    Description: Mental health legislation has a lengthy history in most societies. Legislation commonly outlines the circumstances under which treatment without consent is permitted in psychiatric facilities. While the history of mental health legislation varies somewhat across jurisdictions, many saw significant expansions in mental health law during the nineteenth century, especially with the establishment of large public ‘mental hospitals’. These institutions generally declined during the twentieth century as treatments improved, societies became less tolerant of institutions, and bodies such as the United Nations increased their emphasis on human rights. This chapter summarises the history of mental illness and relevant legislation, early efforts to control people deemed ‘mentally ill’, the emergence and decline of mental hospitals, recent emphasis on human rights, and likely future developments. While this chapter uses the examples of Ireland (a high-income country in the Global North) and India (a lower middle-income country in the Global South), many countries remain under-represented in both the historiography and general literature. This chapter concludes that it is essential that mental health laws are just and fair, but that legislation has always been part of a broader social system of care which has commonly failed people with mental illness. We can and must do better.

    Description: There are two increasingly distinct strands of thought regarding rights to mental health and mental health care in mental health legislation. According to one school of thought, reflected by some (but not all) United Nations (UN) and World Health Organization (WHO) bodies, substitute decision-making and treatment without consent should cease. This is based on a particular, contested reading of the UN Convention on the Rights of Persons with Disabilities and a hope that the need for such measures can be completely eliminated through improved practices. The other school of thought includes many mental health service-users and providers who acknowledge the need for reform and supported decision-making, but believe treatment without consent will still be needed occasionally, and feel the UN and WHO are increasingly detached from clinical evidence and service provision. There is a need for deeper dialogue, inter-disciplinary research, and enhanced collaboration to protect rights in mental health care.

    Description: Do humans have abilities to perform scientific experiments? Do humans possess real powers for performing scientific experiments? I shall treat these two questions in turn where the first will bring us to the second. I shall argue that the scientific image of humans must cohere with the manifest image of humans as having the ability to exercise rational embodied control, which constitutes the power to perform scientific experiments. I first argue why rational embodied control is indispensable to the ability to perform a scientific experiment. I then argue that an ontology of causal powers provides the best explanation for this ability to make the causal difference in reality required for scientists to effectively perform scientific experiments and arrive at scientific truths. I then conclude by considering a major objection against the alternative standard causal theory of action, which would also undermine the thesis that scientists perform experiments. I show why neo-Aristotelian causal power realism does not face this objection in its explanation of how scientists exercise real rational embodied causal control within their experiments.

    Description: "In excess of loss reinsurance, the reinsurer covers the amount of a loss exceeding the policy’s deductible but not piercing its cover limit. Accordingly, a policy’s quantitative scope of cover is significantly affected by the parties’ agreement of a deductible and a cover limit. Yet, the examination of whether a loss has exceeded deductible or cover limit necessitates an educated understanding of what constitutes one loss. In so-called aggregation clauses, the parties to (re-)insurance contracts regularly provide that multiple individual losses are to be added together for presenting one loss to the reinsurer when they arise from the same event, occurrence, catastrophe, cause or accident. Aggregation mechanisms are one of the core instruments for structuring reinsurance contracts. This book systematically examines each element of an aggregation mechanism, tracing the inconsistent usage of aggregation language in the markets and scrutinizing the tests developed by courts and arbitral tribunals. In doing so, it seeks to support insurers, reinsurers, brokers and lawyers in drafting aggregation clauses and in settling claims. Focusing on an analysis of primary sources, particularly judicial decisions, the book interprets each judicial decision to describe a system of inter-related rules, collating, organising and describing the English law of aggregation as applied by the courts and arbitral tribunals. It further draws a comparison between the English position and the corresponding rules in the Principles of Reinsurance Contract Law (PRICL)."

    Description: A case in point is Paracelsus’s view of poisons, which have a richness that has not been captured in previous scholarship. Most scholars only touched on the subject of poison and did not fully reflect on the complexity of its meaning. Consequently, I have decided to explore Paracelsus’s ideas and bring together the various connotations he conferred to the term ‘poison’. For the purpose of this chapter, I have chosen a methodology that would take account of the timing of Paracelsus’s writings as well as their relevance to the subject at hand. I have consequently decided to take a treatise-based approach that would not only focus on works that have a particular emphasis on the topic of poison, but also reflect, to the best extent possible, the chronology of these treatises. The chapter is thus focussed on seven writings, although it makes references to other works where appropriate. At the end, I have tried to synthesise the views of these works and consider the question of consistency of ideas on ‘poison’ throughout Paracelsus’s writings.

    Description: This chapter examines the apparent look of nonchalance evinced by boxers in the face of danger and harm—what is characterized as ‘boxer cool’. It is argued that boxer cool is a culturally derived repertoire of looks, stances and gestures acquired over time, and crucial to navigating lived structural and physical violence. In boxer cool, elements, lessons, and know-how from the world of ‘the hood’ are recalibrated and effectively redeployed in the context of training and competing in the sport of boxing. Boxer cool is derivative of a milieu where individuals must learn to self-manage the complex emotional states and potential conflicts continually emergent in the physical and structural violence endemic to their daily life. Boxer cool thus finds its immediate origins not primarily in the gym or ring but in the necessary cultivation of sophisticated orientations, coping mechanisms, and practices of self-management in persistently dangerous and harmful contexts.
