    Description: Knowledge about horses and horse breeding is a cultural asset, which has evolved over centuries. At the same time, it is an essential economic commodity. The anthropological focus on knowledge of this study is on the current parameters of breeding the “Hannoveraner”, one of the world’s largest and also most popular horse breeds. The author conducts participatory observations on agricultural family farms that breed them and follows the development of individual horses from birth to successful athletes. The aim is to identify the genesis and exchange of the various stocks and forms of knowledge. The guiding questions of the analysis are: What is equine knowledge and how is it currently changing? Equine knowledge accumulates between breeders and horses and the diverse other actors and entities of this multispecies constellation in their shared everyday life. Videographic vignettes and photographs open up further access to the, primarily incorporated, knowledges and practices of horse breeding in agricultural environments, which are at the center of the ethnography.

    Description: The Goettingen University acquired in 1773 a private natural history collection from Christian Wilhelm Buettner, one of its professors. This collection became the core of the University’s Academic Museum. In addition to thousands of items of natural history (minerals, plants, zoological items) 66 Art Things were part of Buettner‘s collection. The publication investigates the question, if and how the emergence of scholarly disciplines was stimulated by processes of forming and working with specific collections, taking the development of the Ethnographic collection starting from the 66 Art Things (1773) to the foundation of the Institute and Collection of Völkerkunde (1935/36) and the emergence of Völkerkunde as a university discipline in Göttingen as an example.

    Description: If injured or wounded soldiers suffer permanent physical or psychological limitations, the question of social security arises after leaving active service. This problem has become particularly apparent again with the increasing military use of the Bundeswehr in missions abroad. Since then, the legislature has attempted to adapt the traditional pension system to the new circumstances on several occasions. The reorganization of the social compensation law once again provides an opportunity to fundamentally question the legal concept of the military pension system. Against this background, the study analyzes the constitutional framework of the law on military pensions. In particular, it shows that compensation for physical or psychological losses resulting from military service is not a voluntary benefit of the state, but on the one hand already results from the constitutionally anchored commitment of soldiers to their employer, and on the other hand can be based on fundamental legal considerations.

    Description: This dissertation examines intelligence surveillance of private telecommunications and its compatibility with the international human right to privacy in Art. 17 ICCPR and in Art. 8 ECHR. These articles provide comprehensive protection against the most modern forms of surveillance including bulk interception. Several criteria apply in terms of the foreseeability of the surveillance laws. Telecommunication’s interception should be subject to authorisation and supervision by independent authorities and effective remedies should be available. Moreover, the study analyzes the extent to which the surveilling state and the state of residence violate their human rights obligations in cases of cross-border surveillance. The main question is whether the established definitions of "jurisdiction" are applicable to this extraterritorial scenario. The extraterritorial exercise of jurisdiction can also be based on effective control over specific objects relevant to human rights. According to this approach, telecommunications data are objects relevant to individual’s right to correspondence and data protection.

    Description: It is rare for a physician to be disbarred; it is even rarer for the disbarment to have a retroactive effect back to the time of granting. The prerequisite for this effect is that the license to practice medicine should not have been granted in the first place, either because the requirements for the training of the future physician were not met or because character defects (unworthiness, unreliability) prevented the person concerned from working as a physician. Although practically rare, the revocation of a license to practice medicine is of particular academic interest because it ultimately results in the entire medical activity of the person affected being subsequently deprived of its legal basis. Strictly speaking, in consequence, each medical intervention becomes unlawful, thus (under certain circumstances) constituting a bodily injury under criminal law as well as giving rise to liability for damages under civil law. However, neither the criminal nor the civil law consequences of such retroactivity have yet been examined in a scientifically sound manner, even to a rudimentary degree. The present dissertation is intended to close this gap, at least in the area of civil law.

    Description: The purchase of additional items in videogames, also called ‘Microtransactions’, has recently grown to become one of the dominating methods of monetization in the games industry. However, many versions of these monetization schemes face severe backlash because it appears that the ways to monetize games are increasingly influencing the contents of the medium and that those games are purposefully designed to bring vulnerable players to spend more money than they meant to. In this thesis, those points of criticism were taken into consideration and as a starting point to explore the legality of these kinds of monetization schemes from a legal standpoint. This was done with regards to the Unfair Competition Law, Youth Protection regulation and general civil law. Also, the chance-based variant of microtransactions, the so called ‘Lootboxes’, have been examined with regard to their legality under gambling regulations.

    Description: The present qualitative interview study has set itself the task of reappraising the developments from the emergence to the official ban of the German-speaking Islamic Circle (DIK) and the associated mosque. In order to approach the question of how it was possible for a radical Islamic mosque to emerge and establish itself in the middle of Hildesheim's Nordstadt, we use the "hotbed" approach1 as a basis for analysis. According to this approach, the geographic distribution of the places of origin of those who left to fight in IS territory is by no means evenly distributed; rather, certain places or neighborhoods stand out in which recurring factors that condition radicalization can be identified. To examine why the now-banned Hildesheim mosque association around the convicted "IS chief recruiter" in Germany, Ahmad A. alias "Abu Walaa," became a hotbed, we conducted a total of nine interviews in the spring and summer of 2021. We spoke with members of the local Muslim community and former visitors of the DIK mosque, non-Muslim persons living in the immediate vicinity of the mosque, as well as with representatives of authorities, institutions and civil society institutions. In a search for sociocultural meaning in the catastrophic events of ‘3.11’, Wiebke Grimmig examines the role of contemporary Japanese artists in the process by which Japanese society has handled the effects of this triple disaster (earthquake, tsunami and atomic disaster) in Fukushima. She focuses on the emotional processing of these events by her respondents, including their biographical background, their economic concerns and the role of contemporary art in Japanese society. This anthropological research involves the analysis of in-depth interviews with contemporary artists from Tokyo, as well as from other locations along the east coast of Japan. This research was conducted over a 12-month period to elucidate the catastrophic events and effects of the ‘3.11’ disaster. In this work, Wiebke Grimmig examines how contemporary Japanese artists portray catastrophic events in terms of emotion, individuality, power, resilience, politics, economics and communication in their biographical narrative and their work. This doctoral thesis provides an important contribution to the socio-scientific field of disaster research.

Both the Federal Constitutional Court and the European Court of Human Rights provided important stimulus for legal reforms.     Description: What are the effects of internal migration controls on migrants without a regular residence permit – on “sans papiers”? The book gives an answer to this question with a comparative study of the United States and Germany. Based on expert interviews and in-depth interviews with forty sans papiers, police controls as well as controls in areas such as labor market, health care, housing, schooling and childcare are carefully analysed. The book discusses whether global economic, political or social processes have restricted the ability of advanced capitalist countries to control migration. It argues that migration policy in the OECD countries has become more similar, but this convergence only takes place at the level of policy goals and legal norms. At the level of implementation, national differences persist. The interviews show that sans papiers in the U.S. continue to have many possibilities to participate in society. In contrast, the comprehensive exclusion of sans papiers in Germany confi rms that there is no general “loss of control”.
    Description: Welche Auswirkungen haben interne Migrationskontrollen auf Migrantinnen und Migranten ohne regulären Aufenthaltsstatus - auf »Sans Papiers«? Dieser Frage geht das Buch mit einem Vergleich zwischen den Vereinigten Staaten und Deutschland nach. Anhand von Expertengesprächen und vierzig qualitativen Interviews mit Sans Papiers werden polizeiliche Kontrollen und Kontrollen in den Bereichen Arbeitsmarkt, Gesundheitsversorgung, Wohnen sowie Schule und Kinderbetreuung eingehend untersucht. Das Buch diskutiert, ob globale ökonomische, politische und soziale Prozesse die Fähigkeit von Nationalstaaten einschränken, Migration zu kontrollieren. Es wird gezeigt, dass sich die Migrationspolitik der OECDStaaten in den vergangenen Jahren zwar auf der Ebene der Leitlinien und Gesetze angeglichen hat. Bei der Implementation von Kontrollen bestehen aber nationale Unterschiede fort. Die Interviews belegen, dass Sans Papiers in den USA weiterhin vielfältige Möglichkeiten zur gesellschaftlichen Partizipation haben. Im Gegenzug zeigt das Beispiel Deutschland, dass angesichts der weitgehenden Exklusion von Sans Papiers keine Rede von einem »Kontrollverlust« sein kann.

    Description: Electricity generation from renewable sources of energy has had a long history in Germany and is highly topical. This paper deals with both aspects. A sociological analysis of technology shows how innovative technologies gradually emerged from the Utopian vision of 'velvet' energies, which became the basis of the rapidly growing regenerative electricity production. The second aspect of the paper is an analysis of the growing potential - as well as possible obstacles - of regenerative energies. The expansion of energy production from renewable sources and the tendency towards the concentration of such installations (e.g. large wind farms or solar parks) is increasingly met with opposition from the public. In addition, it is felt that considerable changes in the energy sector can only be successful if its promoters become more active.

    Description: The liberal professions are subject to an ever changing legal basis and thus constantly undergo minor or major amendments. A fundamental innovation in the current law governing the liberal professions of tax consultants is the authorization to work as in-house tax consultants. Since 2008, the Tax Consultancy Act has made possible to pursue the profession of in-house tax advisor, while lawyers were allowed to work in-house for decades already, with the last amendment of the legal regulations from 2016. This paper deals with the various legal and practical implications of the interactions between the freelance activity as a tax consultant and the activity of in-house tax consultants in an employment relationship. A detailed comparison of the legal basis for tax consultants with that of in-house lawyers is of special interest in light of the current ambiguous legal situation. Special focus is a thorough analysis of the legal question whether or not an in-house tax adviser can be exempted from the obligatory pension insurance.

    Description: In this cultural anthropological examination Frauke Johanna Ahrens enquires into the scientific significance of the herbarium sheets of the Herbarium Göttingen in the period from 1832 to 1852. Based on a historical, object-focused ethnography and praxeology she itemizes how during the establishing phase of the collection institutionalized in 1832 the scientific practices and epistemic interests mutually influenced one another and found expression in the botanical specimens themselves. Each of the five chapters is dedicated to one practice – opening up the collection, ascribing values, acquiring plant material, doing research on herbarium sheets and teaching with herbarium sheets. Together with detailed object descriptions, the analysis emphasizes the materiality of knowledge in this way.

    Description: In the view of the increasingly strong and far-reaching international interdependence of the national legal system, the question as to where the German Basic Law relates concerning the increasing international complexity is becoming ever more important. In response to this, the German Basic Law is said to be a constitution open to international law, which is extracted from the basic principle of ‘Völkerrechtsfreundlichkeit’ (friendliness toward international law). However, it remains vague in which relation such a principle would stand to the rule of law, the principle of democracy or the system of basic rights, if it is inserted into their limitations or constitutes a supreme premise. The focus of this study lays upon the attempt to make the principle of Völkerrechtsfreundlichkeit tangible and to explore its legal content of.
    Description: Angesichts der immer stärkeren und weiterreichenden internationalen Verflechtungen der Rechtsordnung wird auch die Frage immer wichtiger, wie sich das Grundgesetz zu diesen internationalen Bindungen verhält. Dem Grundgesetz wird als Antwort darauf gemeinhin eine Völkerrechtsfreundlichkeit entnommen, welche sich aus den internationalen Bezugnahmen der Grundordnung ergeben soll. Dabei bleibt jedoch regelmäßig offen, wie sich eine solche Völkerrechtsoffenheit des Grundgesetzes zu Prinzipien wie Demokratie und Rechtsstaatlichkeit oder dem Grundrechtsschutz verhält, ob es sich in deren verfassungsrechtlich gewährleistete Grenzen einfügt oder vielmehr als übergeordnete Prämisse dem vorgeht. Im Zentrum der Untersuchung steht daher der Versuch, das Prinzip der Völkerrechtsfreundlichkeit greifbar zu machen und seinen möglichen rechtlichen Gehalt zu umreißen.

In five selected district courts of Lower Saxony, the author has also conducted an extensive document analysis on the use of video testimony, and concluded that the video technology in criminal proceedings is used rarely. In specific reform proposals „de lege ferenda“ also the recent regulations of the Law Reform Act of 2003 victims are included in the evaluative study.
    Description: Die Autorin beleuchtet die Praxis der Videovernehmung kindlicher Zeugen. Ausgangspunkt ihrer empirischen Untersuchung ist die Frage, ob die Gesetzesreform nicht nur gut gemeint ist, sondern auch praktisch umgesetzt werden kann. Hierbei knüpft sie an die Regelungen des 1998 geschaffenen Zeugenschutzgesetzes an, zu dessen Umsetzbarkeit im Sinne eines vom Gesetzgeber intendierten effektiven Opferschutzes, insbesondere der Vermeidung der sog. sekundären Viktimisierung (Traumatisierung), Experten aus Niedersachsen - Staatsanwaltschaft, Polizei und Gerichte - von ihren ersten Erfahrungen berichten. In fünf ausgewählten niedersächsischen Landgerichtsbezirken hat die Autorin zudem eine umfangreiche Aktenanalyse zum Einsatz von Videovernehmung durchgeführt und gelangt zu dem Ergebnis, dass die Videotechnologie im Strafverfahren so gut wie nicht eingesetzt wird. In konkreten Reformvorschlägen de lege ferenda werden auch die neueren Regelungen des Opferrechtsreformgesetzes von 2003 wertend in die Untersuchung einbezogen.

    Description: Reports on medical billing frauds, “premiums” of hospitals (for the referral of a patient) as well as the “medical marketing” arouse increasing attention in times of dwindling financial resources within the socially insured healthcare system and the worry for spreading “rationing”. Out of consideration for the partly remarkably high financial damages the call for a harsh punishment suggests itself, but the criminal law is always late and, above all, isn't capable of compensating the intangible loss of trust. Therefore, the search for instruments of an effective prevention of corruption deserves far more notice, but consequently the question of the real criminal events and of the possible “adjusting screws” for preventive interventions as well. The articles in this volume, which come from the recent (organized on 8 July 2011) annual conference of the Institute of Criminal Law and Justice in Göttingen, present the latest findings available so far. They may provide the interested public with an insight, that is respectably and not clouded by the drive of mass-media scandalisation, into the extent and appearances of corrupt behaviour in the healthcare system and may give the experts suggestions for productive further discussions and innovative problem solvings.
    Description: In Zeiten knapper werdender finanzieller Ressourcen innerhalb des sozialversicherten Gesundheitssystems und der Sorge vor immer weiter um sich greifender „Rationierung“ wecken Berichte über ärztliche Abrechnungsbetrügereien, „Fangprämien“ von Krankenhäusern (für die Überweisung von Patienten) sowie das „Pharmamarketing“ verstärkte Aufmerksamkeit. Mit Rücksicht auf die z.T. außerordentlich hohen Schadenssummen liegt der Ruf nach harter Bestrafung nahe, doch kommt das Strafrecht stets zu spät und vermag vor allem den immateriellen Vertrauensverlust nicht zu kompensieren. Die Suche nach Instrumenten einer effektiven Korruptionsprävention verdient daher weit größere Beachtung, infolgedessen aber ebenso die Frage nach dem tatsächlichen Kriminalitätsgeschehen und nach möglichen „Stellschrauben“ für präventiv wirkende Interventionen. Die Beiträge dieses Bandes, hervorgegangen aus der jüngsten (am 8. Juli 2011 veranstalteten) Jahrestagung des Göttinger Instituts für Kriminalwissenschaften, präsentieren die hierzu bisher vorliegenden Erkenntnisse auf aktuellstem Stand.     Description: Pointing at ambivalences and inconsistencies, contradictory expectations, nationalistic and pragmatic points of view, this study shows parts of the becoming, being and remaining (or not) Danish in Germany. Using qualitative methods and a constructivist approach, Levke Bittlinger examines questions of minority- and nationhood with regard to actors and the main institutions within the Danish minority in the Southern Schleswig region. The research ranges from the backgrounds of people becoming Danish in the postwar time to today’s parents sending their children to Danish institutions for social and material matters. The study reaches from the analysis of the role of the Danish school system, the cultural association including their expectations on new Danish people concerning their integration into the minority to the importance of symbols, practices and historical myths for constructing a minority belonging.

Issues are raised in respect to well-known questions concerning the legal nature of accreditation, as well as to the related encroachment upon fundamental rights. Furthermore, new challenges such as system accreditation and the seldom debated issues concerning the contractual relationships of the involved parties, or the democratic legitimation of the accreditation administration and the legal nature of its decisions are discussed. The study also draws comparisons to similarly structured areas of law - in so doing, further questions of modernisation in higher education, the debate surrounding privatisation and legal aspects of the administrative organisation are commented on.
    Description: Die Akkreditierung von Studiengängen bietet auch fast 15 Jahre nach ihrer Einführung politisch wie juristisch beträchtlichen Anlass zur Diskussion. Die stetige Fortentwicklung des Akkreditierungsverfahrens, die zunehmende Bedeutung von Qualitätssicherung sowie die immer wieder auffl ammende Debatte um den Bologna-Prozess sorgen dafür, dass das Thema aktuell und lebendig bleibt. Die vorliegende Dissertation widmet sich neben der hochschulpolitischen Entwicklung den vielfältigen verwaltungs- und verfassungsrechtlichen Problemen des Akkreditierungswesens an deutschen Hochschulen. Dabei kommen zum einen altbekannte Fragen zur Rechtsnatur der Akkreditierung oder dem Grundrechtseingriff durch die Akkreditierungspfl icht zur Sprache. Des Weiteren geht es aber auch um neue Herausforderungen wie die Systemakkreditierung und um bisher nur wenig erörterte Themen wie die Vertragsverhältnisse der Beteiligten, die demokratische Legitimation der Akkreditierungsverwaltung sowie die Rechtsnatur ihrer Beschlüsse. Außerdem zieht die Arbeit systematische Vergleiche zu Rechtsgebieten mit ähnlichen Strukturen; dabei nimmt sie u.a. Stellung zu weiteren Fragen der Hochschulmodernisierung, der Privatisierungsdebatte und des Verwaltungsorganisationsrechts.

    Description: The Internet and the proceeding digitalisation of content - such as music, videos and written texts - have led to profound and complex challenges in the field of Copyright Law, especially with regard to questions of enforcement as well as adequate compensation of right holders. In recent years, several alternative compensation schemes have been proposed, seeking to solve these issues. In Germany, the discussion still focuses on the so-called "cultural flatrate", that is, in a nutshell, a limitation to copyrights which would legalize sharing of content online. Every holder of a broadband connection to the Internet would have to pay a monthly fee which would be used to remunerate the right holders. This advisory opinion was compiled on behalf of the parliamentary group of the German political party "Bündnis 90/DIE GRÜNEN". The author comprehensively analyses the feasibility of the described alternative compensation scheme under German and European law, discussing both legal and economic obstacles and possible impacts based on a variety of different economic prerequisites.
    Description: In diesem von der Bundestagsfraktion Bündnis 90/Die Grünen in Auftrag gegebenem ergebnisoffenem Gutachten untersucht Prof. Spindler die rechtliche und ökonomische Umsetzbarkeit sowie Ausgestaltung eines Ansatzes zur sog. „Kulturflatrate“. Die Fragestellung war, ob ein Pauschalvergütungsansatz auf Breitbandanschlüsse ein Baustein für ein gerechteres, modernes Urheberrecht, für angemessene Vergütung für die UrheberInnen und einen gesellschaftlichen Interessensausgleich sein kann. Das umfassende und detailreiche Gutachten leistet einen wesentlichen Beitrag zur Diskussion um die Zukunft des Urheberrechts, die in Zeiten des globalen Internets in praktisch jedem Land geführt wird. Es wird vollumfänglich der Öffentlichkeit zugänglich gemacht, damit die Ergebnisse von allen Interessierten genutzt und weiterentwickelt werden können. Prof. Spindler zeigt in seinem Gutachten auf, dass ein Pauschalvergütungsansatz verfassungsrechtlich zulässig und ein attraktives Modell zur angemessenen Vergütung für Kreative sein kann. Für die Situation der NutzerInnen bietet er eine geeignete Alternative zu repressiven und gesellschaftlich höchst konfliktträchtigen Formen der Rechtsdurchsetzung. Gleichzeitig wird aber auch auf gewichtige Schwierigkeiten und Hürden bei der Umsetzung eines solchen Modells hingewiesen. Ausgewertet werden sämtliche Eintragungen im Bundeszentral- und Erziehungsregister zu Personen, die im Jahr 2004 mit einer relevante Bezugsentscheidung im Register erfasst waren. Dadurch konnten über eine Millionen Straffällige, darunter rund 200.000 Frauen, mit allen zu ihnen im Register gespeicherten strafrechtlichen Entscheidungen in die Untersuchung einbezogen werden. Diese konzentriert sich dabei im Wesentlichen auf zwei Themenkomplexe: Einmal wird die Strafzumessung bei weiblichen im Vergleich zu männlichen Straffälligen differenziert untersucht. Dabei zeigt sich, dass Frauen entgegen landläufiger Meinung keinen Strafzumessungsbonus genießen. Zum anderen wird aufgezeigt, dass das Maß der Rückfälligkeit straffälliger Frauen sich je nach justizieller Reaktion unterscheidet und von Kriterien wie Art und Anzahl der Voreintragungen abhängt.

Zum anderen wird aufgezeigt, dass das Maß der Rückfälligkeit straffälliger Frauen sich je nach justizieller Reaktion unterscheidet und von Kriterien wie Art und Anzahl der Voreintragungen abhängt.

    Description: After the fall of the Taliban, the new Afghan constitution of 2004 marks a fundamental beginning for the status of women – at least from a normative perspective. Art. 22 of the Afghan constitution contains: “The citizens of Afghanistan, man and woman, have equal rights and duties before the law.” According to Art. 7 of the constitution the state shall observe i. a. the international treaties to which Afghanistan has joined. This also covers the Convention on the Elimination of All Forms of Discrimination against Women. At the same time, Art. 3 of the constitution provides that no law should contravene the tenets and provisions of the holy religion of Islam in Afghanistan. But how do these different sources of law interact in conflicting legal fields? There are no exiting provisions of the constitution explicitly offering an answer to this problem. This work focuses on the solution of this question regarding the status of women, especially in the law of divorce.

    Description: In September 2018 the criminal law section of the 72nd Deutscher Juristentag (DJT, “German Assembly of Jurists”) debated the question “Sentencing Guidelines vs. Free Judicial Discretion – Is German Sentencing Law in Need of Reform?” Despite the expert opinion provided by Johannes Kaspar and the accompanying scholarly commentaries, ensuing proposals for fundamental reform met with rejection. The comparative perspective was limited to the US Federal sentencing guidelines. The intention of this volume is therefore, on the one hand, to draw a more nuanced picture of Anglo-American sentencing law focusing on three legal systems (England/Wales, USA and Canada) accompanied by commentaries from a German perspective; on the other hand, we want to make the German perspective (better) known within the Anglo-American legal world by reproducing important DJT documents in English language. To ensure the widest possible distribution we opted for a bilingual open access publication.

    Description: Traffic violations represent by far the most significant number of misconducts punished by law. This is due to the fact that the majority of the population actively participates in road traffic. Despite the importance of this topic, only a limited number of empirical studies have been conducted about traffic offenses. The present study intends to reduce this deficit in the field of traffic infringements by analyzing nationwide data about sentences and cases of repeated offenses, differentiating by seriousness of the misdemeanors and their general and traffic specific penalties. For the first time, a complete data set from the "Bundeszentralregister" (Federal Central Criminal Register) is evaluated. This traffic violation data set contains records of 250,000 people. As a result, this research incorporates nearly all people convicted in a specific year in Germany. Under due consideration of criminal records, these data are classified into distinct categories depending on the seriousness of the offense and the type of punishment. Furthermore, this study appraises the correlation between traffic specific reconviction rates and the success of related punishments.

    Description: Recent developments have caused important changes in the IT industry: while being considered comparatively resistant to international relocation of jobs for a long time, the IT industry's landscape has changed a lot in the course of the 1990s, when IT companies started to make use of low-wage destinations and integrated them in globally distributed workflows. According to many authors the internationalisation of the IT industry does not only put jobs in high-wage countries into jeopardy, but also formalizes and standardizes the working processes, thus significantly limiting the employees´ task discretion. Drawing upon case studies in the Indian subsidiaries of two transnationally operating IT companies, the presented study critically questions this prognosis. The results clearly show that the forms of work organisation and control in the IT industry do not develop homogeneously or uniformly in the course of internationalization. Instead, it is possible to identify specific modes of reorganization that are shaped by varying patterns of internationalization, on the one hand, and the institutional settings of the offshore destinations, on the other hand."

All these are reasons why representative recidivism studies are needed. This volume presents an exemplary collection of such endeavors: Austria, Estonia, France, Germany, Switzerland and a comparative study of England and Wales, the Netherlands and Scotland.
    Description: Rückfall gehört zu den zentralen Kategorien der Kriminologie, Strafrechtspraxis und Kriminalpolitik. Nimmt man den spezialpräventiven Anspruch des Strafrechts ernst, muss sich die Strafrechtspolitik daran messen lassen, wie gut es mit welcher Art von Sanktionen gelingt, Rückfälle zu verhindern. Aber auch die Institutionen, die unmittelbar mit Straftaten und Straftätern umgehen, bedürfen einer grundlegenden Information über die Folgen ihres Tuns, insbesondere allgemeine Erkenntnisse über rückfallgefährdete Tätergruppen. Eine an den spezifischen Bedürfnissen schwerstkranker Patienten orientierte Versorgung im häuslichen Umfeld erfordert es, bestehende gesetzliche Regelungen zu hinterfragen, anzupassen oder fortzuentwickeln. Kontrovers diskutiert wird, wie das Grundanliegen des Betäubungsmittelrechts — Schutz der Bevölkerung vor Abhängigkeit und Missbrauch sowie Sicherstellung der notwendigen medizinischen Versorgung — mit dem palliativmedizinischen Selbstverständnis der Gewährung einer bestmöglichen Behandlung von Schmerzpatienten in Einklang gebracht werden kann. In diesem Spannungsfeld fasst der Band die Beiträge eines Expertenworkshops zusammen, der 2012 von der Klinik für Palliativmedizin sowie dem Zentrum für Medizinrecht der Georg-August-Universität Göttingen veranstaltet wurde. In doing so, this is explored whether the federal states have maintained the standard established by the Federal German Prison Act of 1976, legitimized restorative tendencies or established innovations. The present work also makes a contribution to a constitutionally determined understanding of temporary releases from prison and open prisons.

This question has not been systematically dealt with and even less responsed in a satisfactory degree, although there are many contributions to the discussion of the term. The problem is labelled in the social sciences, but has not been resolved in the context of the specific social-scientific framework. This book takes the neglected metalinguistic perspective. Thus it advances the scientific maturity of the "social capital" debate and contributes to the establishment of a well-founded system in social science terms. It brings up social capital by combining an epistemological and ontological analysis and thus finally develops clarification of the concept.

    Description: Can early criminal defense helping to avoid or shorten detention? When early criminal defense means to avoid unnecessary detention which burdens both the involved parties, the enforcement and detention and in terms of costs, the state in unnecessary ways? These questions are discussed in the present investigation. It represents the concept and the results of the accompanying scientific research from a 1998 pilot project carried out in the JVA Hannover. It relies on the analysis of over 1,300 criminal acts and the Federal Central Register’s (Bundeszentralregister) statements, the evaluation of the detention list of the local court of Hanover and on extensive interviews with people involved in the project (defence lawyers, prosecutors, judges, court clerks and remand prisoners). The empirical findings of the accompanying be embedded in a legal framework and criminological conclusions are presented.

    Description: Few crimes capture the interest and attention of the public as sexual driven crime. Relapsing sex offenders especially spark debates on how best to deal with this particular group. Incidents of serious sexual crimes are, fortunately, rare in Germany which partly complicates empirical research into sexual criminality. This study aims to contribute to an understanding of sexual crimes by providing an overview of such offences in Germany by nature of the offence, offender-types, penalties and (partially) criminal careers from the perspective of judicial oversight of sexual crime. The study examines 9,430 sexual offenders from all over Germany based on data from the Federal Central Criminal Register where either custodial sentences were served or non-custodial sanctions imposed in the base year. It tracks the sample group over six years comparing their outcomes with other non-sexual offender types.

    Description: Die Debatte um Sozialkapital ist seit geraumer Zeit in Wissenschaft, Wirtschaft und Politik in Mode. Schaut man sich Untersuchungen dazu an, so scheint Sozialkapital für nahezu alles gut zu sein: sei es die Erhöhung des persönlichen Wohlbefindens, die Revitalisierung benachteiligter Stadtquartiere oder die Stärkung der Volkswirtschaft im globalisierten Standortwettbewerb - je mehr Sozialkapital, desto besser! Doch gerade die behauptete enorme Wirkungsbreite sollte zu begrifflicher und theoretischer Wachsamkeit anhalten. Was dient Wissenschaftlern als Gegenstand ihrer Erkenntnisbemühungen, wenn von »Sozialkapital« die Rede ist? Diese Frage klingt banal, ist aber bisher nicht systematisch bearbeitet oder gar in befriedigendem Maße beantwortet worden, obwohl doch zahlreiche Beiträge zur Begriffsdebatte vorliegen. So ist zwar das Problem in den Sozialwissenschaften benannt, doch im Kontext des speziellen sozialwissenschaftlichen Reflexionsrahmens nicht eingelöst worden. Das vorliegende Buch nimmt die bisher vernachlässigte metasprachliche Perspektive ein. Es erhöht damit den wissenschaftlichen Reifegrades der »Sozialkapital«-Debatte und trägt zur Etablierung eines wohlfundierten Systems sozialwissenschaftlicher Begriffe bei. Es bringt Sozialkapital zur Sprache, indem es über eine Kombination einer erkenntnistheoretischen und ontologischen Analyse eine Präzisierung des Objektbereiches erarbeitet.

Yet it has lasted several years until the Internet has gained reputation as a publication medium for scientists. This development is accompanied by an increasing concentration on the side of scientific publishers, which has lead for some disciplines to almost monopolistic situations. Conversely, the financial resources to purchase and provide access to scientific publications are shrinking on the side of the customers - libraries and researchers, but also other sectors of the public. This results in a disastrous spiral, known as the so-called "publication crisis." As one solution to this crisis new publication concepts using the internet have emerged. They are characterized by the fact that they provide access to scientific works largely free and unrestricted - Open Access.     Description: Schon früher als andere Gesellschaftsbereiche war die Wissenschaft mit dem Internet als einem neuen Kommunikationsmedium konfrontiert. Es hat allerdings etliche Jahre gedauert, bis das Internet auch als Publikationsmedium die Wissenschaftsmärkte erreicht hat. Flankiert wird diese Entwicklung von einer zunehmenden Konzentration auf der Seite der wissenschaftlichen Verleger, die in einigen Fachwissenschaften wohl schon fast zu monopolartigen Situationen geführt hat. Umgekehrt nehmen auf der Seite der Abnehmer - der Bibliotheken und der Wissenschaftler, aber auch der sonstigen Öffentlichkeit - die finanziellen Möglichkeiten immer mehr ab, die zunehmende Zahl an Veröffentlichungen noch zu erwerben und dem interessierten Publikum zur Verfügung zu stellen. Damit hat sich eine unheilvolle Spirale in Bewegung gesetzt, die als sog. »Publikationskrise« bezeichnet wird. A so-called assisted health technology and new information and communication options make the interface between human and machine blurred. The anthology addresses fundamental social, cultural and ethical questions of human-technology interaction and, from a cultural and social scientific research perspective, addresses the question of how technology alters everyday life, cultural orders and knowledge systems.

Eine Vielzahl von Kommunikationstechniken finden mittlerweile ihren Einsatz in medikalisierten Alltagen: neue Biotechnologien verbinden sich mit Techniken des häuslichen Alltags, es hat sich längst ein digitaler Selbstvermessungsmarkt durch Anwendungstechniken wie z.B. Smartphones, Datenbrillen und SmartWatches entwickelt. Es lassen sich medizinische Geräte und Systeme immer einfacher bedienen, die gewonnenen Daten können dabei immer schneller ausgetauscht und ausgewertet werden. Sogenannte assistierte Gesundheitstechnologien, neue Informations- und Kommunikationsmöglichkeiten lassen die Schnittstelle zwischen Mensch und Maschine unscharf werden. Der Sammelband thematisiert grundlegende soziale, kulturelle und ethische Fragen der Mensch-Technik-Interaktion und widmet sich aus kultur- und sozialwissenschaftlicher Forschungsperspektive der Frage, inwieweit Technik den Alltag, kulturelle Ordnungen und Wissenssysteme verändert.     Description: W National Park lies in the border triangle of Benin, Burkina Faso and Niger in West Africa. Established under French colonial rule in 1927, it was designated as the first African transborder biosphere reserve in 2002. Although the Benin part of the reserve was given a participatory management approach in 2002, illegal hunting, logging, transborder mobile herding and cash cropping continue to pose important threats to the reserve. The whole area, especially the buffer zone, is a source of conflicts between the different adjacent communities and between communities and park administration. The book analyses how the surveillance teams operate in this context. It describes encounters between park surveillance staff and local stakeholders in three different arenas: the park’s core area, adjacent villages and public political forums. It shows how, in a setting dominated largely by cash crop production, the abstract idea „national park“ is being translated by park staff and how in the process local meanings of the idea emerge. Drawing on 14 months of ethnographic research between 2008 and 2010, this book contributes to the current state of research on participatory natural resources management. Moreover, it provides insights into the working of state administration in a context of contradictory policies of conservation and rural development.

    Description: This research/analysis focuses on an empirical analysis of the practical criminal law and the success of suspended sentence. The foundation of the research form data sets from the Bundeszentralregister and the Erziehungsregister. About 120.000 German data sets of stayed prison sentences and stayed young offender sentences are analyzed under the following aspects: the sentence received and if the delinquent reoffends in a period of four years after their sanction. Characteristics of age, gender, nationality and perhaps an existing penal background as well as possible probation service are part of the analysis. Also discussed are connections between relapse and the revocation of the parole. Another chapter deals with the success of the suspended sentences compared to other penalties, i.e. fines and prison sentences up to two years.

    Description: What are the effects of internal migration controls on migrants without a regular residence permit – on “sans papiers”? The book gives an answer to this question with a comparative study of the United States and Germany. Based on expert interviews and in-depth interviews with forty sans papiers, police controls as well as controls in areas such as labor market, health care, housing, schooling and childcare are carefully analysed. The book discusses whether global economic, political or social processes have restricted the ability of advanced capitalist countries to control migration. It argues that migration policy in the OECD countries has become more similar, but this convergence only takes place at the level of policy goals and legal norms. At the level of implementation, national differences persist. The interviews show that sans papiers in the U.S. continue to have many possibilities to participate in society. In contrast, the comprehensive exclusion of sans papiers in Germany confi rms that there is no general “loss of control”.

    Description: Die Arbeit befasst sich mit Abweichungen vom Deutschen Corporate Governance Kodex und von § 161 AktG als Pflichtverletzung im Sinne der Untreue und soll insbesondere zur Klärung der Rechtsnatur dieses aktiengesellschaftsrechtlichen Regulierungsinstruments, welches in unserer Rechtsordnung seinesgleichen sucht, beitragen. Aus strafrechtlicher Perspektive ganz in den Mittelpunkt gerückt wird hierbei das Pflichtverletzungsmerkmal des § 266 StGB im Kontext der Organuntreue, welche Rechtsprechung und Wissenschaft zunehmend beschäftigt. Vertieft nachgegangen wird dabei der Frage, inwieweit der Untreuetatbestand zivilrechtsakzessorisch ist. Außerdem wird untersucht, ob jeder Verstoß gegen die aus §§ 93 Abs. 1 S. 1, 116 S. 1 AktG folgende Legalitätspflicht der Organmitglieder von Aktiengesellschaften auch eine Pflichtverletzung im Sinne der Untreue darstellt.

    Description: Reports on medical billing frauds, “premiums” of hospitals (for the referral of a patient) as well as the “medical marketing” arouse increasing attention in times of dwindling financial resources within the socially insured healthcare system and the worry for spreading “rationing”. Out of consideration for the partly remarkably high financial damages the call for a harsh punishment suggests itself, but the criminal law is always late and, above all, isn't capable of compensating the intangible loss of trust. Therefore, the search for instruments of an effective prevention of corruption deserves far more notice, but consequently the question of the real criminal events and of the possible “adjusting screws” for preventive interventions as well. The articles in this volume, which come from the recent (organized on 8 July 2011) annual conference of the Institute of Criminal Law and Justice in Göttingen, present the latest findings available so far. They may provide the interested public with an insight, that is respectably and not clouded by the drive of mass-media scandalisation, into the extent and appearances of corrupt behaviour in the healthcare system and may give the experts suggestions for productive further discussions and innovative problem solvings.

    Description: This volume deals with the future of European criminal law under the Lisbon Treaty. The contributions assess the risks and prospects of the progressing European integration with a special focus on the enlarged competences of the EU in the field of criminal law.
    Description: Das Inkrafttreten des Vertrags von Lissabon hat auch für das europäische Strafrecht erhebliche Änderungen mit sich gebracht: Der Grundsatz der gegenseitigen Anerkennung wurde zum zentralen Strukturprinzip erhoben und die Kompetenzen der EU zur Strafrechtsharmonisierung erheblich erweitert. Zudem soll nach überwiegender Ansicht die EU nunmehr auch erstmals zur Schaffung echten supranationalen Strafrechts ermächtigt sein. Den Gegenpol zu dieser zunehmenden Supranationalisierung des Strafrechts bildet – zumindest aus deutscher Sicht – die Rechtsprechung das BVerfG, das in seinem Lissabon-Urteil versucht, diesem deutlich erweiterten Handlungsspielraum der EU Grenzen zu ziehen. Der vorliegende Band will Wege aufzeigen, wie dieses Spannungsfeld zwischen Europäisierung und Bewahrung einzelstaatlicher Souveränität in dem besonders sensiblen Bereich des Strafrechts gelöst oder zumindest entschärft werden kann. Ziel muss es sein, die mit der Erweiterung der strafrechtlichen Kompetenzen der EU verbundenen Risiken zu bewältigen und die sich eröffnenden Chancen zu nutzen. Die Beiträge sind überwiegend aus dem IV. Kolloquium des Instituts für Kriminalwissenschaften der Georg-August-Universität Göttingen (2. Juli 2010) hervorgegangen, wurden z.T. aber auch exklusiv für diesen Band erstellt.
