This book is an adaptation of an investigation presented to the Private University of Ica, whose objective was to determine the inclusion criteria of the civil third party responsible for the protection of due process, from the point of view of the ICA Criminal Judiciary. The research was of a quantitative approach considering the doctrine and the criminal and constitutional procedural jurisprudence on the subject. El presente libro es una adaptación de una investigación presentada a la Universidad Privada de Ica, que tuvo como objetivo determinar cuáles son los criterios de inclusión del tercero civil responsable para la protección de un debido proceso, desde la óptica de la Judicatura penal de ICA. Ya que está presente en nuestra realidad procesal punitiva un problema que perjudica a una las partes que interviene en el proceso como es el tercero civil responsable, se trata del momento de su incorporación al proceso, porque cada judicatura realiza un realiza una exégesis sobre su configuración legal, precisando que esta debe ser antes de la culminación de la etapa de la investigación preparatoria, al inicio de la investigación preparatoria, identificado al sujeto activo del hecho criminal, surgiendo cuestionamientos, porque se presenta vulneración de derechos fundamentales sobre todo respeto al derecho de defensa. El objeto de discusión en la doctrina y la jurisprudencia y que la polémica se mantiene sin hacer cambios sustantivos a través de una modificación legislativa, un acuerdo plenario u otra medida legislativa que lleve a corregir a las personas que son juzgadas sin haber cometido un delito. La investigación fue de enfoque cuantitativo considerando la doctrina y la jurisprudencia procesal penal y constitucional en torno al tema. Así como la lectura de los conocedores de la problemática a través de la aplicación de la encuesta con abogados y operadores de la judicatura penal.
