    Beschreibung: 20 years of dispute over one and a half seconds of copied music? The dispute in the »Metal on Metal« (German: »Metall auf Metall«) case between the music group Kraftwerk and the composer Moses Pelham even occupied the European Court of Justice in 2019. It shows that copyright has become a socially contentious issue that has pushed its way out of the niche of the artistic sphere and into the everyday lives of almost everyone. This process has not gone unnoticed by academia, and yet academia is only just beginning to understand the implications and effects of this copyright expansion in more detail. Sociologist Georg Fischer provides the first empirical study of sampling in music that explicitly examines the impact of German copyright law on creative practice. He shows the abundance and diversity of creative circumvention strategies that have spread and taken root in the shadow of copyright law – and with which artists necessarily limit their own visibility as well as the aesthetic complexity and monetary exploitation of their works.

Sie zeigt, dass das Urheberrecht zu einem gesellschaftlichen Streitthema geworden ist, das sich aus der Nische des künstlerischen Bereichs in den Alltag nahezu aller Menschen gedrängt hat. Dieser Prozess lief nicht unbemerkt von der Wissenschaft ab und dennoch ist diese gerade erst dabei, die Implikationen und Effekte dieser urheberrechtlichen Ausdehnung genauer zu verstehen. Der Soziologe Georg Fischer liefert die erste empirische Studie zum Sampling in der Musik, die explizit den Einfluss des deutschen Urheberrechts auf die kreative Praxis untersucht. Er zeigt die Fülle und Vielfalt an kreativen Umgehungsstrategien, die sich im Schatten des Urheberrechts ausgebreitet und verankert haben – und mit denen die Künstler_innen die eigene Sichtbarkeit sowie die ästhetische Komplexität und monetäre Verwertung ihrer Werke notgedrungen einschränken.

    Beschreibung: From March 16-19, 2016, the Young Romance Studies Forum on "Center and Periphery" took place at the Julius-Maximilians-Universität Würzburg. In this volume, the dialectical concepts of center and periphery are examined from the perspectives of literary, linguistic, and cultural studies. Their relevance in Romania is examined in the individual contributions on the basis of geographical, spatial, historical, social, and linguistic aspects, in order to include different approaches and methods of analysis. In addition to a heterogeneous approach to the dimensions of the conceptual pair, the volume offers a structured presentation of the individual phenomena studied. The two thematic blocks focus, on the one hand, on diverse literary studies considerations of the dichotomy of the conceptual pair, and, on the other hand, on linguistic conceptions of center and periphery. Thus, new perspectives on both central and peripheral phenomena in Romance studies are opened up, on the one hand by presenting the range of (traditional) centers and peripheries, and on the other hand by referring to current discussions in the context of the two concepts.

Jasmin Degeling pursues this question via a redefinition of Michel Foucault’s concepts of the technologies of the self as well as of care of the self through the lenses of media studies. For that purpose she describes and analyzes the media and aesthetics of Christoph Schlingensief and Elfriede Jelinek as aesthetic therapeutics. The example of the later works of theater, film, and action artist Christoph Schlingensief traces the modern political and aesthetic history of art as a medium of therapeutics, while Elfriede Jelinek’s monumental online novel »Neid (Mein Abfall von allem) – Ein Privatroman« experiments with literary writing in virtual spaces and designs an autobiographical novel that rejects any form of literary subject constitution in a feminist way. The study brings contemporary media of care into view as exercises in healing, health, and survival, and connects them to an archaeology of the aesthetic and media history of modern concepts of health and healing.

Am Beispiel der späteren Arbeiten des Theater-, Film- und Aktionskünstlers Christoph Schlingensief zeichnet sich die moderne politische und ästhetische Geschichte von Kunst als Medium der Therapeutik ab: Der Wunsch nach einer Gesundheit des Denkens, Empfindens wie Lebens verschränkt sich dabei mit der biopolitischen Geschichte moderner, ästhetischer Heilsprogramme. Schlingensiefs Versuch, sich selbst zu heilen, schreibt sich in einen Komplex von Kunstreligion, modernem Vitalismus und Kolonialgeschichte ein. Elfriede Jelineks monumentaler Onlineroman »Neid (Mein Abfall von allem) – Ein Privatroman« experimentiert mit literarischem Schreiben in virtuellen Räumen und entwirft einen autobiographischen Roman, der jeder Form literarischer Subjektkonstitution eine feministische Absage erteilt. Diese Poetik erweist sich als Programm einer spezifisch modernen Sorge um sich: Medientechnisch ermöglicht durch das Heilsversprechen eines von der Realwelt abgetrennten Cyberspace, übt Jelinek im Format des frühen Onlinetagebuchs eine digitale Askese in virtueller Unendlichkeit, Leere und Weite und gibt so Raum für eine komplexe poetische Reflexion des Verhältnisses von Medien, Empfindung und Subjektivierung. Die Studie rückt zeitgenössische Medien der Sorge als Übungen der Heilung, der Gesundheit und des Überlebens in den Blick, und verbindet diese mit einer Archäologie der ästhetischen und medialen Geschichte moderner Konzepte von Gesundheit und Heilung.

Even though YouTube has become emblematic of this cultural technique, media self-documentations are also formative for other services such as Instagram, TikTok, or Snapchat. Robert Dörre understands the emergence of these self-designs as an aesthetic practice and traces the media-historical shifts that public self-documentation has experienced on the Internet. In order to make these specific aesthetics, rituals, motifs, and economies accessible to media cultural studies, the work approaches the phenomenon from five perspectives: The reception as authentic self, the self as part of social media, the self as brand, the serial self, and the self as amateur and artist.

    Beschreibung: In the digital age, we often encounter analog photographs as things that – after having been stored away, lost, or even thrown away – are (re)found. The fascination with such found photographs is reflected in a striking way in contemporary essay and documentary film. Found photo films are an essayistic documentary form that has emerged since the turn of the millennium: Films that work with left-behind, rescued, or found convolutions of photographic images, collecting, selecting, and placing them in a new context. They stand in a field of tension between popular aestheticization and re-auratization of analog media in the course of digitalization as well as a long tradition of cinematically reflecting the materiality and mediality of film by working with photography and found footage. Charlotte Praetorius explores such appropriations of analog photographs through a corpus of international films: How do filmmakers relate to photographic found footage? How do the narratives and the narrativity of photography and history intertwine? How is the photographic material arranged and staged? And how can the relationships between different media and materials be grasped? In doing so, Praetorius is also concerned with taking the forms of documentary and essayistic film seriously as a medium for reflecting on (media) history and at the same time also critically questioning them.

    Beschreibung: »This video is not available in your country.« With this sentence, the video platform YouTube fueled many years of dispute with the German collecting society GEMA. Numerous online discussions focused on the appropriate remuneration for music streaming – GEMA bashing followed. Music and copyright have always been a contentious issue. Digitization set in motion a process that changed the way music and other creative goods are produced, consumed, distributed and exploited. This break undermined previous business models of the music industry and shook basic assumptions in the understanding of copyright. Philip Stade focuses on the particular online discourse YouTube vs. GEMA and, in the spirit of cultural studies, opens up interdisciplinary and historical perspectives on the fields of music business, copyright and capitalism in the digital transformation. The focus is on hegemonic strategies and the central role of social media. Even though the social and economic upheavals of the digital transformation are far from complete, Stade precisely elaborates which overarching shifts are taking place in the relationship between exclusive control and free access. For we are only just beginning to understand how digital capitalism works.

In zahlreichen Online-Diskussionen ging es um die angemessene Vergütung für das Musikstreaming - das GEMA-Bashing folgte. Musik und Urheberrecht waren und sind ein konfliktreiches Thema. Mit der Digitalisierung setzte ein Prozess ein, der die Art veränderte, Musik und andere kreative Güter zu produzieren, zu konsumieren, zu verbreiten und zu verwerten. Diese Zäsur untergrub bisherige Geschäftsmodelle der Musikwirtschaft und erschütterte Grundannahmen im Urheberrechtsverständnis. Philip Stade richtet den Blick auf den besonderen Online-Diskurs YouTube vs. GEMA und eröffnet im Sinne der Cultural Studies interdisziplinäre und historische Sichtweisen auf die Felder Musikwirtschaft, Urheberrecht und Kapitalismus im digitalen Wandel. Im Fokus stehen dabei hegemoniale Strategien sowie die zentrale Rolle Sozialer Medien. Auch wenn die gesellschaftlichen und ökonomischen Umwälzungen des digitalen Wandels längst nicht abgeschlossen sind, arbeitet Stade präzise heraus, welche übergeordneten Verschiebungen im Verhältnis von exklusiver Kontrolle und freiem Zugang stattfinden.
