    Description: Henri Hours' book on the end of the League in Lyon is one of the most important works of 16th century historiography in Lyon, although very few readers have had the opportunity to consult it. This is its main paradox and the challenge of this edition. The thesis was defended at the École Nationale des Chartes in 1951, but it has never been published and, in accordance with the rules of the École, it has never been made available. Only those who knew the author were able to read it, which does not prevent it from appearing in all bibliographies concerning the Wars of Religion. Following his death in 2017 and with the agreement of his family, the Collection Chrétiens & Sociétés has decided to publish this memoir for the first time in order to make it accessible to the public in Lyon and to historians of religious confrontations. Henri Hours meticulously analysed the last years of the League at Lyon, the crucial years 1593-1597. Since 1589, the city had swayed to the side of Catholic intransigence to the point of rejecting its sovereign, Henry IV, and maintaining a costly but necessary war effort in a region crossed by denominational borders. The bishop, Pierre d'Epinac, the consuls of Lyon, the governor of the city, the Savoyard and Spanish spies, but also the street preachers and the little people who were very inclined to be alarmed, were the main actors in these events. Here we touch on the political and religious dimensions of urban history. Through municipal deliberations, correspondence, pamphleteering and some contemporary accounts, Henri Hours unravels the skein of the city's political shift towards submission to the king. By looking back at the writings of some of these actors, notably Pierre Mathieu and Claude de Rubys, he also questions the memory of the event in the consciousness of Lyon.

    Description: Les auteurs de cet ouvrage “ Pierre et Archéologie ”, issu du Colloque international qui s’est tenu à Tautavel (14-15 mai 1998) veulent attirer l’attention sur les nombreux aspects de l’utilisation de la pierre par l’Homme depuis la Préhistoire, et les difficultés pour comprendre et expliquer son identification, son évolution et sa conservation. Mise à part l’utilisation lointaine de la pierre par l’homme préhistorique pour assurer sa survie, il reste le domaine très vaste, plus récent dans le temps, de la pierre de taille utilisée par les hommes. Déjà les gallo-romains se sont servis des pierres dites « du midi » pour des constructions que nous connaissons bien. Mais la pierre n’est pas réservée seulement aux monuments, elle fait partie de la vie quotidienne. En dehors des grands édifices, de nombreuses habitations sont bâties en pierre et souvent leur sol est pavé de pierres. Il y a aussi l’amour de la pierre tout simplement, pour le beau, le toucher : c’est par exemple la sculpture qui agrémente les monuments et même les habitations. Les sarcophages en marbre blanc, sculptés entre la fin de l’Antiquité classique et le Haut Moyen-Age, dont le problème de l’origine est traité dans cet ouvrage, montrent bien la diversité des aspects artistiques que l’Homme a su exploiter. L’ensemble des contributions présentées apporte des données originales sur les méthodes et techniques modernes utilisées pour contribuer à mieux comprendre l’évolution culturelle et artistique de l’humanité, le devenir de la pierre extraite et la restauration des monuments. Ceci montre une fois de plus la nécessité d’une recherche pluridisciplinaire, seule démarche pour assurer la protection et la pérennité de tout ce qui touche notre patrimoine.

    Description: In recent years, through novels and television series ("Vikings", "Millennium", "Borgen" or "Occupied"), Nordic culture has become more visible internationally. At the same time, researchers are questioning what the North is, its conceptualisation, its cultural implications, its geographical characteristics, its social and political challenges. This volume is part of the current debate on the Nordic imaginary based on a notion, Nordicity, which intersects with borealism. Plural and mobile, the North inspires both scriptural and figurative production based on desire, dream, fascination or fantasy. The real, tangible and contingent North is only the apparent surface of a manufactured and invented North. How can we express northernness today? Is a theory of the North possible? This volume attempts to answer these questions by bringing together contributions from researchers in Nordic studies, literature, linguistics and the humanities: each is given the opportunity to define his own conception of Nordicity. Ces dernières années, à travers romans et sériés télévisées ("Vikings", "Millennium", "Borgen" ou "Occupied"), la culture nordique a gagné en visibilité internationale. Simultanément, les chercheurs s'interrogent sur ce qu’est le Nord, sa conceptualisation, ses implications culturelles, ses caractéristiques géographiques, ses enjeux sociaux et politiques. Ce volume s’insère dans le débat actuel sur l’imaginaire nordique à partir d’une notion – la nordicité – qui interagit tout particulièrement avec le boréalisme. Pluriel et mouvant, moteur constant de redéfinitions, le Nord inspire une fabrication tant scripturale que figurale fondée sur le désir, le rêve, la fascination ou le fantasme. Le Nord réel, tangible contingent, n’est que la surface apparente d’un Nord fabriqué et inventé. Comment dire aujourd’hui la nordicité? Une théorie du Nord est-elle possible?     Description: The volume Contro Bernardino. Processi al maestro Amedeo Landi is the result of the discovery of unpublished documentation on the trials - only partly known - against the abacus master Amedeo Landi, who taught the Milanese merchants at the Broletto. This is an exceptional case not only because only one witness to the activity of the Milanese inquisitorial court in the Middle Ages (whose documentation has been entirely lost) was known until now, but also because of the role of the ecclesiastical court and its officials. The wealth of information and themes has prompted a team effort by the professors of the Department of Historical Studies to clarify the many aspects (political, religious, economic, documentary) of an event that shows the vitality of 15th-century Milan, in which the protagonist, the teacher Amedeo Landi, in an attempt to protect his students, clashes with the most important preacher of his time, Brother Bernardino of Siena, whose canonisation process is temporarily blocked precisely to shed light on the Milanese episode.

Processi al maestro Amedeo Landi nasce dal ritrovamento di documentazione inedita riguardo ai processi – solo in parte noti – contro il maestro d’abaco Amedeo Landi che insegnava ai mercanti milanesi presso il Broletto. Si tratta di un caso eccezionale non solo perché finora si conosceva un solo testimone dell’attività del tribunale inquisitoriale milanese nel medioevo (la cui documentazione è andata interamente perduta), ma anche per il ruolo del tribunale ecclesiastico e dei suoi funzionari. La ricchezza delle informazioni e dei temi ha suggerito un lavoro d’équipe dei docenti del Dipartimento di studi storici per chiarire i molteplici aspetti (politici, religiosi, economici, documentari) di una vicenda che mostra la vitalità della Milano quattrocentesca, in cui il protagonista, il maestro Amedeo Landi, nel tentativo di tutelare i suoi studenti si scontra con il più importante predicatore del suo tempo, frate Bernardino da Siena, il cui processo di canonizzazione viene momentaneamente bloccato proprio per fare luce sull’episodio milanese.

    Description: The art of printing with movable type made its appearance in Perugia -then as now, the heart of Italy- in 1471, when the city was under the sway of Braccio Baglioni. Perugia was home to an important university which had been attracting students from all over Europe for more than a century. They found hospitality in two colleges, of which the ‘Sapienza Vecchia’, in particular, was accustomed to accommodating students from abroad. The colleges were themselves instrumental in assisting the work of the earliest printers, all of them foreigners; their enterprise flourished for about fifteen years before strong competition from larger printing centres, notably Venice, took control of the Perugian book market. A second phase in local book production started at the turn of the century under the aegis of two major players, the Cartolari family and Bianchino dal Leone. The history of the book in Perugia is characterized by a quality and originality which is not reflected in the modest quantities produced there, and the major bibliographers have always taken an interest in it. All that and more can be found in this book, the outcome of lengthy research based on detailed analysis of all known editions and archival documents, including a number of new discoveries.

    Description: "The present work addresses the history of Derecho Indiano (Spanish Colonial Law) and proposes to examine the role played by Indiano-Castilian jurists in the New World as creators and enforcers of a science and the practice of law. They were given the task of organising and developing public authorities as well as the new society, and in their engagement with the temporary institutions, they were confronted with realities and situations as diverse as they themselves proclaimed them to be. The works brought together in this volume originally appeared in journals and collected works from different countries, and they are now being presented here in a revised edition. Castile was the kingdom overseeing the expansion across the Atlantic; an expansion to lands and peoples unknown to Europeans up till that point in time. The jurists who worked under these new and challenging circumstances belonged to the Castilian tradition, and they were immersed in this tradition not only due to their university education, but also as a result of their cultural environment and the very structure of the governing bodies and justice system of the kingdom. The confrontation with a reality that was, in so many respects, different from that of the Peninsular – as could already clearly be seen in accounts written by conquistadors, missionaries and the authorities from the early days – encouraged jurists to search for solutions to the new problems that had arisen. Over the years, this led to the creation of what would eventually shape a heterogeneously composed normative corpus, both in civil and canon terms. The differences between the Indiano and Castilian systems were marked to the point that it became a widely accepted truth that the Indiano order could not be fully understood or taken into account either by the advisors of Castile or the lawyers who travelled to the Americas with no prior knowledge of this particular law. Jurists who were born or based in the Indiano provinces would often come to discover the “constitutional discourse” of the monarchy; in other words, they experienced the unfolding plot, so to speak, not through theory, but rather through the impetus provided by the possible solutions to the numerous issues that had arisen. Although Castilian legal literature, which exerted a powerful influence, was present and being circulated throughout the Americas, preferences when it came to specific authors and legal bodies were as different as the readings and interpretations made of them. Several criteria both general and specific in nature took shape. Consequently, “local contexts”, for example, were often discussed in the application of general norms and the “customary background” was similarly taken into account."

    Description: In 1907, the city of Heredia became the epicenter of the most important religious conflict experienced by Costa Rica in the 20th century. A complaint that the theory of evolution was being taught in the Lyceum (i.e. secondary school) of that city, triggered an increasingly intense confrontation between the Catholic parishioners and the circle of young radical intellectuals articulating around the writer and educator Roberto Brenes Mesén. In the course of this process, Costa Rican society, to the alarm of the government of Cleto González Víquez, was the scene of popular mobilizations in defense of the faith, excommunications and burning of impious texts, while Catholic morality was systematically questioned based on sexual abuse attributed to priests. For a moment, it seemed that the country had gone back in time, and that the ghosts of 1884 were present.

I argue that entertainment in vaudevilles was shaped between the perception of difference and similarity, between human trafficking, covert prostitution, anti-Semitism and nationalism. Ultimately, my research shows how a space for Jewish-non-Jewish people was created in the coinciding of the mass migration movement and the emerging mass culture between the Habsburg Monarchy and the United States.

    Description: L'essor du recours au crédit n'est plus à démontrer : le crédit est devenu un mode de paiement courant pour une grande majorité de consommateurs. La loi du 12 juin 1991 relative au crédit à la consommation avait notamment pour objectif de cadenasser l'octroi d'emprunts, dans le souci d'améliorer la protection des consommateurs. Elle fut révisée à diverses reprises. La multiplicité des types de crédit ainsi que les nouvelles réglementations imposées par le contexte européen ont amené le législateur à prendre de nouvelles dispositions visant essentiellement à protéger le consommateur. Au cours de la dernière législature, on peut notamment relever la loi du 7 janvier 2001 modifiant la loi du 12 juin 1991 relative au crédit à la consommation et la loi du 10 août 2001 relative à la Centrale des crédits aux particuliers. Le présent ouvrage analyse ces modifications récentes et procède à un examen actualisé de la jurisprudence.

Diese Lücke will die vorliegende Untersuchung mit dem Titel «Die Rechnungsstellung im schweizerischen Obligationenrecht» schliessen.     Description: The liberal professions are subject to an ever changing legal basis and thus constantly undergo minor or major amendments. A fundamental innovation in the current law governing the liberal professions of tax consultants is the authorization to work as in-house tax consultants. Since 2008, the Tax Consultancy Act has made possible to pursue the profession of in-house tax advisor, while lawyers were allowed to work in-house for decades already, with the last amendment of the legal regulations from 2016. This paper deals with the various legal and practical implications of the interactions between the freelance activity as a tax consultant and the activity of in-house tax consultants in an employment relationship. A detailed comparison of the legal basis for tax consultants with that of in-house lawyers is of special interest in light of the current ambiguous legal situation. Special focus is a thorough analysis of the legal question whether or not an in-house tax adviser can be exempted from the obligatory pension insurance.

    Description: Dès lors qu’elle renvoie à la possibilité de « se fier », à quelqu’un ou à quelque chose, la confiance est au cœur et au fondement des relations sociales, intéressant ce faisant la plupart des sciences sociales. Dans un contexte dominé par le constat partagé d’une « crise » de confiance / ou de défiance – dans la société, dans la démocratie, dans les hommes et les institutions politiques, dans le progrès, dans l’économie, etc. –, une interrogation croisant les analyses de différentes disciplines prend tout son sens. Si le juriste est interpellé par la problématique de la confiance en tant que « juriste dans la cité », il peut également y trouver un concept invitant à renouveler certains cadres classiques des droits constitutionnels, de l’environnement, de l’économie ou encore des finances. L’organisation d’une « journée d’étude interdisciplinaire » tendait à poursuivre ce questionnement, en invitant des spécialistes de disciplines non juridiques à dialoguer avec des juristes. Les points de vue de la philosophie, de l’histoire, de la science politique et de l’économie ont ainsi été mobilisés pour questionner la thématique commune de la confiance. Il s’est agi notamment, d’une part, de se demander si la réflexion sur la confiance était en mesure de développer des outils aptes à renouveler certains cadres théoriques classiques ; d’autre part de s’interroger sur l’impact de ces réflexions théoriques sur le lien social, eu égard aux enjeux actuels.

Si, comme on s’y attendait, les évolutions sont dissemblables, les conclusions de Chris Wickham montrent la force de la tradition byzantine à propos de la grande propriété et du commerce ; l’héritage byzantin n’est pas uniforme, mais, même dans ces domaines éloignés de l’idéologie, il a laissé des traces durables.

    Description: Depuis plus d’un siècle la notion de « nuisible » fait l’objet d’une contestation de plus en plus vive. Pourtant elle connaît une singulière persistance sociale en tant que concept opérationnel qui donne aux hommes une certaine légitimité pour gérer, et souvent détruire, certaines espèces. À l’heure où la France vient d’adopter la loi sur la reconquête de la biodiversité, la question des « nuisibles » reprend une singulière acuité avec la multiplication d’espèces exotiques envahissantes et les vives controverses qui demeurent autour du loup, du renard mais aussi de l’utilisation des insecticides et des herbicides pour se défaire de « gêneurs ». Si la notion de « nuisible » demeure centrale dans la gestion du sauvage par nos sociétés, elle s’avère très variable selon l’époque, l’espèce, le territoire ou le groupe social considéré. Pour dresser un état de la recherche, historiciser cette notion et éclairer les enjeux actuels, il convient de croiser les regards afin de caractériser les différentes conceptions de la notion de « nuisible » qui coexistent actuellement et d’en retracer les origines, tout en s’ouvrant aux acteurs du présent. Ainsi cet ouvrage entend contribuer à explorer les interactions entre les sociétés et la nature, et permettre de mieux saisir leurs coévolutions.

    Description: À un moment où l’on s’efforce de combler le fossé économique, politique et psychologique qui sépare les rives nord et sud de la Méditerranée, il a paru utile de présenter une pratique peu connue - la caravane maritime - qui a, partiellement, joué ce rôle pendant un siècle et demi. Ce vocable quelque peu inattendu désignait la prestation de service que rendirent, de la fin du XVIIe au début du XIXe siècle, les marins européens aux sujets de l’Empire ottoman. Ils assuraient la plupart des liaisons maritimes pour cette immense construction politique à peu près dépourvue de navires de commerce, bien que bordant la majeure partie du littoral méditerranéen. Après avoir exposé les conditions juridiques qui ont encouragé ce type d’association temporaire, Daniel Panzac présente les marins, la pratique quotidienne de la caravane, avant d’évoquer ensuite les affréteurs ottomans. C’est principalement à travers leurs différends que se révèlent les éphémères relations de ces hommes et leur façon de surmonter leur méfiance et leurs préjugés. Ce faisceau dense de liaisons maritimes favorisa la constitution d’un ensemble économique, une « économie-monde », facteur essentiel de cohésion de cet État aussi vaste qu’hétérogène que fut l’Empire ottoman, ensemble dont l’effondrement dans la première moitié du XIXe siècle précéda l’éclatement politique.

So far criminal and/ or verbandsrechtliche questions were the focus. For example the question of whether and how sponsorship contracts may be terminated in cases of misconduct of the sponsored. First, it examines how appropriate cancellation clauses could be like. Second, consider the conditions under which, even without explicit rules for doping a termination in accordance with general principles of contract law is concerned. It also discusses the legal consequences of termination, and in particular its relationship to other contractual consequences of doping, such as claims for damages or penalties.

    Description: Aux xvie et xviie siècles, l’ordre européen était parfois menacé par des crises d’origine régionale. Ces désordres venaient des initiatives scandaleuses d’acteurs politiques habituellement peu présents sur la scène internationale (municipalités, institutions provinciales, seigneurs locaux). Pour résoudre des conflits internes, parfois contre leur propre souverain, ces acteurs n’hésitaient pas à appeler des puissances étrangères à leur secours, dans des logiques de solidarités politico-religieuses internationales. Les « affaires de Provence» (1580-1598) permettent de comprendre le fonctionnement de ce type de crises. Au plus fort des guerres de Religion en France, les catholiques de Provence appelèrent à leur secours le duc de Savoie, le grand-duc de Toscane, les papes et le roi d’Espagne. Parce que la Provence avait une position stratégique entre Barcelone et Gênes, d’autres puissances intervinrent à leur tour: l’Angleterre, l’Empire ottoman, le duché de Lorraine et la République de Venise. À partir d’une étude minutieuse des événements, ce livre mène une réflexion approfondie sur les défis stratégiques, intellectuels et rhétoriques d’une situation vécue à l’époque comme un désordre international, en raison de la marge de manœuvre subversive acquise par des acteurs ordinairement faibles.

    Description: Le Nouveau Festin de Pierre est la dernière pièce sur Dom Juan écrite en France au XVIIe siècle, après le chef-d’oeuvre de Molière. Bien que la comparaison avec le Festin de Molière l’ait toujours discrédité, le Nouveau Festin de Rosimond est une pièce remarquable. L’auteur mélange agréablement plusieurs renvois à une tradition donjuanesque qu’il connaissait très bien, mais il élabore aussi une nouveauté : le triplement de Dom Juan, avec l’introduction de deux amis libertins – Dom Lope et Dom Felix – qui sont aussi les maîtres de débauche pour le protagoniste. Ajoutons les nouveautés scénographiques et le succès international de cette pièce, imitée par Thomas Shadwell en Angleterre, pour accroître l’intérêt de cette édition.

    Description: La famille constitue depuis longtemps un objet d’étude privilégié des historiens des sociétés. Ayant abandonné l’attention presque exclusive accordée autre­fois aux seuls lignages aristocratiques voire royaux, cette histoire de la famille a connu depuis un demi-siècle de profonds renouvellements, tant thématiques que méthodologiques. Directement impliquée dans l’histoire quantitative, notamment par le biais de la « reconstruction des familles », la thématique familiale s’est retrouvée au centre de l’histoire des mentalités. Ultérieurement enfin, via l’importation de problématiques venues des autres sciences sociales et le recours à la démarche « micro-historique », la famille s’est muée en un espace social et anthropologique au sein duquel sont mises à jours les dynamiques qui affectent ces réalités familiales. Dans le même temps, ces réflexions sur le passé d’une réalité sociale toujours vivante viennent en écho aux interrogations contemporaines sur le devenir de la famille nucléaire. La « crise » d’un modèle familial pluriséculaire et les recompositions familiales auxquelles elles donnent lieu placent ces réflexions sur la famille au cœur d’un débat de société particulièrement intense. Dans ce contexte qui fait de la famille un sujet d’actualité brûlant, le colloque organisé à Toulouse a voulu dresser un bilan des travaux les plus récents des meilleurs spécialistes du sujet, il s’est inscrit dans une démarche délibérément comparatiste tout en insistant sur les continuités et les ruptures identifiables tant en termes de problématiques, de démarches que de résultats. Compte tenu de la spécificité du laboratoire à l’origine de cette réflexion, le comparatisme concerne essentiellement les espaces français et ibérique, ce dernier étant compris au sens large puisqu’il intègre les sociétés coloniales ibéro-américaines. Dans le même temps, ce colloque a fait le choix de la transdisciplinarité et de la longue durée, depuis le bas Moyen-Âge jusqu’au xxe siècle. Cette longue phase chronologique coïncide avec l’émergence puis le développement de la structure nucléaire, modèle familial précisément en cours de redéfinition aujourd’hui. À son propos, leurs auteurs y confrontent des approches historiques, sociologiques, anthropologiques et juridiques qui toutes éclairent les complexités de cette histoire tout en contextualisant les interroga­tions contemporaines.

    Description: Le décret de la Communauté française du 24 juillet 1997 définissant les missions prioritaires de l'enseignement est original à plus d'un titre. Quant à la procédure suivie pour son élaboration, tout d'abord : il fait suite aux Assises de l'enseignement et aux travaux du Conseil de l'Éducation et de la Formation qui ont assuré une large participation aux acteurs de la communauté éducative. On s'interroge aujourd'hui sur les rapports entre démocratie représentative et démocratie participative. Le décret « missions » mérite l'attention à cet égard. Quant à son contenu et ses enjeux ensuite. L'exposé des motifs les présente comme suit : « Ce décret aurait dû être le premier de tous les textes législatifs organisant renseignement obligatoire. Définissant les missions de l'Éducation, il est le texte fondateur de tous les autres ». Il a déjà produit plusieurs changements considérables dans le fonctionnement et la vie des écoles, notamment la mise sur pied de « conseils de participation », des règles nouvelles au sujet de l'inscription, de l'évaluation et de l'exclusion des élèves, ou encore à propos de la gratuité de l'enseignement. Les questions que soulève pareille législation sont nombreuses. Peut-on formuler en règles de droit des objectifs généraux ? Quelles sont la valeur et la pertinence de ceux- ci ? Comment les normes décrétales doivent-elles être interprétées ? Que reste-t-il de la liberté d'enseignement garantie par la Constitution ? C'est pour traiter ces questions que le Centre de droit de la culture des Facultés universitaires Saint-Louis a organisé le vendredi 25 septembre 1998 une journée d'études interdisciplinaire. Le présent ouvrage livre une version revue et approfondie des exposés présentés à cette occasion.

Pero López de Ayala, Fernán Pérez de Guzmán, Diego de Valera, Pedro Carrillo de Huete, Alfonso de Palencia, Hernando del Pulgar se penchent tour à tour, à la demande de la cour ou de leur pleine initiative, sur le déroulement des règnes qu’ils connaissent, auxquels ils participent, contre lesquels ils ont souvent des reproches à formuler et pour lesquels ils se donnent volontiers le rôle de censeurs. Cette élaboration de l’Histoire peut être suivie dans le présent ouvrage ; l’histoire de la Castille devient un message politique, avec des arguments, des exemples choisis et toujours des réflexions devant servir aux générations futures.

Parmi la luxuriance des corniches et moulures où s’enroulent des rubans ou s’épanouissent fleurs et feuillages, les planchettes glissées entre les solives ont reçu des peintures dont la variété thématique nous ouvre une nouvelle part de l’imaginaire de ces siècles. La rigueur du programme héraldique voisine avec un monde animal souvent fantastique, mais aussi domestique, familier, ou exotique. Ici et là, des saynètes montrent des personnages humains, au jeu, en fête, au travail (fort peu), ou au combat. Ici, la veine est raffinée, là, d’une truculence comique. Cet ouvrage parcourt, pour la première fois, toutes les régions méditerranéennes qui ont participé de ce goût pour les charpentes peintes, trace la chronologie de leur histoire, observe les traits communs de leur inspiration et fait ressortir les nuances : la Renaissance et l’Antique s’expriment en même temps que la drôlerie des fabliaux.

En rééditant les Principes régénérateurs du systême social, opuscule publié en pluviôse an III (janvier-février 1795), peu de temps avant la déportation de l’auteur à Cayenne, on souhaite ici éclairer un moment essentiel dans l’élaboration de la « synthèse républicaine ». C’est aussi « une nouvelle manière d’écrire l’histoire de la Révolution française » (Michel Vovelle). Un retour critique au texte met en lumière, d’une part, l’acculturation d’un révolutionnaire de premier plan, d’autre part, les thèmes récurrents du discours jacobin. L’essai de Billaud-Varenne est, en effet, une expression du projet montagnard d’« institutions civiles ». Projet d’un lien social pour « mettre en action la morale » et « la donner pour base à la politique », espérance d’un nouvel espace public de réciprocité fraternelle où la citoyenneté compte au rang des droits naturels. Ainsi se dévoile une philosophie de la Révolution française qui n’est pas sans rapport avec la pensée allemande contemporaine de l’événement révolutionnaire.

    Description: Como parte del interés que la década de los años treinta ha suscitado recientemente entre los estudiosos de toda América, este libro ofrece una visión general de la economía y la industria mexicana en uno de los periodos más inexplorados de nuestra historia. Uno de los principales temas que se tratan en esta obra es el conjunto de repercusiones que acarreó la Gran Depresión estadunidense sobre las economías latinoamericanas. En particular, se muestra que al tiempo que cayeron las exportaciones de México, se dinamizaron los mercados internos y se sentaron así las bases para la acumulación de capital productivo en el país. Sin embargo, al no existir políticas macroeconómicas claramente definidas por parte de los gobiernos posrevolucionarios, el crecimiento industrial fue en gran medida desordenado y produjo efectos nocivos a largo plazo en el entero ámbito económico. Así, aunque este libro aborda sobre todo el periodo que va de fines de los años veinte a 1940, presenta un modelo que permite comprender de una forma novedosa la situación de la economía mexicana prevaleciente en la actualidad.

    Description: If the journalistic media are to be able to effectively perform their essential democratic tasks of forming public opinion and controlling state power, they must be independent of the state. At the same time, this state has to guarantee a diverse range of media and to inform the public about its activities. This tension is intensifying in the internet age, in which the expensive production of journalistic content is less and less taken for granted. This updates the state's duty to ensure media pluralism, for example by organizing a public service system or other promotional measures, and to carry out active public relations work. This in turn increases the risk that the state will influence media activity or become the media provider itself. The limits that the state has to observe in this context are worked out in this book on the basis of a cross-media, constitutional and international law analysis of the principle of the media's independence from the state.
    Description: Sollen die journalistischen Medien ihre demokratiewesentlichen Aufgaben der öffentlichen Meinungsbildung und der Kontrolle staatlicher Macht wirksam wahrnehmen können, müssen sie vom Staat unabhängig sein. Gleichzeitig hat ebendieser Staat ein vielfältiges Medienangebot zu gewährleisten und die Öffentlichkeit über seine Tätigkeiten zu informieren. Dieses Spannungsverhältnis verschärft sich im Internetzeitalter, in welchem die teure journalistische Inhaltsproduktion immer weniger als gesichert gilt. So aktualisiert sich dadurch die staatliche Pflicht, den Medienpluralismus etwa durch die Organisation eines Service public-Systems oder anderweitiger Fördermassnahmen zu sichern und eine aktive Öffentlichkeitsarbeit wahrzunehmen. Dies erhöht wiederum die Gefahr, dass der Staat die Medientätigkeit beeinflusst oder selber zum Medienanbieter wird. Welche Grenzen der Staat in diesem Kontext zu beachten hat, wird in diesem Buch anhand einer mediengattungsübergreifenden verfassungs- und völkerrechtlichen Analyse des Prinzips der Staatsunabhängigkeit der Medien herausgearbeitet.

Am Beispiel der internationalen Ausrichtung der deutschen gesetzlichen Unfallversicherung und der australischen Workers Compensation untersucht die Autorin diese Risiken umfassend. Mit einem detaillierten Raster praxisnaher Fallbeispiele ermittelt sie Defizite bei Versicherungsschutz, Leistungsrecht und Arbeitgeberhaftung und zeigt konkrete Lösungsmöglichkeiten auf. Bestehende völkerrechtliche Abkommen und das koordinierende Sozialrecht der EG sind als Musterregelungen in die Untersuchung einbezogen.

The present special edition investigates which opportunities open access to scientific publications offers to legal studies and which challenges it poses. Scientific publishers play an important role with regard to this issue; their perspective is therefore examined first. Nine reports from legal-scientific open access periodicals show that open access is possible with as well as without traditional publishers. Other contributions explain the role of academic infrastructure, especially of libraries and promoters of research. The publication is rounded off by an opinion analysis from a transnational conference on the subject which took place in October 2018 (www.jurOA.de).

    Description: Les relations entre les États-Unis et l’Unesco ont toujours été complexes comme le démontre l’étude des 20 premières années de celles-ci. Lors de la création de l’Unesco quelques Américains ont énormément travaillé pour que cette Institution spécialisée des Nations- Unis existe. Leur rôle et leur apport sont ici soigneusement mis en évidence. Or, les premières déceptions arrivent rapidement car, à tort, du côté de Washington, on espérait voir l’Organisation participer efficacement à la lutte contre le communisme. Néanmoins, à la fin des années 1950, l’Unesco connaît un regain de faveur auprès du gouvernement américain. Et si l’hégémonie financière américaine à l’Unesco n’a jamais fait de doute, sa domination politique est mise en cause dès les premières années. Les États-Unis vont quitter l’Unesco en 1984, quand la première génération d’Américains, fondateurs de l’Unesco et fidèles malgré les déceptions a, depuis longtemps, quitté la scène politique.     Description: Si l’histoire traditionnelle de l’hérésie au Moyen Âge s’est longtemps confondue avec celle des exclus de la société, l’approche récente se focalise davantage sur les diverses autorités qui, au coeur du pouvoir, élaborèrent la norme religieuse : l’hérésie n’existe que parce que l’orthodoxie en a d’abord décidé. Il reste que, loin de se présenter comme une essence immuable, elle s’impose tout au long du Moyen Âge comme un concept et une qualification d’une très grande plasticité. L’extension progressive du domaine de l’hérésie à de nombreuses formes de dissidence finit par lui assurer le statut d’un crime englobant. Cette enquête collective repose sur la conviction que c’est encore en se situant aux marges de l’hérésie, au contact d’activités répréhensibles voisines, telles que l’usure, la sorcellerie ou encore la rébellion politique, que l’on peut le mieux saisir les principes et les mécanismes de la fabrique de l’hérésie.

Quelles sont les raisons qui expliquent que cette bataille – une parmi tant d’autres qui ont émaillé les conflits du xxe siècle – a d’emblée revêtu une dimension historique pour les contemporains ? Pourquoi précisément cette opération militaire est-elle désormais régulièrement commémorée par autant de chefs d’État sous le regard des télévisions du monde entier ? Comment expliquer le statut si particulier acquis par cet événement au fil des décennies, jusqu’au projet d’inscription des plages du Débarquement au patrimoine de l’Unesco ? En revenant à la dramatisation des enjeux d’une bataille annoncée près de quatre années à l’avance, mais aussi aux ressorts politiques, idéologiques, économiques et culturels qui ont contribué à transcender l’événement en épopée, cet ouvrage s’interroge sur la quête d’identité de chacun des acteurs nationaux à travers l’évolution de leur mémoire. Ainsi peut-on mieux comprendre la surprenante transformation de l’épisode guerrier en symbole universel de paix et de liberté.

The present study links the reproach of sexual misconduct as a political argument in medieval discourse to medieval ideas about royalty and government, opening new perspectives of a cultural history of politics in the Later Middle Ages.
    Description: Die politische Rolle des Favoriten und die Art seiner Beziehung zum König sind in der Forschung oft nicht klar gesehen worden, da in den Diskursen des frühen und späten Mittelalters die besondere Nähe zum Herrscher regelmäßig in der Sprache der Liebe und in Gesten der körperlichen Nähe und Intimität zum Ausdruck kam. So entstand der Eindruck, dass der König aus homosexueller Neigung seinem Günstling übermäßigen Einfluss gewährte – auf Kosten der Barone, die ebenfalls einen Anteil an der Macht beanspruchten. In dieser Studie wird die Figur des Favoriten neu betrachtet und in ihrer Bedeutung über den Einzelfall hinaus verständlich gemacht. Sie setzt den Vorwurf sexuellen Fehlverhaltens als politisches Argument in Bezug zur Entwicklung der Vorstellung von Königtum und Herrschaft und eröffnet so neue Perspektiven einer Kulturgeschichte des Politischen im Spätmittelalter.

Ainsi, l’impression est née que le roi, par inclination homosexuelle, accordait une influence excessive à son favori – aux dépens des barons, qui revendiquaient, eux aussi, une part du pouvoir. Dans l’esprit d’une »histoire culturelle de la politique«, le présent ouvrage reconsidère la figure du favori, la rend compréhensible et tangible dans sa signification au-delà du cas individuel. Il met en évidence le caractère constructif des modèles modernes de perception du désir sexuel et souligne l’importance de l’inconduite sexuelle comme argument politique dans le discours médiéval.

These articles provide comprehensive protection against the most modern forms of surveillance including bulk interception. Several criteria apply in terms of the foreseeability of the surveillance laws. Telecommunication’s interception should be subject to authorisation and supervision by independent authorities and effective remedies should be available. Moreover, the study analyzes the extent to which the surveilling state and the state of residence violate their human rights obligations in cases of cross-border surveillance. The main question is whether the established definitions of "jurisdiction" are applicable to this extraterritorial scenario. The extraterritorial exercise of jurisdiction can also be based on effective control over specific objects relevant to human rights. According to this approach, telecommunications data are objects relevant to individual’s right to correspondence and data protection.

Ohne den KSZE-Prozess wäre ein friedlicher Wandel in Europa schwer möglich gewesen. Die Autoren widmen sich gleichermaßen dem politisch-diplomatischen Entscheidungsprozess einzelner Teilnehmerstaaten wie den diversen Oppositionsbewegungen im Osten und zeichnen so ein differenziertes Bild dieser schleichenden, aber schließlich grundstürzenden Veränderungen.

    Description: « Zone tribale du Nord-Yémen », « zone tribale de l’Ouest pakistanais », voilà bien des expressions qui reviennent dans l’actualité pour désigner des régions de confins farouchement réfractaires à l’imposition d’un nouvel ordre politique. Dès la fin du XIXe et au début du XXe siècle, les États européens, emportés dans leur mouvement d’expansion outre-mer, vinrent buter, en périphérie, sur ce type d’espace en quelque sorte interstitiel des relations internationales contemporaines. Dans ces zones où les agents traditionnels de la vie diplomatique pénétraient peu, ou mal, une expertise particulière, celle du renseignement et des agences de sécurité, parut s’imposer. Lorsque la France coloniale s’implante en Syrie et au Liban, au lendemain de la Première Guerre mondiale, elle doit précisément faire face à ce type de résistance, où se combinent turbulences tribales, désordres sociaux et effervescence identitaire. La lutte qui s’engage alors entre bandes armées locales d’une part, et Service des Renseignements de l’armée française de l’autre, dépasse, et de loin, le face-à-face purement martial, mais renvoie à un choc des violences, sociale et guerrière d’un côté, étatique et militaire de l’autre, dont il n’est pas sûr que la leçon ne vaille qu’au passé.

    Description: L’inceste marque de sa monstruosité les consciences collectives. Cantonné dans la sphère du tabou et de l’infamie, nul ne peut le discuter, nul ne peut le pratiquer. Le phénomène existe pourtant sous différentes formes selon les sociétés dans lesquelles il est rencontré et pensé. En France, au xixe siècle, l’inceste a une histoire. Lorsqu’en 1791 les Constituants décident de le décriminaliser, la société française voit s’ouvrir un siècle de débats qui conduit à une requalification profonde du phénomène et de son imaginaire. L’étude croisée des discours entretenus par les élites souligne les étapes qui ont présidé à la construction de l’inceste criminel. À la fin du siècle, il n’est plus l’apanage des aristocrates décriés par les Lumières mais bien celui d’hommes pauvres, devenus les symboles d’une nouvelle dangerosité. La justice, par l’entrelacement de ses échelles et de ses acteurs, contribue également à fabriquer et à imposer progressivement ce masque sur le phénomène incestueux. Mais l’inceste n’est pas qu’un crime au xixe siècle. En tentant de pénétrer au cœur même des familles, cet ouvrage montre qu’il peut également être une sexualité consentie qui se pratique dans la clandestinité de certains foyers français. Réalité multiforme, interdit plus que tabou, l’inceste mérite en ce sens d’être replacé dans une histoire plus courte que l’intemporalité des anthropologues.

    Description: Le marché de la photographie est éclaté en de nombreux segments aux fonctionnements très disparates. Cette diversité s’accompagne d’une grande variété dans les statuts et les modes de rémunération, les photographes pouvant être payés, selon les cas, en droits d’auteur, salaires, bénéfices industriels et commerciaux, bénéfices non commerciaux. La restructuration des marchés autour de nouveaux leaders (Getty, Corbis, Jupiter…), suite à la révolution numérique, a fragilisé les agences d’auteurs et réduit le pouvoir de négociation des photographes au sein de la filière. Elle s’est accompagnée du développement de nouvelles pratiques comme la vente de photographies libres de droits. Très rentables pour les diffuseurs, en termes de coûts de transaction comme en termes de prix d’achat, ces pratiques précarisent les photographes et sapent les fondements du droit d’auteur, tant dans son versant patrimonial que moral. Les revenus de la mode et de la publicité et le développement récent d’un marché des tirages photographiques, marchés au demeurant très sélectifs, ne suffisent pas à compenser l’érosion des revenus des photographes. La porosité croissante des marchés favorise en outre des arbitrages entre droits d’auteur et salaires, en raison de taux de cotisations sociales très inégaux, fragilisant les droits sociaux des photographes. Enfin, les revenus issus de la gestion collective demeurent embryonnaires malgré des perspectives de développement prometteuses.

Im Zusammenhang zeitgenössischer Kategorien der Neudefinition und Neuorganisation von Arbeit mit technischen Entwicklungen und neuen Musikgenres wurden unterschiedliche Musizierformen höchst unterschiedlich praktiziert und behandelt. Durch eine systematische Analyse der Beziehungen zwischen Musizierformen, die bislang meist nur getrennt untersucht wurden, werden Hierarchien von Musizieren und Musizierenden zwischen (Nicht-)Kunst und (Nicht-)Beruflichkeit klar, die teilweise auch Jahrzehnte danach noch öffentliche Wahrnehmungen und wissenschaftliche Kategorisierungen von Musik beeinflussten.
