    Description: Zum niederländischen Militär in der frühen Neuzeit gehörte es, dass Soldaten regelmäßig gemustert wurden. Die Schlagkräftigkeit des Militärs sollte aufrechterhalten werden. Dazu reisten Musterungskommissare in die Garnisonsorte und begutachteten die Truppen. Neben ihren Amtsgeschäften widmeten die Kommissare sich oftmals intensiv "touristischen" Vergnügungen. Die Berichte geben in niederländischer Sprache daher nicht nur Einblicke in das Musterungswesen selbst, sondern vor allem in das Reisen im 18. Jahrhundert. Dabei lassen sie in deutlicher Form das soziale Leben der Zeit nachvollziehen.

    Description: The Finnish novelist Kaarlo (Kalle) Alvar Päätalo’s (1919–2000) main work, the Iijoki series, consists of 26 novels (comprising ca. 17 000 pages) and was written in 1971–1998. In this book the text corpus in Kielipankki concerning Päätalo’s works is introduced to the readers, as well as the possibilities of digital text mining. This book includes scientific articles concerning the works of Kalle Päätalo. It also gives ideas for the research that can be carried out in the future. The authors of this book are researchers in the fields of history, linguistics and literature, respectively. The research results presented in this book speak for the fact that the Iijoki series is a significant source material for future research, for example from the point of view of oral history, language variation, metalanguage, swearing and the reader’s reception. The possibilities for future research seem to be quite plentiful.

Jahrhundert war ein Jahrhundert des weltumspannenden politischen, ökonomischen und sozialen Wandels, der alte Herrschaftssysteme herausforderte und neuen politischen und gesellschaftlichen Kräften in zwei Revolutionen zum Durchbruch verhalf. Die vorliegende Untersuchung thematisiert diesen Prozess am Beispiel der transatlantischen Beziehungen zwischen den Niederlanden und den nach Selbstständigkeit strebenden Kolonien in Amerika zwischen 1776 und 1782. Den amerikanischen Kolonisten ging es um zweierlei: einerseits um die völkerrechtliche Anerkennung ihres Abfalls vom englischen Königreich und andererseits um die finanzielle Unterstützung der amerikanischen Revolutionäre durch die anderen europäischen Staaten. Hierbei spielten die Republik der Vereinigten Niederlande diplomatisch und die Amsterdamer Finanzhäuser ökonomisch eine viel zu lang unterschätzte Rolle. In einer Nahbetrachtung der diplomatischen und finanztechnischen Aktionen der beteiligten Diplomaten, Politiker und Kaufleute und ihrer jeweiligen Einschätzungen durch Roland Richter wird die Komplexität des historischen Prozesses erkennbar und ein weiterführender Beitrag zur transatlantischen Niederlandeforschung geleistet.

    Description: If the journalistic media are to be able to effectively perform their essential democratic tasks of forming public opinion and controlling state power, they must be independent of the state. At the same time, this state has to guarantee a diverse range of media and to inform the public about its activities. This tension is intensifying in the internet age, in which the expensive production of journalistic content is less and less taken for granted. This updates the state's duty to ensure media pluralism, for example by organizing a public service system or other promotional measures, and to carry out active public relations work. This in turn increases the risk that the state will influence media activity or become the media provider itself. The limits that the state has to observe in this context are worked out in this book on the basis of a cross-media, constitutional and international law analysis of the principle of the media's independence from the state.
    Description: Sollen die journalistischen Medien ihre demokratiewesentlichen Aufgaben der öffentlichen Meinungsbildung und der Kontrolle staatlicher Macht wirksam wahrnehmen können, müssen sie vom Staat unabhängig sein. Gleichzeitig hat ebendieser Staat ein vielfältiges Medienangebot zu gewährleisten und die Öffentlichkeit über seine Tätigkeiten zu informieren. Dieses Spannungsverhältnis verschärft sich im Internetzeitalter, in welchem die teure journalistische Inhaltsproduktion immer weniger als gesichert gilt. So aktualisiert sich dadurch die staatliche Pflicht, den Medienpluralismus etwa durch die Organisation eines Service public-Systems oder anderweitiger Fördermassnahmen zu sichern und eine aktive Öffentlichkeitsarbeit wahrzunehmen. Dies erhöht wiederum die Gefahr, dass der Staat die Medientätigkeit beeinflusst oder selber zum Medienanbieter wird. Welche Grenzen der Staat in diesem Kontext zu beachten hat, wird in diesem Buch anhand einer mediengattungsübergreifenden verfassungs- und völkerrechtlichen Analyse des Prinzips der Staatsunabhängigkeit der Medien herausgearbeitet.

The Finnish research field has originally emerged at the collaborative intersection of history, folklore studies, and ethnology.     Description: This dissertation examines intelligence surveillance of private telecommunications and its compatibility with the international human right to privacy in Art. 17 ICCPR and in Art. 8 ECHR. These articles provide comprehensive protection against the most modern forms of surveillance including bulk interception. Several criteria apply in terms of the foreseeability of the surveillance laws. Telecommunication’s interception should be subject to authorisation and supervision by independent authorities and effective remedies should be available. Moreover, the study analyzes the extent to which the surveilling state and the state of residence violate their human rights obligations in cases of cross-border surveillance. The main question is whether the established definitions of "jurisdiction" are applicable to this extraterritorial scenario. The extraterritorial exercise of jurisdiction can also be based on effective control over specific objects relevant to human rights. According to this approach, telecommunications data are objects relevant to individual’s right to correspondence and data protection.

    Description: Dem Vergleichen wird in der Geschichtswissenschaft die Funktion einer historischen Methode zugesprochen, für den Geschichtsunterricht dient es als Methode zur Förderung historischer Kompetenzen. In den Geschichtslehrwerken der Sekundarstufe II taucht es in der Regel in Form von Aufgaben auf. Doch wie relevant sind Vergleichsaufgaben in Lehrwerken überhaupt und welche Fertigkeiten und Kompetenzen benötigen Lernende in der Sekundarstufe II zur (schriftlichen) Lösung einer historischen Vergleichsaufgabe? Diesen Fragen wird mit Hilfe einer zweiteiligen Untersuchung auf der Grundlage einer umfangreichen Frequenzanalyse von Aufgaben in Geschichtslehrwerken der Sekundarstufe II in NRW sowie einer Korpusanalyse von Lernendentexten zu einer authentischen Vergleichsaufgabe aus einem Geschichtslehrwerk nachgegangen. Die Arbeit verbindet den geschichtsdidaktischen Zugang mit dem linguistischen Ansatz der Funktionalen Pragmatik, um das Vergleichen als Handlungsmuster des Geschichtsunterrichts zu bestimmen und es im Hinblick auf seinen kommunikativen Zweck in Teilhandlungen aufzuschlüsseln. Der Zugang wird ergänzt durch den Bezug zur Schreibdidaktik, der gerade im Hinblick auf wissenschaftspropädeutisches Arbeiten in der Sekundarstufe II eine wichtige Rolle spielt. Aus den Ergebnissen der Untersuchungen wird auf der Grundlage eines Indikatorenmodells ein praxisorientierter Weg zum Umgang mit Vergleichsaufgaben im Geschichtsunterricht vorgeschlagen.

Der ausgewählte Zeitraum mit einem Schwerpunkt in den 1920er bis 1960er Jahren spiegelt die technik- wie gesellschaftsgeschichtlich anerkannte Tatsache, dass diese Jahrzehnte eine Achsenzeit insbesondere der Mobilitätstechnik, aber auch auch der ,Demokratisierung' von Technik für alle in der Konsumgesellschaft darstellen. Daher kommt den beiden Mobilitätstechniken Eisenbahn und Auto besondere Bedeutung zu, mit einem deutlichen Schwerpunkt beim Auto als der Identitätsmaschine schlechthin. Der Begriff des Rituals soll auf die Regelmäßigkeit und Dauerhaftigkeit des Auftretens bestimmter Bilder und Aussagen in den befragten Quellen hinweisen, um auf diese Weise zum Verständnis des technikabhängigen sozialen Wandels und der mental formatierenden Wirkung von Bildroutinen beizutragen. Zugleich geht es um die Erschließung von Quellenmaterial, das in der Kulturgeschichte der Technik bislang selten oder jedenfalls nicht mit Blick auf die soziale Konstruktion von Identitäten untersucht worden ist.

    Description: It is rare for a physician to be disbarred; it is even rarer for the disbarment to have a retroactive effect back to the time of granting. The prerequisite for this effect is that the license to practice medicine should not have been granted in the first place, either because the requirements for the training of the future physician were not met or because character defects (unworthiness, unreliability) prevented the person concerned from working as a physician. Although practically rare, the revocation of a license to practice medicine is of particular academic interest because it ultimately results in the entire medical activity of the person affected being subsequently deprived of its legal basis. Strictly speaking, in consequence, each medical intervention becomes unlawful, thus (under certain circumstances) constituting a bodily injury under criminal law as well as giving rise to liability for damages under civil law. However, neither the criminal nor the civil law consequences of such retroactivity have yet been examined in a scientifically sound manner, even to a rudimentary degree. The present dissertation is intended to close this gap, at least in the area of civil law.

In Switzerland, it has found its way into the literature and has already been included in the case law of the Federal Supreme Court on negligence offences. However, critical voices point out that the current status of the discussion is characterized by a large number of different approaches, some of which differ only marginally. A look at the literature actually shows that many essential questions, such as the raison d'être of individual aspects of attribution, are still disputed today. In this dissertation, Nicolas Leu therefore subjects objective attribution to a comprehensive and critical review that also takes into account the criminal offense system in which objective attribution is embedded.
    Description: Im deutschen Schrifttum hat sich die Lehre der objektiven Zurechnung längst als herrschende Meinung durchgesetzt. In der Schweiz hat sie Eingang in die Literatur gefunden und ist bereits in die Rechtsprechung des Bundesgerichts zum Fahrlässigkeitsdelikt eingeflossen. Kritische Stimmen weisen jedoch darauf hin, dass der Diskussionsstand durch eine Vielzahl verschiedener, teilweise nur marginal abweichender Lösungsansätzen geprägt sei. Ein Blick in die Literatur zeigt tatsächlich, dass viele wesentliche Fragen, wie etwa die Existenzberechtigung einzelner Zurechnungsgesichtspunkte, auch heute noch umstritten sind. In der vorliegenden Dissertation unterzieht Nicolas Leu die objektive Zurechnung daher einer umfassenden und kritischen Überprüfung, die auch das Straftatsystem mitberücksichtigt, in das die objektive Zurechnung eingebettet ist.

These natural reserves are established in a transnational entangled space where ideas, imaginations, people, biota and artefacts circulate. The idea of Argentinian national parks has been influenced by various approaches, ranging from the US-American parking policy to the French landscape architecture and the Prussian sustainable forestry to international debates about nature conservation. While national parks are now considered a haven of wilderness, the contemporary interpretation in the first half of the 20th century has been more open. The notion has prevailed in Argentina to perceive national parks as “genuine instruments of colonisation”. Agricultural colonization and displacement of indigenous people, comprehensive programmes for urbanization and touristification of the landscape as well as biological colonisation through salmons, deer, and Douglas firs form an integral part of the Argentinian parking policy. Thus, the connection between nature conservation and colonisation will be examined in this book by asking the following question: How do national parks work?

    Description: Thomas Morus' „Von der besten Staatsverfassung und von der neuen Insel Utopia, ein wahrhaft goldenes Büchlein, genauso wohltuend wie heiter“ ist ein Klassiker der Politischen Philosophie. Das 1516 erstmals erschienene Buch prägte die spätere Tradition fiktiver Staatsmodelle. Der Name 'Utopia' bezeichnet nämlich ein „Nirgendwo“, durch dessen Unauffindbarkeit alle Sehnsüchte in eine unerreichbare Ferne projiziert werden. Als Utopie gilt somit eine Vorstellung, die als Idee zwar denkbar, aber nicht unmittelbar umzusetzen ist. Sie ist Wunschtraum, Konzept und Vision einer Welt oder einer Zeit, in der eine neue gesellschaftliche, religiöse oder technische Ordnung herrscht. Der Band hinterfragt, mit welchen Chancen auf gesellschaftspolitische Diskussion heute überhaupt noch fiktive Staatsmodelle ausgearbeitet werden können. Sind z.B. die modernen, weltweit stark rezipierten Entwürfe wie Rawls' Theorie der Gerechtigkeit, No-zicks' Anarchie, Staat, Utopia oder die Sphären der Gerechtigkeit von Walzer als Utopien zu klassifizieren? Oder sind die fiktiven Elemente in ihnen so realitätsnah, daß man sie nicht mehr als utopisch beschreiben kann? Brauchen wir überhaupt Utopien, um in der Lage zu sein, neue, „zukunftsfähige“ Modelle der politischen Organisation einer Gesellschaft zu entwerfen? Oder ist die Politische Philosophie so saturiert, daß selbst unter dem Veränderungsdruck der Globalisierung in absehbarer Zeit mit neuen Staatsutopien nicht zu rechnen sein wird?

Die Urkunden vom Mittleren Euphrat, die alle aus der Epoche nach der Constitutio Antoniniana stammen, stellen eine singuläre Erkenntnisquelle für die bürgerliche Geschäftswelt dieser Region dar, aus der bislang hauptsächlich die in militärischem Umfeld verfassten Urkunden aus Dura Europos bekannt waren. Als Texte, die nicht mit dem Blick auf ein Publikum konzipiert wurden, sind die untersuchten Urkunden zuverlässige Zeugnisse für die Strukturen der alltäglichen antiken Realität. Die Arbeit, die sich auf die Vertragsurkunden P.Euphr. 6 - P.Euphr. 15 konzentriert, bietet den ersten umfassenden privatrechtsgeschichtlichen Kommentar zu den Euphratpapyri aus dezidiert juristischer Perspektive. Der Inhalt der Urkunden umfasst den Verkauf mehrerer Sklaven, eines Tieres und eines Bootes, eine Verwahrung, ein hypothekarisch gesichertes Darlehen mit Antichrese, einen Schulderlass und eine unvollendete Urkunde. Zu mehreren Urkunden legt die Autorin erstmalig deutsche Übersetzungen vor. Durch stetige Vergleiche mit den Urkunden aus Ägypten einerseits und den Urkunden aus Dura Europos und aus dem Archiv der Babatha andererseits werden im juristischen Kommentar die in den Texten belegten Rechtsinstitute in den Rahmen der Urkundenpraxis in den Provinzen eingeordnet und mögliche Entwicklungslinien aus den verschiedenen Rechtskreisen und Geschäftsgewohnheiten aufgezeigt, wobei auch altorientalische Rechtsinstitute berücksichtigt werden. Ebenso werden die Urkundentäfelchen aus dem Geschäftsleben der westlichen Regionen des Römischen Reiches miteinbezogen. Parallel dazu erfolgt eine eingehende Erforschung des Einflusses des abstrakten römischen Rechts, wie es insbesondere im CIC und in den Institutionen des Gaius überliefert ist, sowie des griechisch-hellenistischen Rechtskreises.     Description: Nothing exceptional happened in front of the youth association building in Kalajoki on 9 September 1953. There was a minor confrontation between regional police forces and local youth, but hundreds of similar events happened in small municipalities across Finland. The event took about ten minutes, nobody was seriously hurt, and collective feelings quickly calmed down. However, after extensive investigations, the regional prosecutor thought otherwise and prosecuted half a dozen local men for rebellion against the state in January 1954. The district court agreed. The municipality was shocked, and the Finnish society was taken by surprise. The case ended up in Supreme Court. This book analyses why and how the last rebellion in the history of Finland occurred in a tiny municipality on the west coast of Finland. The analysis is based on historical microsociology that integrates the insights of microhistory and microsociology into event structure analysis and collective memory studies.

    Description: The Auerspergs [Turjaški] are among the rare noble families in the Slovenian territory with systematically preserved archives that date back to the Middle Ages. Most archival materials of the family, which was largely embedded in the framework of the Province of Carniola until the end of the 15th century, are presently kept in two private family archives: the Turjak Comital Fideicomiss Archives (Gräflich Auersperg'sches Fideikommisarchiv), first kept in the Turjak Castle until 1942 and now in the Carinthian Provincial Archives in Klagenfurt, and the Turjak Ducal Archives (Fürstlich Auersperg'sches Archiv), which were first moved to the Turjak Palace in Ljubljana and the Lower Austrian Lösensteinleiten Castle and finally ended up in the Viennese Haus-, Hof-, und Staatsarchiv.Turjaška knjiga listin 1 (1218–1400) [Turjak Book of Charters I (1218–1400)] contains 277 charters from the private archives of the Carniolan comital and ducal lines of the Auerspergs [Turjaški]. Published in their entirety, the charters are equipped with Slovenian regests and followed in the end by a comprehensive index of names and pictures of seals from the charters. With the publication of the Turjak charters, Slovenian historiography has gained an indispensable aid for the research of Slovenian medieval and modern history.
    Description: V Turjaški knjigi listin I (1218–1400) je objavljeno 277 listin iz zasebnih arhivov kranjske grofovske in knežje linije Turjaških (Auerspergov), ki so jih v sklopu grajskega arhiva do leta 1942 hranili na gradu Turjak, danes pa so shranjene izven slovenskega ozemlja. Listine so objavljene v celoti, opremljene so s slovenskimi regesti, ob koncu pa sledijo še obsežno imensko kazalo in slike pečatov z listin. Pripravljena izdaja turjaških listin sega do leta 1400 in je prvi del serije, v kateri bodo v končni fazi objavljene vse, tudi novoveške turjaške listine. Slovensko zgodovinopisje bo z objavo turjaških listin pridobilo nepogrešljiv pripomoček za raziskovanje slovenske srednjeveške in novoveške zgodovine.

    Description: Matti Kurikka (1863–1915) is a multi-dimensional and controversial character in Finnish history. He was a playwright, a journalist, a socialist, and a theosophist, as well as a speaker for sexual emancipation and women's rights. Kurikka was born in Ingria, and his activities spanned not only Finland, but also Australia and North America, in both of which he led utopian communities. This biographical study explores Kurikka as a literary and political figure and a builder of utopias, whose life opens fascinating views on the societal and cultural currents of the late nineteenth and early twentieth centuries. The book critically re-evaluates earlier research on Kurikka and highlights forgotten phases of his life by using new source materials found in three continents. The sources include digitized newspapers and periodicals, Kurikka's plays and non-fictional books, oral history, and political cartoons.

    Description: Hellenismus ist nicht nur eine Epochenbezeichnung. Der Begriff wurde geprägt, um die wechselseitige Durchdringung von Orient und Okzident und die Verschmelzung der dominierenden griechischen Kultur mit anderen zu beschreiben. Anzeichen für eine lediglich oberflächliche Verbreitung der transformierten griechischen Kultur legen Vergleiche mit neuzeitlichen Kolonialgesellschaften nahe, auch wenn die hellenistischen Reiche kein Mutterland hatten. Die drei letzten vorchristlichen Jahrhunderte waren jedenfalls unstreitig von hoher Mobilität, intensiver Kulturbegegnung, von Symbiose und geistigem Austausch geprägt. Damals wurden die in der Polis entstandenen Ideen zu Herrschaft und Rechtsstaatlichkeit in großflächige Herrschaftsgebilde überführt und gingen später in die lateinische Literatur des römischen Imperiums und dann frühe christliche Gedankengebäude über. Die Frage, wie Konfliktlösung in einer dieser polyethnischen ostmediterranen Gesellschaft funktionierte, kann nur für Ägypten beantwortet werden, da allein hier in nennenswertem Umfang auch Alltagsschriftgut überliefert ist. Anhand der vielfältigen Rechtsschutzgesuche an unterschiedliche Autoritäten (Gerichte, Beamte, Vereinsvorstände) sowie anhand der wenigen Zeugnisse königlicher Regulierung der Rechtsschutzgewährung soll in dieser Untersuchung primär das Konfliktlösungsverhalten der griechischsprachigen Bevölkerungsschicht kartographiert werden, das sich durch die Vielfalt der Instanzen trotz grundlegender Untersuchungen zur Gerichtsorganisation (v.a. von Hans-Julius Wolff) noch immer unserem Verständnis entzieht. Um die bisherigen Ansätze zu überwinden, wird als Ausgangsthese angenommen, dass staatliche Eingriffe in die vorhandene Vielfalt der Konfliktlösungsinstanzen nur bei äußerem Zwang erfolgten und sie ansonsten der Selbstorganisation überlassen wurden.

Frank Jacob widmet sich auf Basis eines analytischen Vergleichsmodells der Frage nach dem Prozess dieser Korrumpierung und zeigt, ob diese einer zwangsläufigen Entwicklung der Ereignisse oder vielmehr dem Machtwillen einiger weniger geschuldet war.

    Description: Die anhaltende Präsenz von Engeln in der Moderne wurde oft auf ein gesteigertes Trostbedürfnis zurückgeführt. Die Engelsfigur ist aber nicht bloß statisches Überbleibsel einer verlorenen Glaubensgewissheit. Vielmehr steht sie in einer produktiven Beziehung zu zentralen geschichtsphilosophischen, politischen und medienästhetischen Fragen der Zeit. Die vorliegende Studie geht den Zusammenhängen zwischen Engelsfigur und Moderne-Diskurs entlang eines Spannungsbogens nach, der von Reflexionen eines metaphysischen Exils Anfang des 20. Jahrhunderts über die Zuspitzung existentieller Bedrohung im Ersten und Zweiten Weltkrieg bis zum Undarstellbarkeitstopos des Holocaust verläuft. Dabei wird deutlich, dass der Engel auf vielfache Weise als Verursacher und gleichzeitig als zukunftsgerichteter Überwinder moderner Formen des Exils auftritt – als Figur, die geschichtsphilosophische Brüche herbeiführt und individualbiographische Traumata sichtbar macht; die die moderne Deformation des Menschen illustriert und wahlweise zu heilen oder voranzutreiben versucht; und die schließlich neue politische Ordnungen entwirft und sie als ästhetische Metalepse bereits in der Exilgegenwart veranschaulicht.

    Description: The text-critical edition Turjaška knjiga listin II [Turjak Book of Charters II], containing 436 published documents from the 15th century, completes the medieval corpus of charters from the private archives of the Carniolan comital and ducal lines of the Auerspergs. Published in their entirety, the charters are equipped with Slovenian regests and followed in the end by a comprehensive index of names and pictures of seals from the charters.The Auerspergs [Turjaški] are among the rare noble families in the Slovenian territory with systematically preserved archives that date back to the Middle Ages. Most archival materials of the family, which was largely embedded in the framework of the Province of Carniola until the end of the 15th century, are presently kept in two private family archives: the Turjak Comital Fideicomiss Archives (Gräflich Auersperg'sches Fideikommisarchiv), first kept in the Turjak Castle until 1942 and now in the Carinthian Provincial Archives in Klagenfurt, and the Turjak Ducal Archives (Fürstlich Auersperg'sches Archiv), which were first moved to the Turjak Palace in Ljubljana and the Lower Austrian Lösensteinleiten Castle and finally ended up in the Viennese Haus-, Hof-, und Staatsarchiv.

Listine so objavljene v celoti, opremljene so s slovenskimi regesti, ob koncu pa sledijo še obsežno imensko kazalo in slike pečatov z listin.

    Description: Die vorliegende Arbeit leistet einen Beitrag zum Verständnis des jüdischen Rechts der Antike und zeigt insbesondere seine Verbindungen zum römischen Recht auf. Am Beispiel der talmudischen Preisregelung אונאה (sog. ona’ah), die im 2. Jahrhundert in Palästina entstand und zunächst große Unterschiede zur römischen Preissicherung bei Grundstücksverkäufen (CJ.4.44.2) aufwies, erläutert die Untersuchung, wie sich das jüdische Recht unter unterschiedlichen Herrschaftsbedingungen entwickelte. Gleichzeitig wird das römische Recht selbst durch die Einbeziehung zeitgebundener wirtschaftlicher und sozialer Rahmenbedingungen nicht bloß dogmatisch analysiert, sondern in seiner historischen Entwicklung und Vergleichbarkeit mit anderen Rechtskulturen erfasst. Beschäftigte sich die bisherige Forschung eingehend mit der römischen laesio enormis (der Begriff stammt aus dem Mittelalter), die garantierte, dass bei Landverkäufen der vereinbarte Preis die Hälfte des Wertes nicht unterschritt, fand die zeitgleiche talmudische Preisgrenze von einem Sechstel bislang kaum Beachtung. Obwohl Grundstücksgeschäfte von der אונאה (ona’ah) ausgenommen waren, liegen beiden Rechtsnormen ähnliche Vorstellungen von materiellem Wert und seiner Preisrelation zugrunde. Die Gemeinsamkeiten und Unterschiede zwischen römischem und jüdischem Recht werden anhand der schriftlichen Thora, der Tosefta, der Mischna, des palästinischen und babylonischen Talmuds, sowie anhand des Corpus Iuris Civilis, des diokletianischen Höchstpreisedikts und des Codex Theodosianus erläutert.

    Description: Unter den epigraphischen Quellen aus späthellenistischer Zeit nimmt der Volksbeschluss über Maße und Gewichte IG II2 1013 eine besondere Rolle für das Verständnis des Rechts- und Wirtschaftslebens im antiken Athen ein. Im vorliegenden Band werden die einzelnen Passagen dieses Dekrets eingehend aus dezidiert juristischer und rechtshistorischer Perspektive untersucht — ein Ansatz, der bisher kaum oder nur unvollständig verfolgt wurde. Dazu wird zunächst eine Neuedition des Psephismas mit eigener Übersetzung präsentiert. Die allgemein von anderen Autoren angenommene Aufteilung in Paragraphen wird in modifizierter Form übernommen. Aufbauend darauf ist dann die inhaltliche Analyse, dem Textfluss folgend, in thematisch zusammenhängende Kapitel gegliedert. Die Untersuchung konzentriert sich dabei unter anderem auf die für inkorrektes oder gar betrügerisches Messen vorgesehenen Rechtsfolgen, wofür sich vor allem eine kritische Betrachtung vorhergehender Editionen des Textes der ersten Zeilen als aufschlussreich erweist. Die im Dekret enthaltenen metrologischen Reformen werden eingehend untersucht; zur Regelung über das Fünfminenstück wird ein gänzlich neuer Erklärungsansatz angeboten. Besondere Aufmerksamkeit finden darüber hinaus Rolle und Funktion der Bule im Rahmen der Bestimmungen des Volksbeschlusses, des Weiteren die Aufgaben der Staatssklaven im Zusammenhang mit der Aufbewahrung offizieller Messinstrumente sowie schließlich die Strafbefugnisse des Areopags. Der letzte Abschnitt ist den komplexen Fragestellungen nach der genauen Datierung sowie den Gründen für den Erlass des Dekrets gewidmet, wobei insbesondere eine neue Sicht der möglichen Rolle Roms in diesem Kontext vorgestellt wird.

    Description: The first Habsburg estates in Carniola were part of territorial acquisitions in eastern Alpine lands that the ascending dynasty obtained in the war with King Ottokar II of Bohemia towards the end of the thirteenth century and then gradually expanded. Even though the Habsburg dynastic territory had by the 1380s covered almost the entire Carniola, the economic base (landed property, which provided the provincial prince with regular income) was considerably limited. A sizeable portion of the territory was burdened by fiefs and pledges. The redemption of one of the vastest sets of pledged estates in the mid-1430s led to the emergence of account books for the following Carniolan fiscal properties: Kamnik, Gamberk, Goričane, Ig, Višnja Gora, Štatenberk, Novo mesto, Kostanjevica with offices Raka and Vivodina, Pazin, Završje, and Vranja. The account books serve as an extraordinary source for the economic history of the late Middle Ages, by also reflecting the turbulent period of the Habsburg European-wide ascendancy and Frederick’s war with the Counts of Celje. The volume constitutes a critical edition of the account books, with the accompanying discussion in the field of property, administrative and political history.
    Description: Zametki habsburške posesti na Kranjskem sodijo v sklop ozemeljskih pridobitev v vzhodnoalpskih deželah, ki jih je vzpenjajoča se dinastija iztržila iz bojev s češkim kraljem Otokarjem II. Přemyslom proti koncu 13. stoletja in so jih kasneje še razširili. Čeprav je v okvir habsburškega dinastičnega teritorija že v osemdesetih letih 14. stoletja spadal večji del kranjskega ozemlja, pa je bil gospodarski temelj (posest, ki je prinašala dohodke) bistveno manjši. Dobršen del ozemlja so bremenili fevdi in zastave. Ob sprostitvi enega od obsežnejših sklopov zastavljene posesti sredi tridesetih let 15. stoletja so nastali obračuni kranjskih komornih gospostev, in sicer za gospostva: Kamnik, Gamberk, Goričane, Ig, Višnja Gora, Štatenberk, Novo mesto, Kostanjevica z uradoma Raka in Vivodina, Pazin, Završje in Vranja. Obračuni predstavljajo izjemen vir za gospodarsko zgodovino poznega srednjega veka, obenem pa se v njih zrcali razgibano obdobje habsburškega evropskega vzpona in Friderikove vojne s celjskimi grofi. Knjiga prinaša tekstnokritično edicijo obračunov s spremljajočo uvodno razpravo s področja posestne, upravne in politične zgodovine.

    Description: As in all medieval cities, writing became increasingly important in Hamburg in the course of the later Middle Ages. In addition to the creation of various city books, there was a growing need to safely store the originals of important documents. These were collected in the so-called Threse, which soon formed a separate section of the emerging municipal archive. Although the holdings in the Hamburg State Archives are largely complete (with the exception of some losses due to the Second World War, among other things), the indexing by Johann Martin Lappenberg, which took place after the fire in Hamburg City Hall in 1842, still forms the basis for working with the material today. A comprehensive scholarly reappraisal remained a desideratum for a long time.

    Description: Dem niederländischen Regierungssitz Den Haag kam durch die weit ausgreifende Politik der Republik zwischen den westfälischen Friedensschlüssen und den ersten beiden Jahrzehnten des 18. Jahrhunderts eine Schlüsselstellung im europäischen Gesandtschaftswesen zu. In den Kriegen, die auf die Epochenwende 1648 und 1659/60 folgten, wurde nicht mehr wie in den vorhergehenden Religionskriegen um die Existenz gerungen, sondern um die Aufrechterhaltung oder Wiederherstellung einer gedachten Machtbalance. Daraus erwuchs den Gesandten eine neue Aufgabenfülle und politische Rolle. Das blieb nicht ohne Wirkung auf die Gesandten, die Veränderungen nicht nur ertrugen, sondern zunehmend selbst gestaltend eingriffen. Diese dynamischen Prozesse in der Arbeitsweise von Gesandten dreier Höfe am niederländischen Regierungssitz Den Haag stehen im Mittelpunkt der vorliegenden Arbeit. Indem aufgearbeitet wird, wie Den Haag von einem Treffpunkt von Gesandten zum Brennpunkt europäischer Diplomatie wurde, möchte die vorliegende Studie einen Beitrag zur Geschichte des Gesandtschaftswesens im frühneuzeitlichen Europa leisten.

Meike Dreckmann-Nielen untersucht, wie sich einstige Mitglieder der Gruppe heute an ihre eigene Vergangenheit erinnern. In ihrer Studie ermöglicht sie einen intimen Einblick in komplexe erinnerungskulturelle Dynamiken im Mikrokosmos der ehemaligen Siedlungsgemeinschaft.

    Description: Neznano in pozabljeno iz 18. stoletja na Slovenskem [The Unknown and Forgotten from the 18th-Century Slovenian Territory] is the first monograph written by the Slovenian Society of 18th Century Studies and presents the less known phenomena and aspects of the 18th-century Slovenian territory. The monograph was compiled by twenty-three Slovenian and international authors whose contributions discuss numerous areas spanning general, cultural, music, art and literary history. It is divided into several chapters. The introduction, containing the presentation of the Slovenian provinces in the 18th century, serves as the basic starting point and is followed by chapters “Pravna, upravna in cerkvena zgodovina” [“Legal, Administrative and Ecclesiastical History”], “Umetnost in obrt” [“Art and Crafts”], “Kulturna in socialna zgodovina” [“Cultural and Social History”] and “Jezikoslovje” [“Linguistics”]. The monograph, which was published in digital form, is also distinguished by rich pictorial content.
    Description: Neznano in pozabljeno iz 18. stoletja na Slovenskem je prva monografija Slovenskega društva za preučevanje 18. stoletja. V njej so predstavljeni manj znani pojavi in vidiki 18. stoletja na Slovenskem. Pri nastanku monografije je sodelovalo 23 slovenskih in tujih avtorjev, ki so s prispevki posegli na številna področja, od obče in kulturne do glasbene, umetnostne in literarne zgodovine. Monografija je razdeljena na več poglavij. Uvodu, v katerem so kot splošno izhodišče predstavljene slovenske dežele v 18. stoletju, sledijo še poglavja Pravna, upravna in cerkvena zgodovina, Umetnost in obrt, Kulturna in socialna zgodovina ter Jezikoslovje. Monografijo, ki je izšla v elektronski obliki, odlikuje tudi bogato slikovno gradivo.

    Description: The purchase of additional items in videogames, also called ‘Microtransactions’, has recently grown to become one of the dominating methods of monetization in the games industry. However, many versions of these monetization schemes face severe backlash because it appears that the ways to monetize games are increasingly influencing the contents of the medium and that those games are purposefully designed to bring vulnerable players to spend more money than they meant to. In this thesis, those points of criticism were taken into consideration and as a starting point to explore the legality of these kinds of monetization schemes from a legal standpoint. This was done with regards to the Unfair Competition Law, Youth Protection regulation and general civil law. Also, the chance-based variant of microtransactions, the so called ‘Lootboxes’, have been examined with regard to their legality under gambling regulations.

    Description: Nach 1989/90 erreichten das Brandenburgische Landeshauptarchiv verstärkt Anfragen zu politischen Leitungsträgern auf Kreis- und Stadtebene aus den Jahren 1945–1952. Ortschronisten und Gemeindeverwaltungen suchten Biografien im Zusammenhang mit der Benennung von Straßen, Plätzen oder Gebäuden. Wissenschaftler erforschten die Strukturen der ehemaligen Landesverwaltung und deren Leiter. Zusammenhängende Angaben dazu lagen jedoch bisher nicht vor. Neben Landräten, Oberbürgermeistern und ihren Stellvertretern stellt Torsten Hartisch auch das leitende Personal der Oberlandratsämter, der Hauptabteilungen, Abteilungen und Referate der Provinzialverwaltung bzw. der Landesregierung in rund 490 Kurzbiografien vor. Ergänzt wird der Band mit einer Aufstellung der Mitglieder der Kreisräte, der Stadträte der kreisfreien Städte, der Vorstände der Kreistage und der Stadtverordnetenversammlung (rund 2000 Personen im Personenindex). Eine Aufstellung der wichtigsten Verwaltungsstrukturen auf Landesebene hilft bei einem schnellen Einstieg und Überblick.
