    Beschreibung: Depuis la fin du xxe siècle, un pan de la critique universitaire s’est montré soucieux d’offrir aux études francophones un soubassement épistémologique capable d’asseoir leur légitimité. Le présent ouvrage se situe résolument dans ce sillage. Son originalité tient sans doute à la contribution d’écrivains et d’étudiants conviés à participer à cet effort réflexif. Adoptant une composition polygraphe qui mêle articles scientifiques, essais et entretiens, ce livre esquisse un inventaire des concepts, pratiques et méthodes permettant d’appréhender les écritures francophones du xxie siècle commençant. Il fait ainsi surgir ou resurgir quelques grandes questions et met en relief certaines nécessités : reconsidérer le concept même de francophonie, inclure la variété de ses espaces et de ses corpus, mais aussi sortir les études francophones de leur confinement. Plus globalement, il s’agit d’élaborer de nouveaux cadres théoriques pour repenser l’espace, le temps et l’histoire littéraire.

    Beschreibung: El análisis semiótico de la diégesis o historia relatada y la actorialización o distribución de los actores del discurso en Ilona llega con la lluvia permite dilucidar la desesperanza como el hilo conductor de la novela, el cual es develado por el relato que hacen los personajes de sus recuerdos. En mi lectura, daré cuenta del componente argumental como universo diégetico donde se desarrolla la trama, así como el componente actoral, donde se localizan los actores Maqroll, Ilona y Larissa, y las acciones que estos realizan y que los afectan. La actorialización definirá, además, cómo estos actores se relacionan con las isotopías semánticas de la nostalgia como sentimiento siempre presente de lo gozado en un pasado feliz, la muerte como experiencia propia y la conciencia de la propia destrucción como correlato necesario de la vida.

The innovative combination of linguistics, history, and cartography makes a wealth of hard-to-reach knowledge readily available to both specialist and general readers. It combines information on languages, dialects, alphabets, religions, mass violence, or migrations over an extended period of time. The story first focuses on Central Europe’s dialect continua, the emergence of states, and the spread of writing technology from the tenth century onward. Most maps concentrate on the last two centuries. The main storyline opens with the emergence of the Western European concept of the nation, in accord with which the ethnolinguistic nation-states of Italy and Germany were founded. In the Central European view, a “proper” nation is none other than the speech community of a single language. The Atlas aspires to help users make the intellectual leap of perceiving languages as products of human history and part of culture. Like states, nations, universities, towns, associations, art, beauty, religions, injustice, or atheism—languages are artefacts invented and shaped by individuals and their groups.

    Beschreibung: Henri Hours' book on the end of the League in Lyon is one of the most important works of 16th century historiography in Lyon, although very few readers have had the opportunity to consult it. This is its main paradox and the challenge of this edition. The thesis was defended at the École Nationale des Chartes in 1951, but it has never been published and, in accordance with the rules of the École, it has never been made available. Only those who knew the author were able to read it, which does not prevent it from appearing in all bibliographies concerning the Wars of Religion. Following his death in 2017 and with the agreement of his family, the Collection Chrétiens & Sociétés has decided to publish this memoir for the first time in order to make it accessible to the public in Lyon and to historians of religious confrontations. Henri Hours meticulously analysed the last years of the League at Lyon, the crucial years 1593-1597. Since 1589, the city had swayed to the side of Catholic intransigence to the point of rejecting its sovereign, Henry IV, and maintaining a costly but necessary war effort in a region crossed by denominational borders. The bishop, Pierre d'Epinac, the consuls of Lyon, the governor of the city, the Savoyard and Spanish spies, but also the street preachers and the little people who were very inclined to be alarmed, were the main actors in these events. Here we touch on the political and religious dimensions of urban history. Through municipal deliberations, correspondence, pamphleteering and some contemporary accounts, Henri Hours unravels the skein of the city's political shift towards submission to the king. By looking back at the writings of some of these actors, notably Pierre Mathieu and Claude de Rubys, he also questions the memory of the event in the consciousness of Lyon.

    Beschreibung: Les auteurs de cet ouvrage “ Pierre et Archéologie ”, issu du Colloque international qui s’est tenu à Tautavel (14-15 mai 1998) veulent attirer l’attention sur les nombreux aspects de l’utilisation de la pierre par l’Homme depuis la Préhistoire, et les difficultés pour comprendre et expliquer son identification, son évolution et sa conservation. Mise à part l’utilisation lointaine de la pierre par l’homme préhistorique pour assurer sa survie, il reste le domaine très vaste, plus récent dans le temps, de la pierre de taille utilisée par les hommes. Déjà les gallo-romains se sont servis des pierres dites « du midi » pour des constructions que nous connaissons bien. Mais la pierre n’est pas réservée seulement aux monuments, elle fait partie de la vie quotidienne. En dehors des grands édifices, de nombreuses habitations sont bâties en pierre et souvent leur sol est pavé de pierres. Il y a aussi l’amour de la pierre tout simplement, pour le beau, le toucher : c’est par exemple la sculpture qui agrémente les monuments et même les habitations. Les sarcophages en marbre blanc, sculptés entre la fin de l’Antiquité classique et le Haut Moyen-Age, dont le problème de l’origine est traité dans cet ouvrage, montrent bien la diversité des aspects artistiques que l’Homme a su exploiter. L’ensemble des contributions présentées apporte des données originales sur les méthodes et techniques modernes utilisées pour contribuer à mieux comprendre l’évolution culturelle et artistique de l’humanité, le devenir de la pierre extraite et la restauration des monuments. Ceci montre une fois de plus la nécessité d’une recherche pluridisciplinaire, seule démarche pour assurer la protection et la pérennité de tout ce qui touche notre patrimoine.

At the same time, researchers are questioning what the North is, its conceptualisation, its cultural implications, its geographical characteristics, its social and political challenges. This volume is part of the current debate on the Nordic imaginary based on a notion, Nordicity, which intersects with borealism. Plural and mobile, the North inspires both scriptural and figurative production based on desire, dream, fascination or fantasy. The real, tangible and contingent North is only the apparent surface of a manufactured and invented North. How can we express northernness today? Is a theory of the North possible? This volume attempts to answer these questions by bringing together contributions from researchers in Nordic studies, literature, linguistics and the humanities: each is given the opportunity to define his own conception of Nordicity. Ces dernières années, à travers romans et sériés télévisées ("Vikings", "Millennium", "Borgen" ou "Occupied"), la culture nordique a gagné en visibilité internationale. Simultanément, les chercheurs s'interrogent sur ce qu’est le Nord, sa conceptualisation, ses implications culturelles, ses caractéristiques géographiques, ses enjeux sociaux et politiques. Ce volume s’insère dans le débat actuel sur l’imaginaire nordique à partir d’une notion – la nordicité – qui interagit tout particulièrement avec le boréalisme. Pluriel et mouvant, moteur constant de redéfinitions, le Nord inspire une fabrication tant scripturale que figurale fondée sur le désir, le rêve, la fascination ou le fantasme.     Beschreibung: Écrire la crise ce n'est pas la raconter. C'est montrer comment elle modifie nos manières de raconter. Encore faut-il s'entendre sur le mot lui-même car peut-on appeler crise (du grec « krisis » : changement brutal) cette lente dissolution des valeurs de la modernité qui nous fait entrer dans un « après » informulable, sinon par le terme souvent controversé de postmodernité ? Au-delà des polémiques que suscite cette notion, il s'agit ici de considérer le postmoderne non pas comme une régression anti-moderne mais comme la prise de conscience d'un certain nombre de dévoiements du projet moderne qui nous projettent dans une ère de turbulence dont les arts, et en particulier la littérature, portent la marque. Ainsi considéré, le postmodernisme n'est ni une école, ni une avant-garde. Il témoigne avant tout d'une crise de culture à la transition des deux siècles, qui s'est transformée en culture de la crise, de sorte que, non seulement la pensée, la science et les arts, s'en trouvent affectés, mais de manière plus profonde encore, la société et l'individu. C'est pourquoi cet essai se propose à la fois, d'examiner l'hypothèse postmoderne comme mise en turbulence des valeurs de la modernité, et de définir le postmodernisme en littérature comme une esthétique qui met en relation les configurations sociales et certaines formes d'écriture contemporaine.

    Beschreibung: Anthropologists have been appearing as key expert witnesses in native title claims for over 20 years. Until now, however, there has been no theoretically-informed, detailed investigation of how the expert testimony of anthropologists is formed and how it is received by judges. This book examines the structure and habitus of both the field of anthropology and the juridical field and how they have interacted in four cases, including the original hearing in the Mabo case. The analysis of background material has been supplemented by interviews with the key protagonists in each case. This allows the reader a unique, insider’s perspective of the courtroom drama that unfolds in each case. The book asks, given the available ethnographic research, how will the anthropologist reconstruct it in a way that is relevant to the legal doctrine of native title when that doctrine gives a wide leeway for interpretation on the critical questions: what is the relevant grouping, what can be counted as a traditional law and when has there been too much change of tradition? How will such evidence be received by judges who are becoming increasingly sceptical about experts tailoring their evidence to suit the party which called them? This book answers these questions by assuming that there is more at stake here than the mere performance of roles. Rather, there is a complex interaction of distinct social fields each with its own habitus, and individual actors are engaged in an active and constructive agency, however subtle, which the painstaking research for this book uncovers.

    Beschreibung: "Printing and Prophecy: Prognostication and Media Change 1450-1550 examines prognostic traditions and late medieval prophetic texts in the first century of printing and their effect on the new medium of print. The many prophetic and prognostic works that followed Europe's earliest known printed book—not the Gutenberg Bible, but the Sibyl's Prophecy, printed by Gutenberg two years earlier and known today only from a single page—over the next century were perennial best sellers for many printers, and they provide the modern observer with a unique way to study the history and inner workings of the print medium. The very popularity of these works, often published as affordable booklets, raised fears of social unrest. Printers therefore had to meet customer demand while at the same time channeling readers' reactions along approved paths. Authors were packaged—and packaged themselves—in word and image to respond to the tension, while leading figures of early modern culture such as Paracelsus, Martin Luther, and Sebastian Brant used printed prophecies for their own purposes in a rapidly changing society. Based on a wide reading of many sources, Printing and Prophecy contributes to the study of early modern literature, including how print changed the relationship among authors, readers, and texts. The prophetic and astrological texts the book examines document changes in early modern society that are particularly relevant to German studies and are key texts for understanding the development of science, religion, and popular culture in the early modern period. By combining the methods of cultural studies and book history, this volume brings a new perspective to the study of Gutenberg and later printers."

    Beschreibung: Mito: relato explicativo, simbólico y dinámico, de uno o varios acontecimientos extraordinarios personales con referente trascendente, que carece en principio de testimonio histórico, se compone de una serie de elementos invariantes reducibles a temas y sometidos a crisis, que presenta un carácter conflictivo, emotivo, funcional, ritual y remite siempre a una cosmogonía o a una escatología absolutas, particulares o universales. Esta definición, general, fría e indeterminada, requiere un tiempo, un espacio, y sobre todo una conciencia que la viva. El mito no es un constructo mental ajeno a las vicisitudes socioculturales: lleva marcada en su piel y sus entrañas la huella de cada individuo y sociedad que lo vio nacer; pero también sabe adaptarse a las condiciones del nuevo tiempo que lo acoge. Mitos de hoy narra esa tensión del mito por mantenerse vivo en el terreno, aparentemente inhóspito, de un mundo desengañado. La Mitocrítica Cultural, aquí puesta en práctica, combina las herramientas tradicionales de la mitocrítica con factores no considerados sistemáticamente por la crítica precedente: la globalización, la inmanencia y el consumismo. Ofrece así una modesta contribución a la tarea de identificar, analizar y sintetizar la tipología de las manifestaciones del mito en la literatura, las artes y los medios de comunicación contemporáneos.     Beschreibung: Die Frage nach der Verbindlichkeit des Rechts, die Frage also, ob dem Recht über seine äußere Zwangsgewalt hinaus eine verpflichtende Kraft zukomme, versteht sich nicht von selbst. Hat der aus der Trennung von Recht und Moral entspringende Rechtspositivismus doch zu der These geführt, daß das Recht – rein rechtlich betrachtet – zu nichts verpflichte. Das widerspricht allerdings den vorherrschenden sozialen Anschauungen. Sie verlangen folglich nach einer Begründung für den dem Recht zugeschriebenen Anspruch verbindlicher Maßgeblichkeit. Demgemäß ranken sich um die Idee solcher Normativität des Rechts Vorstellungen, Bilder und Begriffe, die eine innere Bindung durch Recht plausibel zu machen suchen. Es wird gezeigt, daß sich diese Konnotationen der Idee der Rechtsverbindlichkeit auf drei Grundfiguren zurückführen lassen, die der Grammatik der persönlichen Fürwörter korrespondieren.Der Autor ist Professor für Öffentliches Recht, Rechts- und Staatsphilosophie an der Humboldt-Universität zu Berlin.

Because of their unique state of preservation, they give an unparalleled insight into what an architect with an imperial commission could do, when he had the building-materials and technical expertise of the entire empire at his disposal.〈br/>〈br/>The buildings excavated by Italian teams between the two World Wars were examined in detail by Ward-Perkins between 1948 and 1953. The study was never completed in his lifetime, though the drawings and much of the text existed at least in draft form. The present publication puts these in the public domain, together with Ward-Perkins' authoritative insights into the process by which such a grand project was executed.

    Beschreibung: St Peter's, Barton-upon-Humber, is a redundant medieval church in the care of English Heritage. As a result of a major program of research carried out between 1978 and 2007, it is now the most intensively studied parish church in the UK. Excavations between 1978 and 1984 investigated most of the interior of the building, as well as a swathe of churchyard around its exterior. At the same time, a stone-by-stone record and detailed archaeological study of the fabric and furnishings of the church was undertaken, continuing down to 2007. The twin aims of the project were to understand the architectural history and setting of this complex, multi-period building (Volume 1, Parts 1 and 2) and to recover a substantial sample of the population for palaeopathological study (Volume 2). An extensive program of historical and topographical research also took place in order to set the archaeological evidence firmly in context.

    Beschreibung: "The present work addresses the history of Derecho Indiano (Spanish Colonial Law) and proposes to examine the role played by Indiano-Castilian jurists in the New World as creators and enforcers of a science and the practice of law. They were given the task of organising and developing public authorities as well as the new society, and in their engagement with the temporary institutions, they were confronted with realities and situations as diverse as they themselves proclaimed them to be. The works brought together in this volume originally appeared in journals and collected works from different countries, and they are now being presented here in a revised edition. Castile was the kingdom overseeing the expansion across the Atlantic; an expansion to lands and peoples unknown to Europeans up till that point in time. The jurists who worked under these new and challenging circumstances belonged to the Castilian tradition, and they were immersed in this tradition not only due to their university education, but also as a result of their cultural environment and the very structure of the governing bodies and justice system of the kingdom. The confrontation with a reality that was, in so many respects, different from that of the Peninsular – as could already clearly be seen in accounts written by conquistadors, missionaries and the authorities from the early days – encouraged jurists to search for solutions to the new problems that had arisen. Over the years, this led to the creation of what would eventually shape a heterogeneously composed normative corpus, both in civil and canon terms. The differences between the Indiano and Castilian systems were marked to the point that it became a widely accepted truth that the Indiano order could not be fully understood or taken into account either by the advisors of Castile or the lawyers who travelled to the Americas with no prior knowledge of this particular law. Jurists who were born or based in the Indiano provinces would often come to discover the “constitutional discourse” of the monarchy; in other words, they experienced the unfolding plot, so to speak, not through theory, but rather through the impetus provided by the possible solutions to the numerous issues that had arisen. Although Castilian legal literature, which exerted a powerful influence, was present and being circulated throughout the Americas, preferences when it came to specific authors and legal bodies were as different as the readings and interpretations made of them. Several criteria both general and specific in nature took shape. Consequently, “local contexts”, for example, were often discussed in the application of general norms and the “customary background” was similarly taken into account."

    Beschreibung: La Fontaine affiche nettement sa filiation à l’égard de Marot. Du moins à l’égard d’un Marot. Comme beaucoup d’auteurs de son époque, il voit en effet dans le poète de L’Adolescence clémentine l’efflorescence printanière d’un style proprement français, qui allie au piquant et au brio la naïveté toute vernale d’une écriture. L’auteur des Fables et des Contes admire ainsi le brillant faiseur d’épigrammes. Il y reconnaît « le génie fran­çais », son ingenium, son naturel. Ce naturel s’exprime à la fois dans un esprit gaulois – que Rabelais radicalise trop pour qu’on puisse en faire un allié de marque – et une écriture transparente, non savante, à l’opposé de l’artificieuse et docte poésie de la Pléiade rejetée par le XVIIe siècle comme un accident regrettable dans l’histoire des formes. Cet « élégant badinage », assigné depuis Boileau à Marot, a pu nuire à l’œuvre de ce dernier en en restreignant la portée. La critique moderne a, par contraste, reconnu dans le poète de Cahors un esprit secret, anxieux, au cœur des débats évangéliques du premier XVIe siècle. Le vrai Marot est sûrement à rechercher au carrefour de ces deux interprétations extrêmes ; comme La Fontaine, au demeurant, que l’on ne peut réduire au modèle achevé de l’esthétique galante. La relation qui unit Marot et La Fontaine est bien en tout cas au départ une relation d’ordre formel. Aussi les chercheurs réunis ici ont tous tenté de repenser ou de repréciser les lectures stylistiques de l’un ou l’autre de ces auteurs à travers leur interprétation de L’Adolescence clémentine ou des Amours de Psyché et de Cupidon. La diversité des points de vue adoptés permet d’aider à définir ce qui reste en dernier lieu le plus difficile à caractériser, ce naturel du style, si revêche à l’analyse littéraire.

    Beschreibung: This book is a historical study of the Tajiks in Central Asia from the ancient times to the post-Soviet period. For millennia, these descendants of the original Aryan settlers were part of many different empires set up by Greek, Arab, Turkic and Russian invaders, as well as their own, most notably during the Middle Ages. The emergence of the modern state of Tajikistan began after 1917 under Soviet rule, and culminated in the promulgation of independence from the moribund USSR in 1991. In the subsequent civil war that raged between 1992 and 1997, Tajikistan came close to becoming a failed state. The legacy of that internal conflict remains critical to understanding politics in Tajikistan a generation later. Exploring the patterns of ethnic identity and the exigencies of state formation, the book argues that despite a strong sense of belonging underpinned by shared history, mythology and cultural traits, the Tajiks have not succeeded in forming a consolidated nation. The politics of the Russian colonial administration, the national-territorial delimitation under Stalin, and the Soviet strategy of socio-economic modernisation contributed to the preservation and reification of sub-ethnic cleavages and regional identities. The book demonstrates the impact of region-based elite clans on Tajikistan’s political trajectory in the twilight years of the Soviet era, and identifies objective and subjective factors that led to the civil war. It retraces the formation of an extensive market for corporate policing, privately contracted security and yellow unionism, as well as processes of professionalisation in strikebreaking activities, labour espionage and surveillance. It reconstructs the diverse spectrum of right-wing patriotic leagues and vigilante corps which, in support or in competition with law enforcement agencies, sought to counter the dual dangers of industrial militancy and revolutionary situations. Although considerable research has been done on the rise of socialist parties and trade unions the repressive policies of their opponents have been generally left unexamined. This book fills this gap by reconstructing the methods and strategies used by state authorities and employers to counter outbreaks of labour militancy on a global scale. It adopts a long-term chronology that sheds light on the shocks and strains that marked industrial societies during their turbulent transition into mass politics from the bitter social conflicts of the pre-war period, through the epochal tremors of war and revolution, and the violent spasms of the 1920s and 1930s. Offering a new angle of vision to examine the violent transition to mass politics in industrial societies, this is of great interest to scholars of policing, unionism and striking in the modern era.

On 12 March 2018, Mauritius celebrated fifty years as an independent nation amidst much fanfare. Yet behind the nation's official image of multicultural 'unity in diversity' lurk deep socio-economic inequalities and inter-ethnic tensions that are insistently critiqued in its literature. Against this backdrop, this book analyses how the idea of belonging - a sense of attachment to, and identification with, a place or people - is problematised in a range of contemporary francophone Mauritian novels. The island-nation's complex history and the multi-ethnic composition of its modern-day population mean that belonging is a central but fraught issue in both reality and fiction. Waters explores how diverse forms of affirmative, affective belonging intersect with, and are frequently inhibited by, exclusionary 'politics of belonging' at communal, national or international levels. Using an eclectic theoretical approach to the central concept of belonging, Waters offers in-depth textual analyses of novels by leading Mauritian writers Nathacha Appanah, Ananda Devi, Shenaz Patel, Bertrand de Robillard, Amal Sewtohul and Carl de Souza. Despite their thematic and formal diversity, these novels are shown to be characterised by a common rejection of dominant discourses of ethnic, diasporic affiliation and by a common commitment to the ongoing, future-orientated project of Mauritian nationhood. As such, this book offers an original insight into the dynamics of belonging and exclusion in diverse, multi-ethnic societies.

    Beschreibung: This volume provides an ambitious synopsis of the complex, colourful world of textiles in ancient Mediterranean iconography. A wealth of information on ancient textiles is available from depictions such as sculpture, vase painting, figurines, reliefs and mosaics. Commonly represented in clothing, textiles are also present in furnishings and through the processes of textile production. The challenge for anyone analysing ancient iconography is determining how we interpret what we see. As preserved textiles rarely survive in comparable forms, we must consider the extent to which representations of textiles reflect reality, and critically evaluate the sources. Images are not simple replicas or photographs of reality. Instead, iconography draws on select elements from the surrounding world that were recognisable to the ancient audience, and reveal the perceptions, ideologies, and ideas of the society in which they were produced. Through examining the durable evidence, this anthology reveals the ephemeral world of textiles and their integral role in the daily life, cult and economy of the ancient Mediterranean.

    Beschreibung: L'essor du recours au crédit n'est plus à démontrer : le crédit est devenu un mode de paiement courant pour une grande majorité de consommateurs. La loi du 12 juin 1991 relative au crédit à la consommation avait notamment pour objectif de cadenasser l'octroi d'emprunts, dans le souci d'améliorer la protection des consommateurs. Elle fut révisée à diverses reprises. La multiplicité des types de crédit ainsi que les nouvelles réglementations imposées par le contexte européen ont amené le législateur à prendre de nouvelles dispositions visant essentiellement à protéger le consommateur. Au cours de la dernière législature, on peut notamment relever la loi du 7 janvier 2001 modifiant la loi du 12 juin 1991 relative au crédit à la consommation et la loi du 10 août 2001 relative à la Centrale des crédits aux particuliers. Le présent ouvrage analyse ces modifications récentes et procède à un examen actualisé de la jurisprudence.

    Beschreibung: This open access book is the first ever collection of Karl Popper's writings on deductive logic. Karl R. Popper (1902-1994) was one of the most influential philosophers of the 20th century. His philosophy of science ("falsificationism") and his social and political philosophy ("open society") have been widely discussed way beyond academic philosophy. What is not so well known is that Popper also produced a considerable work on the foundations of deductive logic, most of it published at the end of the 1940s as articles at scattered places. This little-known work deserves to be known better, as it is highly significant for modern proof-theoretic semantics. This collection assembles Popper's published writings on deductive logic in a single volume, together with all reviews of these papers. It also contains a large amount of unpublished material from the Popper Archives, including Popper's correspondence related to deductive logic and manuscripts that were (almost) finished, but did not reach the publication stage. All of these items are critically edited with additional comments by the editors. A general introduction puts Popper's work into the context of current discussions on the foundations of logic. This book should be of interest to logicians, philosophers, and anybody concerned with Popper's work.

    Beschreibung: Terre de mélanges culturels et de politiques coloniales, la Tunisie a attiré de l’Europe des courants d’immigrations aussi bien que des visées impérialistes. La trajectoire des Juifs italiens, dits Livournais, s’inscrit au carrefour de ces axes. Une communauté enracinée en Tunisie depuis le xviie siècle, mais toujours assimilée au monde européen. Une population cosmopolite, mais jalousement attachée à Livourne et à l’Italie. Une double minorité, à l’égard tant de la nombreuse population juive locale que des cent mille émigrés italiens vivant en Tunisie au début du xxe siècle, mais toujours caractérisée par une forte identité collective. Pendant l’entre-deux-guerres, la place sociale de cette communauté fut remise en cause par une série de phénomènes convergents : l’essor du nationalisme tunisien, les tensions diplomatiques italo-françaises, et surtout par la montée au pouvoir du régime fasciste, résolu à encadrer les communautés d’émigration dans sa politique impériale. Sur la base de fonds d’archives et de témoignages inédits, ce travail reconstruit le parcours des Juifs italiens de Tunisie face aux stratégies de fascisation de Rome, en interrogeant les croisements identitaires dans les contextes d’émigration, la question de l’adhésion de masse au totalitarisme et le poids des médiateurs au sein des sociétés coloniales.

Die vorliegende Untersuchung thematisiert diesen Prozess am Beispiel der transatlantischen Beziehungen zwischen den Niederlanden und den nach Selbstständigkeit strebenden Kolonien in Amerika zwischen 1776 und 1782. Den amerikanischen Kolonisten ging es um zweierlei: einerseits um die völkerrechtliche Anerkennung ihres Abfalls vom englischen Königreich und andererseits um die finanzielle Unterstützung der amerikanischen Revolutionäre durch die anderen europäischen Staaten. Hierbei spielten die Republik der Vereinigten Niederlande diplomatisch und die Amsterdamer Finanzhäuser ökonomisch eine viel zu lang unterschätzte Rolle. In einer Nahbetrachtung der diplomatischen und finanztechnischen Aktionen der beteiligten Diplomaten, Politiker und Kaufleute und ihrer jeweiligen Einschätzungen durch Roland Richter wird die Komplexität des historischen Prozesses erkennbar und ein weiterführender Beitrag zur transatlantischen Niederlandeforschung geleistet.

    Beschreibung: Although invoicing is of great importance in practice, there is no fundamental treatment of its effects in the area of ​​application of the Code of Obligations in the Swiss civil law literature. The present study entitled "Invoicing in the Swiss Code of Obligations" aims to close this gap. In it, the author primarily discusses the consequences of invoicing for the origin, scope, due date and limitation of claims and how the invoicing affects the default of the debtor. The thesis is also devoted to the legal consequences of additional declarations by the biller, which are frequently encountered in practice, and sheds light on the legal status of the recipient of the bill.
    Beschreibung: Obschon die Rechnungsstellung in der Praxis von grosser Bedeutung ist, findet sich in der schweizerischen Zivilrechtsliteratur keine grundlegende Abhandlung über deren Wirkungen im Anwendungsbereich des Obligationenrechts. Diese Lücke will die vorliegende Untersuchung mit dem Titel «Die Rechnungsstellung im schweizerischen Obligationenrecht» schliessen. Der Autor erörtert darin vornehmlich, welche Konsequenzen die Rechnungsstellung für die Entstehung, den Umfang, die Fälligkeit und die Verjährung von Forderungen zeitigt und wie sich die Rechnungsstellung auf den Schuldnerverzug auswirkt. Weiter widmet sich die Arbeit den Rechtsfolgen von in der Praxis häufig anzutreffenden Zusatzerklärungen des Rechnungsstellers und beleuchtet die Rechtsstellung des Rechnungsadressaten.

Focusing on a set of Jewish communities, Robert Chazan tells how, by the eleventh century, French Jews had created for themselves a role as local merchants and moneylenders in adapting to the political, economic, and social limits imposed on them. French society, striving to become more powerful and civilized, was willing to extend aid and protection to the Jews in return for general stimulation of trade and urban life and for the immediate profit realized from taxation. While the authorities were relatively successful in protecting the Jews from others, there was no power to impose itself between the Jews and their protectors. The political and social well-being of the Jews was, therefore, dependent on the will of the governing authorities who taxed their holdings and regulated their activities. During the twelfth and thirteenth centuries, the position of the Jews was constantly under attack by reform elements in the church concerned with Jewish moneylending and blasphemous materials in Jewish books; these reformers were eventually devoted to a serious missionizing effort within the Jewish community. The Jews' situation was further complicated by deep popular animosity, expressing itself in a damaging set of slanders and occasionally in physical violence. Despite the impressive achievements of the Jews in medieval northern France, by the thirteenth century their community was increasingly constricted; and in 1306, they were expelled from royal France by Philip IV. Overcoming the handicap of a lack of copious source material, Chazan analyzes the Jews' political status, their relations with key elements of Christian society, their demographic development, their economic outlets, their internal organization, and their attitudes toward the Christian environment. As it highlights aspects of French society from an unusual perspective, Medieval Jewry in Northern France should be of special interest to the historian of medieval France as well as to the student of Jewish history. This story is also significant for all who are fascinated by the capacity of human groups to respond and adapt creatively to a hostile and limiting environment.

    Beschreibung: This social, cultural, and political history of Slavic Muslim women of the Yugoslav region in the first decades of the post-Ottoman era is the first to provide a comprehensive overview of the issues confronting these women. It is based on a study of voluntary associations (philanthropic, cultural, Islamic-traditionalist, and feminist) of the period. It is broadly held that Muslim women were silent and relegated to a purely private space until 1945, when the communist state “unveiled” and “liberated” them from the top down.  After systematic archival research in Bosnia, Croatia, Serbia, and Austria, Fabio Giomi challenges this view by showing:  How different sectors of the Yugoslav elite through association publications, imagined the role of Muslim women in post-Ottoman times, and how Muslim women took part in the construction or the contestation of these narratives.  How associa­tions employed different means in order to forge a generation of “New Muslim Women” able to cope with the post-Ottoman political and social circumstances.  And how Muslim women used the tools provided by the associations in order to pursue their own projects, aims and agendas.  The insights are relevant for today’s challenges facing Muslim women in Europe. The text is illustrated with exceptional photographs.

Should antitrust law intervene? Is it a case of sham litigation? This work attempts to answer those questions through a comparative analysis, examining the law and case law in the US and in the EU from both a patent and a competition law perspective and seeking a workable theory of harm.

The authors argue for the presence of a major ritual causeway of the late Bronze and Iron Age and outline the extent to which ritual monuments also contributed to the character of Roman Lincoln. This book is based on more than a hundred publicly-funded excavations and building surveys undertaken between 1945 and 2000. It surveys all aspects of city life, from housing and fortifications to the water supply and rubbish disposal. It includes a CD Rom with a Geographic Information System (GIS) and a relational data-base known as LARA (the Lincoln Archaeological Research Assessment).

    Beschreibung: The liberal professions are subject to an ever changing legal basis and thus constantly undergo minor or major amendments. A fundamental innovation in the current law governing the liberal professions of tax consultants is the authorization to work as in-house tax consultants. Since 2008, the Tax Consultancy Act has made possible to pursue the profession of in-house tax advisor, while lawyers were allowed to work in-house for decades already, with the last amendment of the legal regulations from 2016. This paper deals with the various legal and practical implications of the interactions between the freelance activity as a tax consultant and the activity of in-house tax consultants in an employment relationship. A detailed comparison of the legal basis for tax consultants with that of in-house lawyers is of special interest in light of the current ambiguous legal situation. Special focus is a thorough analysis of the legal question whether or not an in-house tax adviser can be exempted from the obligatory pension insurance.

    Beschreibung: The authors comprehensively analyze all the available information regarding the ritual practices of Slavic pre-Christian religion that can be found in written medieval texts. After investigating every kind of reference to such practices, they offer a reconstruction of Slavic pre-Christian religion on the basis of these medieval testimonies. In doing so, they overcome the challenges presented by the fact that all of these sources are indirect, since the Slavs did not acquire literacy until they became Christians. Thus the writers of these texts mostly professed a monotheistic religion, being Christians and in some cases Muslims. The picture that they offer is biased and determined by their own faith. The present analysis innovatively combines testimonies from every Slavic area (Eastern, Western, and Southern), showing their mutual correspondences and emphasizing the relationship between the Slavic pre-Christian religion and its Indo-European roots.

It brought together nearly three hundred participants from seventeen countries with the goal of confronting research and interventions conducted in Lascaux Cave since 2001 with the experiences gained in other countries in the domain of preservation in subterranean environments. Twelve presentations addressed questions related to disciplines such as hydrogeology, climatology and microbiology in relation to the protection and valorization of decorated caves. The talks were followed by debates allowing the experts and all other participants to freely express themselves. This volume, which constitutes the proceedings of this symposium, is composed of the studies presented during the sessions and full transcriptions of the debates. It provides both a synthesis of the conservation activities realized at Lascaux between 2001 and 2009 and the state of research and the conditions of the cave as of 2009.

    Beschreibung: Dès lors qu’elle renvoie à la possibilité de « se fier », à quelqu’un ou à quelque chose, la confiance est au cœur et au fondement des relations sociales, intéressant ce faisant la plupart des sciences sociales. Dans un contexte dominé par le constat partagé d’une « crise » de confiance / ou de défiance – dans la société, dans la démocratie, dans les hommes et les institutions politiques, dans le progrès, dans l’économie, etc. –, une interrogation croisant les analyses de différentes disciplines prend tout son sens. Si le juriste est interpellé par la problématique de la confiance en tant que « juriste dans la cité », il peut également y trouver un concept invitant à renouveler certains cadres classiques des droits constitutionnels, de l’environnement, de l’économie ou encore des finances. L’organisation d’une « journée d’étude interdisciplinaire » tendait à poursuivre ce questionnement, en invitant des spécialistes de disciplines non juridiques à dialoguer avec des juristes. Les points de vue de la philosophie, de l’histoire, de la science politique et de l’économie ont ainsi été mobilisés pour questionner la thématique commune de la confiance. Il s’est agi notamment, d’une part, de se demander si la réflexion sur la confiance était en mesure de développer des outils aptes à renouveler certains cadres théoriques classiques ; d’autre part de s’interroger sur l’impact de ces réflexions théoriques sur le lien social, eu égard aux enjeux actuels.

    Beschreibung: Ce quatrième et dernier volume du programme L’héritage byzantin en Italie (VIIIe-XIIe siècle), qui cherchait à analyser et à comparer l’évolution des régions autrefois soumises à l’autorité byzantine, de la Vénétie à la Sicile et à la Sardaigne en passant par Ravenne, Rome, Naples, le Salento et la Calabre, a pour thème des realia. On s’est intéressé aux originalités touchant à l’occupation du sol, aux formes de la grande propriété, aux contrats agraires et aux platee (listes de dépendants), enfin à la production et au commerce. La Sicile (sous les dominations byzantine et islamique) et la Sardaigne judicale (souvent négligée) sont bien représentées, à côté des diverses régions continentales ayant dépendu de l’Exarchat. Si, comme on s’y attendait, les évolutions sont dissemblables, les conclusions de Chris Wickham montrent la force de la tradition byzantine à propos de la grande propriété et du commerce ; l’héritage byzantin n’est pas uniforme, mais, même dans ces domaines éloignés de l’idéologie, il a laissé des traces durables.

    Beschreibung: Scholarship on early medieval England has seen an exponential increase in scholarly work by and about women over the past twenty years, but the field has remained peculiarly resistant to the transformative potential of feminist critique. Since 2016, Medieval Studies has been rocked by conversations about the state of the field, shifting from #MeToo to #WhiteFeminism to the purposeful rethinking of the label “Anglo-Saxonist.” This volume takes a step toward decentering the traditional scholarly conversation with thirteen new essays by American, Canadian, European, and UK professors, along with independent scholars and early career researchers from a range of disciplinary perspectives. Topics range from virginity, women’s literacy, and medical discourse to affect, medievalism, and masculinity. The theoretical and political commitments of this volume comprise one strand of a multivalent effort to rethink the parameters of the discipline and to create a scholarly community that is innovative, inclusive, and diverse.

    Beschreibung: Envois & Dédicaces constitue une réflexion sur le don du livre, qu’il se manifeste par un ex-dono, un envoi manuscrit ou une dédicace imprimée. Si cette dernière a été étudiée à propos de tel ou tel auteur, il nous manquait encore une réflexion d’ensemble sur celle-ci. Quant à l’envoi, jugé marginal et mondain, il n’a guère été abordé, hormis par les bibliophiles. On en trouvera ici un « bref traité » qui en souligne toute la richesse. Pas plus qu’il n’existe d’éléments insignifiants dans la vie psychique, ainsi que Freud nous l’a appris, il n’existe dans le livre de détail dépourvu de valeur. La modernité s’est intéressée longuement à la signature, beaucoup moins à l’envoi et à la dédicace, parce qu’elle estimait la littérature intransitive. Elle transite cependant et s’adresse à quelqu’un. Et ce qui semble à première vue accessoire joue un rôle non négligeable, sinon capital, dans la constitution du sens d’un livre. Telle est l’hypothèse d’Envois & Dédicaces, et son pari. Sa première partie, « Perspective cavalière » s’interroge, entre autres, sur la position en tiers du lecteur ainsi que sur la place de la dédicace, premiers mots d’un livre qui se révèlent souvent aussi ses derniers mots. La seconde, « Couleurs locales », examine la façon dont quelques auteurs se sont appropriés ce geste : un musicien, Bach, et cinq écrivains, Voltaire, Hugo, Baudelaire, Montherlant, Goffette, ce dernier nous offrant, en guise de conclusion, un poème inédit adressé « à ceux qui partent ».

    Beschreibung: Depuis plus d’un siècle la notion de « nuisible » fait l’objet d’une contestation de plus en plus vive. Pourtant elle connaît une singulière persistance sociale en tant que concept opérationnel qui donne aux hommes une certaine légitimité pour gérer, et souvent détruire, certaines espèces. À l’heure où la France vient d’adopter la loi sur la reconquête de la biodiversité, la question des « nuisibles » reprend une singulière acuité avec la multiplication d’espèces exotiques envahissantes et les vives controverses qui demeurent autour du loup, du renard mais aussi de l’utilisation des insecticides et des herbicides pour se défaire de « gêneurs ». Si la notion de « nuisible » demeure centrale dans la gestion du sauvage par nos sociétés, elle s’avère très variable selon l’époque, l’espèce, le territoire ou le groupe social considéré. Pour dresser un état de la recherche, historiciser cette notion et éclairer les enjeux actuels, il convient de croiser les regards afin de caractériser les différentes conceptions de la notion de « nuisible » qui coexistent actuellement et d’en retracer les origines, tout en s’ouvrant aux acteurs du présent. Ainsi cet ouvrage entend contribuer à explorer les interactions entre les sociétés et la nature, et permettre de mieux saisir leurs coévolutions.

    Beschreibung: This chapter examines the writings of the renowned late-eighteenth-century Moroccan ambassador Ibn Uthmân Al-Meknassî, the first known traveller from his country to leave an account of European quarantine as experienced during his two diplomatic missions in Spain’s Ceuta (1779) and Malta’s Valletta (1782). It shows that quarantine, on the one hand, acted as a marker of otherness by which Ibn Othman was identified as a Muslim, though this was not a uniform process, owing to the fact that significant differences existed in the degree of alterity experienced in Spain and Malta, and indeed other parts of the Mediterranean. The subjective opinion on quarantine, on the other hand, was also one of the means through which Ibn Uthmân situated himself within Makhzen (Moroccan government) elites at a time when a division between those who declared themselves in favour of European-style modernisation and those who advocated a rejection of European novelties was already visible.

    Beschreibung: The Eve of Spain demonstrates how the telling and retelling of one of Spain’s founding myths played a central role in the formation of that country’s national identity. King Roderigo, the last Visigoth king of Spain, rapes (or possibly seduces) La Cava, the daughter of his friend and counselor, Count Julian. In revenge, the count travels to North Africa and conspires with its Berber rulers to send an invading army into Spain. So begins the Muslim conquest and the end of Visigothic rule. A few years later, in Northern Spain, Pelayo initiates a Christian resistance and starts a new line of kings to which the present-day Spanish monarchy traces its roots.Patricia E. Grieve follows the evolution of this story from the Middle Ages into the modern era, as shifts in religious tolerance and cultural acceptance influenced its retelling. She explains how increasing anti-Semitism came to be woven into the tale during the Christian conquest of the peninsula—in the form of traitorous Jewish conspirators. In the sixteenth century, the tale was linked to the looming threat of the Ottoman Turks. The story continued to resonate through the Enlightenment and into modern historiography, revealing the complex interactions of racial and religious conflict and evolving ideas of women’s sexuality.In following the story of La Cava, Rodrigo, and Pelayo, Grieve explains how foundational myths and popular legends articulate struggles for national identity. She explores how myths are developed around few historical facts, how they come to be written into history, and how they are exploited politically, as in the expulsion of the Jews from Spain in 1492 followed by that of the Moriscos in 1609. Finally, Grieve focuses on the misogynistic elements of the story and asks why the fall of Spain is figured as a cautionary tale about a woman’s sexuality.

Ce vocable quelque peu inattendu désignait la prestation de service que rendirent, de la fin du XVIIe au début du XIXe siècle, les marins européens aux sujets de l’Empire ottoman. Ils assuraient la plupart des liaisons maritimes pour cette immense construction politique à peu près dépourvue de navires de commerce, bien que bordant la majeure partie du littoral méditerranéen. Après avoir exposé les conditions juridiques qui ont encouragé ce type d’association temporaire, Daniel Panzac présente les marins, la pratique quotidienne de la caravane, avant d’évoquer ensuite les affréteurs ottomans. C’est principalement à travers leurs différends que se révèlent les éphémères relations de ces hommes et leur façon de surmonter leur méfiance et leurs préjugés. Ce faisceau dense de liaisons maritimes favorisa la constitution d’un ensemble économique, une « économie-monde », facteur essentiel de cohésion de cet État aussi vaste qu’hétérogène que fut l’Empire ottoman, ensemble dont l’effondrement dans la première moitié du XIXe siècle précéda l’éclatement politique.

    Beschreibung: In 1803 in the colonial South American city of La Plata, Doña Martina Vilvado y Balverde presented herself to church and crown officials to denounce her husband of more than four years, Don Antonio Yta, as a "woman in disguise." Forced to submit to a medical inspection that revealed a woman's body, Don Antonio confessed to having been María Yta, but continued to assert his maleness and claimed to have a functional "member" that appeared, he said, when necessary. Passing to América is at once a historical biography and an in-depth examination of the sex/gender complex in an era before "gender" had been divorced from "sex." The book presents readers with the original court docket, including Don Antonio's extended confession, in which he tells his life story, and the equally extraordinary biographical sketch offered by Felipa Ybañez of her "son María," both in English translation and the original Spanish. Thomas A. Abercrombie's analysis not only grapples with how to understand the sex/gender system within the Spanish Atlantic empire at the turn of the nineteenth century but also explores what Antonio/María and contemporaries can teach us about the complexities of the relationship between sex and gender today. Passing to América brings to light a previously obscure case of gender transgression and puts Don Antonio's life into its social and historical context in order to explore the meaning of "trans" identity in Spain and its American colonies. This accessible and intriguing study provides new insight into historical and contemporary gender construction that will interest students and scholars of gender studies and colonial Spanish literature and history.     Beschreibung: El título de esta obra Originales e inéditos 1928. José Carlos Mariátegui es, en cierta medida, atrevido, por cuanto se considera que las obras completas, es decir, todos los escritos de Mariátegui están publicados, según se tiene conocimiento. Pese a dichas publicaciones, las lecturas de sus fuentes directas (léase, revistas de 1928) prospera ron y tomaron dimensiones para la decisión de compilar los escritos y cotejar con las posteriores publicaciones. Entendemos por inédito lo no publicado y estaría en contradicción si las obras de Mariátegui hubieran sido publicadas en su totalidad. Pero existe un enigma para los que desean leer y confiar en esa llamada totalidad. No hay nada más inquietante para un acucioso lector que indagar las fuentes directas como si en la indagación se tratara de manuscritos, y estas fuentes, indudablemente, son los primeros escritos de Mariátegui en distintas revistas de su época (consideramos aquí 1928). Y esta edición crítica nos presenta la compilación de los escritos de Mariátegui poco conocidos, digámoslo de alguna manera, como «manuscritos» o «inéditos», porque fueron archivados, y no tuvieron la disposición de su reedición. No nos plantearemos sus razones, sólo dejamos constancia de ello como un acto irresoluto.

    Beschreibung: The increased detection of doping in professional sports has led to a strengthening of the discussion on the legal aspects of doping. So far criminal and/ or verbandsrechtliche questions were the focus. For example the question of whether and how sponsorship contracts may be terminated in cases of misconduct of the sponsored. First, it examines how appropriate cancellation clauses could be like. Second, consider the conditions under which, even without explicit rules for doping a termination in accordance with general principles of contract law is concerned. It also discusses the legal consequences of termination, and in particular its relationship to other contractual consequences of doping, such as claims for damages or penalties.

A special emphasis is placed on the artistic expressions of religious experience including re-enactments of musical compositions and dance configurations, which were created to embody India in Germany. In the Renaissance, an era of epistemic fractures, when the clash between the 'new science' (Copernicus, Galileo, Vesalius, Bacon, etcetera) and the authority of ancient texts produced the very notion of modernity, the extended and expanding geography of ancient Rome becomes, for Shakespeare and the Elizabethans, a privileged arena in which to question the nature of bodies and the place they hold in a changing order of the universe. Drawing on the rich scenario provided by Shakespeare's Rome, and adopting an interdisciplinary perspective, the authors of this volume address the way in which the different bodies of the earthly and heavenly spheres are re-mapped in Shakespeare's time and in early modern European culture. More precisely, they investigate the way bodies are fashioned to suit or deconstruct a culturally articulated system of analogies between earth and heaven, microcosm and macrocosm. As a whole, this collection brings to the fore a wide range of issues connected to the Renaissance re-mapping of the world and the human. It should interest not only Shakespeare scholars but all those working on the interaction between sciences and humanities.

    Beschreibung: Neben der Biblia pauperum ist das Speculum humanae salvationis das wohl bekannteste typologische Werk des Mittelalters. Vom lateinischen Text sind 328 handschriftliche mittelalterliche Quellen überliefert. Von seiner Popularität zeugen überdies Übersetzungen ins Deutsche, Französische, Niederländische, Englische und Tschechische. Diese Arbeit stellt eine der beiden niederländischen Fassungen des Speculum, und zwar die Prosaübersetzung aus dem Jahre 1464, in den Mittelpunkt. Neben Struktur und Funktion des lateinischen Textes werden in einem chronologisch-thematisch organisierten status quaestionis die Accessusfragen nach Herkunft und Autorschaft des Speculum erörtert. Vom mittelniederländischen Prosa-Spieghel werden eine genaue kodikologische Beschreibung und eine breit angelegte Analyse der Sprache geboten. Auch der literaturhistorische Kontext und die Übersetzungs- und Bearbeitungstechnik werden eingehen behandelt. Die kritische Edition nach der Haarlemer Handschrift erfüllt ein altes Forschungsdesiderat, indem sie sowohl den Vergleich mit der bereits vor mehr als einem halben Jahrhundert herausgegebenen Versübertragung ermöglicht, als auch eine eminent wichtige Schnittstelle zwischen handschriftlicher und gedruckter Tradition in den Niederlanden für die Forschung zugänglich macht.
