and from numerous archives, both Spanish and Roman, has made it possible to analyze the consequences of the question of the so-called "intruders" starting from the case of Valentín Ortigosa, a character whose notoriety in these years contrasts with the oblivion of his name after disappearing from public life in 1843.

Esta causa y sus repercusiones son estudiadas con detenimiento en este libro, tanto desde el punto de vista jurídico, civil y canónico, como desde la óptica política. La documentación recogida de hemerotecas y de numerosos archivos, españoles y de Roma, ha permitido analizar las consecuencias de la cuestión de los llamados “intrusos” a partir del caso de Valentín Ortigosa, un personaje cuya notoriedad en estos años contrasta con el olvido de su nombre tras desaparecer de la vida pública en 1843.

    Description: At the end of the 19th century, Spain enjoyed a favorable climate for developing true freedom of the press, a right recognized in Article 13 of the Constitution of 1876 and developed through the Printing Police Law of 1883. However, throughout the period of the Bourbon Restoration (1883-1923), the Spanish government, represented by the conservative and liberal parties that peacefully took turns in power, adopted a series of measures that distorted the longed-for freedom of Spanish publications. The political and social events characteristic of this period (especially the terrorism of the end of the 19th century, the colonial conflicts in Cuba and Morocco or the influence of the regionalisms of the 20th century), had a notable influence on the actions of the public authorities. The latter used different legal instruments (the approval of different laws limiting freedom, the frequent declaration of the suspension of constitutional guarantees or the multiple sentences imposed through the ordinary courts), and other indirect mechanisms (the reptile funds or the sending of guidelines to newspapers under the threat of suspension or suppression of the newspapers), which served to establish a regime of information control, especially severe with the press that did not follow the guidelines of the liberal regime in place, and which left the liberal Printing Press Law practically without effect.

Los acontecimientos políticos y sociales característicos de esta etapa (especialmente, el terrorismo de finales del siglo XIX, los conflictos coloniales en Cuba y Marruecos o la influencia de los regionalismos del siglo XX), influyeron de forma notable en la actuación del poder público. Este utilizó distintos instrumentos legales (la aprobación de distintas leyes que limitaban la libertad, la frecuente declaración de la suspensión de garantías constitucionales o las múltiples condenas impuestas a través de los tribunales ordinarios), y otros mecanismos indirectos (los fondos de reptiles o el envío de orientaciones a los periódicos bajo la amenaza de la suspensión o la supresión de los periódicos), que les sirvieron para establecer un régimen de control informativo, especialmente severo con la prensa que no seguía las directrices del régimen liberal instaurado, y que dejó prácticamente sin efecto la Ley de Imprenta liberal.

    Description: Bei der Beschreibung der Rechtssysteme und Gesetze der heutigen mehrheitlich muslimischen Staaten in der Region des Nahen Ostens und Nordafrikas werden zwei Kategorien von Gesetzen unterschieden: eine aus dem islamischen und eine aus dem nichtislamischen Recht abgeleitete. Diesem Gedanken folgend, wird in der Literatur festgestellt, dass neuartige Rechtsgebiete keinen Bezug zum islamischen Recht haben, da sie nicht durch das klassische islamische Recht geregelt wurden. Im Gegensatz dazu ist das Thema Organtransplantation von Natur aus mit dem islamischen Recht verbunden, da der Islam sich selbst als alle Aspekte des Lebens umfassend versteht. Diese Untersuchung, die sich auf die Analyse der Organtransplantationsgesetze der MENA-Staaten stützt, regt dazu an, zu überdenken, dass eine strikte Dichotomie zwischen islamischen und nicht-islamischen Gesetzen nicht existiert. Die Gesetze zur Organtransplantation in den MENA-Staaten folgen im Allgemeinen einem internationalen Rechtsstandard und stehen gleichzeitig im Einklang mit der Scharia.
    Description: When describing the legal systems and laws of today’s Muslim-majority states in the Middle Eastern and North African region, two categories of laws are identified: one derived from Islamic and one from non-Islamic law. Following this notion, the literature finds that novel legal areas do not have any connection to Islamic law since they were not regulated by classical Islamic law. In contrast, the topic of organ transplantation is inherently connected to Islamic law because Islam considers itself to encompass all aspects of life. This research based on the analysis of organ transplantation laws of the MENA states encourages to rethink that a strict dichotomy between Islamic and non-Islamic laws does not exist. Organ transplantation laws in MENA states generally follow an international legal standard while also complying with the sharia.

    Description: References to community interests appear from time to time in scholarly writings in the field of international relations and international law. The concept of community interests refers to interests protected by international law binding either all or a group of states and go beyond the delimitation of a sovereign sphere of influence. In the literature, there are existing examples of research, such as in books and journal articles, that consider the various manifestations of what has been described as “community interests” in many areas regulated by international law, including natural resources, global markets, human rights, and the use of force, and observe how law has evolved from a legal system based on more or less specific consent and aimed at promoting the particular interests of states, to one that is more generally oriented towards collectively protecting common interests and values. However, this topic has not been thoroughly researched, meaning that there is a huge gap in the existing literature, particularly in the context of ocean governance and sustainability. This Special Issue attempts to fill this gap, so as to attract more studies on this important topic in academia.

The country has since descended into civil war, the people have been plunged back into conflict and poverty, and the state is again characterised by fragility and human insecurity. As the Myanmar people oppose the regime and fight for their rights, the international community must find ways to act in solidarity.     Description: While the media tends to pay the most attention to violent secessionist movements or peaceful independence movements, it is just as important to understand why there are regions where political movements for autonomy fail to develop. In neglecting regions without political movements or full-blown independence demands, theories may be partial at best and incorrect at worst. State Institutions, Civic Associations, and Identity Demands examines over a dozen regions, comparing and contrasting successful cases to abandoned, unsuccessful, or dormant cases. The cases range from successful secession (East Timor, Singapore) and ongoing secessionist movements (Southern Philippines), to internally divided regional movements (Kachin State), low-level regionalist stirrings (Lanna, Taiwan), and local but not regional mobilization of identity (Bali, Minahasan), all the way to failed movements (Bataks, South Maluku) and regions that remain politically inert (East and North Malaysia, Northeast Thailand). While each chapter is written by a country expert, the contributions rely on a range of methods, from comparative historical analysis, to ethnography, field interviews, and data from public opinion surveys. Together, they contribute important new knowledge on little-known cases that nevertheless illuminate the history of regions and ethnic groups in Southeast Asia. Although focused on Southeast Asia, the book identifies the factors that can explain why movements emerge and successfully develop and concludes with a chapter by Henry Hale that illustrates how this can be applied globally.

    Description: This book provides a systematic analysis of the Russian-Ukraine war, using the concept of resilient fighting power to assess the operational performance of both sides during the first year of the full-scale invasion. The Russian war in Ukraine began in 2014 and continued for eight years, before the full-scale invasion of 24 February 2022. It is not a new war, but the intensity of the warfighting revived many discussions about the conduct of inter-state warfare, which has not been seen in Europe for decades. This book does not aim to offer an exhaustive operational analysis of the war, but rather provides a preliminary systematic analysis across various domains of warfare using the concept of fighting power to assess the operational performance of both sides. First, the book discusses the conceptual component and the post-Cold War adaptations of the Soviet strategic tradition by both the Ukrainian and the Russian Armed Forces. Following that, it gives an evaluation of the various aspects of warfighting in the land, air, maritime and cyber domains. Then, the book examines the role of international allied assistance, sanctions and weapons delivery in strengthening the resilience of the Ukrainian Armed Forces. The book concludes with some comments on the role of inter-state warfare in the current strategic environment and future warfare. This book will be of much interest to students of military and strategic studies, defence studies, foreign policy, Russian studies and international relations.

Debate persists as to whether those countries and territories that tightly managed their borders, like New Zealand, Australia, or Hong Kong, got it ‘right’ compared to those that did not.     Description: Around the world each year, millions of citizens turn out to vote but leave their ballots empty or spoil them. Increasingly, campaigns have emerged that promote “invalid” votes like these. Why do citizens choose to cast blank and spoiled votes? And how do campaigns mobilizing the invalid vote influence this decision? None of the Above answers these questions using evidence from presidential and gubernatorial elections in eighteen Latin American democracies. Author Mollie J. Cohen draws on a broad range of methods and sources, incorporating data from electoral management bodies, nationally representative surveys, survey experiments, focus groups, semi-structured interviews, and news sources. Contrary to received wisdom, this book shows that most citizens cast blank or spoiled votes in presidential elections on purpose. By participating in invalid vote campaigns, citizens can voice their concerns about low-quality candidates while also expressing a preference for high-quality democracy. Campaigns promoting blank and spoiled votes come about more often, and succeed at higher rates, when incumbent politicians undermine the quality of elections. Surprisingly, invalid vote campaigns can shore up the quality of democracy in the short term. None of the Above shows that swings in blank and spoiled vote rates can serve as a warning about the trajectory of a country’s democracy.

Drawing on his research and professional experience, Anani shows how incorporating the BRP into African leadership and governance thinking would encourage more voluntary public participation in politics, guarantee transparency and accountability in decision-making, particularly when it comes to the use of public resources, and ultimately encourage more public confidence in leaders. Anani also provides concrete suggestions for how to achieve all this, not through quick fixes, but rather through educational campaigns directed at public officials and through new communities of learning and practice designed to champion the BRP in villages, schools, workplaces, places of worship, and other social organizations.     Description: Childhood Deployed examines the reintegration of former child soldiers in Sierra Leone. Based on eighteen months of participant-observer ethnographic fieldwork and ten years of follow-up research, the book argues that there is a fundamental disconnect between the Western idea of the child soldier and the individual lived experiences of the child soldiers of Sierra Leone. Susan Shepler contends that the reintegration of former child soldiers is a political process having to do with changing notions of childhood as one of the central structures of society. For most Westerners the tragedy of the idea of “child soldier” centers around perceptions of lost and violated innocence. In contrast, Shepler finds that for most Sierra Leoneans, the problem is not lost innocence but the horror of being separated from one’s family and the resulting generational break in youth education. Further, Shepler argues that Sierra Leonean former child soldiers find themselves forced to strategically perform (or refuse to perform) as the“child soldier” Western human rights initiatives expect in order to most effectively gain access to the resources available for their social reintegration. The strategies don’t always work—in some cases, Shepler finds, Western human rights initiatives do more harm than good. While this volume focuses on the well-known case of child soldiers in Sierra Leone, it speaks to the larger concerns of childhood studies with a detailed ethnography of people struggling over the situated meaning of the categories of childhood.It offers an example of the cultural politics of childhood in action, in which the very definition of childhood is at stake and an important site of political contestation.

In pursuit of an answer, this book examines America's first nativist movement, which responded to the rapid influx of 4.2 million immigrants between 1840 and 1860 and culminated in the dramatic rise of the National American Party. As previous studies have focused on the coasts, historians have not yet completely explained why westerners joined the ranks of the National American, or "Know Nothing," Party or why the nation's bloodiest anti-immigrant riots erupted in western cities-namely Chicago, Cincinnati, Louisville, and St. Louis. In focusing on the antebellum West, Inventing America's First Immigration Crisis illuminates the cultural, economic, and political issues that originally motivated American nativism and explains how it ultimately shaped the political relationship between church and state. In six detailed chapters, Ritter explains how unprecedented immigration from Europe and rapid westward expansion reignited fears of Catholicism as a corrosive force. He presents new research on the inner sanctums of the secretive Order of Know-Nothings and provides original data on immigration, crime, and poverty in the urban West. Ritter argues that the country's first bout of political nativism actually renewed Americans' commitment to church-state separation. Native-born Americans compelled Catholics and immigrants, who might have otherwise shared an affinity for monarchism, to accept American-style democracy. Catholics and immigrants forced Americans to adopt a more inclusive definition of religious freedom. This study offers valuable insight into the history of nativism in U.S. politics and sheds light on present-day concerns about immigration, particularly the role of anti-Islamic appeals in recent elections.

    Description: Okinawan life, at the crossroads of American militarism and Japanese capitalism, embodies a fundamental contradiction to the myth of the monoethnic state. Suspended in a state of exception, Okinawans have never been officially classified as colonial subjects of the Japanese empire or the United States, nor have they ever been treated as equal citizens of Japan. As a result, they live amid one of the densest concentrations of U.S. military bases in the world. By bringing Foucauldian biopolitics into conversation with Japanese Marxian theorizations of capitalism, Alegal uncovers Japan's determination to protect its middle class from the racialized sexual contact around its mainland bases by displacing them onto Okinawa, while simultaneously upholding Okinawa as a symbol of the infringement of Japanese sovereignty figured in terms of a patriarchal monoethnic state. This symbolism, however, has provoked ambivalence within Okinawa. In base towns that facilitated encounters between G.I.s and Okinawan women, the racial politics of the United States collided with the postcolonial politics of the Asia Pacific. Through close readings of poetry, reportage, film, and memoir on base-town life since 1945, Shimabuku traces a continuing failure to "become Japanese." What she discerns instead is a complex politics surrounding sex work, tipping with volatility along the razor's edge between insurgency and collaboration. At stake in sovereign power's attempt to secure Okinawa as a military fortress was the need to contain alegality itself-that is, a life force irreducible to the legal order. If biopolitics is the state's attempt to monopolize life, then Alegal is a story about how borderland actors reclaimed the power of life for themselves. In addition to scholars of Japan and Okinawa, this book is essential reading for anyone interested in postcolonialism, militarism, mixed-race studies, gender and sexuality, or the production of sovereignty in the modern world.     Description: Deportation limbo traces the efforts of two Nordic welfare states, Denmark and Sweden, to address the so-called implementation gap in deportation enforcement. It offers an original, empirically grounded account of how often-futile, injurious policy measures devoted to pressuring non-deported people to leave are implemented and contested in practice. In doing so, it presents a critique of the widespread, normalised use of detention, encampment, and destitution, which routinely fail to enhance deportations while exposing deportable people to conditions that cause their premature death. The book takes the ‘deportation limbo’ as a starting point for exploring the violent nature of borders, the racial boundaries of welfare states, and the limits of state control over cross-border mobility. Building on unprecedented access to detention and deportation camps and migration offices in both countries, it presents ethnographic material capturing frontline officials’ tension-ridden efforts to regulate non-deported people using forced deportation, incarceration, encampment, and destitution. Using a continuum of state violence as the analytical lens, the book offers a uniquely comprehensive account of how the borders of Nordic welfare states are drawn through practices that subject racialised ‘others’ to expulsion, incarceration, and destitution. The book is the first to systematically document the renewed deportation turn in Denmark and Sweden, and to critically examine its implications: for the people targeted by intensified deportation measures, and for the individual officials, institutions, and societies enforcing them. It offers an important, critical contribution to current debates on the violence of deportation regimes, the politico-bureaucratic structures and practices that sustain them, and their human costs.

    Description: En este libro, resultado de años de trabajo en las aulas y en el campo de la investigación social, se reflexiona y debate, especialmente, sobre dos cuestiones que se consideran trascendentes respecto del conocimiento metodológico: la producción de los datos y los diseños de investigación. La primera de ellas invita a atender el complejo pasaje del hecho al dato, pero, también, pone luz sobre un proceso que, si no es recorrido adecuadamente, transforma los datos en una deformada y falsa representación de la realidad en estudio. Descuidar este trayecto de la investigación condena al siguiente análisis que se haga sobre los datos a una patética expresión del “sinsentido", aunque se utilicen los más potentes y actualizados métodos y técnicas. En relación con los diseños de investigación, se discute qué se entiende por estrategia teórica y metodológica, y cómo se involucra y complejiza la noción de diseño.

It argues that the strategy of this group oscillated irregularly between a business model built on connections and a professional business model adapted to markets.     Description: Social class remains a fundamental presence in British life in the twenty-first century. It is woven into the very fabric of social and political discourse, undiminished by the end of mass industry; unaugmented despite the ascendancy of 'ordinary working people' and other substitute phrases. Absent from this landscape, however, is any compelling Marxist expression or analysis of class. In Class Matters, Charles Umney brings Marxist analysis out of the 19th century textiles mill, and into the call centres, office blocks and fast food chains of modern Britain. He shows how core Marxist concepts are vital to understanding increasing pay inequality, decreasing job security, increasing routinisation and managerial control of the labour process. Providing a critical analysis of competing perspectives, Umney argues that class must be understood as a dynamic and exploitative process integral to capitalism - rather than a descriptive categorisation - in order for us to better understand the gains capital has made at the expense of labour over the last four decades.

After all, Turkey should not be judged by standards other than the Copenhagen criteria. The answer is that the public debate outside 'Brussels' will not be limited to these official criteria.
