    Description: At the beginning of the 21st century, the role that the history of law should play in the training of jurists cannot be the same as the discipline played in the last century, hence the importance of reflecting on the scope that from now on the subjects of historical content should have in the different curricula in which the knowledge of law in its historical dimension has a place. The delimitation of the role to be played by historical education requires reflection on the three traditional dimensions of knowledge, the material, spatial and temporal dimensions. This is the reasoning that justified the first symposium of the Spanish Society of Law Historians.

    Description: The Faculty of Philosophy and Letters in Madrid commissioned Marcelino Menéndez Pelayo and Nicolás Salmerón to write a report on the royal decrees that reduced university staffing levels, given by virtue of the authorisations granted by the Budget Law of 30 June 1892. The text of the opinion is reproduced together with some extracts from a well-known book by the professor from the Central University (Historia de los heterodoxos españoles) which help to understand the context of the message. It thus serves to document the extent of an opinion, which is not confined to a single group - the Krausist group - but is shared by other sectors that conceive of the university as something more than an administrative office. The key ideas are: the immobility of the teaching staff; an ideal of family life geared towards scientific research; the demand for autonomy - freedom of action - for the university body; the conception of the university as the representative of national culture; the promotion of scientific and not only professional faculties; the intervention of the university in the choice of its staff; the elimination of course exams... In short, it rejected "the trampling importation of the French centralist regime" and called for emancipation from excessive official tutelage.

Se reproduce el texto del dictamen junto a unos fragmentos de un conocido libro del profesor de la Central (Historia de los heterodoxos españoles) que ayudan a comprender el contexto del mensaje. Sirve así para documentar la extensión de una opinión, que no se circunscribe a un solo grupo –el krausista– sino que es compartida por otros sectores que conciben la universidad como algo más que una oficina administrativa.     Description: Travel experienced a high point in the interwar period with the beginning of mass tourism in Spain. While Spanish intellectuals visited Europe or America to define their identity and their position in the cultural field, the Spain of the Second Republic attracted many writers, scientists and artists from other countries, who found here one of the great cultural epicenters, but also a country where traditions and ways of life that resisted the push of modern life survived. The Civil War confirmed the idea that the Spanish landscape was the stage where the future of the world was beginning to be decided, and many European and American intellectuals came here in those years, while Renau began the evacuation of the Spanish artistic treasure to protect it from fascist barbarism. This book analyzes the vision of Spain and the world derived from the travels of Walter Benjamin, Nancy Cunard, Walter Starkie, Ortiz Echagüe, Mª Teresa León, Concha Méndez, Mijail Koltsov or the collaborators of the travel magazine Oasis -directed by the engineers Vicente Olmo and Silverio de la Torre-, but also the experience of the inner journey of many of them and the influence of those cultural experiences.

    Description: Gregorio López de Tovar (1547-1636) was, besides being a prosecutor, oidor and counselor of Orders, the architect of a repertoire of laws and glosses destined to accompany the successful official edition that in 1555 his grandfather, Gregorio López de Valenzuela (1490-1560), had prepared of the Partidas. The memoirs in which, throughout most of his life, he recorded these and other public and private events, remained unpublished as a whole until now. Beyond the editorial history of this code, to which they have contributed, their possibilities remained untapped for knowledge of the mechanics of access and promotion within the judicial machinery or of the social customs of his privileged estate, among other inquisitive aspects.

    Description: Valentín Ortigosa, born in 1784 in Arriate (Málaga), emigrated to Mexico in 1803, where he was ordained a priest. He returned to Spain in 1810. His biography will reflect the events that took place in those years of the 19th century in which he lived, especially the problems that arose in the relations between Rome and Madrid as the representative system was being established. Although he would never occupy a relevant public position, Ortigosa moved in the circle of Agustín Argüelles, or José María de Calatrava; he enjoyed the favor of the queen governor María Cristina and his political opinions, especially in relation to the independence of the American countries, found echo in the press. Presented by the Regent to be bishop of Malaga in 1836, being suspended in fact the relations between the crown of Spain and Rome, his designation was not confirmed, but he was named capitular vicar and this allowed him to rule the Diocese without having been consecrated bishop; he became one of the "intrusive bishops". Due to denunciations of the Chapter of Malaga, a case was opened against him before the Tribunal of the Archbishopric of Seville. Later the appeal of force that Ortigosa raised before the Audience of Seville, and its execution by the Supreme Court ended up giving rise to the rupture of the relationship with the Holy See with the closing of the Nunciature of Madrid in January of 1841. This case and its repercussions are studied in detail in this book, both from the juridical, civil and canonical point of view, as well as from the political point of view. The documentation collected from newspaper archives and from numerous archives, both Spanish and Roman, has made it possible to analyze the consequences of the question of the so-called "intruders" starting from the case of Valentín Ortigosa, a character whose notoriety in these years contrasts with the oblivion of his name after disappearing from public life in 1843.

Su biografía reflejará los acontecimientos que se suceden en esos años del s. XIX en los que vivió, especialmente los problemas que surgieron en las relaciones entre Roma y Madrid a medida que el sistema representativo se iba instaurando. Aunque no ocuparía nunca un cargo público relevante, Ortigosa se movió en el círculo de Agustín Argüelles, o José María de Calatrava; gozó del favor de la reina gobernadora María Cristina y sus opiniones políticas, en especial en lo relacionado con la independencia de los países americanos, encontraron eco en la prensa. Presentado por la Regente para ser obispo de Málaga en 1836, estando suspendidas de hecho las relaciones entre la corona de España y Roma, su designación no se confirmó, pero fue nombrado vicario capitular y esto le permitió regentar la Diócesis sin haber sido consagrado obispo; se convirtió en uno de los “obispos intrusos”. Por denuncias del Cabildo de Málaga se abrió una causa contra él ante el Tribunal del Arzobispado hispalense. Mas tarde el recurso de fuerza que Ortigosa planteó ante la Audiencia de Sevilla, y su ejecución por el Tribunal Supremo acabó dando lugar a la ruptura de la relación con la Santa Sede con el cierre de la Nunciatura de Madrid en enero de 1841. Esta causa y sus repercusiones son estudiadas con detenimiento en este libro, tanto desde el punto de vista jurídico, civil y canónico, como desde la óptica política. La documentación recogida de hemerotecas y de numerosos archivos, españoles y de Roma, ha permitido analizar las consecuencias de la cuestión de los llamados “intrusos” a partir del caso de Valentín Ortigosa, un personaje cuya notoriedad en estos años contrasta con el olvido de su nombre tras desaparecer de la vida pública en 1843.

    Description: At the end of the 19th century, Spain enjoyed a favorable climate for developing true freedom of the press, a right recognized in Article 13 of the Constitution of 1876 and developed through the Printing Police Law of 1883. However, throughout the period of the Bourbon Restoration (1883-1923), the Spanish government, represented by the conservative and liberal parties that peacefully took turns in power, adopted a series of measures that distorted the longed-for freedom of Spanish publications. The political and social events characteristic of this period (especially the terrorism of the end of the 19th century, the colonial conflicts in Cuba and Morocco or the influence of the regionalisms of the 20th century), had a notable influence on the actions of the public authorities. The latter used different legal instruments (the approval of different laws limiting freedom, the frequent declaration of the suspension of constitutional guarantees or the multiple sentences imposed through the ordinary courts), and other indirect mechanisms (the reptile funds or the sending of guidelines to newspapers under the threat of suspension or suppression of the newspapers), which served to establish a regime of information control, especially severe with the press that did not follow the guidelines of the liberal regime in place, and which left the liberal Printing Press Law practically without effect.

    Description: A finales del siglo XIX, España gozaba de un clima favorable para desarrollar una verdadera libertad de prensa, derecho reconocido en el artículo 13 de la Constitución de 1876 y desarrollado a través de la Ley de Policía de Imprenta de 1883. Sin embargo, a lo largo del período de la Restauración borbónica (1883-1923), el Gobierno español, representado por el partido conservador y el liberal que se turnaban pacíficamente en el poder, adoptó una serie de medidas que distorsionaron la ansiada libertad de las publicaciones españolas. Los acontecimientos políticos y sociales característicos de esta etapa (especialmente, el terrorismo de finales del siglo XIX, los conflictos coloniales en Cuba y Marruecos o la influencia de los regionalismos del siglo XX), influyeron de forma notable en la actuación del poder público. Este utilizó distintos instrumentos legales (la aprobación de distintas leyes que limitaban la libertad, la frecuente declaración de la suspensión de garantías constitucionales o las múltiples condenas impuestas a través de los tribunales ordinarios), y otros mecanismos indirectos (los fondos de reptiles o el envío de orientaciones a los periódicos bajo la amenaza de la suspensión o la supresión de los periódicos), que les sirvieron para establecer un régimen de control informativo, especialmente severo con la prensa que no seguía las directrices del régimen liberal instaurado, y que dejó prácticamente sin efecto la Ley de Imprenta liberal.

In fact, the disciplines of drawing have always been confronted with themes and issues relating to transitions from one condition to another. The history of representation tells us of transformations, even epochal ones, relating to ‘drawing’, with all that such transitions entail: suffice it to think of the evolution of forms of representation, of instrumental apparatuses, of the mutability of supports, of the analogical-digital transition underway, of the new modes of communication on platforms, of the hypertrophic offer of images also on the net that confirms Guy Debord’s intuitions relating to the new spectacularisation of society. Similarly, representation triggers transitions in the prefiguration and communication of design, the anticipation and foreshadowing of future events.The challenges posed by the digital pose open questions whose scope can only be glimpsed, such as the relationship between drawing and the act of modelling, and the construction of new paradigms of visual language and communication. ‘Transitions’, almost implicitly, points to possible futures, the evolution of technique and the search for new modes of expression; at the same time, however, it can suggest silences and reflections in a process of connection between history, theory, criticism and construction.

The comparison of the accounting documentation it generated with the monument itself and the lapidary signs identified thanks to the application of new technologies, has made it possible to approach the daily life of one of the most important construction undertakings of the Castilian Middle Ages and to contribute to a new reading of the resources, the people and the organization of the stonemasonry workshops.

    Description: La historia de la democracia en el espacio ibérico es inseparable de los pioneros esfuerzos del movimiento republicano por ensanchar la esfera pública y construir una sociedad de ciudadanos iguales en derechos y oportunidades. El estudio de las culturas republicanas en la historia contemporánea de Portugal y España se ha consolidado como una importante corriente de investigación en las últimas décadas. Evaluar la distancia recorrida era una tarea inaplazable que este volumen ha pretendido alcanzar.     Description: La historiografía tradicional ha sostenido que España padeció una imagen pésima en la Francia del siglo XVIII, donde el mundo de los philosophes habría alimentado la mitología antiespañola de la llamada «leyenda negra» con su desprecio, desinterés y desconocimiento del país vecino. La historiografía, sin embargo, nunca ha profundizado en la búsqueda de una imagen positiva de España en la Francia ilustrada. Este ensayo desvela la existencia de destacados intelectuales y medios periodísticos franceses interesados en abrir canales de comunicación y estrechar contactos con España. Reconocedores del valor del legado histórico español y críticos con sus compatriotas philosophes, los componentes de esa corriente francesa proespañola —que pertenecieron en su mayoría al ámbito del reformismo moderado y valoraron positivamente los progresos de la España borbónica— admitieron el carácter arquetípico de algunas manifestaciones culturales españolas, sobre todo el teatro y la novela, géneros en los que España —sostuvieron— fue prototipo y modelo de los mejores autores franceses y europeos de los siglos XVI y XVII, e incluso podría seguir siéndolo durante el XVIII.

    Description: En las regiones a las dos orillas del Gaditanum fretum existía una concentración de ciudades única en el Imperio. La importancia y el significado de estas ciudades como centros de poder se mantienen -según el debate actual- sin interrupción hasta comienzos del siglo VIII, pero, ¿cómo se desarrolla a partir de entonces, después de estos años que hasta ahora siempre se habían considerado como punto de inflexión decisivo en la historia de estas regiones? Ya en 1985, Hugh N. Kennedy llamó la atención sobre el hecho de que la llamada «Madīna» debería considerarse consecuencia de transformaciones sociales y económicas, más que resultado de una «islamización» abrupta de la sociedad. Este volumen, en función de la nueva valoración del mundo de las ciudades de la Antigüedad tardía, quiere cuestionar sus consecuencias para la época de la temprana Edad Media, desde una perspectiva interdisciplinar y sobre una nueva base material.

Sin embargo, son numerosos los casos de autores que se sustraen a la mirada del lector. La autorialidad no constituye necesariamente el atributo de un sujeto; puede estratificarse involucrando a otros actores de la producción de lo escrito. Las modalidades de presencia del autor también son múltiples: mientras unos tienden a difuminarse mediante el anonimato o el apócrifo, otros se manifiestan. Este libro se propone renunciar al creador como instancia unívoca para considerar los casos límite en que éste se esquiva y definir las relaciones entre el autor y las diferentes figuras que reviste en la obra. Dicha exploración de la ocultación autorial se realiza a partir de textos españoles, desde la Edad Media hasta el siglo xviii, antes de que el estatuto del autor sea plenamente reconocido.

    Description: El siglo XIX elevó la Guerra de la Independencia al rango de mito fundador de la nación española: el Dos de Mayo, el sitio de Zaragoza, la batalla de Bailén suenan todavía hoy como las hazañas de una gesta patriótica sin parangón. Esta interpretación tiene una historia: la sacralización de las guerras napoleónicas, en tanto que mito liberal, elaborado en los años 1830, conoció numerosos vaivenes, al paso de una historia política sobresaltada. ¿Qué lugar ocupa este mito en la vida política española del siglo XIX?     Description: This book analyses the social relations between the Malvezzi lineage and the College of Spain in Bologna. The apparently strange symbiosis between a family of the urban oligarchy and a secular university college can be explained in the context of the creation of factions favourable to the Houses of Austria and Valois, which polarised Italian political life. Thus, the college, which participated in the administrative structures of the monarchy, became part of a Hispanophile circuit created in Bologna and led by the Malvezzi family. The aim of these affinity networks was the social promotion of their male leaders through political and military service to the Spanish monarchs. From the precedents in the kingdom of Naples, we move on to the articulation of a philo-Habsburg party in Bologna that extended its influence beyond the city, and which counted on the College of Spain and several of its collegiates throughout the 16th century. In this way, the foundations of the Malvezzi's local power are integrated into the Italian philo-Spanish networks, combining the urban, regional and international scales. A study that relies on Network Analysis in order to properly interpret the involvement of the college and the personal interests of each of the Italian leaders involved. Finally, it addresses questions related to symbolic capital, attempting to unravel the fundamental points of the hispanophilic narrative elaborated by the Malvezzi family and the collaboration of the College of Spain in this ideological enterprise. This contribution not only broadens our knowledge of the phenomenon of philo-Spanish factions in Renaissance Italy, but also allows us to interpret the role played by a university college in a city where, unlike Rome, Naples or Milan, there were no centres of reference for the Spanish Monarchy.

    Description: En este libro se analizan las relaciones sociales entre el linaje Malvezzi y el Colegio de España en Bolonia. La aparentemente extraña simbiosis entre una familia de la oligarquía urbana y un colegio secular universitario se explica en el contexto de creación de facciones favorables a las Casas de Austria y de Valois, que polarizaron la vida política italiana. Así, el colegio, partícipe de las estructuras administrativas de la monarquía, se incorporó a un circuito hispanófilo creado en Bolonia y liderado precisamente por la familia Malvezzi. El objetivo de estas redes de afinidad era la promoción social de sus líderes masculinos a través del servicio político y militar a los monarcas españoles. Desde los precedentes en el reino de Nápoles, se avanza hacia la articulación de un partido filo-Habsburgo en Bolonia que extendió su influencia más allá de la ciudad, y que contó con el Colegio de España y con varios de sus colegiales a lo largo del siglo XVI. De esta forma, se integran los fundamentos del poder local de los Malvezzi dentro de las redes filoespañolas italianas, combinando las escalas urbana, regional e internacional. Un estudio que se apoya en el Análisis de Redes para poder interpretar adecuadamente la participación del colegio y los intereses personales de cada uno de los líderes italianos involucrados. Por último, se abordan las cuestiones relativas al capital simbólico, tratando de desgranar los puntos fundamentales del relato hispanófilo elaborado por la familia Malvezzi y la colaboración del Colegio de España en dicha empresa ideológica. Esta contribución no solo amplía el conocimiento del fenómeno de las facciones filoespañolas en la Italia del Renacimiento, sino que también permite interpretar el rol que jugó un colegio universitario en una ciudad en la que, a diferencia de Roma, Nápoles o Milán, no había centros de referencia de la Monarquía Hispánica.

    Description: F. López de Gómara's Historia de las Indias is the only chronicle of the Indies in the sixteenth century to offer a complete overview of the process of discovery and conquest, even though the author had never been to the Indies. The intelligence and elegance of Gómara's style explain the remarkable success of the work both in Spain and in Europe, in spite of a diffusion disrupted by the prohibition decrees from 1553. Of the two parts that compose it, it is the first, critically edited here, that has had the greatest influence on the history of ideas.

    Description: El cine forma parte hoy en día del patrimonio nacional. Sin embargo, la cuestión de la nacionalidad de los productos fílmicos está relacionada con diferentes aspectos: industrial, económico, historiográfico y estético. En cuanto al criterio oficial, se vincula habitualmente al espacio de producción; sin embargo, la nacionalidad del director de la película o de los actores, la ubicación de los espacios de rodaje, el idioma, o los acentos, la relación con unas corrientes estéticas o con géneros cinematográficos nacionalmente marcados pueden también ser considerados como tipos de clasificación. En España, el problema se plantea de forma más compleja que en otros muchos países ya que sobrepone casi de manera constante la nacionalidad regional o autonómica y la nación o las naciones. La película se convierte así en un territorio inestable y de difícil percepción, suponiendo interferencias que desacreditan cualquier análisis ignorante de la diversidad de los contextos. Por otra parte, el cine español ya no se puede concebir desconectado del resto de Europa, y la hispanidad sigue aportando elementos propios de una comunidad transnacional lingüística, cultural e histórica. Reflexionar sobre la nacionalidad en el cine supone explorar las interconexiones, las mezclas, las porosidades que ponen en tela de juicio una lectura limitada y estrecha de un concepto como el de «nación». Este es el camino por donde este libro pretende ir.

    Description: The federal system adopted in the constituent process of 1853-1860 responded, on the one hand, to the confederative experience of previous years and, on the other, to the imprint of the model based on the Constitution of the United States of America of 1787. However, the Argentine constituents departed from this model by granting the National Congress the power to dictate the "civil, commercial, criminal and mining" Codes (Art. 67, sub. 11 CN). In this way, the constitutional organisation reflected the federal aspiration that allowed the provinces to preserve their historical-political identity, but various circumstantial reasons, such as the shortage of lawyers in the interior of the country and the felt need to standardise customs and legislation, led the Convention members to adopt the European system of codification in the area of substantive law. As a result of this process, a hybrid model was established, with federal features as regards the exercise of political and jurisdictional powers at the provincial level, but with a clear unitary element in the codification of substantive law. The reservation added in 1860 reinforced the intangibility of the jurisdictional power of the provinces, which thus retained their own courts and the power to regulate their procedural law. On the other hand, it was provided that until the National Congress enacted the substantive codes, the provinces were empowered to maintain their civil and criminal legislation (art. 108 CN). The first Argentine Criminal Code would not come into force until 1887, so, in exercise of this transitory power, many provinces adopted various codification projects in the previous years that were exclusively within their territorial scope. The Tejedor Project was adopted by the Province of Buenos Aires in 1877; La Rioja, which was the pioneer, adopted it in 1876; Entre Ríos, San Juan, Corrientes, San Luis and Catamarca in 1878; Mendoza in 1779; Santa Fe and Salta in 1880 and Tucumán in 1881; and the Provinces of Jujuy and Santiago del Estero did not adopt provincial codes but were governed by Castilian law until the first National Code was enacted. Cordoba, for its part, adopted, practically unchanged, the draft of the revision commission presented to the National Congress in 1881. This book attempts to analyse some aspects of that first moment of provincial codification, focusing on the Criminal Code in force in the Province of Cordoba between 1882 and 1886, trying to understand the way in which the operators of justice in Cordoba represented the codified law and to determine to what extent it is possible to associate that representation with what has been called "code culture". We believe that the experience of provincial codification cannot be fully understood without taking into account the way in which the new law was used in the courts. In this sense, the Historical Archive of the Province of Cordoba preserves, in its Crime Fund, an important number of cases that were consulted and analysed in this work. The documentary universe for the period in which the code was in force (1883-1886) is 403 cases. The aim is to offer a qualitative analysis which, based on the documentary testimonies, allows us to offer an adequate description of the features which, in terms of legal culture, can be considered characteristic of the practical experience of the provincial penal codification.

Sin embargo, los constituyentes argentinos se apartaron de ese modelo al otorgar al Congreso Nacional la potestad de dictar los Códigos “civil, comercial, penal y de minería” (art. 67, inc. 11 CN). De esta manera la organización constitucional reflejaba la aspiración federal que permitía a las provincias conservar su identidad histórico-política, diversas razones coyunturales como la escasez de letrados en el interior del país y la sentida necesidad de uniformar las costumbres y la legislación, llevaron a los convencionales a adoptar el sistema europeo de la codificación en materia de derecho sustantivo. Como resultado de este proceso, se instauró un modelo híbrido, con rasgos federales en lo que se refiere al ejercicio de las potestades políticas y jurisdiccionales en el ámbito provincial, pero con un claro elemento unitario situado en la codificación del derecho sustantivo. La reserva agregada en 1860 reforzó la intangibilidad del poder jurisdiccional de las provincias, que conservaron así sus propios tribunales y la potestad para regular su derecho procesal. Por otra parte, se dispuso que hasta tanto el Congreso Nacional no sancionase los códigos sustantivos, las provincias se entendían facultadas para mantener su legislación civil y penal (art. 108 CN). El primer Código Penal Argentino no entraría en vigencia sino hasta 1887, por ello, en ejercicio de esa potestad transitoria, muchas provincias adoptaron en los años anteriores diversos proyectos de codificación que rigieron exclusivamente dentro de su ámbito territorial. Este libro intenta analizar algunos aspectos de ese primer momento de codificación provincial, poniendo el foco de atención en el Código Penal vigente en la Provincia de Córdoba entre 1882 y 1886, procurando comprender el modo en el que los operadores de la justicia cordobesa se representaron el derecho codificado y determinar en qué medida es posible asociar esa representación a lo que se ha llamado “cultura del código”. Creemos que la experiencia de la codificación provincial no puede ser comprendida cabalmente si no se tiene en cuenta el modo en que la nueva ley fue utilizada en los tribunales. En este sentido, el Archivo Histórico de la Provincia de Córdoba conserva, en su Fondo del Crimen, una importante cantidad de casos que fueron consultados y analizados en este trabajo. El universo documental para el período en que el código estuvo vigente (1883-1886) es de 403 casos. Se procura ofrecer un análisis cualitativo que, partiendo de los testimonios documentales, nos permita ofrecer una adecuada descripción referida a los rasgos que, en el plano de la cultura jurídica, pueden considerarse característicos de la experiencia práctica de la codificación penal provincial.

    Description: The personal diary that Modesto de la Torre wrote between 1821 and 1822 reflects the perceptions of a young royalist military man about a New Spain that was gaining independence from the Peninsula to become a Mexican Empire. The author traveled from Cadiz to Mexico City with the retinue that accompanied the last viceroy, Juan O'Donojú, and in his pages he describes the nature, towns and cities he passed through, as well as the political and military events that took place during those years. Anecdotes, both major and minor, are found in these brief chronicles. In addition, the dialogue with himself, through writing, is a means to exorcise the crisis of the culture of masculinity that was part of his imaginary. This crisis was largely caused by the nationalist discourse of the Mexicans and their military victories, which became the central theme of his reflections and is extensively analyzed in the study that precedes the transcription of the diary. The spontaneous and secret character of the Apuntaciones makes them a singular source for historians of the early 19th century, of nationalism, and of the little-known first-person writings in the Latin American world of the time.

    Description: Giving, taking away and declaring jurisdiction was one of the most important royalties of the monarch in the Ancien Régime and one of the most difficult to delegate. It was no less so in a world in which any act of power involving the alteration of the legal situations obtained by the unequal subjects that composed it required knowledge of the cause, and in which sovereignty was expressed in the capacity to judge others without being judged. For this reason, the examination of the methods and practice followed for the determination of jurisdictional competences and disputes becomes a privileged observatory for studying the crisis of the judicial Monarchy and its replacement by an administrative State in a Spain that in 1768 was bicontinental and in 1845 peninsular and little more than Antillean. This book gives an account of all the methods which, without being able to attack the root of the problem consisting of the multiplicity of privileged jurisdictions, were tried to reduce its consequences in a period framed by the expansion of these jurisdictions and the birth of the contentious-administrative jurisdiction. This work of constitutional history does not lose sight of the political value of the power to determine competences first between courts and then between powers and authorities, and thus to "supplement the constitution", and notes how, for almost a century, systems for resolving competences that obeyed the character of a "trial between judges" coexisted in tension with others in which the aim was to unilaterally decide disputes by invoking the economic and governmental dimension of the power of the princes. But this period also saw a shift from the consideration of jurisdictional competence as a necessary evil, a last resort to be resorted to in order to maintain harmony between authorities, to the normalisation of the conflict in a new French-style taxonomy of "jurisdiction" and "attributions".

No era para menos en un mundo en el que todo acto de poder que implicase la alteración de las situaciones jurídicas que obtenían los desiguales sujetos que la componían exigía conocimiento de causa, y en el que la soberanía se expresaba en la capacidad de juzgar a otros sin ser juzgado. Por ello el examen de los métodos y la práctica seguida para la determinación de las competencias y disputas jurisdiccionales se convierte en un observatorio privilegiado para estudiar la crisis de la Monarquía judicial y su sustitución por un Estado administrativo en una España que en 1768 era bicontinental y en 1845 peninsular y poco más que antillana. En este libro se da cuenta de todos los métodos que, sin poder atacar la raíz del problema consistente en la multiplicidad de fueros privilegiados, se ensayaron para minorar sus consecuencias en un periodo enmarcado por la expansión de esos fueros y el nacimiento de la jurisdicción contencioso-administrativa. Esta obra de historia constitucional no pierde de vista el valor político de la facultad de determinar las competencias primero entre tribunales y luego entre potestades y poderes, y con ello “suplir la constitución”, y constata cómo durante prácticamente un siglo convivieron en tensión sistemas de solución de competencias que obedecían al carácter de “juicio entre jueces” con otros en los que se trataba de decidir unilateralmente las disputas invocando la dimensión económica y gubernativa del poder de los príncipes. Pero también en este periodo se pasó de la consideración de la competencia jurisdiccional como mal necesario, último recurso al que había de llegarse para mantener la armonía entre autoridades, a la normalización del conflicto en una nueva taxonomía “de jurisdicción” y “de atribuciones” de cuño francés.

    Description: Through a shifted and enriched approach, combining history and anthropology/sociology, this book addresses the forms of social integration and the multiple cultural hybridizations produced by slavery in the societies of Europe, Africa and America during the medieval and modern periods. Analyzing the normative contours used to define the identity of the slave, it then discusses his attempts and modalities of integration in the host societies, measuring the socialization process that may have resulted. Questioning the social mechanisms of the ancient societies that presided over the mixing of populations, as attested by the sources, is one of the areas that historians in this field (Atlantic societies, Maghreb) are most interested in. Among their main projects is that of deconstructing illusions of "racial" and cultural homogeneity in contemporary societies. A work on the acculturation and agency capacity of slaves, on the capacity of enslaved persons (not only freed) to exist as actors in the social sphere, particularly in the Iberian peninsula and the Mediterranean area, is the aim of this work. By proposing a history of Mediterranean brewing, it challenges preconceived ideas about cultural divisions and civilizational confinements.

    Description: In 1711, in the freezing winter of Madrid, Coadjutor Brother Felipe Frutos, a soldier in the wars of Catalonia in the 1690s, a Jesuit in the convulsive Barcelona of 1701-1705, sat down to write his life, although he had no hope of seeing it published. Why would he take up the quill? For one who had been a small and roguish peasant in the region of Segovia, experiences had accumulated and his prominence had moved from Spain to New Spain, crossing the south of France until he reached Italy. From ship to carriage or on muleback, he had lived unusual adventures in times of misery and cold, a thousand facets that are captured in a writing that is very much his own. Frutos writes as he is: humorous, inventive, self-taught. The study and annotated edition of his diary, which covers the years 1674 to 1711, and of his "Relación sucinta de las propiedades de los indios mexicanos", written in 1722, make this volume an exceptional source to understand the vision "from below" of a universe that extends from Rome to Acapulco, through which some of the most relevant characters and historical events of the period parade, intertwined with the personal perception of Frutos towards Castilians, Catalans, Romans and Indians.

    Description: Repertoire and selection of references consisting of more than 1600 individual references that were published in Spanish law journals between 1836 and 1935. The fundamental criterion for the organisation of the material was the attribution of each reference to a specific legal discipline or area of interest. The aims of this repertoire are: i) to present references that are largely unknown and/or scarcely worked in historiography; ii) to provide data to researchers when they are looking for a legal concept or institution of their interest, thus leading them to find primary sources; iii) to present references when inquiring about a specific author; iv) to provide data on how a legal book was received in its historical moment through the reviews and commentaries of the period covered; iv) to provide references on the study and teaching of a legal discipline and on legal studies in general.

Los propósitos que animan a este repertorio se concentran en: i) presentar referencias hemerográficas en buena parte poco conocidas y/o escasamente trabajadas en la historiografía; ii) suministrar datos a investigadores cuando busquen algún concepto o institución jurídica de su interés, conduciéndolos así a localizar fuentes primarias; iii) presentar referencias cuando se indague sobre un autor específico; iv) aportar datos sobre cómo fue recibida en su momento histórico una obra jurídica a través de las reseñas y recensiones de la época; iv) suministrar referencias sobre el estudio y enseñanza de una disciplina jurídica y los estudios de Derecho en general.

    Description: Beacons and swamps is a proposal for dialogue with the historiography of Argentine prisons, which saw provincial prisons as "swamps": immobile, grey, unchanging spaces. Although it is true that the pace of change in the provinces differed enormously from that of the capital, the work of the local prison reformers was to build "beacons" of modernity, in the style of the one installed in Buenos Aires: the famous National Penitentiary. Much has been discussed about the "panopticon", that institutional model of the society of control, but little is known about those "swamps" that constituted "the grey punishment of the majority". The aim of this book is to explore what is hidden in those provincial confinement spaces, where most of the national prison population was punished. It is based on the hypothesis that it is precisely there, under those swamps, that the original Argentine prison is hidden, because it was forged in those grey places of transition rather than in the "modernising beacons" of Buenos Aires or Ushuaia. Far from the "model", and from the punitive "should be", the embryos of the contemporary prison are hidden in the marshes. Delving into the mud and unearthing these vestiges, investigating the logic of the functioning of provincial prisons, will allow a better understanding of the emergence and consolidation of the punitive devices that characterise Argentine prisons today.

    Description: Faros y pantanos, es una propuesta de diálogo con la historiografía de las prisiones argentinas que vio en las cárceles provinciales, “pantanos”: espacios inmóviles, grises y sin cambios. Si bien es cierto que los ritmos de cambio provinciales diferían enormemente con el de la capital, el trabajo de los reformistas penitenciarios locales fue el de construir “faros” de modernidad, al estilo del instalado en Buenos Aires: la célebre Penitenciaría Nacional. Se ha discutido mucho sobre el “panóptico”, aquel modelo institucional de la sociedad de control, sin embargo, poco se conoce de aquellos “pantanos” que constituyeron “el gris castigo de la mayoría”. La apuesta de este libro es explorar lo que esconden aquellos espacios de reclusión provinciales, donde se castigaba a la mayor parte de la población carcelaria nacional. Se parte de la hipótesis de que, precisamente allí, debajo de aquellos pantanos se esconde la prisión argentina primigenia, porque se fraguó en esos grises lugares de transición más que en los “faros modernizadores” de Buenos Aires o Ushuaia. Apartadas del “modelo”, y del “deber ser” punitivo, se esconden en la marisma los embriones de la prisión contemporánea. Adentrarse en el barro y desenterrar esos vestigios, investigar acerca de la lógica de funcionamiento de las cárceles provinciales, permitirá comprender mejor el surgimiento y la consolidación de los dispositivos punitivos que caracterizan a las cárceles argentinas hoy.

    Description: Este libro quiere ser una aportación novedosa a la historia española del proceso secularizador. Su propósito es demostrar que se puede hablar de secularización en España antes de que la noción tenga efectiva productividad jurídica y constitucional. El periodo elegido (1700-1845) es precisamente época clave de las interrogaciones sobre secularización de lo político; pero tales interrogaciones son heterogéneas, ya que la propia idea de secularización se pone a debate y está sometida a múltiples bloqueos. Parece empezar a funcionar entonces un proceso de secularización social y cultural antes que político. En efecto, la influencia secularizadora de las ideas de la Ilustración conlleva cambios sociales y nuevas prácticas culturales, científicas y artísticas, que transforman, hasta en el seno de la Iglesia, la percepción de lo sagrado. Tales cambios ocasionan, a principios del siglo xix, la ruptura de la convención entre la Monarquía, la Iglesia y la Nación.

    Description: This work compiles the doctoral theses presented at the Faculty of Law of the Central University of Madrid between 1847, the year in which the modern thesis was created in the Spanish university, and 1914, expanding this second edition with the records of the graduates who achieved the degree of doctor in this same faculty in the immediately preceding period, 1845 to 1847, and in which the presentation of a doctoral thesis was not yet required; therefore, the total number of records in this edition is increased to 3,092, compared to the 3,073 of the previous edition. The catalogue is arranged chronologically, which makes it easier for the researcher to sequence the evolution of an important part of the country's legal scientific production, and the research trends of the Faculty in the period studied. The catalogue is accompanied by an extensive introduction which studies the legislation governing doctorates in liberal Spain and the methodology followed in compiling the catalogue. It closes with several appendices that complement the study: a table of the teaching staff of the doctoral courses (by course and onomastic), a table of the syllabuses in force over the almost seventy years covered by the work, and a graph of the theses presented by year. The final index of graduates facilitates immediate consultation of the catalogue.

    Description: Este trabajo recopila las tesis doctorales presentadas en la Facultad de Derecho de la Universidad Central de Madrid entre los años 1847, año en que se crea en la universidad española la tesis moderna, y 1914, ampliando esta segunda edición con los registros de los graduandos que alcanzaron el grado de doctor en esta misma facultad en el periodo inmediatamente anterior, 1845 a 1847, y en el que todavía no se exigía la presentación de una tesis doctoral; por ello el número total de registros en esta edición se amplía a 3.092, frente a los 3.073 de la edición anterior. El catálogo está ordenado cronológicamente, lo que facilitará al investigador secuenciar la evolución de una parte importante de la producción científica jurídica del país, y las tendencias de investigación de la Facultad en el periodo estudiado. Al catálogo le acompaña una amplia introducción en la que se estudia la legislación del doctorado en la España liberal y la metodología seguida en la confección del catálogo. Se cierra con varios apéndices que complementan el estudio: cuadro del profesorado de los curso de doctorado (por curso y onomástico), tabla con los planes de estudios vigentes a lo largo de los casi setenta años que abarca el trabajo, gráfica de las tesis presentadas por año. El índice final de graduandos facilita la consulta inmediata del catálogo.

    Description: If the reform of secondary education enacted in 1894 by the minister Segismundo Moret encouraged Miguel de Unamuno to print some reflections on the teaching of Latin in Spain, the disaster of 98 prompted him to write about higher education. In both cases, the underlying idea was to "make a homeland", to link the task of teaching with the truth, in the face of a sad realisation: "The school of lies is what is commonly called patriotism". Unamuno does not believe in official reforms, but in people, which is why he criticises, in a phrase that has become famous, "this weaving and unweaving of Penelope's web of our official teaching from the ministry".

    Description: Si la reforma de la segunda enseñanza promulgada en 1894 por el ministro Segismundo Moret animó a Miguel de Unamuno a dar a la imprenta unas reflexiones sobre la enseñanza del latín en España, el desastre del 98 le empujó a escribir sobre la enseñanza superior. En uno y otro caso subyace la idea de “hacer patria”, de vincular la tarea docente con la verdad, frente a una triste constatación: “Escuela de mentira es lo que comúnmente se llama patriotismo”. Unamuno no cree en las reformas oficiales, sino en las personas, por eso critica, en una frase que se ha hecho famosa, “ese tejer y destejer desde el ministerio la tela de Penélope de nuestra enseñanza oficial”.

    Description: The manuscript 9/1784 of the Library of the Real Academia de la Historia (Royal Academy of History), known as Registro de Cortes or Libro de Cortes (Registry of Parliament/Book of Parliament), contains a collection of simple copies made by the court scribes and lawyers of the Castilian Cortes (Parliament) at the beginning of the 16th century, in which numerous documents for internal use from the time of John II of Castile, Henry IV of Castile and the Catholic Monarchs were collected. Its time span covers the period between 1425 and 1502. The Registry’s texts allow us to understand the operation of the parliamentary institution in numerous matters that are not included in the ordenamientos (ordinances) and the cuadernos de peticiones (notebooks of petitions) published by the Academy itself in the mid-19th century. Although the scientific community was familiar with some of the parts already published, a complete edition of the manuscript was missing, along with an explanation of the meaning of its use in the courtly context, the question of authorship and the characteristics of the copied texts, not to mention the identification of the main actors who played a leading role in that representative assembly. In short, the Registry illustrates the course of the Castilian Cortes in the political framework of its time.

    Description: El manuscrito 9/1784 de la Biblioteca de la Real Academia de la Historia, conocido como Registro de Cortes o Libro de Cortes, guarda una colección de copias simples elaborada por los escribanos y letrados de las Cortes castellanas a comienzos del siglo XVI, donde se recogieron numerosos documentos de uso interno de la época de Juan II, Enrique IV y Reyes Católicos. Su arco temporal cubre el período comprendido entre 1425 y 1502. Los textos del Registro permiten comprender el funcionamiento de la institución en numerosos asuntos que no aparecen recogidos en los ordenamientos y los cuadernos de peticiones que publicó la propia Academia a mediados del siglo XIX. Aunque la comunidad científica conocía algunas partes ya publicadas, se echaba en falta una edición completa del manuscrito junto con una explicación del sentido que tuvo su uso en el marco cortesano, la cuestión de la autoría y las características de los textos copiados, sin olvidar la identificación de los actores principales que protagonizaron aquella asamblea representativa. El Registro ilustra, en definitiva, el curso de las Cortes castellanas en el marco político de su tiempo.

    Description: A study of the (incomplete) draft of the Civil Code drawn up by the Cortes in 1821, within the framework of the ideas and texts of the contemporary European codification. It reconstructs the parliamentary life of the text in the Spanish Cortes and the biographies of the deputies who worked on it, in particular Nicolás Mª Garelly. The analysis of three relevant issues addressed by Garelly and his colleagues – namely the theory of legislation, the conditions affecting the legal status of individuals, their civil rights - completes the monograph, which also includes a new edition of the printed booklet (December 1821) that constitutes our sole source of knowledge.

    Description: Estudio del (incompleto) proyecto de Código civil elaborado por las Cortes en 1821, en el marco de las ideas y textos de la codificación civil europea del momento y de la Constitución de 1812. Se reconstruye la vida parlamentaria del intento de las Cortes y las biografías de los diputados que estuvieron tras su elaboración, en particular el valenciano Nicolás Mª Garelly. El análisis de tres relevantes cuestiones abordadas por Garelly y sus colegas –la teoría de la ley, las condiciones que afectaban el estatuto jurídico de los individuos, los derechos civiles de éstos− completa la monografía, que incluye una nueva edición del folleto impreso (en diciembre de 1821) que constituye nuestra única fuente de conocimiento.
