    Description: Provokation, Schriftstellersein als Lebensform und eine die Grenzen des Kanons sprengende Literatur: Um Jörg Fauser, Jürgen Ploog und Carl Weissner entsteht in den 1960er Jahren eine literarische Strömung, die sich an der amerikanischen Beatliteratur und dem Underground orientiert. Dieser Teil deutscher Literaturgeschichte stand lange im Schatten der Gruppe 47 und anderer.     Description: The volume, dedicated to the 44th International Conference of the Italian Union for Drawing, investigates the theme of ‘Transitions’, which particularly effectively represents our time and the current condition of the discipline of Drawing. The term, beyond its generic meaning of an intermediate stage in a process in which a condition changes from one state to another, has always been used in various fields, from music to geophysics. In fact, the disciplines of drawing have always been confronted with themes and issues relating to transitions from one condition to another. The history of representation tells us of transformations, even epochal ones, relating to ‘drawing’, with all that such transitions entail: suffice it to think of the evolution of forms of representation, of instrumental apparatuses, of the mutability of supports, of the analogical-digital transition underway, of the new modes of communication on platforms, of the hypertrophic offer of images also on the net that confirms Guy Debord’s intuitions relating to the new spectacularisation of society. Similarly, representation triggers transitions in the prefiguration and communication of design, the anticipation and foreshadowing of future events.The challenges posed by the digital pose open questions whose scope can only be glimpsed, such as the relationship between drawing and the act of modelling, and the construction of new paradigms of visual language and communication. ‘Transitions’, almost implicitly, points to possible futures, the evolution of technique and the search for new modes of expression; at the same time, however, it can suggest silences and reflections in a process of connection between history, theory, criticism and construction.

Auch aus ex post Perspektive bleibt ein Transparenzdefizit bestehen. Aufgrund der mit dem Einsatz von KI-Systemen verbundenen spezifischen Risiken stellt sich die Frage, ob und inwieweit der Staat gegenüber dem Bürger KI einsetzen darf. Dabei hängt das »Ob« des hoheitlichen KI-Einsatzes entscheidend von der Reichweite der Haftung des Staates auf Sekundärebene ab. Das überkommene Staatshaftungsrecht bietet hierfür de lege lata keinen ausreichenden Sekundärrechtsschutz. Der hoheitliche KI-Einsatz wäre ohne die Implementierung eines angemessenen Haftungstatbestands auf Sekundärebene verfassungswidrig. Aus diesem Blickwinkel heraus fordert Pauli die Einführung eines speziellen öffentlich-rechtlichen Gefährdungshaftungstatbestands, den sie abschließend in einem konkreten Gesetzgebungsvorschlag ausformt.

Das etablierte Thema der Automatisierung in Staat und Verwaltung unterliegt im Zuge der gegenwärtigen soziotechnischen Transformationsprozesse neuen Dynamiken und stellt den Anlass der Arbeit dar. Ausgehend von einer kritischen Betrachtung des juristischen Verständnisses von Entscheidungen und Entscheidungsbildung wird der Bedarf einer interdisziplinär offenen Rechtswissenschaft nach einer analytischen De- und Rekonstruktion der sich wandelnden staatlich-exekutiven Entscheidungsgebilde festgestellt. Für diese Zwecke wird unter Beachtung rechtsstaatlicher Anforderungen an Kontrolle und Individualrechtsschutz die interdisziplinär informierte, ›deskriptive Systematik der Entscheidungsarchitektur‹ eingeführt, deren Anwendung die Herleitung konkreter verfassungsrechtlicher Ergebnisse sowie konstruktive, interdisziplinäre Analysen komplexer staatlicher Entscheidungsbildung ermöglicht.

Untersuchungsfunde in dem zugrundeliegenden Strafverfahren weiter genutzt werden dürfen oder aus Gründen des Grundrechtsschutzes einer Verwertungssperre unterliegen. Verwendungsregelungen hingegen regeln den Transfer von Informationen von einem Ausgangsverfahren in andere Verfahren; diese Informationen und Daten stellen Zufallsfunde dar. Verwertungsverbote sind nur in wenigen Fällen gesetzlich geregelt; Verwendungsregelungen kennt das Gesetz inzwischen flächendeckend. Beide Formen der weiteren Nutzung von Informationen stellen einen eigenständigen Eingriff in das Recht auf informationelle Selbstbestimmung dar, weshalb es auch im Fall der Verwertung spezieller Verwertungsbefugnisnormen bedarf. Die Arbeit unternimmt es de lege ferenda, die Begriffe der unmittelbaren wie mittelbaren Verwertung und Verwendung zu bestimmen sowie gesetzliche Regelungen für Verwertungsbefugnisse zu schaffen. Parallel werden die bestehenden Verwendungsregelungen im Rahmen eines weiteren Gesetzesvorschlags auf ihre Verfassungsmäßigkeit hin überprüft.

Analysiert wird die Rolle von Gustav Schmoller als Führungsfigur der Deutschen Historischen Schule und maßgeblichem Mitbegründer und Vorsitzenden des Vereins. Es zeigt sich, dass die Sozialpsychiatrie gesellschaftliche Modernisierungsschübe reflektiert und nachholend umsetzt.

Die Informationsgesellschaft pflegt einen selbstverständlichen Umgang mit sich immer weiter entwickelnden technischen Geräten. Als Schein oder Unwirklichkeit konnotiert, bleiben die neuen Phänomene der Virtualität dabei jedoch weitgehend unreflektiert. Tobias Holischkas phänomenologische Analyse zeigt, dass insbesondere der virtuelle Ort als versammelndes Prinzip eine Realität schafft, die - ganz im Gegensatz zum abstrakten Konzept des Cyberspace - eine ontologische Verbindung zur menschlichen Alltagswelt herstellt und sie auf diese Weise erweitert.

In fact, the disciplines of drawing have always been confronted with themes and issues relating to transitions from one condition to another. The history of representation tells us of transformations, even epochal ones, relating to ‘drawing’, with all that such transitions entail: suffice it to think of the evolution of forms of representation, of instrumental apparatuses, of the mutability of supports, of the analogical-digital transition underway, of the new modes of communication on platforms, of the hypertrophic offer of images also on the net that confirms Guy Debord’s intuitions relating to the new spectacularisation of society. Similarly, representation triggers transitions in the prefiguration and communication of design, the anticipation and foreshadowing of future events.The challenges posed by the digital pose open questions whose scope can only be glimpsed, such as the relationship between drawing and the act of modelling, and the construction of new paradigms of visual language and communication. ‘Transitions’, almost implicitly, points to possible futures, the evolution of technique and the search for new modes of expression; at the same time, however, it can suggest silences and reflections in a process of connection between history, theory, criticism and construction.

Das Opfer ist so bloß die »Leinwand«, auf der sich das Unrecht zwischen Täter und Staat abspielt. Die Arbeit argumentiert demgegenüber für einen strafrechtlichen Paradigmenwechsel, um Verbrechen als Verletzung individueller Rechte und zugleich der Rechtsgemeinschaft zu begreifen. Mit einem interdisziplinären Zugang weist es anhand des geltenden Strafrechts die Verletzung subjektiver Rechte von Verbrechensopfern als Wesenselement des Kriminalunrechts aus. In fact, the disciplines of drawing have always been confronted with themes and issues relating to transitions from one condition to another. The history of representation tells us of transformations, even epochal ones, relating to ‘drawing’, with all that such transitions entail: suffice it to think of the evolution of forms of representation, of instrumental apparatuses, of the mutability of supports, of the analogical-digital transition underway, of the new modes of communication on platforms, of the hypertrophic offer of images also on the net that confirms Guy Debord’s intuitions relating to the new spectacularisation of society. Similarly, representation triggers transitions in the prefiguration and communication of design, the anticipation and foreshadowing of future events.The challenges posed by the digital pose open questions whose scope can only be glimpsed, such as the relationship between drawing and the act of modelling, and the construction of new paradigms of visual language and communication. ‘Transitions’, almost implicitly, points to possible futures, the evolution of technique and the search for new modes of expression; at the same time, however, it can suggest silences and reflections in a process of connection between history, theory, criticism and construction.

    Description: The volume, dedicated to the 44th International Conference of the Italian Union for Drawing, investigates the theme of ‘Transitions’, which particularly effectively represents our time and the current condition of the discipline of Drawing. The term, beyond its generic meaning of an intermediate stage in a process in which a condition changes from one state to another, has always been used in various fields, from music to geophysics. In fact, the disciplines of drawing have always been confronted with themes and issues relating to transitions from one condition to another. The history of representation tells us of transformations, even epochal ones, relating to ‘drawing’, with all that such transitions entail: suffice it to think of the evolution of forms of representation, of instrumental apparatuses, of the mutability of supports, of the analogical-digital transition underway, of the new modes of communication on platforms, of the hypertrophic offer of images also on the net that confirms Guy Debord’s intuitions relating to the new spectacularisation of society. Similarly, representation triggers transitions in the prefiguration and communication of design, the anticipation and foreshadowing of future events.The challenges posed by the digital pose open questions whose scope can only be glimpsed, such as the relationship between drawing and the act of modelling, and the construction of new paradigms of visual language and communication. ‘Transitions’, almost implicitly, points to possible futures, the evolution of technique and the search for new modes of expression; at the same time, however, it can suggest silences and reflections in a process of connection between history, theory, criticism and construction.

    Description: Zur Bewältigung von Organisierter (Drogen)Kriminalität finden zeitlich und finanziell aufwändige, meist verdeckte Ermittlungen gegen eine Vielzahl von Akteuren statt. Um diese Hintergrundermittlungen nicht vorzeitig aufzudecken, wird die sog. ›Legendierte Kontrolle‹ eingesetzt, bei der die Ermittlungsbehörden eine Durchsuchung als allgemeine Verkehrskontrolle tarnen. Die Arbeit ordnet das Instrument in das bestehende System verdeckter und täuschender Ermittlungsmaßnahmen ein. Sie analysiert die verfassungs- und strafverfahrensrechtliche Zulässigkeit des staatlichen Vorgehens, das sich im Grenzbereich zwischen Gefahrenabwehr und Strafverfolgung bewegt. Ein besonderer Schwerpunkt liegt auf der Frage, ob entgegen dem Grundsatz der Aktenwahrheit eine legendierte, also unzutreffende oder unvollständige Aktenführung erlaubt sein kann. Hier werden die Grenzen der staatlichen Täuschungsbefugnis – trotz der Maxime einer effektiven Strafverfolgung – gegenüber Beschuldigten herausgearbeitet.

Bleibt dieses Begreifen aus, wird der Gründungsakt zur gewesenen Freiheit und die Verwaltung des Staats zur Expert*innensache. Doch wo bleibt da die kreative Freiheit? Diese Frage macht eine Kritik der ethischen Institution notwendig. Dabei zeigt Thies Münchow in Anschluss an Kant und Hegel den integralen Zusammenhang von Ethik und Politik auf und nimmt zuletzt eine Neubestimmung der politischen Theologie vor.

    Description: Die Europäische Union steht vor großen Herausforderungen. Erweiterung und Vertiefung der Union stehen auf der Politikagenda. Ob die Vorschläge des Europäischen Verfassungskonvents für eine grundlegende Erneuerung des Unionsvertrages diesbezüglich zukunftsfähig sind, bedarf einer intensiven Diskussion. In den Beiträgen des vorliegenden Bandes stehen Probleme speziell der europäischen Wirtschaftsverfassung im Mittelpunkt. Obwohl der Begriff der Wirtschaftsverfassung nicht eindeutig definiert ist, sind juristische und vor allem verfassungs- und institutionenökonomische Analysen von Belang. Dabei spannen die Beiträge einen Bogen über die wichtigsten Problembereiche. Grundsätzliche Überlegungen zu einer europäischen Verfassung führen zu den Fragen: Benötigen wir überhaupt eine Verfassung für Europa? Wie ist das Verhältnis zwischen den Nationalstaaten und der Union zu regeln? Freiheit, Bürgersouveränität und Subsidiarität - als eine spezielle Ausprägung des Prinzips der komparativen Wettbewerbsvorteile - spielen in der europäischen Wirtschaftsverfassung eine zentrale Rolle. Sie ergänzen sich mit Überlegungen zur europäischen Finanzverfassung, in der auch die Frage nach den institutionellen Ebenen gestellt wird, die für die Bereitstellung und Finanzierung unterschiedlicher Güter in der Union verantwortlich sind. Gefragt wird auch, ob eine Koordination der nationalen Arbeitsmarktpolitiken auf EU-Ebene sinnvoll ist, oder ob die Bekämpfung der Arbeitslosigkeit im nationalen Politikbereich verbleiben sollte. Vor dem Hintergrund der Theorie optimaler Jurisdiktionen stellt sich die Frage nach der optimalen Länderzahl für die EU-Erweiterung. Optimalitätsprobleme aufgrund der Erweiterung des Euro-Raumes werden hinsichtlich der Entscheidungseffizienz des Rats der Europäischen Zentralbank erörtert.     Description: Die Digitalisierung des Maklergeschäfts hat dazu geführt, dass der Abschluss eines Maklervertrages zwischen dem Maklerkunden und dem Makler regelmäßig online im Internet zustande kommt. Der Makler ist dann verpflichtet, seinen Kunden über das Verbraucherwiderrufsrecht zu belehren. Sofern dies nicht ordnungsgemäß geschieht, ist der Maklervertrag innerhalb einer Frist von einem Jahr und 14 Tagen widerrufbar. Macht der Maklerkunde davon Gebrauch, ist er auch dann nicht zur Zahlung der Maklerprovision verpflichtet, wenn er die Früchte der Maklerleistung nutzt und den notariellen Kaufvertrag schließt. Vor diesem Hintergrund beschäftigt sich die Arbeit mit weiteren zahlreichen praktischen Problemstellungen, die aus dem Abschluss eines Online-Maklervertrages resultieren und plädiert, insbesondere vor dem Hintergrund der rein erfolgsabhängigen Vergütung des Maklers, auf eine Abkehr von der Pflicht zur Belehrung über das Widerrufsrecht bei Abschluss des Maklervertrages.

    Description: In der Arbeit werden zunächst die Bedeutung des Wettbewerbs im Vergaberecht und dessen Verhältnis zum Wettbewerbsrecht untersucht. Anschließend werden allgemeine vergaberechtliche Grundsätze dargestellt. Dabei werden ihre wettbewerbspolitische Funktion und die darüber hinausgehende Bedeutung beleuchtet. Weiterhin wird untersucht, wie wettbewerbswidrige Verhaltensweisen auf Bieter- oder Auftraggeberseite unter vergaberechtlichen Gesichtspunkten systematisiert werden können. Auch wird thematisiert, inwieweit wettbewerbsrechtliche Ansprüche vor den Vergabenachprüfungsinstanzen geltend gemacht werden können. Aus der Untersuchung resultiert, dass die praktische Bedeutung des Wettbewerbsrechts im Vergaberecht gering ist, denn das Vergaberecht verfügt bereits über eigene Instrumente, mit denen verschiedene Wettbewerbsprobleme ohne den Umweg über das Wettbewerbsrecht unterbunden werden können.

Similarly, representation triggers transitions in the prefiguration and communication of design, the anticipation and foreshadowing of future events.The challenges posed by the digital pose open questions whose scope can only be glimpsed, such as the relationship between drawing and the act of modelling, and the construction of new paradigms of visual language and communication. ‘Transitions’, almost implicitly, points to possible futures, the evolution of technique and the search for new modes of expression; at the same time, however, it can suggest silences and reflections in a process of connection between history, theory, criticism and construction.
