    Description: Magnetic resonance imaging of the brain and spinal cord in patients with multiple sclerosis is crucial for diagnosis as well as monitoring and predicting disease activity. Comprehensive MR measurements including assessment of brain and spinal cord volume changes have the potential to improve patient monitoring, allow earlier detection of subclinical disease activity, and identify patients with depleted brain reserve who are at highest risk of disability progression. Cerebral atrophy measurements are now a secondary outcome of many clinical trials, although their wider use in routine clinical practice is still hampered by some technical limitations. However, evidence from clinical practice shows that assessment of brain and spinal cord volume change is feasible and has the potential to improve patient treatment.

    The ethical challenges experienced by healthcare workers during the war in Syria (2023)

    Description: The war in Syria has lasted for many years and continues to cast a dark shadow over its people, including healthcare workers caring for those injured and in distress. During the war, healthcare workers have been exposed to unprecedented challenges, becoming targets of bombing, killing, siege, arrest, and torture. Moreover, healthcare workers continue to experience difficult situations that require them to make decisions with no clear or easy moral choice. The present study aimed to understand the experiences of healthcare workers and the difficulties and challenges that hinder applying existing ethical frameworks and codes for disasters within Syria’s context of revolution and war. Qualitative analysis of interviews led to classification of the ethical challenges experienced by healthcare workers into four groups: the risks from providing care; stewardship of resources and work challenges; corruption and organizational pressure; and psychological, emotional, and social stress. The study also showed that both Syrian healthcare workers and the developers of ethical frameworks adopt many similar values and principles. Yet, the participants adopted several unique moral values not identified in ethical frameworks as a result of navigating their professional duties under the circumstances of the Syrian war. At last, recognizing the challenges and precarious tasks healthcare workers cope with during wars and other similar disasters could help volunteers, medical personnel, and humanitarian organizations deciding to work in Syria better understand the specific context and obstacles for ethical decision-making. Moreover, attracting attention for and support of Syrian healthcare workers locally and globally presents a long-lasting benefit.

    Description: The phenomenon of proliferation of international organizations has urged focus on the responsibility of international organizations under international law as the effect of their activities is witnessed everywhere in our daily life. The main purpose of the present book is to examine and review some specific aspects relevant to the question of international legal responsibility of international organizations, mainly, with a view to assessing the International Law Commission’s work on the codification of the international legal rules applicable on international organizations in this area. At the same time, the intention is to address the major challenge to the codification of general rules for international organizations, namely, their wide-varying nature and their differences from each other. Furthermore, the perspective has been enlarged by elaborating on the broader concept of accountability of international organizations.

    Description: This study analyses legal barriers to data sharing in the context of the Open Research Data Pilot, which the European Commission is running within its research framework programme Horizon2020. In the first part of the study, data protection issues are analysed. The main focus is on the Data Protection Directive (95/46/EC) and its implementation in selected EU Member States. Additionally, the upcoming General Data Protection Regulation (2016/679/EU) and relevant changes are described. Special focus is placed on leading data protection principles. Next, the study describes the use of research data in the Open Research Data Pilot and how data protection principles influence such use. The experiences of the European Commission in running the Open Research Data Pilot so far, as well as basic examples of repository use forms, are considered. The second part of the study analyses the extent to which legislation on public sector information (PSI) influences access to and re-use of research data. The PSI Directive (2003/98/EC) and the impact of its revision in 2013 (2013/37/EU) are described. There is a special focus on the application of PSI legislation to public libraries, including university and research libraries, and its practical implications. In the final part of the study the results are critically evaluated and core recommendations are made to improve the legal situation in relation to research data.

    Description: In September 2018 the criminal law section of the 72nd Deutscher Juristentag (DJT, “German Assembly of Jurists”) debated the question “Sentencing Guidelines vs. Free Judicial Discretion – Is German Sentencing Law in Need of Reform?” Despite the expert opinion provided by Johannes Kaspar and the accompanying scholarly commentaries, ensuing proposals for fundamental reform met with rejection. The comparative perspective was limited to the US Federal sentencing guidelines. The intention of this volume is therefore, on the one hand, to draw a more nuanced picture of Anglo-American sentencing law focusing on three legal systems (England/Wales, USA and Canada) accompanied by commentaries from a German perspective; on the other hand, we want to make the German perspective (better) known within the Anglo-American legal world by reproducing important DJT documents in English language. To ensure the widest possible distribution we opted for a bilingual open access publication.

    Description: This study addresses the most important legal issues when implementing an open access e-infrastructure for research data. It examines the legal requirements for different kinds of usage of research data in an open access infrastructure, such as OpenAIREplus, which links them to publications. The existing legal framework regarding potentially relevant intellectual property (IP) rights is analysed from the general European perspective as well as from that of selected EU Member States. Various examples and usage scenarios are used to explain the scope of protection of the potentially relevant IP rights. In addition different licence models are analysed in order to identify the licence that is best suited to the aim of open access, especially in the context of the infrastructure of OpenAIREplus. Based on the outcomes of these analyses, some recommendations to the European legislator as well as data- and e-infrastructure providers are given on improving the rights situation in relation to research data.

Para compreender as contradições e os conflitos emergentes nesse contexto, foram utilizadas a abordagem qualitativa e as entrevistas semi-estruturadas. As falas desses sujeitos evidenciam a necessidade de formação e a disposição dos trabalhadores para rever conceitos e experimentar novas tecnologias com vistas à melhoria do atendimento. O trabalho apresenta uma contribuição na busca de alternativas para disseminar a educação permanente e a saúde como direito humano universal e integral.

    Description: This book contains some of the papers that were presented at the first meeting of the newly formed African Expert Study Group on International Criminal Law / Groupe des Experts Africaines en Droit Pénal International held in September 2011 in Brussels, Belgium. The group was established under the auspices of the Multinational Development Policy Dialogue (hereinafter ‘MDPD’) and the Rule of Law programme of the German Konrad-Adenauer-Stiftung (‘KAS’) in 2010 modeled on the successful sister group in Latin America. This latter group was originally founded as an expert group to monitor the implementation of the Rome Statute of the International Criminal Court (‘ICC’) in Latin America within the framework of cooperation between KAS’ regional Rule of Law Programme and the Department for Foreign and International Law of the Institute for Criminal Law and Criminal Justice of the Georg-August-Universität Göttingen in 2002. The newly formed African group consists of judicial experts with both academic and practical background from various parts of Sub-Saharan Africa. The importance of such a group for the African continent cannot be overestimated. Africa plays a vital role in international criminal law and justice, both as an active player at the ICC and at the regional and national level. As for the group’s composition and outreach, the aim is to broaden regional representation and further consolidate membership. In 2012, the group will meet in Nairobi, Kenya to deal with topics surrounding the ‘Potential for the domestic prosecution of international crimes in Africa.’ Topics for future meetings abound given the multi-faceted African legal and political practice regarding international criminal justice in general and the ICC in particular. The group should in particular monitor the recent international or transnational criminal justice developments at the regional African level as well as relevant national developments.     Description: Recidivism belongs to the main categories of criminology, crime policy and criminal justice. If the target of preventing offenders from reoffending is taken seriously crime policy should be measured by success of certain penal sanctions in terms of relapses. Also institutions that deal directly with crime and offenders need to get basic information on the consequences of their actions; particularly general knowledge about offender groups at risk of reoffending. All these are reasons why representative recidivism studies are needed. Meanwhile a lot of European countries gather systematic and comprehensive information on recidivism, periodically and on a national level. This volume presents an exemplary collection of such endeavors: Austria, Estonia, France, Germany, Switzerland and a comparative study of England and Wales, the Netherlands and Scotland.

Nimmt man den spezialpräventiven Anspruch des Strafrechts ernst, muss sich die Strafrechtspolitik daran messen lassen, wie gut es mit welcher Art von Sanktionen gelingt, Rückfälle zu verhindern. Aber auch die Institutionen, die unmittelbar mit Straftaten und Straftätern umgehen, bedürfen einer grundlegenden Information über die Folgen ihres Tuns, insbesondere allgemeine Erkenntnisse über rückfallgefährdete Tätergruppen. All dies sind Gründe, warum repräsentative Rückfalluntersuchungen benötigt werden.     Description: Ilustrado, este livro apresenta informações sobre as principais parasitoses que acometem ovinos criados no Brasil, com o objetivo fornecer subsídios para a elaboração de estratégias de profilaxia das enfermidades decorrentes desse tipo de contaminação. Baseada em estudos realizados no Brasil e no exterior, a obra reproduz e comenta também resultados de dissertações e teses elaboradas por estudantes de pós-graduação da Unesp de Botucatu. De acordo com os autores, a verminose causada por nematódeos gastrintestinais constitui o principal problema sanitário dos rebanhos ovinos, animais que podem ser contaminados simultaneamente por várias das inúmeras espécies do parasita. A ocorrência de cada espécie, explicam, relaciona se com fatores como a frequência de tratamentos com anti-helmíntico, o manejo e as condições ambientais. No Sul do Brasil, por exemplo, as temperaturas baixas do inverno favorecem a ocorrência de Ostertagia (Teladorsagia spp.) circumcincta, espécie que não tem sido registrada em ovinos criados em outras regiões. Em todo o país predominam a H. contortus (durante o verão), além da Trichostrongylus spp. e O. circumcincta que incidem nos meses mais frios.

    Description: O Transtorno de Déficit de Atenção e Hiperatividade (TDAH) e a indisciplina são na atualidade assuntos que aparecem com forte incidência no cotidiano escolar. Algumas condutas apresentadas pelas crianças, neste contexto, são vistas como indicativos de tal transtorno e isso vem contribuindo para que crianças ainda muito pequenas sejam encaminhadas pelos educadores aos profissionais da saúde, por apresentarem na escola comportamentos considerados indisciplinados, agitados e impulsivos. A presente pesquisa tem como principal objetivo, discutir a relação entre indisciplina e o diagnóstico de TDAH, a partir da queixa do professor da educação infantil. Pretende ainda, analisar a postura dos educadores diante do processo de patologização no campo educacional, levando em conta a sociedade eugênica e disciplinar, que foi consolidada com o processo de higienização ocorrido no início do século XX, como também, construir uma reflexão crítica acerca das práticas sociais e educativas que ora se configuram, mediante a análise da educação contemporânea e do resgate histórico da escolarização no Brasil. A pesquisa se caracteriza como um estudo de caso qualitativo e as estratégias metodológicas empregadas para a coleta de dados incluíram a observação participante, entrevistas semiestruturadas, diário de campo e análise de documentos. Os resultados foram organizados em oito eixos temáticos e indicaram principalmente que os educadores apresentam dificuldades para estabelecer diferenças entre indisciplina e o TDAH e o que é normal e patológico, o que tem causado o aumento expressivo no número de encaminhamentos de crianças aos profissionais de saúde e a consequente patologização e medicalização da infância.

    Description: Am 22. Juni 2018 fand in Göttingen das 12. Kriminalwissenschaftliche Kolloquium, am folgenden Tag das Symposium aus Anlass des Abschieds von Jörg-Martin Jehle statt. Im selben Jahr wurde Jörg-Martin Jehle nach 22 Jahren an der Georg-August-Universität Göttingen emeritiert. Dieses Ereignis fiel zusammen mit dem 50. Geburtstag der Göttinger Kriminologie, dem das 12. Kolloquium gewidmet war.     The ethical and legal regulation of human tissue and biobank research in Europe (2021)

    Description: Human tissue and biobank research is of increasing importance for understanding the causes of widespread diseases and developing effective therapies. However, while the success of biobank research depends on the availability of a large number of samples and the consolidation of collections across country borders is very desirable from the perspective of researchers, the legal and ethical requirements for the procurement, storage and use of human tissue samples are rather heterogeneous across different countries. Moreover, the lack of comprehensive supranational regulation on human tissue and biobanking can be seen as posing a serious threat to transnational biomedical research. Against this background, it was one of the aims of the EU-funded Tiss.EU project (“Evaluation of Legislation and Related Guidelines on the Procurement, Storage and Transfer of Human Tissues and Cells in the European Union – an Evidence-Based Impact Analysis”) to analyse the ethical and legal regulation of human tissue and biobank research across the 27 European Member States plus Switzerland. The results of nine international workshops and three conferences are gathered in this volume. While the country reports evaluate the implementation of ethical and legal guidelines at a national level, point out their strengths and deficits, and, where required, create an evidence base for the revision of said legislation, the conference reports address more general ethical and legal issues in this field. The volume is completed by a final presentation of project’s results.

The author, a medical doctor and social anthropologist, tells the story of six Tanzanian HIV-seropositive women, focusing on their negotiation and perception of illness and disease. Furthermore, the high levels of discrimination and stigmatization in the context of HIV-seropositivity that they experience are presented in detail, weaving together the impacts of an HIV-seropositive diagnosis with results analyzed both from a Medical Anthropology and Public Health perspective. Despite a new era of antiretroviral treatment, available in Tanzania free of cost, that has given cause for hope in a change in how the disease is perceived, the book impressively underlines that being HIV-seropositive remains a great challenge and heavy burden for women in Tanzania.

    Description: The German reunification in 1989/90 is paradigmatic for fundamental geopolitical changes, in the context of a change of the entire legal system. Further well-known examples of the State’s national desire for reformations with respect to legal principles are the great reform of the penal system in 1975, the reform of the law of obligations in 2002 and the fundamental reorganization of the law with respect to illiquid debtors. The Koreans are not only interested in the Germans’ experience of the last quarter of a century because of legal-historical reasons, but also in particular because of the possible case of a Korean reunification. The present volume contains the contributions to the 4th symposium of the Faculty of Law of the Georg-August-Universität Göttingen and the Yonsei Law School (Seoul), which was held in Göttingen in February 2015.
    Description: Die deutsche Wiedervereinigung von 1989/90 steht exemplarisch für grundlegende geopolitische Veränderungen im Zusammenhang eines Wechsels des gesamten Rechtsrahmens.     Description: The feeling of grief and other emotions victims of a crime may face are not limited to certain stages in the criminal proceeding and do not necessarily end with conviction and imprisonment of the offender. Disregarding the needs of the victim, the German penal system generally focuses only on offenders and the need to reintegrate them into society. By implementing laws concerning restorative justice programs in the prison system the German legislator seeks to dissolve this apparent contradiction. During this international conference both practitioners and scholars depicted existing restorative justice programs and outlined their legal framework. It became apparent that the reintegration of criminal offenders and additional considerations of victim interests do not necessarily exclude each other but, to the contrary, may even complement one another.
    Description: Das Leid und die Bedürfnisse von Kriminalitätstopfern lassen sich nicht in Verfahrensstadien greifen. Sie sind oft auch noch nach einer Verurteilung des Täters und einem damit verbundenen Freiheitsentzug präsent. Demgegenüber ist der Justizvollzug klassischerweise an Tätern und deren Resozialisierungsbedarf ausgerichtet. Diesen scheinbaren Widerspruch möchte eine Opferorientierung im Justizvollzugsziel ausräumen. Auf der internationalen Tagung wurden einerseits Projekte aus der Praxis vorgestellt, andererseits der theoretische Kontext wissenschaftlich aufbereitet. Es wurde deutlich, dass die am Täter ausgerichtete Resozialisierung und der Einbezug von Opferinteressen kein Widerspruch sein müssen, sondern sogar gegenseitig verstärkend wirken können.

    Description: The study presented in this book is a direct response to the needs for defining and registering criminal and judicial data on the European level. Based upon work done in creating the European Sourcebook of Crime and Criminal Justice Statistics (ESB), the project results will improve and complement the standards developed so far for definitions and statistical registration in four fields (police, prosecution, courts, prison), in order to contribute to the picture of criminal justice in Europe. Possibilities to optimize the offence definitions used so far in the ESB context were explored. Also, further crime types, especially those subject to EU-harmonized definition, were tested and introduced. Apart from this, the prosecution chapter of the ESB questionnaire was changed and expanded. Data collection possibilities regarding compulsory measures in the investigatory stage were tested, and a more sophisticated approach for recording sanctions and measures as well as prison data was developed. The study explored how far national statistics can provide such data and developed a concept for collation on European level. It was funded by the European Commission under the AGIS 2006 program.
