    Beschreibung: In 'An Aqueous Territory' Ernesto Bassi traces the configuration of a geographic space he calls the transimperial Greater Caribbean between 1760 and 1860. Focusing on the Caribbean coast of New Granada (present-day Colombia), Bassi shows that the region's residents did not live their lives bounded by geopolitical borders. Rather, the cross-border activities of sailors, traders, revolutionaries, indigenous peoples, and others reflected their perceptions of the Caribbean as a transimperial space where trade, information, and people circulated, both conforming to and in defiance of imperial regulations. Bassi demonstrates that the islands, continental coasts, and open waters of the transimperial Greater Caribbean constituted a space that was simultaneously Spanish, British, French, Dutch, Danish, Anglo-American, African, and indigenous.

Providing a history of how bodies have been thought and seen to mirror the nation, Heinrich charts the trajectory from an imperial idea of the body as a machine with interchangeable parts to current representations in which the parts are worth more than the whole and may be harvested at will--what he calls a diasporic form of the body. In seeing the body this way Heinrich makes clear his case for a new method he calls biopolitical aesthetics, one that uses the tools of literary and visual culture analysis to restore agency to aesthetics in the production of meaning in life during contemporary biopolitical times.

    Beschreibung: This volume provides the first account of the pioneering efforts at sex reform in America from the Gilded Age to the Progressive era. Despite the atmosphere of extreme prudery and the existence of the Comstock laws after the Civil War, a group of radicals emerged to attack conventional beliefs about sex, from traditional marriage to women’s chattel status in society. These men and women had in common a direct, unrespectable, iconoclastic style. They put forth outrageous journalism and had a penchant for martyrdom and for using the courts to publicize their ideologies.From rare and generally unknown sources, Hal D. Sears pieced together the story of the sex radicals and their surprising ideas. Moses Harman, a minister turned abolitionist and freethinker, is a central figure in the narrative. His Lucifer, the Light Bearer, the only journal of sexual liberty published from the early 1880s to 1907, was dedicated to free love, sex education, women’s rights, and related causes. To a great degree Harman’s publication defines the limits of social dissent in the late nineteenth century.Other members of the sex radical circle included E. B. Foote, a medical doctor who made a fortune with a home medical book crammed with sex information; Edwin Walker and Lillian Harman, who became a cause célèbre among radicals when their jailhouse honeymoon in Kansas challenged the right of the state to regulate marriage; Elmina Slenker, who promoted a theory of sexual energy sublimation and the idea that women were the superior sex; and Lois Waisbrooker, Dora Forster, Lillie White, and other feminists who, almost a century ago, taught and preached the very ideas we hear today in the women’s movement.Of course, all these people got into trouble with the law, mostly through the machinations of their archvillain, Anthony Comstock. Sears examines Comstock’s powers of postal censorship and describes Comstock’s personal vendettas against sexual dissenters, particularly the free love philosopher Ezra Heywood. He gives a legal history of obscenity and explains the sex radicals’ significance in the emergence of obscenity law.Although the sex radicals attest the important reform vitality of provincial culture in late nineteenthcentury America, until now they have been almost ignored by historians. Those who have studied sex radicalism at all, apart from its communitarian and sectarian aspects, have viewed it merely as a subsidiary of the more respectable feminist movement. In this book Sears gives careful consideration to the links between sex radicalism and spiritualism, feminism, anticlericalism, anarchism, and the freethought movement. He presents sex radicalism as a separate and unique movement which illuminates new reaches of the Victorian landscape and establishes a tradition for presentday liberation trends.

    Beschreibung: Anthropologists have been appearing as key expert witnesses in native title claims for over 20 years. Until now, however, there has been no theoretically-informed, detailed investigation of how the expert testimony of anthropologists is formed and how it is received by judges. This book examines the structure and habitus of both the field of anthropology and the juridical field and how they have interacted in four cases, including the original hearing in the Mabo case. The analysis of background material has been supplemented by interviews with the key protagonists in each case. This allows the reader a unique, insider’s perspective of the courtroom drama that unfolds in each case. The book asks, given the available ethnographic research, how will the anthropologist reconstruct it in a way that is relevant to the legal doctrine of native title when that doctrine gives a wide leeway for interpretation on the critical questions: what is the relevant grouping, what can be counted as a traditional law and when has there been too much change of tradition? How will such evidence be received by judges who are becoming increasingly sceptical about experts tailoring their evidence to suit the party which called them? This book answers these questions by assuming that there is more at stake here than the mere performance of roles. Rather, there is a complex interaction of distinct social fields each with its own habitus, and individual actors are engaged in an active and constructive agency, however subtle, which the painstaking research for this book uncovers.

    Beschreibung: The question of how to maintain the continuity of diplomacy while developing democracy without military intervention is an old and new issue. The challenge can be described as a dilemma between democracy and diplomatic coherence. This dilemma is not unique to the twenty-first century; it has been a constant challenge to the development of democracy. In non-Western countries, democratisation originated in the nineteenth century and has had many successes and failures. After the Russo-Japanese War, political parties began to take power in Japan. The best embodiment of diplomacy in Japan's emerging democracy—the development of parliamentary democracy and mass-based democracy—is Shidehara Kijūrō (1872–1951), who served as foreign minister from 1924 to 1927 and from 1929 to 1931, and was prime minister from 1945 to 1946. As a diplomat from the Ministry of Foreign Affairs, Shidehara had long grappled with the issue of how to ensure diplomatic coherence in modern Japan, which was becoming increasingly democratic. Although Shidehara succeeded to some extent in promoting diplomacy in cooperation with the US and the UK under party politics, the rise of the military after the Manchurian Incident forced him to retire for a period. However, after the Pacific War, Shidehara became prime minister of the US-occupied Japan and attempted to restore cooperative diplomacy under party politics. Shidehara came to the conclusion that the way to achieve both democracy and diplomatic coherence was through nonpartisan diplomacy towards peace. This book examines the tension between diplomacy and democracy, focusing on Shidehara’s life and exploring modern Japan’s footsteps. Shidehara was undoubtedly one of Japan’s most important diplomatic figures.

    Beschreibung: "Printing and Prophecy: Prognostication and Media Change 1450-1550 examines prognostic traditions and late medieval prophetic texts in the first century of printing and their effect on the new medium of print. The many prophetic and prognostic works that followed Europe's earliest known printed book—not the Gutenberg Bible, but the Sibyl's Prophecy, printed by Gutenberg two years earlier and known today only from a single page—over the next century were perennial best sellers for many printers, and they provide the modern observer with a unique way to study the history and inner workings of the print medium. The very popularity of these works, often published as affordable booklets, raised fears of social unrest. Printers therefore had to meet customer demand while at the same time channeling readers' reactions along approved paths. Authors were packaged—and packaged themselves—in word and image to respond to the tension, while leading figures of early modern culture such as Paracelsus, Martin Luther, and Sebastian Brant used printed prophecies for their own purposes in a rapidly changing society. Based on a wide reading of many sources, Printing and Prophecy contributes to the study of early modern literature, including how print changed the relationship among authors, readers, and texts. The prophetic and astrological texts the book examines document changes in early modern society that are particularly relevant to German studies and are key texts for understanding the development of science, religion, and popular culture in the early modern period. By combining the methods of cultural studies and book history, this volume brings a new perspective to the study of Gutenberg and later printers."

Processi al maestro Amedeo Landi is the result of the discovery of unpublished documentation on the trials - only partly known - against the abacus master Amedeo Landi, who taught the Milanese merchants at the Broletto. This is an exceptional case not only because only one witness to the activity of the Milanese inquisitorial court in the Middle Ages (whose documentation has been entirely lost) was known until now, but also because of the role of the ecclesiastical court and its officials. The wealth of information and themes has prompted a team effort by the professors of the Department of Historical Studies to clarify the many aspects (political, religious, economic, documentary) of an event that shows the vitality of 15th-century Milan, in which the protagonist, the teacher Amedeo Landi, in an attempt to protect his students, clashes with the most important preacher of his time, Brother Bernardino of Siena, whose canonisation process is temporarily blocked precisely to shed light on the Milanese episode.

Processi al maestro Amedeo Landi nasce dal ritrovamento di documentazione inedita riguardo ai processi – solo in parte noti – contro il maestro d’abaco Amedeo Landi che insegnava ai mercanti milanesi presso il Broletto. Si tratta di un caso eccezionale non solo perché finora si conosceva un solo testimone dell’attività del tribunale inquisitoriale milanese nel medioevo (la cui documentazione è andata interamente perduta), ma anche per il ruolo del tribunale ecclesiastico e dei suoi funzionari. La ricchezza delle informazioni e dei temi ha suggerito un lavoro d’équipe dei docenti del Dipartimento di studi storici per chiarire i molteplici aspetti (politici, religiosi, economici, documentari) di una vicenda che mostra la vitalità della Milano quattrocentesca, in cui il protagonista, il maestro Amedeo Landi, nel tentativo di tutelare i suoi studenti si scontra con il più importante predicatore del suo tempo, frate Bernardino da Siena, il cui processo di canonizzazione viene momentaneamente bloccato proprio per fare luce sull’episodio milanese.

    Beschreibung: The art of printing with movable type made its appearance in Perugia -then as now, the heart of Italy- in 1471, when the city was under the sway of Braccio Baglioni. Perugia was home to an important university which had been attracting students from all over Europe for more than a century. They found hospitality in two colleges, of which the ‘Sapienza Vecchia’, in particular, was accustomed to accommodating students from abroad. The colleges were themselves instrumental in assisting the work of the earliest printers, all of them foreigners; their enterprise flourished for about fifteen years before strong competition from larger printing centres, notably Venice, took control of the Perugian book market. A second phase in local book production started at the turn of the century under the aegis of two major players, the Cartolari family and Bianchino dal Leone. The history of the book in Perugia is characterized by a quality and originality which is not reflected in the modest quantities produced there, and the major bibliographers have always taken an interest in it. All that and more can be found in this book, the outcome of lengthy research based on detailed analysis of all known editions and archival documents, including a number of new discoveries.

    Beschreibung: For the first time, this book examines the comparative impact of the Obama administration on the NATO and defense policies of European allies. Germany, Poland and Turkey serve as case studies to evaluate American policies vis-à-vis NATO Europe. All three are representative for the Alliance in various ways. Thus, the results of this book offer an outlook for NATO Europe and the Alliance as a whole. Despite the fact that all three countries are highly dependent on American security guarantees in theory and practice, the results of this study reveal different national responses. Indeed, the book demonstrates multi-, bi-, and unilateralization attempts in reaction to US engagement in and vis-à-vis NATO Europe. Hence, a better understanding of current developments within the Alliance as well as the basis for the future debate about the transatlantic organisation are provided. Aylin Matlé works for the Konrad-Adenauer-Stiftung e.V.; most recently, she worked for the foundation's Israel office in Jerusalem. Previously, Aylin Matlé was a research associate at the chair of international relations and European politics at the Martin-Luther-Universität Halle-Wittenberg.

    Beschreibung: Die Frage nach der Verbindlichkeit des Rechts, die Frage also, ob dem Recht über seine äußere Zwangsgewalt hinaus eine verpflichtende Kraft zukomme, versteht sich nicht von selbst. Hat der aus der Trennung von Recht und Moral entspringende Rechtspositivismus doch zu der These geführt, daß das Recht – rein rechtlich betrachtet – zu nichts verpflichte. Das widerspricht allerdings den vorherrschenden sozialen Anschauungen. Sie verlangen folglich nach einer Begründung für den dem Recht zugeschriebenen Anspruch verbindlicher Maßgeblichkeit. Demgemäß ranken sich um die Idee solcher Normativität des Rechts Vorstellungen, Bilder und Begriffe, die eine innere Bindung durch Recht plausibel zu machen suchen. Es wird gezeigt, daß sich diese Konnotationen der Idee der Rechtsverbindlichkeit auf drei Grundfiguren zurückführen lassen, die der Grammatik der persönlichen Fürwörter korrespondieren.Der Autor ist Professor für Öffentliches Recht, Rechts- und Staatsphilosophie an der Humboldt-Universität zu Berlin.

    Beschreibung: St Peter's, Barton-upon-Humber, is a redundant medieval church in the care of English Heritage. As a result of a major program of research carried out between 1978 and 2007, it is now the most intensively studied parish church in the UK. Excavations between 1978 and 1984 investigated most of the interior of the building, as well as a swathe of churchyard around its exterior. At the same time, a stone-by-stone record and detailed archaeological study of the fabric and furnishings of the church was undertaken, continuing down to 2007. The twin aims of the project were to understand the architectural history and setting of this complex, multi-period building (Volume 1, Parts 1 and 2) and to recover a substantial sample of the population for palaeopathological study (Volume 2). An extensive program of historical and topographical research also took place in order to set the archaeological evidence firmly in context.

    Beschreibung: Ce volume est le quatrième d’une série d’ouvrages portant sur « Statuts, écritures et pratiques sociales dans les sociétés de la Méditerranée occidentale à la fin du Moyen Âge (XIIe-XVe siècle) », visant à étudier les statuts communaux dans une optique d’histoire sociale, non pas comme une source « normative » mais comme une source de la pratique, de leur matérialité et de leur forme d’écriture aux pratiques sociales en passant par les conditions de leur production et de conservation, leur inscription dans un paysage documentaire communal, leur structure et leur contenu. Ce dernier ouvrage s’intéresse aux statuts « vus de l’extérieur » c’est-à-dire au rapport entre le texte statutaire et sa mise en jeu dans des pratiques sociales concrètes, mais aussi à la manière dont les acteurs médiévaux se posent la question de l’usage de la norme, aux divers moments documentaires où ils font référence ou allèguent explicitement les statuts dans leurs pratiques. Il n’est donc question de statuts qu’à travers d’autres documents, qu’ils fassent partie du paysage documentaire communal (délibérations communales, registres de justice, registres de compte, criées, épigraphie, iconographie, etc.) ou qu’ils soient élaborés en marge des écrits de gouvernement (registres notariés, testaments, récits de miracles, procès de canonisation, sources narratives, chroniques, etc.). Le but est de repérer, d’analyser et d’étudier la manière dont les normes statutaires se sont diffusées – ou pas –, ont été appliquées – ou pas – dans les pratiques politiques, économiques et sociales de la commune : comment ont-elles été validées, reproduites, conservées, diffusées ?     Beschreibung: In 1907, the city of Heredia became the epicenter of the most important religious conflict experienced by Costa Rica in the 20th century. A complaint that the theory of evolution was being taught in the Lyceum (i.e. secondary school) of that city, triggered an increasingly intense confrontation between the Catholic parishioners and the circle of young radical intellectuals articulating around the writer and educator Roberto Brenes Mesén. In the course of this process, Costa Rican society, to the alarm of the government of Cleto González Víquez, was the scene of popular mobilizations in defense of the faith, excommunications and burning of impious texts, while Catholic morality was systematically questioned based on sexual abuse attributed to priests. For a moment, it seemed that the country had gone back in time, and that the ghosts of 1884 were present.

    Beschreibung: The different theoretical notions and practices of the relations between the state and religious communities in early modern Europe constitute one of the most interesting problems in historiography. Moving away from a simple «toleration» versus «non-toleration» dichotomy, the author sets out to analyse the inter-confessional relations in selected European territories in a «longue duree» perspective, between Reformation and Enlightenment. Outlining the relations between the state and the different Churches (confessions) in the Polish-Lithuanian Commonwealth, the Holy Roman Empire of Germany, and the Northern Netherlands serves to highlight the specificity of Northern Netherlands serves to highlight the specificity of «free» (non-absolutist) composite states, where the particularly complex process of defining the raison d’etat determined the level of religious toleration that was politically feasible and socially acceptable.

Dazu reisten Musterungskommissare in die Garnisonsorte und begutachteten die Truppen. Neben ihren Amtsgeschäften widmeten die Kommissare sich oftmals intensiv "touristischen" Vergnügungen. Die Berichte geben in niederländischer Sprache daher nicht nur Einblicke in das Musterungswesen selbst, sondern vor allem in das Reisen im 18. Jahrhundert.     Beschreibung: "Noble conceptions of politics in eighteenth-century Sweden (ca 1740–1790) is a study of how the Swedish nobility articulated its political ideals, self-images and loyalties during the Age of Liberty and under the rule of Gustav III. This book takes a close look at the aristocracy’s understanding of a free constitution and at the nobility’s complex relationship with the monarchy. Central themes are the old notion of mixed government, classical republican conceptions of liberty and patriotism, as well as noble thoughts on the rights and duties of the citizen, including the right to rebellion against an unrighteous ruler. The study is a conceptual analysis of public and private political statements made by members of the nobility, such as Diet speeches and personal correspondence. The book contributes to the large body of research on estate-based identities and the transformation of political language in the second half of the eighteenth century by connecting Swedish political ideals and concepts to their European context."

He shows that the idea of constitutionalism has popular origins and was not the exclusive creation of a caste of lawyers. El Imperio se pinta como una aventura espuria en la que a excepción de unos cuantos conservadores despechados, los mexicanos tuvieron muy poco que ver: antes bien el país entero olvidó sus antiguas disensiones para seguir las banderas de Patria y República que empuñaba Benito Juárez. Sin embargo, esta página romántica de la Historia Patria cuadra mal con la realidad de un régimen que si bien es cierto fue impuesto por las bayonetas francesa, también fue deseado, organizado y administrado por mexicanos. ¿Quiénes fueron estos? ¿Por qué colaboraron con el usurpador, adhiriéndose a un proyecto político que a posteriori parece absurdo? Al intentar dar respuesta a estas preguntas, esta obra intenta revalorar el episodio imperial como parte integral de la historia mexicana.

A wealth of information on ancient textiles is available from depictions such as sculpture, vase painting, figurines, reliefs and mosaics. Commonly represented in clothing, textiles are also present in furnishings and through the processes of textile production. The challenge for anyone analysing ancient iconography is determining how we interpret what we see. As preserved textiles rarely survive in comparable forms, we must consider the extent to which representations of textiles reflect reality, and critically evaluate the sources. Images are not simple replicas or photographs of reality. Instead, iconography draws on select elements from the surrounding world that were recognisable to the ancient audience, and reveal the perceptions, ideologies, and ideas of the society in which they were produced. Through examining the durable evidence, this anthology reveals the ephemeral world of textiles and their integral role in the daily life, cult and economy of the ancient Mediterranean.

    Beschreibung: In the monography Auf die Tour, I analyze the participation of Jews in popular culture in Vienna, Budapest and New York. I argue that entertainment in vaudevilles was shaped between the perception of difference and similarity, between human trafficking, covert prostitution, anti-Semitism and nationalism. Ultimately, my research shows how a space for Jewish-non-Jewish people was created in the coinciding of the mass migration movement and the emerging mass culture between the Habsburg Monarchy and the United States.

Zwischen Differenzwahrnehmungen und Ähnlichkeitsdenken, zwischen Menschenhandel, verdeckter Prostitution, Antisemitismus und Nationalismus gestaltete sich Unterhaltung in Varietés. Meine Forschung zeigt, wie sich ein Raum für jüdisch-nichtjüdische Begegnungen in der Massenmigrationsbewegung und der entstehenden Massenkultur zwischen der Habsburgermonarchie und den Vereinigten Staaten ergab.

    Beschreibung: L'essor du recours au crédit n'est plus à démontrer : le crédit est devenu un mode de paiement courant pour une grande majorité de consommateurs. La loi du 12 juin 1991 relative au crédit à la consommation avait notamment pour objectif de cadenasser l'octroi d'emprunts, dans le souci d'améliorer la protection des consommateurs. Elle fut révisée à diverses reprises. La multiplicité des types de crédit ainsi que les nouvelles réglementations imposées par le contexte européen ont amené le législateur à prendre de nouvelles dispositions visant essentiellement à protéger le consommateur. Au cours de la dernière législature, on peut notamment relever la loi du 7 janvier 2001 modifiant la loi du 12 juin 1991 relative au crédit à la consommation et la loi du 10 août 2001 relative à la Centrale des crédits aux particuliers. Le présent ouvrage analyse ces modifications récentes et procède à un examen actualisé de la jurisprudence.

    Beschreibung: Lucius Polk Brown was a professional chemist who became a bureaucrat in the field of public health during the Progressive era, when middleclass reformers first attempted to order American society through integrated systems. In his native state of Tennessee, between 1908 and 1915 Brown created a public health enforcement agency, began educating the masses to public health needs, waged flamboyant campaigns against those who violated the laws, and attracted widespread support for pure food and drug control. Moving on to become director of the Bureau of Food and Drugs in the New York City Department of Health in 1915, he continued his battle for public health reform amidst the maze of government agencies and political power struggles surrounding Tammany Hall.In Many respects Brown was typical of Progressive reformers. A middleclass, AngloSaxon Protestant and a professional, he represented a link between the nineteenthcentury agrarian and the twentiethcentury urbanite. More importantly, Brown exemplified a new character on the American scene: a scientist out of the agriculturalexperimentstation mold entering public life, ready to challenge politicians on their own ground.This book contains fresh insights on the history of the public health movement in America, one area of reform that has not received the attention it deserves. Except for incidental references, the major figures of food and drug regulation at the local level have been largely ignored by historians. Lucius Polk Brown’s quest for pure food and drugs is representative of what municipal and state officials, as scientific people, encountered when they fought for the passage of new laws, struggled to enforce existing ones, and battled with the politicians, quacks, ignorance that threatened their efforts.Brown’s diversified career provides a unique opportunity for studying a scientific reformer caught up in the political turmoil of the Progressive era. His experience in government service spanned twelve years and touched on two dissimilar political systems. In focusing on Brown’s struggles, achievements, and failures, Margaret Ripley Wolfe provides a comparative study of state and municipal health administrations, of bureaucratic development in a rural southern state and a northern metropolis. For that reason this book should be of interest to political scientists and public health officials as well as to social historians and students of the Progressive era.

    Beschreibung: Although invoicing is of great importance in practice, there is no fundamental treatment of its effects in the area of ​​application of the Code of Obligations in the Swiss civil law literature. The present study entitled "Invoicing in the Swiss Code of Obligations" aims to close this gap. In it, the author primarily discusses the consequences of invoicing for the origin, scope, due date and limitation of claims and how the invoicing affects the default of the debtor. The thesis is also devoted to the legal consequences of additional declarations by the biller, which are frequently encountered in practice, and sheds light on the legal status of the recipient of the bill.
    Beschreibung: Obschon die Rechnungsstellung in der Praxis von grosser Bedeutung ist, findet sich in der schweizerischen Zivilrechtsliteratur keine grundlegende Abhandlung über deren Wirkungen im Anwendungsbereich des Obligationenrechts. Diese Lücke will die vorliegende Untersuchung mit dem Titel «Die Rechnungsstellung im schweizerischen Obligationenrecht» schliessen. Der Autor erörtert darin vornehmlich, welche Konsequenzen die Rechnungsstellung für die Entstehung, den Umfang, die Fälligkeit und die Verjährung von Forderungen zeitigt und wie sich die Rechnungsstellung auf den Schuldnerverzug auswirkt. Weiter widmet sich die Arbeit den Rechtsfolgen von in der Praxis häufig anzutreffenden Zusatzerklärungen des Rechnungsstellers und beleuchtet die Rechtsstellung des Rechnungsadressaten.

    Beschreibung: This social, cultural, and political history of Slavic Muslim women of the Yugoslav region in the first decades of the post-Ottoman era is the first to provide a comprehensive overview of the issues confronting these women. It is based on a study of voluntary associations (philanthropic, cultural, Islamic-traditionalist, and feminist) of the period. It is broadly held that Muslim women were silent and relegated to a purely private space until 1945, when the communist state “unveiled” and “liberated” them from the top down.  After systematic archival research in Bosnia, Croatia, Serbia, and Austria, Fabio Giomi challenges this view by showing:  How different sectors of the Yugoslav elite through association publications, imagined the role of Muslim women in post-Ottoman times, and how Muslim women took part in the construction or the contestation of these narratives.  How associa­tions employed different means in order to forge a generation of “New Muslim Women” able to cope with the post-Ottoman political and social circumstances.  And how Muslim women used the tools provided by the associations in order to pursue their own projects, aims and agendas.  The insights are relevant for today’s challenges facing Muslim women in Europe. The text is illustrated with exceptional photographs.

    Beschreibung: Ginseng and Borderland explores the territorial boundaries and political relations between Qing China and Chosŏn Korea during the period from the early seventeenth to the late nineteenth centuries. By examining a unique body of materials written in Chinese, Manchu, and Korean, and building on recent studies in New Qing History, Seonmin Kim adds new perspectives to current understandings of the remarkable transformation of the Manchu Qing dynasty (1636–1912) from a tribal state to a universal empire. This book discusses early Manchu history and explores the Qing Empire’s policy of controlling Manchuria and Chosŏn Korea. Kim also contributes to the Korean history of the Chosŏn dynasty (1392–1910) by challenging conventional accounts that embrace a China-centered interpretation of the tributary relationship between the two polities, stressing instead the agency of Chosŏn Korea in the formation of the Qing Empire. This study demonstrates how Koreans interpreted and employed this relationship in order to preserve the boundary—and peace—with the suzerain power. By focusing on the historical significance of the China-Korea boundary, this book defines the nature of the Qing Empire through the dynamics of contacts and conflicts under both the cultural and material frameworks of its tributary relationship with Chosŏn Korea.

The EPO and most other countries around the world impose less burdensome disclosure duties upon patent applicants. What is there to learn from the experience in the US? Have these tools resulted in any benefit worth considering? Yet regardless of the disclosure duties imposed upon patent applicants, a deceptive conduct before the Patent Office could lead to unwarranted exclusive rights and have a negative impact on competition. Should antitrust law intervene? Is it a case of sham litigation? While missionaries were successful in pacifying many Indians, the Seris—independent groups of hunter-gatherers who lived on the desert shores and islands of the Gulf of California—steadfastly defied Spanish efforts to subjugate them. Empire of Sand is a documentary history of Spanish attempts to convert, control, and ultimately annihilate the Seris. These papers of religious, military, and government officials attest to the Seris’ resilience in the face of numerous Spanish attempts to conquer them and remove them from their lands. The documents include early observations of the Seris by Jesuit missionaries, descriptions of the collapse of the Seri mission system in 1748, accounts of the invasion of Tiburón Island in 1750 and the Sonora Expedition of 1767–71, and reports of late eighteenth-century Seri hostilities. Thomas E. Sheridan’s introduction puts the documents in perspective, while his notes objectively clarify their significance. By skillfully weaving the documents into a coherent narrative of Spanish–Seri interaction, he has produced a compelling account of empire and resistance that speaks to anthropologists, historians, and all readers who take heart in stories of resistance to oppression.

    Beschreibung: The liberal professions are subject to an ever changing legal basis and thus constantly undergo minor or major amendments. A fundamental innovation in the current law governing the liberal professions of tax consultants is the authorization to work as in-house tax consultants. Since 2008, the Tax Consultancy Act has made possible to pursue the profession of in-house tax advisor, while lawyers were allowed to work in-house for decades already, with the last amendment of the legal regulations from 2016. This paper deals with the various legal and practical implications of the interactions between the freelance activity as a tax consultant and the activity of in-house tax consultants in an employment relationship. A detailed comparison of the legal basis for tax consultants with that of in-house lawyers is of special interest in light of the current ambiguous legal situation. Deserts are environments in perpetual flux and home to peoples as diverse as their surroundings, peoples who grapple with a broad spectrum of cultural, political and environmental issues as they wrest livelihoods from marginal lands. The cultures, environments and histories of deserts, while fundamentally entangled, are rarely studied as part of a network. To bring different disciplines together, the 1st Oxford Interdisciplinary Deserts Conference in March 2010 brought together a wide range of researchers from backgrounds as varied as physics, history, archaeology anthropology, geology and geography. This volume draws on the diversity of papers presented to give an overview of current research in deserts and drylands. Readers are invited to explore the wide range of desert environments and peoples and the ever-evolving challenges they face.

Dans un contexte dominé par le constat partagé d’une « crise » de confiance / ou de défiance – dans la société, dans la démocratie, dans les hommes et les institutions politiques, dans le progrès, dans l’économie, etc. –, une interrogation croisant les analyses de différentes disciplines prend tout son sens. Si le juriste est interpellé par la problématique de la confiance en tant que « juriste dans la cité », il peut également y trouver un concept invitant à renouveler certains cadres classiques des droits constitutionnels, de l’environnement, de l’économie ou encore des finances. L’organisation d’une « journée d’étude interdisciplinaire » tendait à poursuivre ce questionnement, en invitant des spécialistes de disciplines non juridiques à dialoguer avec des juristes. Les points de vue de la philosophie, de l’histoire, de la science politique et de l’économie ont ainsi été mobilisés pour questionner la thématique commune de la confiance. Il s’est agi notamment, d’une part, de se demander si la réflexion sur la confiance était en mesure de développer des outils aptes à renouveler certains cadres théoriques classiques ; d’autre part de s’interroger sur l’impact de ces réflexions théoriques sur le lien social, eu égard aux enjeux actuels.

    Beschreibung: Creative Spaces: Urban Culture and Marginality is an interdisciplinary exploration of the different ways in which marginal urban spaces have become privileged locations for creativity in Latin America. The essays within the collection reassess dominant theoretical notions of ‘marginality’ in the region and argue that, in contemporary society, it invariably allows for (if not leads to) the production of the new. While Latin American cities have, since their foundation, always included marginal spaces (due, for example, to the segregation of indigenous groups), the massive expansion of informal housing constructed on occupied land in the second half of the twentieth century have brought them into the collective imaginary like never before. Originally viewed as spaces of deprivation, violence, and dangerous alterity, the urban margins were later romanticized as spaces of opportunity and popular empowerment. Instead, this volume analyses the production of new art forms, political organizations and subjectivities emerging from the urban margins in Latin America, neither condemning nor idealizing the effects they produce. To account for the complex nature of contemporary urban marginality, the volume draws on research from a wide spectrum of disciplines, ranging from cultural and urban studies to architecture and sociology. Thus the collection analyzes how these different conceptions of marginal spaces work together and contribute to the imagined and material reality of the wider city.

    Beschreibung: This chapter examines the writings of the renowned late-eighteenth-century Moroccan ambassador Ibn Uthmân Al-Meknassî, the first known traveller from his country to leave an account of European quarantine as experienced during his two diplomatic missions in Spain’s Ceuta (1779) and Malta’s Valletta (1782). It shows that quarantine, on the one hand, acted as a marker of otherness by which Ibn Othman was identified as a Muslim, though this was not a uniform process, owing to the fact that significant differences existed in the degree of alterity experienced in Spain and Malta, and indeed other parts of the Mediterranean. The subjective opinion on quarantine, on the other hand, was also one of the means through which Ibn Uthmân situated himself within Makhzen (Moroccan government) elites at a time when a division between those who declared themselves in favour of European-style modernisation and those who advocated a rejection of European novelties was already visible.

    Beschreibung: "An Equal Burden forms the first scholarly study of the Army Medical Services in the First World War to focus on the roles and experiences of the men of the ranks of the Royal Army Medical Corps (RAMC). These men, through their work as stretcher bearers and orderlies, provided a range of labour, both physical and emotional, in aid of the sick and wounded. They were not professional medical caregivers, yet were called upon to provide medical care, however rudimentary; they served in uniform, under military discipline, yet were forbidden, as non-combatants, from carrying weapons. Their service as men in wartime, was thus unique. Structured both chronologically and thematically, this study examines both the work that RAMC rankers undertook and its importance to the running of the chain of medical evacuation. It additionally explores the gendered status of these men within the medical, military and cultural hierarchies of a society engaged in total war, locating their service within the context of that of doctors, female nurses and combatant servicemen. Through close readings of official documents, personal papers, and cultural representations, both verbal and visual, it argues that the ranks of the RAMC formed a space in which non-commissioned servicemen, through their many roles, defined and redefined medical caregiving as men’s work in wartime."

    Beschreibung: The increased detection of doping in professional sports has led to a strengthening of the discussion on the legal aspects of doping. So far criminal and/ or verbandsrechtliche questions were the focus. For example the question of whether and how sponsorship contracts may be terminated in cases of misconduct of the sponsored. First, it examines how appropriate cancellation clauses could be like. Second, consider the conditions under which, even without explicit rules for doping a termination in accordance with general principles of contract law is concerned. It also discusses the legal consequences of termination, and in particular its relationship to other contractual consequences of doping, such as claims for damages or penalties.

    Beschreibung: Ancient Rome has always been considered a compendium of City and World. In the Renaissance, an era of epistemic fractures, when the clash between the 'new science' (Copernicus, Galileo, Vesalius, Bacon, etcetera) and the authority of ancient texts produced the very notion of modernity, the extended and expanding geography of ancient Rome becomes, for Shakespeare and the Elizabethans, a privileged arena in which to question the nature of bodies and the place they hold in a changing order of the universe. Drawing on the rich scenario provided by Shakespeare's Rome, and adopting an interdisciplinary perspective, the authors of this volume address the way in which the different bodies of the earthly and heavenly spheres are re-mapped in Shakespeare's time and in early modern European culture. More precisely, they investigate the way bodies are fashioned to suit or deconstruct a culturally articulated system of analogies between earth and heaven, microcosm and macrocosm. As a whole, this collection brings to the fore a wide range of issues connected to the Renaissance re-mapping of the world and the human. It should interest not only Shakespeare scholars but all those working on the interaction between sciences and humanities.

    Beschreibung: The jurisprudence of the African Commission on Human and Peoples' Rights has widely recognised the right to life as a foundational right. Without the right to life, other rights cannot be implemented. The Commission adopted General Comment No.3 on the African Charter on Human and Peoples' Rights on the right to life (Article 4) during its 57th Ordinary Session, held in Banjul, The Gambia, in November 2015. It is designed to guide the interpretation and application of the right to life under the Charter and to ensure its coherent application to a range of situations, including its implementation at the domestic level. The General Comment does not put in place new standards or highlight best practices but rather sets out the Commission’s perspective on dimensions of this universally recognised right. The text is also available, in the four official languages of the African Union, on the African Commission’s website: www.achpr.org
