    Beschreibung: One of the most basic questions for any legal system is that of methodology: how one interprets, analyzes, weighs and applies a mass of often competing legal rules, precedents, practices, customs, and traditions to reach final determinations and practical guidance about the correct legal-prescribed course of action in any given situation. Questions of legal methodology raise not only practical concerns, but theoretical and philosophical ones as well. We expect law to be more than the arbitrary result of a given decision maker’s personal preferences, and so we demand that legal methodologies to be principled as well as practical. These issues are especially acute in religious legal systems, where the stakes are raised by concerns for respecting not just human, but divine law. Despite this, the major scholars and codifiers of halakhah, or Jewish law, have only rarely explicated their own methods for reaching principled legal decisions. This book explains the major jurisprudential factors driving the halakhic jurisprudence of Rabbi Yehiel Mikhel Epstein, twentieth century author of the Arukh Hashulchan—the most comprehensive, seminal, and original modern restatement of Jewish law since Maimonides. Reasoning inductively from a broad review of hundreds of rulings from the Orach Chaim section of the Arukh Hashulchan, the book teases out and explicates ten core principles of halakhic decision-making that animate Rabbi Epstein’s halakhic decision-making. Along the way, it compares the Arukh Hashulchan methodology to that of the Mishna Berura. This book will help any reader understand important methodological issues in both Jewish and general jurisprudence.

    Beschreibung: Isaak Babel (1894–1940) is arguably one of the greatest modern short story writers of the early twentieth century. Yet his life and work are shrouded in the mystery of who Babel was—an Odessa Jew who wrote in Russian, who came from one of the most vibrant centers of east European Jewish culture and all his life loved Yiddish and the stories of Sholom Aleichem.This is the first book in English to study the intertextuality of Babel’s work. It looks at Babel’s cultural identity as a case study in the contradictions and tensions of literary influence, personal loyalties, and ideological constraint. The complex and often ambivalent relations between the two cultures inevitably raise controversial issues that touch on the reception of Babel and other Jewish intellectuals in Russian literature, as well as the “Jewishness” of their work.

Carnival in Tel-Aviv presents a historical-anthropological analysis of this mass public event and explores the ethnographic dimension of Zionism. This study sheds new light on the ideological world of urban Zionism, the capitalistic aspects of Zionist culture, and the urban nature of the Zionist project, which sought to create a nation of warriors and farmers, but in fact nationalized the urban space and constructed it as its main public sphere.

    Beschreibung: Exemplary Bodies: Constructing the Jew in Russian Culture, 1880s to 2008 explores the construction of the Jew’s physical and ontological body in Russian culture as represented in literature, film, and non-literary texts from the 1880s to the present. With the rise of the dominance of biological and racialist discourse in the 1880s, the depiction of Jewish characters in Russian literary and cultural productions underwent a significant change, as these cultural practices recast the Jew not only as an archetypal “exotic” and religious or class Other (as in Romanticism and realist writing), but as a biological Other whose acts, deeds, and thoughts were determined by racial differences. This Jew allegedly had physical and psychological characteristics that were genetically determined and that could not be changed by education, acculturation, conversion to Christianity, or change of social status. This stereotype has become a stable archetype that continues to operate in Russian society.

    Beschreibung: Between the years 1550 and 1650, Italy's Jewish intellectuals created a unique and enduring synthesis of the great literary and philosophical heritage of the Andalusian Jews and the Renaissance`s renewal of perspective. While remaining faithful to the beliefs, behaviors, and language of their tradition, Italian Jews proved themselves open to a rapidly evolving world of great richness. The crisis of Aristotelianism (which progressively touched upon all fields of knowledge), religious fractures and unrest, the scientific revolution, and the new perception of reality expressed through a transformation of the visual arts: these are some of the changes experienced by Italian Jews which they were affected by in their own particular way. This book explores the complex relations between Jews and the world that surrounded them during a critical period of European civilization. The relations were rich, problematic, and in some cases strained, alternating between opposition and dialogue.

    Beschreibung: The Mishna Berura is, without a doubt, Rabbi Israel Meir Kagan's greatest and most complex contribution to the canon of Orthodox Jewish Law; it is a singular work that synthesizes Jewish traditions, laws, and mores into a practical halakhic guide to daily religious life. For all of his traditionalism, Rabbi Kagan was an iconoclast, and the Mishna Berura broke from many of the traditional approaches of deciding halakhic directives. Instead, he favored studying, engaging, and asserting decisions in a nuanced, almost natural approach to how ethical people should live their daily lives consistent with Jewish law. Today, the Mishna Berura has gained widespread recognition and is considered authoritative by essentially all of contemporary Orthodox Jewry, a measure of greatness that few works of Halakha have attained. Michael J. Broyde and Ira Bedzow here investigate this seminal text and explore its background and decision-making process.

    Beschreibung: Volume 12 of the Archive opens with a study by Yefim Melamed (Kyiv) about the history of Stalin's security services overseeing Jewish writers in the late 1930s and early 1950s resulted in repressions and the killing of many of them. The appendix to his article presents a unique material: the reports of a secret agent who reported on the activities of the "brothers in writing." Grigory Kan (Moscow) contributes to the study of the interminable topic: the Jews and the Russian revolution. His research is dedicated to Aaron Zundelevich (1852-1923), a prominent figure in the narodnik's movement, a member of the Executive Committee of the "People's Will." Roberta de Giorgi (Udine, Italy) focuses in her research on the history of translations and publicationa of Leo Tolstoy's Three Tales, the proceeds of which the author, at the request of Sholem Aleichem, donated to the Jews who suffered from the pogrom in Chisinau. The story turned out to be extremely confusing and fascinating and adds new touches to the biographies of L. N. Tolstoy and Sholem Aleichem, as well as to the history of literary life and publishing at the beginning of the 20th century. In her article, Maria Gulakova (St. Petersburg) publishes a letter from ethnographer and public figure Moses Krol (1862-1942) to Chaim Zhitlovsky. Information contained in a letter from Krol (then an émigré in Paris), dated March 26, 1936, sheds light on a little-known attempt to organize the resettlement of European Jews in the 1930s to Ecuador. Gulakova's research is based on materials collected from various archives in Moscow, Kyiv, New York, Jerusalem and Leeds.
