    Description: Depuis la fin du xxe siècle, un pan de la critique universitaire s’est montré soucieux d’offrir aux études francophones un soubassement épistémologique capable d’asseoir leur légitimité. Le présent ouvrage se situe résolument dans ce sillage. Son originalité tient sans doute à la contribution d’écrivains et d’étudiants conviés à participer à cet effort réflexif. Adoptant une composition polygraphe qui mêle articles scientifiques, essais et entretiens, ce livre esquisse un inventaire des concepts, pratiques et méthodes permettant d’appréhender les écritures francophones du xxie siècle commençant. Il fait ainsi surgir ou resurgir quelques grandes questions et met en relief certaines nécessités : reconsidérer le concept même de francophonie, inclure la variété de ses espaces et de ses corpus, mais aussi sortir les études francophones de leur confinement. Plus globalement, il s’agit d’élaborer de nouveaux cadres théoriques pour repenser l’espace, le temps et l’histoire littéraire.

En mi lectura, daré cuenta del componente argumental como universo diégetico donde se desarrolla la trama, así como el componente actoral, donde se localizan los actores Maqroll, Ilona y Larissa, y las acciones que estos realizan y que los afectan. La actorialización definirá, además, cómo estos actores se relacionan con las isotopías semánticas de la nostalgia como sentimiento siempre presente de lo gozado en un pasado feliz, la muerte como experiencia propia y la conciencia de la propia destrucción como correlato necesario de la vida.

    Description: Écrire la crise ce n'est pas la raconter. C'est montrer comment elle modifie nos manières de raconter. Encore faut-il s'entendre sur le mot lui-même car peut-on appeler crise (du grec « krisis » : changement brutal) cette lente dissolution des valeurs de la modernité qui nous fait entrer dans un « après » informulable, sinon par le terme souvent controversé de postmodernité ? Au-delà des polémiques que suscite cette notion, il s'agit ici de considérer le postmoderne non pas comme une régression anti-moderne mais comme la prise de conscience d'un certain nombre de dévoiements du projet moderne qui nous projettent dans une ère de turbulence dont les arts, et en particulier la littérature, portent la marque. Ainsi considéré, le postmodernisme n'est ni une école, ni une avant-garde. Il témoigne avant tout d'une crise de culture à la transition des deux siècles, qui s'est transformée en culture de la crise, de sorte que, non seulement la pensée, la science et les arts, s'en trouvent affectés, mais de manière plus profonde encore, la société et l'individu. C'est pourquoi cet essai se propose à la fois, d'examiner l'hypothèse postmoderne comme mise en turbulence des valeurs de la modernité, et de définir le postmodernisme en littérature comme une esthétique qui met en relation les configurations sociales et certaines formes d'écriture contemporaine.

    Description: In publishing this book, an early version of which was first published under the auspices of the Academy of Athens, the French School at Athens highlights the research work of Aspasia Louvi-Kizi, an eminent specialist in the Frank and Byzantine Peloponnese, whose work reveals all of the complexity of the architectural forms, influences and models at work in the monuments of the medieval Byzantine city of Mystras. Out of all of the architecture created by the despotic couple formed by Manuel Cantacuzène (1349-1380) and his wife Isabelle de Lusignan, who were instrumental in turning Mystras into a centre of power, Aspasia Louvi-Kizi focuses on two of the city’s most iconic monuments, the monasteries of Peribleptos and Pantanassa, proposing a new history of their construction. Their architecture incorporates elements of Frank art, meaning western or gothic art, which were foreign to the local Byzantine tradition. The gothic aspect of Mystras’ architecture, as distinct from the Franco-Byzantine influences in the neighbouring crusader principality of Achaea, has more to do with Western art in Cyprus, and its introduction by Isabelle to the Peloponnese was to prove decisive. The Western elements that decorate the facades of clocks and towers, combined with the Byzantine features to constitute a concrete expression of the despotic couple’s pro-Western politics, in line with the imperial politics of Constantinople at the time. In the fragmented and multipolar world of the Eastern Mediterranean on the eve of the Ottoman conquest, this book highlights the role Mystras played as a centre of power in the region and, in doing so, contributes to a fresh take on the city as a whole. By continuing the international conversation about a renowned site, the French School at Athens shows its commitment to a multi-layered approach that reveals the complexity of the interactions at work in the history of the Greek world in transition.

    Description: Mito: relato explicativo, simbólico y dinámico, de uno o varios acontecimientos extraordinarios personales con referente trascendente, que carece en principio de testimonio histórico, se compone de una serie de elementos invariantes reducibles a temas y sometidos a crisis, que presenta un carácter conflictivo, emotivo, funcional, ritual y remite siempre a una cosmogonía o a una escatología absolutas, particulares o universales. Esta definición, general, fría e indeterminada, requiere un tiempo, un espacio, y sobre todo una conciencia que la viva. El mito no es un constructo mental ajeno a las vicisitudes socioculturales: lleva marcada en su piel y sus entrañas la huella de cada individuo y sociedad que lo vio nacer; pero también sabe adaptarse a las condiciones del nuevo tiempo que lo acoge. Mitos de hoy narra esa tensión del mito por mantenerse vivo en el terreno, aparentemente inhóspito, de un mundo desengañado. La Mitocrítica Cultural, aquí puesta en práctica, combina las herramientas tradicionales de la mitocrítica con factores no considerados sistemáticamente por la crítica precedente: la globalización, la inmanencia y el consumismo. Das widerspricht allerdings den vorherrschenden sozialen Anschauungen. Sie verlangen folglich nach einer Begründung für den dem Recht zugeschriebenen Anspruch verbindlicher Maßgeblichkeit. Demgemäß ranken sich um die Idee solcher Normativität des Rechts Vorstellungen, Bilder und Begriffe, die eine innere Bindung durch Recht plausibel zu machen suchen.     Description: Ce volume est le quatrième d’une série d’ouvrages portant sur « Statuts, écritures et pratiques sociales dans les sociétés de la Méditerranée occidentale à la fin du Moyen Âge (XIIe-XVe siècle) », visant à étudier les statuts communaux dans une optique d’histoire sociale, non pas comme une source « normative » mais comme une source de la pratique, de leur matérialité et de leur forme d’écriture aux pratiques sociales en passant par les conditions de leur production et de conservation, leur inscription dans un paysage documentaire communal, leur structure et leur contenu. Ce dernier ouvrage s’intéresse aux statuts « vus de l’extérieur » c’est-à-dire au rapport entre le texte statutaire et sa mise en jeu dans des pratiques sociales concrètes, mais aussi à la manière dont les acteurs médiévaux se posent la question de l’usage de la norme, aux divers moments documentaires où ils font référence ou allèguent explicitement les statuts dans leurs pratiques. Il n’est donc question de statuts qu’à travers d’autres documents, qu’ils fassent partie du paysage documentaire communal (délibérations communales, registres de justice, registres de compte, criées, épigraphie, iconographie, etc.) ou qu’ils soient élaborés en marge des écrits de gouvernement (registres notariés, testaments, récits de miracles, procès de canonisation, sources narratives, chroniques, etc.). Le but est de repérer, d’analyser et d’étudier la manière dont les normes statutaires se sont diffusées – ou pas –, ont été appliquées – ou pas – dans les pratiques politiques, économiques et sociales de la commune : comment ont-elles été validées, reproduites, conservées, diffusées ?     Description: In 1907, the city of Heredia became the epicenter of the most important religious conflict experienced by Costa Rica in the 20th century. A complaint that the theory of evolution was being taught in the Lyceum (i.e. secondary school) of that city, triggered an increasingly intense confrontation between the Catholic parishioners and the circle of young radical intellectuals articulating around the writer and educator Roberto Brenes Mesén. In the course of this process, Costa Rican society, to the alarm of the government of Cleto González Víquez, was the scene of popular mobilizations in defense of the faith, excommunications and burning of impious texts, while Catholic morality was systematically questioned based on sexual abuse attributed to priests. For a moment, it seemed that the country had gone back in time, and that the ghosts of 1884 were present.

    Description: La Fontaine affiche nettement sa filiation à l’égard de Marot. Du moins à l’égard d’un Marot. Comme beaucoup d’auteurs de son époque, il voit en effet dans le poète de L’Adolescence clémentine l’efflorescence printanière d’un style proprement français, qui allie au piquant et au brio la naïveté toute vernale d’une écriture. L’auteur des Fables et des Contes admire ainsi le brillant faiseur d’épigrammes. Il y reconnaît « le génie fran­çais », son ingenium, son naturel. Ce naturel s’exprime à la fois dans un esprit gaulois – que Rabelais radicalise trop pour qu’on puisse en faire un allié de marque – et une écriture transparente, non savante, à l’opposé de l’artificieuse et docte poésie de la Pléiade rejetée par le XVIIe siècle comme un accident regrettable dans l’histoire des formes. Cet « élégant badinage », assigné depuis Boileau à Marot, a pu nuire à l’œuvre de ce dernier en en restreignant la portée. La critique moderne a, par contraste, reconnu dans le poète de Cahors un esprit secret, anxieux, au cœur des débats évangéliques du premier XVIe siècle. Le vrai Marot est sûrement à rechercher au carrefour de ces deux interprétations extrêmes ; comme La Fontaine, au demeurant, que l’on ne peut réduire au modèle achevé de l’esthétique galante. La relation qui unit Marot et La Fontaine est bien en tout cas au départ une relation d’ordre formel. Aussi les chercheurs réunis ici ont tous tenté de repenser ou de repréciser les lectures stylistiques de l’un ou l’autre de ces auteurs à travers leur interprétation de L’Adolescence clémentine ou des Amours de Psyché et de Cupidon. La diversité des points de vue adoptés permet d’aider à définir ce qui reste en dernier lieu le plus difficile à caractériser, ce naturel du style, si revêche à l’analyse littéraire.

Retraçant le tortueux « itinéraire intellectuel » de Gide à partir de la débâcle jusqu’à l’épuration, cet ouvrage examine le rôle ambigu du doyen des lettres françaises, dont les manœuvres complexes permettent d’aborder de façon privilégiée trois questions de grande importance : la relation entre littérature et politique pendant la Seconde Guerre mondiale, les refoulements et les repositionnements qui continuent à alimenter la controverse à propos de cette période, enfin le rôle des intellectuels reconnus en temps de crise nationale. À l’exception du Journal datant du début de la guerre, la critique s’est peu intéressée aux publications de Gide pendant les années sombres. Jocelyn Van Tuyl scrute tous ces textes en détail, retrace l’évolution des opinions politiques de Gide et, surtout, lit ces écrits de guerre les uns à la lumière des autres. Car c’est l’interaction entre ces textes qui révèle toute la complexité des positions politiques de Gide et la virtuosité rhétorique que l’auteur déploie pour redresser son image ternie.

    Description: In the monography Auf die Tour, I analyze the participation of Jews in popular culture in Vienna, Budapest and New York. I argue that entertainment in vaudevilles was shaped between the perception of difference and similarity, between human trafficking, covert prostitution, anti-Semitism and nationalism. Ultimately, my research shows how a space for Jewish-non-Jewish people was created in the coinciding of the mass migration movement and the emerging mass culture between the Habsburg Monarchy and the United States.

Zwischen Differenzwahrnehmungen und Ähnlichkeitsdenken, zwischen Menschenhandel, verdeckter Prostitution, Antisemitismus und Nationalismus gestaltete sich Unterhaltung in Varietés.     Description: Au début du siècle dernier, le sultan du Maroc vient de signer un traité qui place désormais son pays sous le protectorat de la France (30 mars 1912). À l’ombre du maréchal Lyautey, un sultan de substitution, totalement soumis aux nouveaux maîtres français, a été proclamé. Cependant, nombreux sont ceux qui, au Maroc, refusent le fait accompli et se révoltent face à la mainmise étrangère sur le pays. Ainsi, dans le Sud marocain, Moulay Ahmed el Hiba, fils d’un marabout ouest-saharien (Ma el Aïnin), se fait proclamer sultan du Jihad en 1912 ; une première fois à Tiznit, la seconde à Marrakech. Ces événements ont donné naissance à un mouvement qui pendant plus de vingt ans (1912-1934) symbolisera pour ces populations berbères et ouest-sahariennes la résistance à l’avancée inéluctable des troupes coloniales françaises et espagnoles. Fondée sur une analyse croisée d’archives inédites, aussi bien françaises que marocaines, l’auteur fait la lumière sur un événement fondateur de la conquête coloniale du Maroc. Mythifiée, récupérée ou occultée, la figure fondatrice du mouvement hibiste est encore aujourd’hui le sujet d’un conflit mémoriel ayant pour objet l’Ouest saharien.

    Description: L'essor du recours au crédit n'est plus à démontrer : le crédit est devenu un mode de paiement courant pour une grande majorité de consommateurs. La loi du 12 juin 1991 relative au crédit à la consommation avait notamment pour objectif de cadenasser l'octroi d'emprunts, dans le souci d'améliorer la protection des consommateurs. Elle fut révisée à diverses reprises. La multiplicité des types de crédit ainsi que les nouvelles réglementations imposées par le contexte européen ont amené le législateur à prendre de nouvelles dispositions visant essentiellement à protéger le consommateur. Au cours de la dernière législature, on peut notamment relever la loi du 7 janvier 2001 modifiant la loi du 12 juin 1991 relative au crédit à la consommation et la loi du 10 août 2001 relative à la Centrale des crédits aux particuliers. Le présent ouvrage analyse ces modifications récentes et procède à un examen actualisé de la jurisprudence.

    Description: La figure du baiser occupe une place de choix dans les romans de Mary Shelley (1797-1851), femme de lettres anglaise traditionnellement attachée au courant romantique. Cet ouvrage veut contribuer à la connaissance, encore trop peu développée en France, de cette romancière, par le biais d’une figure littéraire qui entretient un rapport fort à la littérature en général et au romantisme en particulier. Il s’agira d’étudier les modalités de la représentation du baiser dans les sept romans que Mary Shelley produisit entre 1818 et 1837. Figure de la rencontre de deux subjectivités, le baiser se décline sur un mode sensible, mythique et philosophique chez la romancière. Au terme de ce parcours, c’est une figure bien particulière de l’écrivain qui sera (re)découverte.

    Description: Although invoicing is of great importance in practice, there is no fundamental treatment of its effects in the area of ​​application of the Code of Obligations in the Swiss civil law literature. The present study entitled "Invoicing in the Swiss Code of Obligations" aims to close this gap. In it, the author primarily discusses the consequences of invoicing for the origin, scope, due date and limitation of claims and how the invoicing affects the default of the debtor. The thesis is also devoted to the legal consequences of additional declarations by the biller, which are frequently encountered in practice, and sheds light on the legal status of the recipient of the bill.
    Description: Obschon die Rechnungsstellung in der Praxis von grosser Bedeutung ist, findet sich in der schweizerischen Zivilrechtsliteratur keine grundlegende Abhandlung über deren Wirkungen im Anwendungsbereich des Obligationenrechts. Diese Lücke will die vorliegende Untersuchung mit dem Titel «Die Rechnungsstellung im schweizerischen Obligationenrecht» schliessen. Der Autor erörtert darin vornehmlich, welche Konsequenzen die Rechnungsstellung für die Entstehung, den Umfang, die Fälligkeit und die Verjährung von Forderungen zeitigt und wie sich die Rechnungsstellung auf den Schuldnerverzug auswirkt. Weiter widmet sich die Arbeit den Rechtsfolgen von in der Praxis häufig anzutreffenden Zusatzerklärungen des Rechnungsstellers und beleuchtet die Rechtsstellung des Rechnungsadressaten.

S’interrogeant sur les causes de cette contradiction, cet ouvrage s’efforce de montrer l’existence d’une véritable stratégie du voyage gidien : lisible autant dans la structure des œuvres que dans leur organisation thématique ou symbolique, elle permet à son auteur de vivre et de dire ce que la société et une part de lui-même condamnaient au silence. Chargé à la fois de révéler et de dissimuler, le voyage est ainsi au cœur de l’ambiguïté gidienne. Partant des rapports historiques de Gide avec le voyage, c’est donc en fait dans une relecture de son œuvre que nous sommes embarqués, voyageant à notre tour à la poursuite d’un éternel absent.

    Description: The liberal professions are subject to an ever changing legal basis and thus constantly undergo minor or major amendments. A fundamental innovation in the current law governing the liberal professions of tax consultants is the authorization to work as in-house tax consultants. Since 2008, the Tax Consultancy Act has made possible to pursue the profession of in-house tax advisor, while lawyers were allowed to work in-house for decades already, with the last amendment of the legal regulations from 2016. This paper deals with the various legal and practical implications of the interactions between the freelance activity as a tax consultant and the activity of in-house tax consultants in an employment relationship. A detailed comparison of the legal basis for tax consultants with that of in-house lawyers is of special interest in light of the current ambiguous legal situation. Special focus is a thorough analysis of the legal question whether or not an in-house tax adviser can be exempted from the obligatory pension insurance.

    Description: Dès lors qu’elle renvoie à la possibilité de « se fier », à quelqu’un ou à quelque chose, la confiance est au cœur et au fondement des relations sociales, intéressant ce faisant la plupart des sciences sociales. Dans un contexte dominé par le constat partagé d’une « crise » de confiance / ou de défiance – dans la société, dans la démocratie, dans les hommes et les institutions politiques, dans le progrès, dans l’économie, etc. –, une interrogation croisant les analyses de différentes disciplines prend tout son sens. Si le juriste est interpellé par la problématique de la confiance en tant que « juriste dans la cité », il peut également y trouver un concept invitant à renouveler certains cadres classiques des droits constitutionnels, de l’environnement, de l’économie ou encore des finances. L’organisation d’une « journée d’étude interdisciplinaire » tendait à poursuivre ce questionnement, en invitant des spécialistes de disciplines non juridiques à dialoguer avec des juristes. Les points de vue de la philosophie, de l’histoire, de la science politique et de l’économie ont ainsi été mobilisés pour questionner la thématique commune de la confiance. Il s’est agi notamment, d’une part, de se demander si la réflexion sur la confiance était en mesure de développer des outils aptes à renouveler certains cadres théoriques classiques ; d’autre part de s’interroger sur l’impact de ces réflexions théoriques sur le lien social, eu égard aux enjeux actuels.

    Description: Envois & Dédicaces constitue une réflexion sur le don du livre, qu’il se manifeste par un ex-dono, un envoi manuscrit ou une dédicace imprimée. Si cette dernière a été étudiée à propos de tel ou tel auteur, il nous manquait encore une réflexion d’ensemble sur celle-ci. Quant à l’envoi, jugé marginal et mondain, il n’a guère été abordé, hormis par les bibliophiles. On en trouvera ici un « bref traité » qui en souligne toute la richesse. Pas plus qu’il n’existe d’éléments insignifiants dans la vie psychique, ainsi que Freud nous l’a appris, il n’existe dans le livre de détail dépourvu de valeur. La modernité s’est intéressée longuement à la signature, beaucoup moins à l’envoi et à la dédicace, parce qu’elle estimait la littérature intransitive. Elle transite cependant et s’adresse à quelqu’un. Et ce qui semble à première vue accessoire joue un rôle non négligeable, sinon capital, dans la constitution du sens d’un livre. Telle est l’hypothèse d’Envois & Dédicaces, et son pari. Sa première partie, « Perspective cavalière » s’interroge, entre autres, sur la position en tiers du lecteur ainsi que sur la place de la dédicace, premiers mots d’un livre qui se révèlent souvent aussi ses derniers mots. La seconde, « Couleurs locales », examine la façon dont quelques auteurs se sont appropriés ce geste : un musicien, Bach, et cinq écrivains, Voltaire, Hugo, Baudelaire, Montherlant, Goffette, ce dernier nous offrant, en guise de conclusion, un poème inédit adressé « à ceux qui partent ».

    Description: El título de esta obra Originales e inéditos 1928. José Carlos Mariátegui es, en cierta medida, atrevido, por cuanto se considera que las obras completas, es decir, todos los escritos de Mariátegui están publicados, según se tiene conocimiento. Pese a dichas publicaciones, las lecturas de sus fuentes directas (léase, revistas de 1928) prospera ron y tomaron dimensiones para la decisión de compilar los escritos y cotejar con las posteriores publicaciones. Entendemos por inédito lo no publicado y estaría en contradicción si las obras de Mariátegui hubieran sido publicadas en su totalidad. Pero existe un enigma para los que desean leer y confiar en esa llamada totalidad. No hay nada más inquietante para un acucioso lector que indagar las fuentes directas como si en la indagación se tratara de manuscritos, y estas fuentes, indudablemente, son los primeros escritos de Mariátegui en distintas revistas de su época (consideramos aquí 1928). Y esta edición crítica nos presenta la compilación de los escritos de Mariátegui poco conocidos, digámoslo de alguna manera, como «manuscritos» o «inéditos», porque fueron archivados, y no tuvieron la disposición de su reedición. No nos plantearemos sus razones, sólo dejamos constancia de ello como un acto irresoluto.

    Description: Neben der Biblia pauperum ist das Speculum humanae salvationis das wohl bekannteste typologische Werk des Mittelalters. Vom lateinischen Text sind 328 handschriftliche mittelalterliche Quellen überliefert. Von seiner Popularität zeugen überdies Übersetzungen ins Deutsche, Französische, Niederländische, Englische und Tschechische. Diese Arbeit stellt eine der beiden niederländischen Fassungen des Speculum, und zwar die Prosaübersetzung aus dem Jahre 1464, in den Mittelpunkt. Neben Struktur und Funktion des lateinischen Textes werden in einem chronologisch-thematisch organisierten status quaestionis die Accessusfragen nach Herkunft und Autorschaft des Speculum erörtert. Vom mittelniederländischen Prosa-Spieghel werden eine genaue kodikologische Beschreibung und eine breit angelegte Analyse der Sprache geboten. Auch der literaturhistorische Kontext und die Übersetzungs- und Bearbeitungstechnik werden eingehen behandelt. Die kritische Edition nach der Haarlemer Handschrift erfüllt ein altes Forschungsdesiderat, indem sie sowohl den Vergleich mit der bereits vor mehr als einem halben Jahrhundert herausgegebenen Versübertragung ermöglicht, als auch eine eminent wichtige Schnittstelle zwischen handschriftlicher und gedruckter Tradition in den Niederlanden für die Forschung zugänglich macht.

    Description: Aux xvie et xviie siècles, l’ordre européen était parfois menacé par des crises d’origine régionale. Ces désordres venaient des initiatives scandaleuses d’acteurs politiques habituellement peu présents sur la scène internationale (municipalités, institutions provinciales, seigneurs locaux). Pour résoudre des conflits internes, parfois contre leur propre souverain, ces acteurs n’hésitaient pas à appeler des puissances étrangères à leur secours, dans des logiques de solidarités politico-religieuses internationales. Les « affaires de Provence» (1580-1598) permettent de comprendre le fonctionnement de ce type de crises. Au plus fort des guerres de Religion en France, les catholiques de Provence appelèrent à leur secours le duc de Savoie, le grand-duc de Toscane, les papes et le roi d’Espagne. Parce que la Provence avait une position stratégique entre Barcelone et Gênes, d’autres puissances intervinrent à leur tour: l’Angleterre, l’Empire ottoman, le duché de Lorraine et la République de Venise. À partir d’une étude minutieuse des événements, ce livre mène une réflexion approfondie sur les défis stratégiques, intellectuels et rhétoriques d’une situation vécue à l’époque comme un désordre international, en raison de la marge de manœuvre subversive acquise par des acteurs ordinairement faibles.

    Description: Le décret de la Communauté française du 24 juillet 1997 définissant les missions prioritaires de l'enseignement est original à plus d'un titre. Quant à la procédure suivie pour son élaboration, tout d'abord : il fait suite aux Assises de l'enseignement et aux travaux du Conseil de l'Éducation et de la Formation qui ont assuré une large participation aux acteurs de la communauté éducative. On s'interroge aujourd'hui sur les rapports entre démocratie représentative et démocratie participative. Le décret « missions » mérite l'attention à cet égard. Quant à son contenu et ses enjeux ensuite. L'exposé des motifs les présente comme suit : « Ce décret aurait dû être le premier de tous les textes législatifs organisant renseignement obligatoire. Définissant les missions de l'Éducation, il est le texte fondateur de tous les autres ». Il a déjà produit plusieurs changements considérables dans le fonctionnement et la vie des écoles, notamment la mise sur pied de « conseils de participation », des règles nouvelles au sujet de l'inscription, de l'évaluation et de l'exclusion des élèves, ou encore à propos de la gratuité de l'enseignement. Les questions que soulève pareille législation sont nombreuses. Peut-on formuler en règles de droit des objectifs généraux ? Quelles sont la valeur et la pertinence de ceux- ci ? Comment les normes décrétales doivent-elles être interprétées ? Que reste-t-il de la liberté d'enseignement garantie par la Constitution ? C'est pour traiter ces questions que le Centre de droit de la culture des Facultés universitaires Saint-Louis a organisé le vendredi 25 septembre 1998 une journée d'études interdisciplinaire. Le présent ouvrage livre une version revue et approfondie des exposés présentés à cette occasion.

On redécouvre aujourd’hui, à la faveur de restaurations, le foisonnant décor des plafonds, plus rarement celui des murs. Cet ouvrage parcourt, pour la première fois, toutes les régions méditerranéennes qui ont participé de ce goût pour les charpentes peintes, trace la chronologie de leur histoire, observe les traits communs de leur inspiration et fait ressortir les nuances : la Renaissance et l’Antique s’expriment en même temps que la drôlerie des fabliaux.

    Description: At the end of the 1970s, a new genre cycle was formed in US cinema. Starting with space opera in cinema, for which George Lucas' Star Wars is paradigmatic, fantasy established itself for the first time as an independent cinematic genre in distinction from fairy tales and fantastic fiction. The enthusiasm for pen & paper role-playing games and the continuing J. R. R. Tolkien craze culminated in the following years in a series of films that absorbed, pushed and further developed the diversity of modern film technology and production: the spectrum of films ranged from live-action films (Conan the Barbarian) to puppet animation (The Dark Crystal) to animated films (The Last Unicorn), in which George Lucas as well as Jim Henson and the production companies behind them at the time played leading roles. Contemporary critics had written these films off as conservative, sometimes even reactionary genre plays. In contrast, this essay unfolds a (historical) poetics of the US fantasy film. With its film-analytical case studies, the volume shows how the films of the years 1977 to 1987 are embedded in a specific film culture and how the genre cycle as part of the Hollywood system prepared and significantly influenced the triumph of blockbuster cinema in the 1990s.

Sein Privatnachlass in Hohenfinow nordöstlich von Berlin wurde beim Vormarsch der Roten Armee 1945 vernichtet. Ziel der Edition ist es, die verschollenen Dokumente zu rekonstruieren. Etwa 2000 Stück, die meisten unveröffentlicht, konnten in verschiedenen Archiven ausfindig gemacht werden, z. B. im Politischen Archiv des Auswärtigen Amtes und im Bundesarchiv Berlin. Sie korrigieren das Bild dieses in der deutschen und internationalen Geschichtswissenschaft zumeist verkannten Kriegskanzlers in zahlreichen wesentlichen Zügen. Bethmann Hollweg verfügte über einen tiefen Blick in die Bewegungen der Zeit. Diesen ausgeprägten Vorausblick hatten in der neueren deutschen Geschichte neben ihm nur ganz wenige Kanzler wie Bismarck und Adenauer.

En rééditant les Principes régénérateurs du systême social, opuscule publié en pluviôse an III (janvier-février 1795), peu de temps avant la déportation de l’auteur à Cayenne, on souhaite ici éclairer un moment essentiel dans l’élaboration de la « synthèse républicaine ». C’est aussi « une nouvelle manière d’écrire l’histoire de la Révolution française » (Michel Vovelle). Un retour critique au texte met en lumière, d’une part, l’acculturation d’un révolutionnaire de premier plan, d’autre part, les thèmes récurrents du discours jacobin. L’essai de Billaud-Varenne est, en effet, une expression du projet montagnard d’« institutions civiles ». Projet d’un lien social pour « mettre en action la morale » et « la donner pour base à la politique », espérance d’un nouvel espace public de réciprocité fraternelle où la citoyenneté compte au rang des droits naturels. Ainsi se dévoile une philosophie de la Révolution française qui n’est pas sans rapport avec la pensée allemande contemporaine de l’événement révolutionnaire.

    Description: If the journalistic media are to be able to effectively perform their essential democratic tasks of forming public opinion and controlling state power, they must be independent of the state. At the same time, this state has to guarantee a diverse range of media and to inform the public about its activities. This tension is intensifying in the internet age, in which the expensive production of journalistic content is less and less taken for granted. This updates the state's duty to ensure media pluralism, for example by organizing a public service system or other promotional measures, and to carry out active public relations work. This in turn increases the risk that the state will influence media activity or become the media provider itself. The limits that the state has to observe in this context are worked out in this book on the basis of a cross-media, constitutional and international law analysis of the principle of the media's independence from the state.
    Description: Sollen die journalistischen Medien ihre demokratiewesentlichen Aufgaben der öffentlichen Meinungsbildung und der Kontrolle staatlicher Macht wirksam wahrnehmen können, müssen sie vom Staat unabhängig sein. Gleichzeitig hat ebendieser Staat ein vielfältiges Medienangebot zu gewährleisten und die Öffentlichkeit über seine Tätigkeiten zu informieren. Dieses Spannungsverhältnis verschärft sich im Internetzeitalter, in welchem die teure journalistische Inhaltsproduktion immer weniger als gesichert gilt. So aktualisiert sich dadurch die staatliche Pflicht, den Medienpluralismus etwa durch die Organisation eines Service public-Systems oder anderweitiger Fördermassnahmen zu sichern und eine aktive Öffentlichkeitsarbeit wahrzunehmen. Dies erhöht wiederum die Gefahr, dass der Staat die Medientätigkeit beeinflusst oder selber zum Medienanbieter wird. Welche Grenzen der Staat in diesem Kontext zu beachten hat, wird in diesem Buch anhand einer mediengattungsübergreifenden verfassungs- und völkerrechtlichen Analyse des Prinzips der Staatsunabhängigkeit der Medien herausgearbeitet.

Am Beispiel der internationalen Ausrichtung der deutschen gesetzlichen Unfallversicherung und der australischen Workers Compensation untersucht die Autorin diese Risiken umfassend. Mit einem detaillierten Raster praxisnaher Fallbeispiele ermittelt sie Defizite bei Versicherungsschutz, Leistungsrecht und Arbeitgeberhaftung und zeigt konkrete Lösungsmöglichkeiten auf. Bestehende völkerrechtliche Abkommen und das koordinierende Sozialrecht der EG sind als Musterregelungen in die Untersuchung einbezogen.

    Description: The present work starts from the problem when investigating how the same penalty for the crime of Fraudulent Embezzlement affects the principle of proportionality, so it is necessary to refer to Article 387 of the Penal Code, which reads as follows: The public official or servant who appropriates or uses, in any form, for himself or for another, funds or effects whose collection, administration or custody are entrusted to him by reason of his position, shall be punished with deprivation of liberty for not less than two nor more than eight years. It is an aggravating circumstance if the funds or effects were destined for welfare purposes or social support programs. In these cases, the prison sentence shall be not less than four nor more than ten years. According to the Plenary Agreement No. 4-2005/CJ-116, Plenary Jurisdiction of the Permanent and Transitory Criminal Chambers of the Supreme Court of Justice, the elements of the criminal offense of embezzlement are (i) the existence of a functional relationship, (ii) the collection, administration or custody, (iii) appropriation or use, (iv) the recipient: for himself or for a third party, (v) funds and effects. The result was that when punishing with the same penalty in the crime of Fraudulent Misappropriation in its modality of appropriation and use, despite the differences if we appreciate them from a patrimonial perspective or from the perspective of safeguarding the right of property of the public entity, in the modality of use there is an excess in the penalization, affecting the principle of proportionality, reason for which it should have a different treatment.

    Description: El presente trabajo se inicia del problema cuando se investiga de qué manera al sancionar con una misma pena en el delito de Peculado Doloso afecta el principio de proporcionalidad, por lo que es necesario remitirnos al artículo 387 del Código Penal, cuyo tenor es como sigue: El funcionario o servidor público que se apropia o utiliza, en cualquier forma, para sí o para otro, caudales o efectos cuya percepción, administración o custodia le estén confiados por razón de su cargo, será reprimido con pena privativa de la libertad no menor de dos ni mayor de ocho años. Constituye circunstancia agravante si los caudales o efectos estuvieran destinados a fines asistenciales o a programas de apoyo social. En estos casos, la pena privativa de la libertad será no menor de cuatro ni mayor de diez años. Según lo establecido por el Acuerdo Plenario N.° 4-2005/CJ-116, Pleno jurisdiccional de las Salas Penales Permanentes y Transitoria de la Corte Suprema de Justicia, los elementos del tipo penal de peculado son (i) la existencia de una relación funcional, (ii) la percepción, administración o custodia, (iii) apropiación o utilización, (iv) el destinatario: para sí o para un tercero, (v) caudales y efectos. El resultado fue que al sancionar con una misma pena en el delito de Peculado Doloso en su modalidad de apropiación y utilización visten de igual contenido de ilicitud, pese a las diferencias si las apreciamos desde una perspectiva patrimonialista o de salvaguarda del derecho de propiedad del ente público, en la modalidad de utilizar existe un exceso en la penalización afectándose el principio de proporcionalidad, razón por la cual debe tener un tratamiento distinto.

Other contributions explain the role of academic infrastructure, especially of libraries and promoters of research.     Description: Les relations entre les États-Unis et l’Unesco ont toujours été complexes comme le démontre l’étude des 20 premières années de celles-ci. Lors de la création de l’Unesco quelques Américains ont énormément travaillé pour que cette Institution spécialisée des Nations- Unis existe. Leur rôle et leur apport sont ici soigneusement mis en évidence. Or, les premières déceptions arrivent rapidement car, à tort, du côté de Washington, on espérait voir l’Organisation participer efficacement à la lutte contre le communisme. Néanmoins, à la fin des années 1950, l’Unesco connaît un regain de faveur auprès du gouvernement américain. Et si l’hégémonie financière américaine à l’Unesco n’a jamais fait de doute, sa domination politique est mise en cause dès les premières années. Les États-Unis vont quitter l’Unesco en 1984, quand la première génération d’Américains, fondateurs de l’Unesco et fidèles malgré les déceptions a, depuis longtemps, quitté la scène politique.     Description: Si l’histoire traditionnelle de l’hérésie au Moyen Âge s’est longtemps confondue avec celle des exclus de la société, l’approche récente se focalise davantage sur les diverses autorités qui, au coeur du pouvoir, élaborèrent la norme religieuse : l’hérésie n’existe que parce que l’orthodoxie en a d’abord décidé. Il reste que, loin de se présenter comme une essence immuable, elle s’impose tout au long du Moyen Âge comme un concept et une qualification d’une très grande plasticité. L’extension progressive du domaine de l’hérésie à de nombreuses formes de dissidence finit par lui assurer le statut d’un crime englobant. Cette enquête collective repose sur la conviction que c’est encore en se situant aux marges de l’hérésie, au contact d’activités répréhensibles voisines, telles que l’usure, la sorcellerie ou encore la rébellion politique, que l’on peut le mieux saisir les principes et les mécanismes de la fabrique de l’hérésie.
