    Description: "Hegels Rechtsphilosophie ist eine Art Logik der bürgerlichen Person im Sinne eines begrifflichen Kommentars zur Institution rechtsstaatlicher Gesetze. Sie analysiert methodische Stufen in der Ordnung explizit geregelter Praxisformen und kritisiert das klassische Naturrecht in seinem Intuitionismus und Kants Ethik in ihrem Formalismus. Das Institut des Eigentums rekonstruiert sie als erfahrungsgesättigte sittliche Form bürgerlicher Freiheit, auch wenn es im reinen Kapitalismus seinen Sinn verfehlen kann. Dabei sind übliche Fehldeutungen etwa von Idee und Begriff, Geist und Natur, Wille und Freiheit, dem Staat und einer der Form nach immer auch monarchischen Regierung zu vermeiden. Es geht damit um die Wiederentdeckung von Hegel als dem sozialliberalen Philosophen der Freiheit und um die Abwehr des Geredes von einem Staatsphilosophen. Die Neuerscheinung richtet sich an Lehrende und Studierende der Rechts-, Sozial- und Staatswissenschaften und der Philosophie. Der Autor ist philosophischer Logiker und Universitätsprofessor mit besonderem Forschungsschwerpunkt in der sprachanalytischen und in der klassischen deutschen Philosophie."

    Description: "Die moderne Lehre von der Gesetzesauslegung beruht im Wesentlichen auf der Interpretationstheorie des frühen 20. Jahrhunderts. Der Vortrag stellt diese Theorie in den historischen Zusammenhang. Ihre Grundlage ist ein neuer, positivistisch-voluntaristischer Rechtsbegriff. Aus ihm erklärt sich die um 1900 aufkommende Vorstellung, es gebe Lücken im Recht, die nur durch richterliche Rechtsschöpfung gefüllt werden können. Mit ihm hängt auch die Uneinigkeit darüber zusammen, ob das Ziel der Auslegung darin besteht, den gegenwärtig vernünftigen Gesetzessinn (objektive Theorie) oder den Willen des Gesetzgebers (subjektive Theorie) zu ermitteln, oder ob die Auslegung im Rahmen der gegebenen Möglichkeiten dem Ermessen des Interpreten zu überlassen ist (Reine Rechtslehre). Der Autor war bis zu seiner Pensionierung (2009) Ordinarius für Deutsche Rechtsgeschichte und Bürgerliches Recht an der Universität Tübingen; er gilt als einer der besten Kenner der Geschichte der juristischen Methodenlehre."

    Description: Title in English: Methodological publication of work with inclusive classroom with the focus on pupils with physical disability: Methodical Manual Publication is one of the outputs of the project Quality Inclusive Education of Pupils with Special Education Needs at elementary and secondary school. This text focuses on teaching pupils with physical disabilities in an inclusive classroom. The text is divided into three chapters, the first one defines theoretical background. Described is physical disability with an emphasis on cerebral palsy together with the specifics of the target group of pupils. Part of the chapter also defines special pedagogical diagnostics. The second chapter focuses on the education of pupil with cerebral palsy in inclusive school. In the third chapter are presented results of the research part of the project with special education needs – with physical disabilities with the focus on cerebral palsy.

    Description: Die kulturwissenschaftlichen Perspektiven auf das Recht sind vielfältig. Der Band geht vor allem den normativen Verwendungsweisen des ‚Kultur‘-Begriffs in der Rechtswissenschaft nach – von der neukantianischen Kulturphilosophie bis zum Poststrukturalismus, bei kommunitaristischen und multikulturalistischen Autoren, in der ‚kulturwissenschaftlichen Verfassungslehre‘ sowie in jenen Ansätzen, denen zufolge das Grundgesetz von einer ‚christlichen Kultur‘ überformt wird. Seine Antwort auf die Frage, was der Begriff der Kultur zur Eigenreflexion des Rechts beitragen kann, lautet: Nichts, außer Verwirrung. Die These von der Kultur als einer Geltungsquelle von Recht ist falsch. Es führt kein Weg von der Kultur zum Rechtssystem oder von kulturellen Werten zum Gehalt juridischer Normen. Der Kulturbegriff kann deshalb am Ende wenig anderes leisten, als die Anforderungen zu unterlaufen, denen rechtliches Begründen genügen muss. Der Autor lehrt Rechtsphilosophie an der Westfälischen Wilhelms-Universität Münster und forscht im dortigen Exzellenzcluster „Religion und Politik“.
