    Description: The present work starts from the problem when investigating how the same penalty for the crime of Fraudulent Embezzlement affects the principle of proportionality, so it is necessary to refer to Article 387 of the Penal Code, which reads as follows: The public official or servant who appropriates or uses, in any form, for himself or for another, funds or effects whose collection, administration or custody are entrusted to him by reason of his position, shall be punished with deprivation of liberty for not less than two nor more than eight years. It is an aggravating circumstance if the funds or effects were destined for welfare purposes or social support programs. In these cases, the prison sentence shall be not less than four nor more than ten years. According to the Plenary Agreement No. 4-2005/CJ-116, Plenary Jurisdiction of the Permanent and Transitory Criminal Chambers of the Supreme Court of Justice, the elements of the criminal offense of embezzlement are (i) the existence of a functional relationship, (ii) the collection, administration or custody, (iii) appropriation or use, (iv) the recipient: for himself or for a third party, (v) funds and effects. The result was that when punishing with the same penalty in the crime of Fraudulent Misappropriation in its modality of appropriation and use, despite the differences if we appreciate them from a patrimonial perspective or from the perspective of safeguarding the right of property of the public entity, in the modality of use there is an excess in the penalization, affecting the principle of proportionality, reason for which it should have a different treatment.

    Description: El presente trabajo se inicia del problema cuando se investiga de qué manera al sancionar con una misma pena en el delito de Peculado Doloso afecta el principio de proporcionalidad, por lo que es necesario remitirnos al artículo 387 del Código Penal, cuyo tenor es como sigue: El funcionario o servidor público que se apropia o utiliza, en cualquier forma, para sí o para otro, caudales o efectos cuya percepción, administración o custodia le estén confiados por razón de su cargo, será reprimido con pena privativa de la libertad no menor de dos ni mayor de ocho años. Constituye circunstancia agravante si los caudales o efectos estuvieran destinados a fines asistenciales o a programas de apoyo social. En estos casos, la pena privativa de la libertad será no menor de cuatro ni mayor de diez años. Según lo establecido por el Acuerdo Plenario N.° 4-2005/CJ-116, Pleno jurisdiccional de las Salas Penales Permanentes y Transitoria de la Corte Suprema de Justicia, los elementos del tipo penal de peculado son (i) la existencia de una relación funcional, (ii) la percepción, administración o custodia, (iii) apropiación o utilización, (iv) el destinatario: para sí o para un tercero, (v) caudales y efectos. El resultado fue que al sancionar con una misma pena en el delito de Peculado Doloso en su modalidad de apropiación y utilización visten de igual contenido de ilicitud, pese a las diferencias si las apreciamos desde una perspectiva patrimonialista o de salvaguarda del derecho de propiedad del ente público, en la modalidad de utilizar existe un exceso en la penalización afectándose el principio de proporcionalidad, razón por la cual debe tener un tratamiento distinto.

    Description: The Faculty of Philosophy and Letters in Madrid commissioned Marcelino Menéndez Pelayo and Nicolás Salmerón to write a report on the royal decrees that reduced university staffing levels, given by virtue of the authorisations granted by the Budget Law of 30 June 1892. The text of the opinion is reproduced together with some extracts from a well-known book by the professor from the Central University (Historia de los heterodoxos españoles) which help to understand the context of the message. It thus serves to document the extent of an opinion, which is not confined to a single group - the Krausist group - but is shared by other sectors that conceive of the university as something more than an administrative office. The key ideas are: the immobility of the teaching staff; an ideal of family life geared towards scientific research; the demand for autonomy - freedom of action - for the university body; the conception of the university as the representative of national culture; the promotion of scientific and not only professional faculties; the intervention of the university in the choice of its staff; the elimination of course exams... In short, it rejected "the trampling importation of the French centralist regime" and called for emancipation from excessive official tutelage.

    Description: La Facultad de Filosofía y Letras de Madrid comisionó a Marcelino Menéndez Pelayo y a Nicolás Salmerón para redactar un informe sobre los reales decretos que reducían las plantillas de las universidades, dados en virtud de las autorizaciones concedidas por la Ley de Presupuestos de 30 de junio de 1892. Se reproduce el texto del dictamen junto a unos fragmentos de un conocido libro del profesor de la Central (Historia de los heterodoxos españoles) que ayudan a comprender el contexto del mensaje. Sirve así para documentar la extensión de una opinión, que no se circunscribe a un solo grupo –el krausista– sino que es compartida por otros sectores que conciben la universidad como algo más que una oficina administrativa. Las ideas clave son: la inamovilidad profesoral; un ideal de vida familiar encaminada a la indagación científica; la exigencia de autonomía –libertad de acción– para el cuerpo universitario; la concepción de la universidad como representante de la cultura nacional; el fomento de las facultades científicas y no solo profesionales; la intervención de la universidad en la elección de su personal; la eliminación de los exámenes de curso... En definitiva, se rechaza “la atropellada importación del régimen centralista francés” y se reclama la emancipación de la excesiva tutela oficial.

    Description: Engativá is one of the 21 political-administrative divisions of the Capital District of Bogotá (Colombia), and is distinguished by its urban composition, a high population density and its soils dedicated mainly to residential, commercial and industrial use. However, this territory is also characterized by the presence of ecosystems rich in biodiversity that are threatened by factors associated with urbanization and the effects of climate change. In this locality there are three urban wetlands of RAMSAR category: Juan Amarillo, Jaboque and Santa María del Lago, in addition, in terms of water management, by the administrative jurisdiction of Engativá is a portion of land of the basins of the Bogotá River and the Salitre River. On the other hand, among the green areas that make up the urban fabric, such as neighborhood parks, complementary conservation areas such as the botanical garden and La Florida Regional Park stand out. In relation to these urban ecosystems, which are part of the Main Ecological Structure of the Capital District and its environmental region, this book contains an analysis of each of these components, highlighting elements of their historical trajectory, specialized legal regulations and a description of specific challenges. One of the purposes of the systematization of information collected here is to make evident the nuances of the environmental urban planning managed in the administrative jurisdiction of Engativá: a place where urban vitality and nature converge in a fragile balance, marked by a complex trajectory of environmental degradation and adoption of the inhabitants to the territory.

    Description: Engativá es una de las 21 divisiones político – administrativas del Distrito Capital de Bogotá (Colombia), y se distingue por su composición urbana, una alta densidad poblacional y sus suelos dedicados principalmente al uso residencial, comercial e industrial. No obstante, este territorio también es caracterizable por la presencia de ecosistemas ricos en biodiversidad que se encuentran amenazados por factores asociados a la urbanización y los efectos del cambio climático. En esta localidad se encuentran tres humedales urbanos de categoría RAMSAR: Juan Amarillo, Jaboque y Santa María del Lago, además, en materia de ordenamiento hídrico, por la jurisdicción administrativa de Engativá se encuentra una porción de terreno de las cuencas del río Bogotá y del río salitre. Por otra parte, entre las áreas verdes constitutivas del tejido urbano como los parques de carácter vecinal, sobresalen las áreas complementarias para la conservación como el jardín botánico y el Parque regional La Florida. En relación con estos ecosistemas urbanos, que hacen parte de la Estructura Ecológica Principal del Distrito Capital y su región ambiental, el presente libro contiene un análisis de cada uno de estos componentes, resaltando elementos de su trayectoria histórica, las regulaciones jurídicas especializadas y una descripción de los desafíos específicos. Uno de los propósitos de la sistematización de información aquí recogida es hacer evidentes los matices del ordenamiento urbano ambiental gestionado en la jurisdicción administrativa de Engativá: un lugar donde convergen la vitalidad urbana y la naturaleza en un equilibrio frágil, marcado por una trayectoria compleja de degradación ambiental y adoptación de los habitantes al territorio.

    Description: The Capital District, as a territorial entity located in the center of the Bogota Savanna, has the political and administrative responsibility to lead environmental sustainability and articulate with the Corporación Autónoma Regional de Cundinamarca (CAR) in order to preserve the ecological structure of the territory and promote sustainable land uses (urban and rural). To this end, there is a set of administrative tools and instruments contemplated in the Land Use Plan (POT) of the Capital District that all citizens should know and use to protect the ecosystems of the savanna of Bogota and the human rights associated with environmental sustainability. The objective of this publication is to contribute to the dissemination of these tools, through conceptualization and synthesis of relevant legal information on the subject. To achieve this purpose, this book is structured in two parts, the first one presents a theoretical contextualization and history of land use planning in Bogota and the second part presents the main concepts of the main ecological structure following the articles of the POT of Bogota - District Decree 555 of 2021.

    Description: Since the turn of the century, the approach of the European Court of Human Rights to reviewing individual cases has taken a procedural turn. As well as analysing the substantive claims of individuals, the Court is increasingly building into its analysis a review of the applicable domestic process for protecting human rights. This shift in approach will be referred to as the Court’s current methodology. The greater use of this form of review, and its normative justification, has been discussed elsewhere. Indeed, although the adoption of this methodology may be understood broadly as an implementation of the principle of subsidiarity, it has also been observed to mark a shift away from the orthodox approach to subsidiarity. This book thus seeks to contribute to the understanding of process-based review by conducting a doctrinal analysis of two key aspects of the Court’s process-based methodology. First, the Court’s engagement with the adequacy of balancing in light of the Convention of the relevant interests at issue within domestic processes. Second, the development of a process based approach under the rubric of Article 35 of the Convention, entailing the requirement for the exhaustion of domestic remedies. Specifically, these two methodological aspects of the Court’s review will be understood in relation to their evolution within the Convention jurisprudence. Part II engages with the explicit introduction of the concept of subsidiarity into the Convention system. Part III then turns to consider the development of the Court’s engagement with the adequacy of balancing in domestic processes. This doctrinal analysis reveals that this aspect of the Court’s jurisprudence has three distinct phases, with the most recent phase entailing an emerging rule of law approach. Part IV will then examine the jurisprudential foundations for the Court’s process-based approach towards its assessment under Article 35. This section will also conduct a study of the development of structural guidance for specific domestic processes under Article 35, using the example of domestic individual complaint mechanisms. Finally, the book will explore the recent operation of process-based methodologies across Articles 5, 10, and 8 of the Convention (Part V), revealing the duality between substance and process-based focuses within the Court’s review under different areas of the Convention.

    Description: With the globalization in which we find ourselves, violence against women or members of the family nucleus has been increasing as it develops in each of the homes and this occurs when there are violent acts by the aggressor towards the victims of this particular most of the cases are brought to the attention of the competent authorities. It must be understood that in Latin America, where the countries are less developed, violence occurs against women and this does not have a real index, because most of them do not make it known that they are victims of violence. In the Ecuadorian State there are several types of violence that are known by the Public Prosecutor's Office, the cases of physical violence and psychological violence are the ones that are related to each other, that is to say, physical and psychological aggression. In Ecuador with the reform of the Organic Integral Penal Code in 2019 and its subsequent validity and application in June 2020, the implementation of new legal mechanisms to suspend the substantiation of the process in matters of violence against women or members of the family nucleus, as special procedures to solve the problems of this matter is given, considering that the constitutional norm establishes that the State will guarantee the victim the punishment of the aggressor through special procedures in relation to violence.

    Description: Con la globalización en la que nos encontramos la violencia contra la mujer o miembros del núcleo familiar ha ido en aumento ya que se desarrolla en cada uno de los hogares y esta ocurre cuando existe actos violentos por parte del agresor hacia las víctimas de este particular la mayoría de los casos son puestos en conocimiento de las autoridades competente. Hay que entender que América Latina donde los países son menos desarrollados, la violencia ocurre contra la mujer y ésta no tiene un índice real, debido a que la mayoría no pone en conocimiento de qué son víctimas de violencia. En el Estado ecuatoriano existen diversos tipos de violencia que son conocidos por fiscalía de mayor forma se dan los casos de violencia física y violencia psicológica estos tipos de violencia son los que se relacionan entre sí, es decir, la agresión física y psicológica. En el Ecuador con la reforma del Código Orgánico Integral Penal en el año 2019 y su posterior vigencia y aplicación en mes en el mes de junio del 2020, se da la implementación de nuevos mecanismos legales para suspender la sustanciación del proceso en materia de violencia contra la mujer o miembros del núcleo familiar, como procedimientos especiales para solucionar los problemas de esta materia considerando que la norma constitucional establece que el Estado garantizará a la víctima la sanción del agresor mediante procedimientos especiales en relación a la violencia.

El cuerpo de profesores agregados de universidad fue creado en 1965 y se integró en el de catedráticos en 1983.

    Description: Gregorio López de Tovar (1547-1636) was, besides being a prosecutor, oidor and counselor of Orders, the architect of a repertoire of laws and glosses destined to accompany the successful official edition that in 1555 his grandfather, Gregorio López de Valenzuela (1490-1560), had prepared of the Partidas. The memoirs in which, throughout most of his life, he recorded these and other public and private events, remained unpublished as a whole until now. Beyond the editorial history of this code, to which they have contributed, their possibilities remained untapped for knowledge of the mechanics of access and promotion within the judicial machinery or of the social customs of his privileged estate, among other inquisitive aspects.

    Description: Valentín Ortigosa, born in 1784 in Arriate (Málaga), emigrated to Mexico in 1803, where he was ordained a priest. He returned to Spain in 1810. His biography will reflect the events that took place in those years of the 19th century in which he lived, especially the problems that arose in the relations between Rome and Madrid as the representative system was being established. Although he would never occupy a relevant public position, Ortigosa moved in the circle of Agustín Argüelles, or José María de Calatrava; he enjoyed the favor of the queen governor María Cristina and his political opinions, especially in relation to the independence of the American countries, found echo in the press. Presented by the Regent to be bishop of Malaga in 1836, being suspended in fact the relations between the crown of Spain and Rome, his designation was not confirmed, but he was named capitular vicar and this allowed him to rule the Diocese without having been consecrated bishop; he became one of the "intrusive bishops". Due to denunciations of the Chapter of Malaga, a case was opened against him before the Tribunal of the Archbishopric of Seville. Later the appeal of force that Ortigosa raised before the Audience of Seville, and its execution by the Supreme Court ended up giving rise to the rupture of the relationship with the Holy See with the closing of the Nunciature of Madrid in January of 1841. This case and its repercussions are studied in detail in this book, both from the juridical, civil and canonical point of view, as well as from the political point of view. The documentation collected from newspaper archives and from numerous archives, both Spanish and Roman, has made it possible to analyze the consequences of the question of the so-called "intruders" starting from the case of Valentín Ortigosa, a character whose notoriety in these years contrasts with the oblivion of his name after disappearing from public life in 1843.

Su biografía reflejará los acontecimientos que se suceden en esos años del s. XIX en los que vivió, especialmente los problemas que surgieron en las relaciones entre Roma y Madrid a medida que el sistema representativo se iba instaurando. Aunque no ocuparía nunca un cargo público relevante, Ortigosa se movió en el círculo de Agustín Argüelles, o José María de Calatrava; gozó del favor de la reina gobernadora María Cristina y sus opiniones políticas, en especial en lo relacionado con la independencia de los países americanos, encontraron eco en la prensa. Presentado por la Regente para ser obispo de Málaga en 1836, estando suspendidas de hecho las relaciones entre la corona de España y Roma, su designación no se confirmó, pero fue nombrado vicario capitular y esto le permitió regentar la Diócesis sin haber sido consagrado obispo; se convirtió en uno de los “obispos intrusos”. Por denuncias del Cabildo de Málaga se abrió una causa contra él ante el Tribunal del Arzobispado hispalense. Mas tarde el recurso de fuerza que Ortigosa planteó ante la Audiencia de Sevilla, y su ejecución por el Tribunal Supremo acabó dando lugar a la ruptura de la relación con la Santa Sede con el cierre de la Nunciatura de Madrid en enero de 1841. Esta causa y sus repercusiones son estudiadas con detenimiento en este libro, tanto desde el punto de vista jurídico, civil y canónico, como desde la óptica política. La documentación recogida de hemerotecas y de numerosos archivos, españoles y de Roma, ha permitido analizar las consecuencias de la cuestión de los llamados “intrusos” a partir del caso de Valentín Ortigosa, un personaje cuya notoriedad en estos años contrasta con el olvido de su nombre tras desaparecer de la vida pública en 1843.

    Description: At the end of the 19th century, Spain enjoyed a favorable climate for developing true freedom of the press, a right recognized in Article 13 of the Constitution of 1876 and developed through the Printing Police Law of 1883. However, throughout the period of the Bourbon Restoration (1883-1923), the Spanish government, represented by the conservative and liberal parties that peacefully took turns in power, adopted a series of measures that distorted the longed-for freedom of Spanish publications. The political and social events characteristic of this period (especially the terrorism of the end of the 19th century, the colonial conflicts in Cuba and Morocco or the influence of the regionalisms of the 20th century), had a notable influence on the actions of the public authorities. The latter used different legal instruments (the approval of different laws limiting freedom, the frequent declaration of the suspension of constitutional guarantees or the multiple sentences imposed through the ordinary courts), and other indirect mechanisms (the reptile funds or the sending of guidelines to newspapers under the threat of suspension or suppression of the newspapers), which served to establish a regime of information control, especially severe with the press that did not follow the guidelines of the liberal regime in place, and which left the liberal Printing Press Law practically without effect.

    Description: Bei der Beschreibung der Rechtssysteme und Gesetze der heutigen mehrheitlich muslimischen Staaten in der Region des Nahen Ostens und Nordafrikas werden zwei Kategorien von Gesetzen unterschieden: eine aus dem islamischen und eine aus dem nichtislamischen Recht abgeleitete. Diesem Gedanken folgend, wird in der Literatur festgestellt, dass neuartige Rechtsgebiete keinen Bezug zum islamischen Recht haben, da sie nicht durch das klassische islamische Recht geregelt wurden. Im Gegensatz dazu ist das Thema Organtransplantation von Natur aus mit dem islamischen Recht verbunden, da der Islam sich selbst als alle Aspekte des Lebens umfassend versteht. Diese Untersuchung, die sich auf die Analyse der Organtransplantationsgesetze der MENA-Staaten stützt, regt dazu an, zu überdenken, dass eine strikte Dichotomie zwischen islamischen und nicht-islamischen Gesetzen nicht existiert. Die Gesetze zur Organtransplantation in den MENA-Staaten folgen im Allgemeinen einem internationalen Rechtsstandard und stehen gleichzeitig im Einklang mit der Scharia.
    Description: When describing the legal systems and laws of today’s Muslim-majority states in the Middle Eastern and North African region, two categories of laws are identified: one derived from Islamic and one from non-Islamic law. Following this notion, the literature finds that novel legal areas do not have any connection to Islamic law since they were not regulated by classical Islamic law. In contrast, the topic of organ transplantation is inherently connected to Islamic law because Islam considers itself to encompass all aspects of life. This research based on the analysis of organ transplantation laws of the MENA states encourages to rethink that a strict dichotomy between Islamic and non-Islamic laws does not exist. Organ transplantation laws in MENA states generally follow an international legal standard while also complying with the sharia.

    Description: References to community interests appear from time to time in scholarly writings in the field of international relations and international law. The concept of community interests refers to interests protected by international law binding either all or a group of states and go beyond the delimitation of a sovereign sphere of influence. In the literature, there are existing examples of research, such as in books and journal articles, that consider the various manifestations of what has been described as “community interests” in many areas regulated by international law, including natural resources, global markets, human rights, and the use of force, and observe how law has evolved from a legal system based on more or less specific consent and aimed at promoting the particular interests of states, to one that is more generally oriented towards collectively protecting common interests and values. However, this topic has not been thoroughly researched, meaning that there is a huge gap in the existing literature, particularly in the context of ocean governance and sustainability. This Special Issue attempts to fill this gap, so as to attract more studies on this important topic in academia.

    Description: Ways of evaluating the societal impact of real-world labs as a transdisciplinary and transformative research format are under discussion. We present an evaluation approach rooted in structuration theory, with a focus on structure-agency dynamics at the science-society interface. We applied the theory with its four modalities (interpretation schemes, norms, allocative and authoritative resources) to the case of the Mirke neighbourhood in Wuppertal, Germany. Six projects promoted the capacity for co-productive city-making. The effects of the projects were jointly analysed in a co-evaluation process. Previously proposed subcategories of the modalities as an empirical operationalisation were tested and confirmed as being applicable. Five new subcategories were generated. The use of the modalities seems appropriate for co-evaluation processes. The tool is practical, focused on real-world effects, and suitable for transdisciplinary interpretation processes. We encourage further empirical testing of the tool, as well as development of the subcategories.

    Description: Real-world laboratories (RwLs) are gaining further traction as a means to achieve systemic impacts towards sustainability transformation. To guide the analysis of intended impacts, we introduce the concept of leverage points, discerning where, how, and to what end RwLs intervene in systems. Building on conceptual reasoning, we further develop our argument by exploring two RwL cases. Examining RwLs through the lens of the leverage points opens the way for a balanced and comprehensive approach to systemic experimentation. We invite RwL researchers and practitioners to further advance RwLs' transformative capacity by targeting the design and emerging direction of a system, contributing to a culture of sustainability.

    Description: In Germany, there are over 32,000 schools, representing great potential for climate protection. On the one hand, this applies to educational work, as understanding the effects of climate change and measures to reduce GHG emissions is an important step to empower students with knowledge and skills. On the other hand, school buildings are often in bad condition, energy is wasted, and the possibilities for using renewable energies are hardly used. In our "Schools4Future" project, we enabled students and teachers to draw up their own CO2 balances, identify weaknesses in the building, detect wasted electricity, and determine the potential for using renewable energies. Emissions from the school cafeteria, school trips, and paper consumption could also be identified. The fact that the data can be collected by the students themselves provides increased awareness of the contribution made to the climate balance by the various school areas. The most climate-friendly school emits 297 kg whilst the school with the highest emissions emits over one ton CO2 per student and year. Our approach is suitable to qualify students in the sense of citizen science, carry out a scientific investigation, experience self-efficacy through one's own actions, and engage politically regarding their concerns.

    Description: Although somewhat marginal in relation to the other senses, smell is the most potent way of anchoring ourselves to the world. We subconsciously find our place in it by sniffing our body, the body of the one next to us, the room in which we are, the culture with which we are familiar. There is an incessant olfactory flow consisting of bodies, human and nonhuman, that are agents of generation, consumption, diffusion, reproduction and dissolution of odours. As they move or pause, as they cluster with others or try to move away, these bodies constantly partake in this olfactory flow, this dense planetary swirl that leaves nothing outside. The law aims at presenting itself as rational and objective. Smell, on the other hand, is one of the least integrated senses in the legal edifice, in comparison to, say, seeing and hearing. This can be attributed mainly to the fact that sense-making of smell and law are different, even antithetical. Smell operates undercurrent, tickling the olfactory antennas of individual and collective bodies while habitually hiding behind other sensory volumes. Law, on the other hand, has an interest in appearing present, universal, constant. Olfactory sense-making relies on its elusiveness; legal sense-making invests in its obviousness. Yet, the two can interact in most unexpected ways, as this volume amply shows. If anything, smell airs the way in which law conceptualises and contextualises its own actuality. Smell brings law forth by allowing it to show its underbelly, its elusive sense-making that is invariably sacrificed in preference to the necessity of legal impressions of constancy. However, smell’s fragmentary, discontinuous and unstable nature, despite all the ordering that goes to it, poses a peculiar challenge to the law. This volume sets out to investigate this juncture.

I maintain that qualitative research is a fertile field to strengthen interactivity over one-sidedness, the experiential character among those who possess scientific knowledge; as well as social knowledge, popular knowledge, in the integral perspective of the ecology of knowledge, as the study of all existing sciences in the world.

Uno de ellos es justamente el tema del Derecho originario, indígena, ancestral que ahora es abordado como justicia intercultural, o pluralismo jurídico, y que recién empieza a ser tratado como una teoría y tendencia nueva que debe merecer un lugar en la construcción de un nuevo país en los próximos años.

    Description: The peasants' struggle to defend their dignity, achieve their freedom and shield their fundamental rights was arduous from the beginning; contradictorily, the marginalization suffered by the Spaniards in the colonial era was minor compared to the bloody exploitation of which they were victims in the republican era, a time where the flags of freedom and autonomy of the country were raised utopianly -ideally for the one who even came in a noble gesture to offer their lives, always first in the battle line of the liberation struggle-. In this context, a generation of Puno intellectuals arose, many of them knowledgeable in law, who from different fronts contributed to the feat of recognition of the rights that the man from the countryside always deserved for his own condition as a human being. This article focuses on the stage from 1821 to 1920, considering the political, legal and constitutional context; as well as in the indigenista movement both in its political, cultural and social sphere, given that its relevance is not exhausted in the temporal or historical aspect, especially if it continues to be part of the reflection on identity as a social group and of general shape as a nation and as a country

En ese contexto, surge una generación de intelectuales puneños, muchos de ellos entendidos en leyes, quienes desde distintos frentes aportaron en la gesta del reconocimiento de los derechos que el hombre del campo siempre mereció por su propia condición de ser humano.     Description: Throughout the history of our country there were different cultural developments, in this essay we are going to take into account only one, this is the Paracas culture, one of the oldest in Peru, also known as the dominators of the desert since they originated in the north of our country. The aim of this essay will be based mainly on demonstrating that the Paracas were not just a simple cultural development or a group of inhabitants of ancient Peru, on the contrary, we seek to highlight that each behaviourthroughout their period of development had a very important purpose that would demonstrate why the Paracas were a state that had a great administrative and sovereign power throughout the extension of its territory.In the course of the essay, first of all, general aspects of the Paracas state are mentioned, such as its period of development in ancient Peru, its discovery, its marvellous textile technique expressed mainly in its ceremonial and funerary mantles, as well as its architectural constructions. The fundamental aspects for a society to establish itself as a state are established, which according to García Toma and Porrúa Pérez are Population, Territory and Authority or Political Power, then each element is developed in relation to Paracas.In relation to the Paracas Territory, the territorial extension that they managed to dominate is mentioned and, of course, their capital is defined. Regarding the political power, which was considered as a theocratic government, we will explain the origin and the influences they had for this development to take place. Last but not least, we will talk about the population as the basis for the formation of a state, taking into account the importance of the economic activities they carried out. Finally, taking these three points into account, we will come to the conclusion that the Paracas were a highly organised population in various aspects, which would lead us to consider them as a very well-developed state of Ancient Peru.

El objetivo de este ensayo se basará principalmente en demostrar que los Paracas no solo fueron un simple desarrollo cultural o un grupo de habitantes del Perú antiguo, muy por el contrario, buscamos destacar que cada comportamiento en todo su periodo de desarrollo tenía un fin muy importante que demostraría por qué los Paracas fueron un Estado que contaba con un gran poder administrativo y soberano en toda la extensión de su territorio.En el transcurso del ensayo primeramente se mencionan aspectos generales del estado Paracas como su periodo de desarrollo del Perú antiguo, su descubrimiento, su maravillosa técnica textil expresados principalmente en sus mantos ceremoniales y funerarios, como también sus construcciones arquitectónicas. Se establecen los aspectos fundamentales para que una sociedad se establezca como estado el cual según García Toma y Porrúa Pérez son Población, Territorio y Autoridad o Poder Político, luego se desarrolla cada elemento en relación a Paracas.En base al Territorio Paracas se menciona la extensión territorial que lograron dominar y por su puesto definir cuál fuesu capital. Respecto al Poder político el cual era considerado como un gobierno teocrático, explicaremos el origen y las influencias que tuvieron para que se diera dicho desarrollo, por ultimo y no menos importante hablaremos sobre la población como base de la formación de un estado, teniendo en cuenta la importancia de las actividades económicas que estos realizaban. Finalmente tomando en cuenta estos tres puntos se llega a la conclusión de que los Paracas fueron una población sumamente organizada en diversos aspectos, lo que nos llevaría a considerarlo como un estado muy bien desarrollado del Perú Antiguo

Therefore, this essay aims to substantiate that the Incas formed a State, under the various requirements or essential elements therefore it requires. TheInca culture is studied and analyzed by historians, sociologists, anthropologists, etc. who throughout history tried to find out and interpret the various vestiges and the reason for their expansion and organization, as well as the form and type of government in the empire, which resemble the form of Roman government, omnipotent and centralist with a close cosmological, theological, blood bond. A sovereign State, with a high power over the population (ayllus) and the other ethnic groups absorbed by two modalities: by a peaceful way (respecting their culture and language) and by another violent and ruthless (imposing their culture and language).

    Description: In the present research work, it has the objective of demonstrating and arguing that the organization and characteristics of Chavín correspond properly to that of a State, such as government, territory and nation. As for its sociopolitical organization, itwas established under a theocratic system as one of the first forms of institutionalization, for which it was headed by the priests, followed by the warrior nobility and the people. Establishing ideological legitimacy, severely in religion and mythology; on the other hand, Chavín was constituted by a coercive force that contributed to the good organization that it possessed inside and outside its territory, therefore, it is implied that it was a great State, likewise, they have demonstrated their abilitiessuch as: the use of stone for the construction of public and private temples, which benefit from the good development of their society within their territory, in relation to the sovereignty that they had over political, social, cultural and economic activities. Another characteristic is that it possessed production surpluses, which manifested it through the distribution of wealth; and investigating a little more in the activities carried out by the inhabitants of Chavín, it is shown that they had a fairly developed agriculture. So, based on all the information collected and the analysis of each of the characteristics, we can conclude that Chavín meets the conditions and requirements to be considered a State.

    Description: El presente ensayo tiene el objetivode argumentarque la organización y las características de Chavín corresponden propiamente a la de un Estado,tales comogobierno, territorio y nación. En cuanto a su organización sociopolítica, se constituyó bajo un sistema teocrático como una de las primeras formas de institucionalización, por lo cual, estaba encabezada por los sacerdotes, seguido de la nobleza guerrera yel pueblo, estableciendo la legitimación ideológica, basándose en la religión y mitología; por otra parte, Chavín estaba constituida por una fuerza coactiva que contribuía a la buena organización que poseía dentro y fuera de su territorio, por ende, se daentender que fue un gran Estado,así mismo, han demostrado sus habilidades como el uso de la piedra para la construcción de templos de carácter público y privado que beneficiaban al buen desarrollo de su sociedad dentro de su territorio, en relación con la soberanía que esta tenía para con las actividades políticas, sociales, culturales y económicas. Otra característica es que poseía los excedentes de producción, que lo manifestaban a través del reparto de la riqueza; e indagando un poco más en las actividades que realizaban los pobladores de Chavín, se muestra que poseían una agricultura bastante desarrollada. Entonces, en base a toda la información recopilada y el análisis de cada una de las características, se concluye que Chavín cumple con las condiciones y requisitos para ser considerada como un Estado.

Aiming to test the state of teaching and learning during the pandemic, the lecture series asked whether ERT and learning (ERTL) compromised or enhanced the teaching and learning of law. Among others, various academics from UP Law as well as from the universities of KwaZulu-Natal, Johannesburg and Free State. as well as officials from the DHET, participated in the series. This collection comprises chapters written by some of the representatives who were involved in the lecture series. This book aims to set the tone for teaching and learning of law after the pandemic. It is our hope that the lessons learnt during the pandemic will be adopted in the day-to-day teaching pedagogy of law in the future. Despite the disruptions caused by the pandemic, a possibly unseen benefit can be identified. As this book argues, law teaching and learning using technological innovations have been positive for both academics and students. Thanks to technological innovation, the discipline of law is arguably in a far better position after the pandemic than before.

    Description: This book is about a distinctive ‘abyssal’ approach to the crisis of modernity. In this framing, influenced by contemporary critical Black studies, another understanding of the world of modernity is foregrounded – a world violently forged through the projects of Indigenous dispossession, chattel slavery and colonial world-making. Modern and colonial world-making violently forged the ‘human’ by dividing those with ontological security from those without, and by carving out the ‘world’ in a fixed grid of space and time, delineating a linear temporality of ‘progress’ and ‘development’. The distinctiveness of abyssal thought is that it inverts the stakes of critique and brings indeterminacy into the heart of ontological assumptions of a world of entities, essences, and universal determination. This is an approach that does not focus upon tropes of rescue and salvation but upon the generative power of negation. In doing so, it highlights how Caribbean experiences and writings have been drawn upon to provide an important and distinct perspective for critical thought. "How is it that ontology has come to be seen as the antidote for modernity? While Foucault denigrated ontology as a mistaken and parochial exercise, contemporary social theory holds out the promise that new modes of planetary knowledge will save us from our own excesses. These countries are: Burkina Faso, Cameroon, Côte d’Ivoire, the Democratic Republic of Congo, Ethiopia, Eswatini, the Gambia, Ghana, Kenya, Lesotho, Malawi, Mauritius, Nigeria, Sierra Leone, Tanzania, and Zimbabwe. Each of the chapters traces the impact that the Protocol has had on the policies, laws, court decisions, civil society activism, and legal education in the particular state. Each chapter also discusses the relationship of the state with the African human rights mechanisms. The book is an update of two prior volumes of essays, titled The impact of the African Charter and the Maputo Protocol in selected African states, published by PULP in 2012 and 2016, and edited by the Centre for Human Rights, Universityof Pretoria (Centre) and Victor Ayeni, respectively. The third edition, focused more narrowly on the Maputo Protocol, appears as the continent marks 20 years since the adoption of the Protocol on 11 July 2003. By 11 July 2023, 54 out of 55 African Union member states (with the exception of Morocco) have become party to the African Charter, and 44 of them have accepted the Maputo Protocol. The book is edited by and contains several chapters by alumni of the Master’s in Human Rights and Democratisation in Africa programme of the Centre.     Description: This essay shows that Chimú is a State, but what is a State? therefore, it is a politically organized society directed by a ruling class and whose purpose is to achieve the common welfare of the population that is settled in a certain territory. In this sense, the State is made up of three essential elements: Power, People and Territory. Therefore, the Chimú State -discovered by Max Uhle in 1902-complies with the three fundamental elements. As for the territory, it included the entire north coast of Peru from Tumbes to the Chillón River, being its capital Chan Chan, from there power was exercised through the "Ciquic" or maximum Chimú rulers and in the surrounding valleys through the "Alaec", both were in charge of organizing and directing the human element -the town-that was dedicated to various economic activities such as fishing, crafts, goldsmithing, agriculture, etc., which allowed the subsistence and development of all the Chimu state.

En ese sentido, el Estado este compuesto por tres elementos esenciales: Poder, Pueblo y Territorio. Por tanto, el Estado Chimú -descubierta por Max Uhle en 1902-cumple con los tres elementos fundamentales. En cuanto al territorio, comprendiótoda la costa norte del Perú desde Tumbes hasta el Rio Chillón, siendo su capital Chan Chan, desde allí se ejerció el poder a través del “Ciquic” o máximos gobernantes chimú y en los valles circundantes por medio de los “Alaec”, ambos se encargaban de organizar y dirigir al elemento humano -el pueblo-que se dedicaba a diversas actividades económicas como la pesca, la artesanía, la orfebrería, la agricultura, etc., que permitía la subsistencia y el desarrollo de todo el Estado Chimú.

    Description: The federal system adopted in the constituent process of 1853-1860 responded, on the one hand, to the confederative experience of previous years and, on the other, to the imprint of the model based on the Constitution of the United States of America of 1787. However, the Argentine constituents departed from this model by granting the National Congress the power to dictate the "civil, commercial, criminal and mining" Codes (Art. 67, sub. 11 CN). In this way, the constitutional organisation reflected the federal aspiration that allowed the provinces to preserve their historical-political identity, but various circumstantial reasons, such as the shortage of lawyers in the interior of the country and the felt need to standardise customs and legislation, led the Convention members to adopt the European system of codification in the area of substantive law. As a result of this process, a hybrid model was established, with federal features as regards the exercise of political and jurisdictional powers at the provincial level, but with a clear unitary element in the codification of substantive law. The reservation added in 1860 reinforced the intangibility of the jurisdictional power of the provinces, which thus retained their own courts and the power to regulate their procedural law. On the other hand, it was provided that until the National Congress enacted the substantive codes, the provinces were empowered to maintain their civil and criminal legislation (art. 108 CN). The first Argentine Criminal Code would not come into force until 1887, so, in exercise of this transitory power, many provinces adopted various codification projects in the previous years that were exclusively within their territorial scope. The Tejedor Project was adopted by the Province of Buenos Aires in 1877; La Rioja, which was the pioneer, adopted it in 1876; Entre Ríos, San Juan, Corrientes, San Luis and Catamarca in 1878; Mendoza in 1779; Santa Fe and Salta in 1880 and Tucumán in 1881; and the Provinces of Jujuy and Santiago del Estero did not adopt provincial codes but were governed by Castilian law until the first National Code was enacted. Cordoba, for its part, adopted, practically unchanged, the draft of the revision commission presented to the National Congress in 1881. This book attempts to analyse some aspects of that first moment of provincial codification, focusing on the Criminal Code in force in the Province of Cordoba between 1882 and 1886, trying to understand the way in which the operators of justice in Cordoba represented the codified law and to determine to what extent it is possible to associate that representation with what has been called "code culture". We believe that the experience of provincial codification cannot be fully understood without taking into account the way in which the new law was used in the courts. In this sense, the Historical Archive of the Province of Cordoba preserves, in its Crime Fund, an important number of cases that were consulted and analysed in this work. The documentary universe for the period in which the code was in force (1883-1886) is 403 cases. The aim is to offer a qualitative analysis which, based on the documentary testimonies, allows us to offer an adequate description of the features which, in terms of legal culture, can be considered characteristic of the practical experience of the provincial penal codification.

Sin embargo, los constituyentes argentinos se apartaron de ese modelo al otorgar al Congreso Nacional la potestad de dictar los Códigos “civil, comercial, penal y de minería” (art. 67, inc. 11 CN). De esta manera la organización constitucional reflejaba la aspiración federal que permitía a las provincias conservar su identidad histórico-política, diversas razones coyunturales como la escasez de letrados en el interior del país y la sentida necesidad de uniformar las costumbres y la legislación, llevaron a los convencionales a adoptar el sistema europeo de la codificación en materia de derecho sustantivo. Como resultado de este proceso, se instauró un modelo híbrido, con rasgos federales en lo que se refiere al ejercicio de las potestades políticas y jurisdiccionales en el ámbito provincial, pero con un claro elemento unitario situado en la codificación del derecho sustantivo. La reserva agregada en 1860 reforzó la intangibilidad del poder jurisdiccional de las provincias, que conservaron así sus propios tribunales y la potestad para regular su derecho procesal. Por otra parte, se dispuso que hasta tanto el Congreso Nacional no sancionase los códigos sustantivos, las provincias se entendían facultadas para mantener su legislación civil y penal (art. 108 CN). El primer Código Penal Argentino no entraría en vigencia sino hasta 1887, por ello, en ejercicio de esa potestad transitoria, muchas provincias adoptaron en los años anteriores diversos proyectos de codificación que rigieron exclusivamente dentro de su ámbito territorial. El Proyecto Tejedor fue adoptado por la Provincia de Buenos Aires en 1877, La Rioja, quien fue la pionera, lo adoptó en 1876; Entre Ríos, San Juan, Corrientes, San Luis y Catamarca en 1878; Mendoza en 1779; Santa Fe y Salta en 1880 y Tucumán en 1881.Con respecto a las Provincias de Jujuy y Santiago del Estero no se dieron códigos provinciales rigiéndose por la normativa Castellana hasta la sanción del primer Código Nacional. Este libro intenta analizar algunos aspectos de ese primer momento de codificación provincial, poniendo el foco de atención en el Código Penal vigente en la Provincia de Córdoba entre 1882 y 1886, procurando comprender el modo en el que los operadores de la justicia cordobesa se representaron el derecho codificado y determinar en qué medida es posible asociar esa representación a lo que se ha llamado “cultura del código”. Creemos que la experiencia de la codificación provincial no puede ser comprendida cabalmente si no se tiene en cuenta el modo en que la nueva ley fue utilizada en los tribunales. En este sentido, el Archivo Histórico de la Provincia de Córdoba conserva, en su Fondo del Crimen, una importante cantidad de casos que fueron consultados y analizados en este trabajo. El universo documental para el período en que el código estuvo vigente (1883-1886) es de 403 casos. Se procura ofrecer un análisis cualitativo que, partiendo de los testimonios documentales, nos permita ofrecer una adecuada descripción referida a los rasgos que, en el plano de la cultura jurídica, pueden considerarse característicos de la experiencia práctica de la codificación penal provincial.

    Description: The COVID-19 pandemic has jolted societies out of normality, possibly creating new conditions for sustainability transformations. What does this mean for sustainability research? Because of the scope of the crisis, researchers have been heavily involved: not only have they had to speed up the pace of scientific production to provide urgently needed COVID-19 knowledge, but they have also been affected citizens. For sustainability science, this calls for an experience-based reflection on the positionality and orientation of research aiming to support sustainability transformations. Twenty sustainability researchers discussed their sustainability research on COVID-19 in three workshops based on the following questions: How does the pandemic - and the measures taken to deal with it - affect sustainable development? What can we learn from the pandemic from the perspective of societal transformation? The present discussion paper emerged from this multidisciplinary exchange among sustainability researchers, considering five topics: impacts of the COVID-19 crisis on sustainability transformations; learning for sustainability transformations; the role of solidarity; governance and political steering; and the role of science in society. Our discussions led to a meta-level reflection on what sustainability research can learn from research on COVID-19 regarding topics and disciplinary angles, time dimensions, the role of researchers, and how adequate preparation for both crises and long-term transformations requires interdisciplinary interaction.

    Description: This Wuppertal Paper analyses the energy transition models of Colombia and Germany. The emphasis of the exercise is on an analysis of options for the complete decarbonization of the energy system in Colombia as a Global South country. To this end, it analyses the current situation, projections, public policy and narratives, and contrasts it with Germany as one of the countries of the Global North with which Colombia has historically maintained energy trade relations and is currently collaborating in the exploration of energy alternatives for decarbonization. Detailed analysis of sectoral energy consumption in Colombia shows the sectors with the highest fossil energy consumption (in this order): transport (fuels), industry (gas, coal), electricity generation (gas, coal) and residential (gas). We show the projected increase in demand for fuels and electricity, and calculate the amount of electricity theoretically needed to substitute fossil sources in each sector. We estimate the total electricity required for decarbonization via sector coupling and derive a first estimation of the range of additional renewable energy capacities needed to supply this demand. We find that required capacities are expectedly large (56-110 GW), depending on decarbonization pathways, and that export capacity beyond national demand may be limited. Our analysis of the policy and scenario arena in both countries finds that Colombia is still lacking both sector-specific decarbonization strategies and an embedding in a systemic vision of a systemic energy transition. Germany has more advanced sector strategies and (national) systemic visions, but lacks embedding assumptions on energy imports in a global-system analysis, i.e. in the analysis of an energy transition in potential exporting countries like Colombia. We formulate requirements to close these gaps in our conclusions.

    Description: There is a growing body of scientific evidence supporting sufficiency as an inevitable strategy for mitigating climate change. Despite this, sufficiency plays a minor role in existing climate and energy policies. Following previous work on the National Energy and Climate Plans of EU countries, we conduct a similar content analysis of the recommendations made by citizen assemblies on climate change mitigation in ten European countries and the EU, and compare the results of these studies. Citizen assemblies are representative mini-publics and enjoy a high level of legitimacy. We identify a total of 860 mitigation policy recommendations in the citizen assemblies' documents, of which 332 (39 %) include sufficiency. Most of the sufficiency policies relate to the mobility sector, the least relate to the buildings sector. Regulatory instruments are the most often proposed means for achieving sufficiency, followed by fiscal and economic instruments. The average approval rate of sufficiency policies is high (93 %), with the highest rates for regulatory policies. Compared to National Energy and Climate Plans, the citizen assembly recommendations include a significantly higher share of sufficiency policies (factor three to six) with a stronger focus on regulatory policies. Consequently, the recommendations can be interpreted as a call for a sufficiency turn and a regulatory turn in climate mitigation politics. These results suggest that the observed lack of sufficiency in climate policy making is not due to a lack of legitimacy, but rather reflects a reluctance to implement sufficiency policies, the constitution of the policy making process and competing interests.

    Description: Considering that 40% of the European Union's energy consumption can be traced back to its buildings, it is essential to improve their energy efficiency in order to achieve the EU's energy efficiency targets. Both the rate of energy renovation and its depth, i.e. the amount of energy savings during a renovation, need to be improved. Energy Performance Certificates (EPC), regulated by the EU's Energy Performance of Buildings Directive (EPBD), are an important instrument to enhance the market uptake of energy-efficient new buildings and the energy-efficient renovation of existing buildings. Against this background, the Horizon2020 funded project QualDeEPC will work on EU-wide convergence of the building assessment and the issuance, design, and use of quality-enhanced EPCs as well as their recommendations for building renovation. The aim is to make these recommendations coherent with deep energy renovation towards a nearly-zero energy building stock by 2050. The first part of the QualDeEPC project (work package 2) aims to identify the priorities for elements of EPC schemes that show a need to be improved, and for which the project will investigate further and propose how the elements can be improved. The first step in identifying these priorities is taking stock of the existing EPC schemes. Based on the input from all national consortium partners and other sources, the Wuppertal Institute prepared this detailed overview of the country-specific EPC assessment and certification procedures and their links to other policies and programmes, existing initiatives, and projects. The analysis was based on a list of almost 50 potential options for enhancing the existing EPC schemes. The aim of this deliverable is to present this stock-taking by a detailed analysis on which of the potential enhanced EPC elements are already implemented in which form in which country, covering all 28 countries that were EU member states until 31 January 2020. All partners conducted bilateral interviews with the major actors in the EPC procedures, including executive bodies on EPC at regional and/or national level. For countries not represented in the Consortium, Wuppertal Institut and EAP conducted specific literature research, e.g. from the Concerted Action EPBD, and aimed to obtain contributions from other member states. The information collected allows a detailed presentation on the elements implemented as well as a cross-country comparison matrix (see Annex I) in this report, which outlines the current EPC practices across the EU regarding the elements of a good practice scheme or innovative improvement options, their comparability, compliance with EU legislation, and to which extent they differ or converge. The results show, once more, the high diversity in EPC schemes across the EU. They also provide useful information in at least two directions: 1) which improvement options are not yet implemented at all or in sufficient quality in most QualDeEPC partner countries as well as other EU member states, and could therefore be interesting candidates for the further work of the QualDeEPC project in development, testing, discussion, and possibly implementation of elements for enhanced and converging EPC schemes; and 2) which countries, within or beyond the QualDeEPC project, offer good practice examples for the implementation of these options that could serve to guide the development and implementation in other countries. This deliverable will thus serve as a basis for the upcoming tasks to develop priorities and actual proposals for improvement of EPC schemes.

    Description: The international architecture competition Solar Decathlon Europe was held in Wuppertal in 2022 and focused on sustainable building and living in the city. The student teams participating in the competition developed buildings that would enable climate-friendly living and be tailored to the "Mirke" district in Wuppertal and the individual needs of the residents in this neighborhood. Not only the neighborhood was the focus of the competition, but also the residents of the Mirke district were involved in the project through a neighborhood panel. As part of the Mirke neighborhood panel, three survey waves were conducted between May 2021 and August 2022. The results and insights gained from the neighborhood panel were incorporated into the project and shared with the architectural teams participating in the competition. In addition, the results were shared and discussed with the urban development department of the city of Wuppertal, local initiatives, and other partners in the neighborhood.

    Description: To date, the circular economy has fallen short of its promise to reduce our resource demand and transform our production and consumption system. One key problem is the lack of understanding that highly promising strategies such as refuse, rethink, and reduce can be properly addressed using research on sufficiency. This article argues that a shift in focus is required in research and policy development from consumers who buy and handle circularly designed products to consumption patterns that follow the logic of sufficiency and explain how sufficiency-oriented concepts can be incorporated into existing social practices. The authors show that sufficiency is not necessarily as radical and unattractive as is often claimed, making it a suitable yet underrated strategy for sustainability and the transition to an effective circular economy. The case of urban gardening shows that small interventions can have far-reaching effects and transform consumption patterns as the logic of availability is contested by newly developed concepts of "enoughness" and opposition to "über-availability." The authors propose utilizing comprehensive state-of-the-art theories of consumption and human action when developing strategies and policies to make the circular economy sustainable while being more critical of utilitarian approaches. Using social practice theories that have proven to be beneficial allows human actions to be comprehensively analyzed by recognizing their embeddedness in social and material frameworks; addressing the meaning, competences, and materials of routinized human behavior; and examining indirect effects.

Today, these are ruled by the German Building Energy Act, which is currently being amended.     Description: Agriculture is a major sector responsible for greenhouse gas emissions. Local food production can contribute to reducing transport-related emissions. Since most of the worldwide population lives in cities, locally producing food implies practicing agriculture in urban and peri-urban areas. Exemplary, we analyze the potential to produce fresh vegetables within Berlin, Germany. We investigate the spatial extent of five different urban spaces for soil-based agriculture or gardening, i.e., non-built residential areas, allotment gardens, rooftops, supermarket parking lots, and cemeteries. We also quantify inputs required for such food production in terms of water, human resources, and investment. Our findings highlight that up to 82% of Berlin’s vegetable demand could be produced within the city, based on a reasonable validation of existing areas. Meeting this potential requires 42 km2 of urban spaces for cultivation, a considerable amount of irrigation water, around 17 thousand gardeners, and over 750 million EUR of initial investments. The final vegetable cost would be around 2 EUR to 10 EUR per kg without any profit margin. We conclude that it is realistic to produce a significant amount of Berlin's vegetable demand within the city, even if it comes with great challenges.
