Lisa Schwaiger nimmt eine Bestandsaufnahme alternativer Nachrichtenmedien im deutschsprachigen Raum vor und ordnet diese typologisch ein. Mit einem netzwerkanalytischen Ansatz untersucht sie die Relationen zwischen Alternativ- und Mainstreammedien in der Twitter-Sphäre und liefert neue Erkenntnisse zu einem gesellschaftlich hochrelevanten Thema.

    Description: 20 years of dispute over one and a half seconds of copied music? The dispute in the »Metal on Metal« (German: »Metall auf Metall«) case between the music group Kraftwerk and the composer Moses Pelham even occupied the European Court of Justice in 2019. It shows that copyright has become a socially contentious issue that has pushed its way out of the niche of the artistic sphere and into the everyday lives of almost everyone. This process has not gone unnoticed by academia, and yet academia is only just beginning to understand the implications and effects of this copyright expansion in more detail. Sociologist Georg Fischer provides the first empirical study of sampling in music that explicitly examines the impact of German copyright law on creative practice. He shows the abundance and diversity of creative circumvention strategies that have spread and taken root in the shadow of copyright law – and with which artists necessarily limit their own visibility as well as the aesthetic complexity and monetary exploitation of their works.

Sie zeigt, dass das Urheberrecht zu einem gesellschaftlichen Streitthema geworden ist, das sich aus der Nische des künstlerischen Bereichs in den Alltag nahezu aller Menschen gedrängt hat. Dieser Prozess lief nicht unbemerkt von der Wissenschaft ab und dennoch ist diese gerade erst dabei, die Implikationen und Effekte dieser urheberrechtlichen Ausdehnung genauer zu verstehen. Der Soziologe Georg Fischer liefert die erste empirische Studie zum Sampling in der Musik, die explizit den Einfluss des deutschen Urheberrechts auf die kreative Praxis untersucht. Er zeigt die Fülle und Vielfalt an kreativen Umgehungsstrategien, die sich im Schatten des Urheberrechts ausgebreitet und verankert haben – und mit denen die Künstler_innen die eigene Sichtbarkeit sowie die ästhetische Komplexität und monetäre Verwertung ihrer Werke notgedrungen einschränken.

    Description: If the journalistic media are to be able to effectively perform their essential democratic tasks of forming public opinion and controlling state power, they must be independent of the state. At the same time, this state has to guarantee a diverse range of media and to inform the public about its activities. This tension is intensifying in the internet age, in which the expensive production of journalistic content is less and less taken for granted. This updates the state's duty to ensure media pluralism, for example by organizing a public service system or other promotional measures, and to carry out active public relations work. This in turn increases the risk that the state will influence media activity or become the media provider itself. The limits that the state has to observe in this context are worked out in this book on the basis of a cross-media, constitutional and international law analysis of the principle of the media's independence from the state.
    Description: Sollen die journalistischen Medien ihre demokratiewesentlichen Aufgaben der öffentlichen Meinungsbildung und der Kontrolle staatlicher Macht wirksam wahrnehmen können, müssen sie vom Staat unabhängig sein. Gleichzeitig hat ebendieser Staat ein vielfältiges Medienangebot zu gewährleisten und die Öffentlichkeit über seine Tätigkeiten zu informieren. Dieses Spannungsverhältnis verschärft sich im Internetzeitalter, in welchem die teure journalistische Inhaltsproduktion immer weniger als gesichert gilt. So aktualisiert sich dadurch die staatliche Pflicht, den Medienpluralismus etwa durch die Organisation eines Service public-Systems oder anderweitiger Fördermassnahmen zu sichern und eine aktive Öffentlichkeitsarbeit wahrzunehmen. Dies erhöht wiederum die Gefahr, dass der Staat die Medientätigkeit beeinflusst oder selber zum Medienanbieter wird. Welche Grenzen der Staat in diesem Kontext zu beachten hat, wird in diesem Buch anhand einer mediengattungsübergreifenden verfassungs- und völkerrechtlichen Analyse des Prinzips der Staatsunabhängigkeit der Medien herausgearbeitet.

    Description: This dissertation examines intelligence surveillance of private telecommunications and its compatibility with the international human right to privacy in Art. 17 ICCPR and in Art. 8 ECHR. These articles provide comprehensive protection against the most modern forms of surveillance including bulk interception. Several criteria apply in terms of the foreseeability of the surveillance laws. Telecommunication’s interception should be subject to authorisation and supervision by independent authorities and effective remedies should be available. Moreover, the study analyzes the extent to which the surveilling state and the state of residence violate their human rights obligations in cases of cross-border surveillance. The main question is whether the established definitions of "jurisdiction" are applicable to this extraterritorial scenario. The extraterritorial exercise of jurisdiction can also be based on effective control over specific objects relevant to human rights. According to this approach, telecommunications data are objects relevant to individual’s right to correspondence and data protection.

    Description: It is rare for a physician to be disbarred; it is even rarer for the disbarment to have a retroactive effect back to the time of granting. The prerequisite for this effect is that the license to practice medicine should not have been granted in the first place, either because the requirements for the training of the future physician were not met or because character defects (unworthiness, unreliability) prevented the person concerned from working as a physician. Although practically rare, the revocation of a license to practice medicine is of particular academic interest because it ultimately results in the entire medical activity of the person affected being subsequently deprived of its legal basis. Strictly speaking, in consequence, each medical intervention becomes unlawful, thus (under certain circumstances) constituting a bodily injury under criminal law as well as giving rise to liability for damages under civil law. However, neither the criminal nor the civil law consequences of such retroactivity have yet been examined in a scientifically sound manner, even to a rudimentary degree. The present dissertation is intended to close this gap, at least in the area of civil law.

In Switzerland, it has found its way into the literature and has already been included in the case law of the Federal Supreme Court on negligence offences. However, critical voices point out that the current status of the discussion is characterized by a large number of different approaches, some of which differ only marginally. A look at the literature actually shows that many essential questions, such as the raison d'être of individual aspects of attribution, are still disputed today. In this dissertation, Nicolas Leu therefore subjects objective attribution to a comprehensive and critical review that also takes into account the criminal offense system in which objective attribution is embedded.
    Description: Im deutschen Schrifttum hat sich die Lehre der objektiven Zurechnung längst als herrschende Meinung durchgesetzt. In der Schweiz hat sie Eingang in die Literatur gefunden und ist bereits in die Rechtsprechung des Bundesgerichts zum Fahrlässigkeitsdelikt eingeflossen. Kritische Stimmen weisen jedoch darauf hin, dass der Diskussionsstand durch eine Vielzahl verschiedener, teilweise nur marginal abweichender Lösungsansätzen geprägt sei. Ein Blick in die Literatur zeigt tatsächlich, dass viele wesentliche Fragen, wie etwa die Existenzberechtigung einzelner Zurechnungsgesichtspunkte, auch heute noch umstritten sind. In der vorliegenden Dissertation unterzieht Nicolas Leu die objektive Zurechnung daher einer umfassenden und kritischen Überprüfung, die auch das Straftatsystem mitberücksichtigt, in das die objektive Zurechnung eingebettet ist.

    Description: From March 16-19, 2016, the Young Romance Studies Forum on "Center and Periphery" took place at the Julius-Maximilians-Universität Würzburg. In this volume, the dialectical concepts of center and periphery are examined from the perspectives of literary, linguistic, and cultural studies. Their relevance in Romania is examined in the individual contributions on the basis of geographical, spatial, historical, social, and linguistic aspects, in order to include different approaches and methods of analysis. In addition to a heterogeneous approach to the dimensions of the conceptual pair, the volume offers a structured presentation of the individual phenomena studied. The two thematic blocks focus, on the one hand, on diverse literary studies considerations of the dichotomy of the conceptual pair, and, on the other hand, on linguistic conceptions of center and periphery. Thus, new perspectives on both central and peripheral phenomena in Romance studies are opened up, on the one hand by presenting the range of (traditional) centers and peripheries, and on the other hand by referring to current discussions in the context of the two concepts.

Dem Narrativ der »Willkommenskultur« folgte ein Wechselbad der Diskurse hin zum drohenden Staatsversagen, der Belastungsgrenze oder sexueller Übergriffe. Dabei ging es primär um die Befindlichkeit der Nation und der »Flüchtling« wurde zum Verursacher nationaler Bedrängnisse. Uwe Becker analysiert diese Diskurse und zeichnet nach, welche Narrative sich im »langen Sommer der Flucht« aufgebaut haben. Dabei zeigt er auf, wie sie im kollektiven Gedächtnis ruhen, jederzeit aktivierbar sind und bis heute eine restriktive Flüchtlingspolitik legitimieren.

Die Engelsfigur ist aber nicht bloß statisches Überbleibsel einer verlorenen Glaubensgewissheit. Vielmehr steht sie in einer produktiven Beziehung zu zentralen geschichtsphilosophischen, politischen und medienästhetischen Fragen der Zeit. Die vorliegende Studie geht den Zusammenhängen zwischen Engelsfigur und Moderne-Diskurs entlang eines Spannungsbogens nach, der von Reflexionen eines metaphysischen Exils Anfang des 20. Jahrhunderts über die Zuspitzung existentieller Bedrohung im Ersten und Zweiten Weltkrieg bis zum Undarstellbarkeitstopos des Holocaust verläuft. Dabei wird deutlich, dass der Engel auf vielfache Weise als Verursacher und gleichzeitig als zukunftsgerichteter Überwinder moderner Formen des Exils auftritt – als Figur, die geschichtsphilosophische Brüche herbeiführt und individualbiographische Traumata sichtbar macht; die die moderne Deformation des Menschen illustriert und wahlweise zu heilen oder voranzutreiben versucht; und die schließlich neue politische Ordnungen entwirft und sie als ästhetische Metalepse bereits in der Exilgegenwart veranschaulicht.

It highlights the historical roots of this important structural principle and shows the goals of equality of arms. The work pays particular attention to the case law of the European Court of Human Rights (ECHR). In the decisive evidence procedure, this requires a procedural balance between the accused person on the one hand and law enforcement authorities on the other. To what extent does Swiss procedural reality - with its postponement of crucial procedural steps in the pre-litigation - meet this demand? Based on empirical data, it is shown that the institutional superiority of law enforcement agencies in the underregulated preliminary proceedings has the potential to objectively restrict the defendant's rights of defense. The author discusses how this problem can be dealt with in a holistic view of the Swiss criminal trial using various variants.  
    Description: Der Begriff der Waffengleichheit wird im Kontext des Strafverfahrens häufig verwendet aber nur selten trennscharf definiert. Die vorliegende Arbeit schickt sich an, dem Begriff eine inhaltliche Kontur zu verleihen. Sie beleuchtet die historischen Wurzeln dieses wichtigen Strukturprinzips und zeigt die Ziele der Waffengleichheit auf. Ein besonderes Augenmerk richtet das Werk auf die Rechtsprechung des Europäischen Gerichtshofs für Menschenrechte (EGMR). Dieser verlangt im entscheidenden Beweisverfahren nach einer Verfahrensbalance zwischen beschuldigter Person auf der einen und Strafverfolgungsbehörden auf der anderen Seite. Inwieweit hält die Schweizer Verfahrenswirklichkeit – mit ihrer Verschiebung entscheidender Verfahrensschritte ins Vorverfahren – dieser Forderung stand? Auf Grundlage empirischer Daten wird aufgezeigt, dass die institutionelle Übermacht der Strafverfolgungsbehörden im unterregulierten Vorverfahren das Potenzial birgt, die Verteidigungsrechte der beschuldigten Person in unsachlicher Weise einzuschränken. Wie diesem Problem begegnet werden kann, diskutiert der Autor in einer gesamthaften Betrachtung des schweizerischen Strafprozesses anhand verschiedener Varianten.

Group-Talk ist die Feldbezeichnung für das wöchentliche Arbeitstreffen einer teilnehmend beobachteten Forschungsgruppe in der Computational Neuroscience (CNS). Dass (soziale) Wirklichkeit in Interaktionsprozessen erzeugt und institutionalisiert wird, ist eine aus der Wissenssoziologie bzw. dem Sozialkonstruktivismus bereits wohlbekannte Erkenntnis. Dass diese Erzeugung maßgeblich durch kommunikatives Handeln prozessiert wird, ist spätestens seit dem Kommunikativen Konstruktivismus bekannt. Zentral in vorliegender Analyse ist daher die spezifische Form des kommunikativen Handelns, das besondere Format, in dem die CNS, als relativ junger und interdisziplinärer Forschungskontext, von den disziplinär heterogenen Wissenschaftler/-innen im Feld, kommunikativ (re-)konstruiert wird. Die wissenssoziologische Gattungsanalyse dient dabei dazu, den reinen Situationalismus zu überschreiten und die soziologische Mikroanalyse (Handeln), vor dem Hintergrund einer fokussiert-ethnographischen Feldstudie, mit gesellschaftlichen Emergenzphänomenen auf Meso- und Makroebene zu verknüpfen. Erst diese systematische Verbindung des direkt beobachtbaren Wie der Kommunikation mit dem durch ethnographisches Wissen rekonstruierten Warum, überschreitet den Horizont reiner Beschreibung und führt in die Bereiche des soziologischen Verstehens und Erklärens.

    Description: The purchase of additional items in videogames, also called ‘Microtransactions’, has recently grown to become one of the dominating methods of monetization in the games industry. However, many versions of these monetization schemes face severe backlash because it appears that the ways to monetize games are increasingly influencing the contents of the medium and that those games are purposefully designed to bring vulnerable players to spend more money than they meant to. In this thesis, those points of criticism were taken into consideration and as a starting point to explore the legality of these kinds of monetization schemes from a legal standpoint. This was done with regards to the Unfair Competition Law, Youth Protection regulation and general civil law. Also, the chance-based variant of microtransactions, the so called ‘Lootboxes’, have been examined with regard to their legality under gambling regulations.

    Description: In the years 1738/39, Gottsched was mostly concerned with two events: his departure from the “Deutsche Gesellschaft” which he had been heading and the resulting developments, and the continuation of his disputes on the philosophy of Christian Wolff which he had been conducting with the Lutheran-Orthodox theologians. Through the support of the influential Imperial Count Ernst von Manteuffel, Gottsched now acquired strong political backing. This is documented by 52 of the total of 204 letters published in this volume, a correspondence in which Mrs Gottsched also soon became involved. The letters of other correspondents also deal with Wolff’s rationalist philosophy, as well as other very varied themes such as theater, teaching of the German language in schools, the problems of Leipzig students, newspaper polemics, planned translation projects and the competing editions of the writings of Martin Opitz, the “father of German poetry”, that were undertaken in Leipzig and Zurich.

    Description: Collecting societies are central players in copyright law in Germany with an annual turnover of currently almost two billion euros. Hundreds of thousands of cultural workers are directly dependent on the exploitation of their rights by collecting societies. Critics are of the opinion that these rights owners have only insufficient influence on the supposedly intransparent distribution of funds by the collecting societies. The criticism culminated in accusations of "mafia-like structures". This paper examines the internal structure and corporate governance of collecting societies. While their activities and state supervision are partially harmonized throughout Europe and regulated in the German VGG, the internal structure of the societies as a hybrid between private and public law has hardly been investigated. With the help of interviews with stakeholders, it is possible to evaluate the status quo and to make suggestions for improvement that are suitable for raising the standard of co-determination.

    Description: Of the 218 letters, 126 belong to correspondence with the Imperial Count Ernst Christoph von Manteuffel, a dedicated patron of the supporters of Christian Wolff and the head of the Berlin chapter of the Society of Alethophiles. In Berlin and Leipzig great hopes were placed in the Prussian heir apparent Friedrich II, whom many saw a kind of Platonian "philosopher king" who would help elevate reason and Wolffian philosophy to new heights. The letters document the development of a rationalistic strain in Gottsched's sermons. They also provide insight into the satires of Wolff's opponents written by L.A.V. Gottsched. Gottsched's speeches concerning Martin Opitz and the "book printing anniversary" (Buchdruckjubiläum) found strong resonance in the correspondence and inspired letters concerning similar undertakings. Jakob Brucker's letters illuminate the planning and creation of the "Bilder-sal", a contemporary history of notable scholars that featured biographies and portraits, and which came to include Gottsched and his wife.
