    Description: En 1908, afin de lutter contre le favoritisme qui mine autant l’efficacité de l’administration publique que la démocratie, le Parlement canadien décrète que les fonctionnaires de l’État seront dorénavant nommés selon le principe du mérite, en fonction de processus administrés par un organisme indépendant : la Commission de la fonction publique du Canada. Publié à l’occasion du centenaire de la commission, ce livre retrace l’histoire de ce principe et de cette institution, nés dans la controverse et, depuis, le sujet d’inlassables débats. Il permet de mieux comprendre la résilience exceptionnelle et la contribution unique de la commission à l’édification d’une administration publique indépendante, qui constitue un pilier important de la démocratie parlementaire canadienne. On y découvre également comment la commission a contribué, au fil des ans, à trouver un équilibre sans cesse renouvelé entre trois objectifs, reliés mais parfois contradictoires, associés à la dotation de l’administration publique d’une démocratie libérale : la neutralité politique de l’administration, l’égalité démocratique et l’efficacité en matière de gestion.

    Description: Sexual Assault in Canada is the first English-language book in almost two decades to assess the state of sexual assault law and legal practice in Canada. Gathering together feminist scholars, lawyers, activists and policy-makers, it presents a picture of the difficult issues that Canadian women face when reporting and prosecuting sexual violence. The volume addresses many themes including the systematic undermining of women who have been sexually assaulted, the experiences of marginalized women, and the role of women’s activism. It explores sexual assault in various contexts, including professional sports, the doctor–patient relationship, and residential schools. And it highlights the influence of certain players in the reporting and litigation of sexual violence, including health care providers, social workers, police, lawyers and judges. Sexual Assault in Canada provides both a multi-faceted assessment of the progress of feminist reforms to Canadian sexual assault law and practice, and articulates a myriad of new ideas, proposed changes to law, and inspired activist strategies. This book was created to celebrate the tenth anniversary of Jane Doe’s remarkable legal victory against the Toronto police for sex discrimination in the policing of rape and for negligence in failing to warn her of a serial rapist. The case made legal history and motivated a new generation of feminist activists. This book honours her pioneering work by reflecting on how law, legal practice and activism have evolved over the past decade and where feminist research and reform should lead in the years to come.

    Description: La violence et la peur font tellement partie de nos vies que, parfois, elles se confondent avec elles. Elles s'insinuent aussi bien dans le social que dans l'individuel et déterminent l'histoire de l'un et de l'autre. Le crime, quant à lui, semble d'être devenu un acte privilégié non seulement pour dire la violence, mais aussi pour vivre la peur. Le criminel, à cet égard, a parfois pour fonction de permettre de défini son contraire, l'individu de bonne réputation. L'époque actuelle favorise un individualisme d'un genre nouveau : la personne menacée de toutes parts tente de se protéger en démonisant un groupe particulier. Heureusement, le monde d'aujourd'hui produit aussi des individus qui, du fait de l'affaissement des valeurs anciennes, se montrent plus tolérants à l'égard des autres. Cette acceptation d'autrui fait obstacles à certaines formes de violence et favorise la non-violence. Le présent ouvrage nous conduit à examiner quels sens revêtent la violence, la peur et le crime et quels sont leur rapports mutuels. Il s'adresse à tous ceux qui s'intéressent à la justice pénale et sociale. Il fait ressortir certains problèmes et indique certains moyens permettant de résoudre les conflits, y compris ceux vécus par l'exclu. Il touche les pratiques sociales et les personnes appelées à les gérer, à assurer la sécurité et à éliminer la peur.     Description: La violence a multiples faces, toutes celles qu'on lui donne selon les soucis de l'heure et les jeunes font toujours partie de ces soucis. Le piège de la violence dans lequel le jeune peut tomber ne dépend pas uniquement de son agir, mais relève de la façon dont on appréhende cet agir en termes de violence. Ce piège ne dépend pas non plus uniquement de ce qu'est le jeune; il relève souvent de la manière dont on se saisit de sa personne pour en préciser le profil délinquant. Dans ce processus qui conduit souvent au pénal, le piège se referme sur le jeune et peut le détruire complètement. L'ouvrage examine comment cette violence particulière capable de détruire le jeune s'infiltre socialement. Cette violence n'a pas sa source dans quelque intervention extraordinaire de l'autorité étatique, mais bien dans un quotidien plus ou moins banal où rationalisations, peurs, intérêts, idéologies reconduisent les structures en place. La violence des jeunes prend la figure de l'institution qui la combat.
