    Notizen: The Employment Relations Act 1999 (ERA) has provided trade unions in the UK with new opportunities for achieving recognition. After a long history of anti-unionism in the offshore oil and gas industry, employers have voluntarily ceded recognition to Trades Union Congress (TUC)-affiliated trade unions. The legitimacy of this recognition process has been contested by the non-TUC Offshore Industry Liaison Committee (OILC), an offshore workers’ union, seeking to act as a recognised bargaining agent. The ERA may be promoting ‘business friendly’ agreements at the expense of claims to recognition of other bargaining agents and of democratic employee choice.

    Notizen: Using the example of occupational health and safety regulation, this article examines the tensions between neo-liberalism and social democratic policy approaches in the context of pre-accession transitional Lithuania. It is argued that attempts to provide a ‘business-friendly’ investment climate may be creating a ‘race to the bottom’ as legislative failures to provide for employee voice come into conflict with assumptions of the so-called European social model.

    Notizen: The Health and Safety at Work Act (HSWA 1974), passed twenty-five years ago, has been hailed as a significant advance for organised labour and a model for modern work-place regulation. This article argues that, contrary to conventional interpretations, the making of the Act was dominated by business interests. We suggest that the Act’s emphasis on self-regulation and goal-setting made it vulnerable to deregu-latory initiatives, which are unlikely to be reversed by new Labour in the foreseeable future.

    Notizen: Abstract.  Despite the apparent stability of the wage bargaining institutions in West Germany, aggregate union membership has been declining dramatically since the early 1990s. However, aggregate gross membership numbers do not distinguish between employment status and it is impossible to disaggregate these sufficiently. This paper uses four waves of the German Socio-economic Panel in 1985, 1989, 1993, and 1998 to perform a panel analysis of net union membership among employees. We estimate a correlated random-effects probit model suggested by Chamberlain (Handbook of Econometrics, Vol. II, Amsterdam: Elsevier Science, 1984) to take proper account of individual-specific effects. Our results suggest that at the individual level the propensity to be a union member has not changed considerably over time. Thus, the aggregate decline in membership is due to composition effects. We also use the estimates to predict net union density at the industry level based on the IAB employment subsample for the time period 1985–97.

    Notizen: Central place theory predicts that geographic markets located in rural areas have lower demand thresholds, and, therefore, a higher frequency of business establishments relative to areas that are more proximate to urban centers, other things equal. Wensley and Stabler (1998) confirm this prediction using data on the location and frequency of business activities in rural Saskatchewan. We demonstrate that this relationship may not always hold true depending on the existence and magnitude of agglomeration economies. If average cost differences associated with being located in an urbanized area are sufficiently large, then the relationship between urban proximity and number of establishments may be reversed. We provide evidence of this reversal using 1996 cross-sectional data on hospital services in Texas.

    Notizen: During the past decade, major governance breakdowns in public limited companies have brought issues of corporate governance to the forefront of debate. As a result, a series of governance codes have been introduced into the UK that have sought to obligate publicly listed companies to certain practices in their overall operations. One of the codes, the Hampel Code, specifically called for an increased role for institutional investors in governance issues. Using financial system theory as a framework for discussion, this paper questions the viability of institutional investors taking a more active role in monitoring and enforcing governance in the UK. It is argued that, if institutional investors choose to increase participation, then it could create anomalies to the efficient operation of the capital markets, involve institutional investors as delegated monitors, increase costs and create free rider problems.

    Notizen: Systems development managers today are working with increasingly complex systems, revealing a need for computer-aided techniques in software system definition, design, and construction. The ultimate task of the software engineer is the development of tools and procedures which reduce the effort involved in production of effective software. To be effective, software must possess characteristics of correctness, reliability, efficiency, documentation, and flexibility. This paper develops a measure for software effectiveness and a computer aid for determining process structure in program module specification. The proposed method uses various criteria and a mixed integer program to decompose a system graph into program modules.

    Notizen: Does financial development translate into a comparative advantage in industries that use more external finance? The author uses industry-level data on firms’ dependence on external finance for 36 industries and 56 countries to examine this question. It is shown that countries with better-developed financial systems have higher export shares and trade balances in industries that use more external finance. These results are robust to the use of alternative measures of external dependence and financial development and are not due to reverse causality or simultaneity bias.
