    Description: Gegenstand der Arbeit ist der Umgang der Kriminaljustiz mit Straftaten von Frauen – ein weithin vernachlässigtes Thema im Bereich der empirischen Kriminologie. Ausgewertet werden sämtliche Eintragungen im Bundeszentral- und Erziehungsregister zu Personen, die im Jahr 2004 mit einer relevante Bezugsentscheidung im Register erfasst waren. Dadurch konnten über eine Millionen Straffällige, darunter rund 200.000 Frauen, mit allen zu ihnen im Register gespeicherten strafrechtlichen Entscheidungen in die Untersuchung einbezogen werden. Diese konzentriert sich dabei im Wesentlichen auf zwei Themenkomplexe: Einmal wird die Strafzumessung bei weiblichen im Vergleich zu männlichen Straffälligen differenziert untersucht. Dabei zeigt sich, dass Frauen entgegen landläufiger Meinung keinen Strafzumessungsbonus genießen. Zum anderen wird aufgezeigt, dass das Maß der Rückfälligkeit straffälliger Frauen sich je nach justizieller Reaktion unterscheidet und von Kriterien wie Art und Anzahl der Voreintragungen abhängt.

    Description: Recidivism belongs to the main categories of criminology, crime policy and criminal justice. If the target of preventing offenders from reoffending is taken seriously crime policy should be measured by success of certain penal sanctions in terms of relapses. Also institutions that deal directly with crime and offenders need to get basic information on the consequences of their actions; particularly general knowledge about offender groups at risk of reoffending. All these are reasons why representative recidivism studies are needed. Meanwhile a lot of European countries gather systematic and comprehensive information on recidivism, periodically and on a national level. This volume presents an exemplary collection of such endeavors: Austria, Estonia, France, Germany, Switzerland and a comparative study of England and Wales, the Netherlands and Scotland.
    Description: Rückfall gehört zu den zentralen Kategorien der Kriminologie, Strafrechtspraxis und Kriminalpolitik. Nimmt man den spezialpräventiven Anspruch des Strafrechts ernst, muss sich die Strafrechtspolitik daran messen lassen, wie gut es mit welcher Art von Sanktionen gelingt, Rückfälle zu verhindern. Aber auch die Institutionen, die unmittelbar mit Straftaten und Straftätern umgehen, bedürfen einer grundlegenden Information über die Folgen ihres Tuns, insbesondere allgemeine Erkenntnisse über rückfallgefährdete Tätergruppen. All dies sind Gründe, warum repräsentative Rückfalluntersuchungen benötigt werden. Systematische und umfassende Informationen zum Rückfall werden mittlerweile in vielen europäischen Ländern regelmäßig und landesweit erhoben. Der vorliegende Band will hierzu eine exemplarische Zusammenstellung dieser Bestrebungen bieten: Deutschland, Estland, Frankreich, Österreich, die Schweiz und eine Vergleichsstudie aus England und Wales, den Niederlanden und Schottland.

    Description: Situating Sustainability reframes our understanding of sustainability through an emerging international terrain of concepts and case studies. These approaches include material practices, such as extraction and disaster recovery, and extend into the domains of human rights and education. This volume addresses the need in sustainability science to recognize the deep and diverse cultural histories that define environmental politics.     Description: The drug policies of the Nordic countries have been relatively strict. Since this seems to contradict the internationally recognized liberal criminal policy in general, analyses have been devoted to try to understand this gap. Why doesn’t the “Scandinavian exceptionalism” apply to the drug policies? The new question in relation to drug policy is, however, if and how the Nordic countries will adapt to a situation when several countries all over the world are questioning ‘the war on drugs’ and orienting themselves in the direction of decriminalization and legalization. An analysis of a possible change in drug policies must be undertaken against the background of the existing policies. There are both similarities and differences between the five countries. A common feature is a stress on the demand side through both treatment and punishments directed against the user and abuser. Differences are shown in degrees of toughness in drug policies with Sweden strongest stressing a zero-tolerance stand and Denmark being the most liberal in the Nordic context. The strong welfare state ideology of all the countries is important for understanding the obstacles to a more liberal and permissive drug policy. The welfare state is an interventionist state. To not do anything about what is considered to be a problem both for the individual and the society is just not an option. In most of the countries the traditions from the temperance movements also have influenced the drug policies through the stepping-stone or gateway theory, not making a distinction between soft and hard drugs. At the same time, a number of facts and processes work in the direction of change. The drug policies of the countries have not delivered, including high numbers of drug-related deaths. The debate has opened up in just a short period of time. Many of the political youth parties demand decriminalisation of use of drugs and so have some public authorities. Human rights arguments are increasingly being put forward as a critique of police interventions. A tendency for politicians to meet the critique seems to be to separate the marginal abuser from the recreational user. The first one should be given treatment and care according to welfare state ideology. The second one, however, could be punished since the user in line with neo-liberal theory can choose and by the use contributes to the drug trade and even the killings in poor suburbs. The Nordic countries stand at a crossroads, but what new roads will be taken is far from clear.

Inzichten in de werking van het geheugen, het gedrag, logisch denkvermogen en het nemen van beslissingen kunnen uitkomst bieden als er sprake is van valse voorwendselen, fraude, diefstal of zelfs moord, maar vaak is daar wel de toelichting van een deskundige voor nodig. Op onderhoudende en toegankelijke wijze beschrijven rechtspsychologen Willem Albert Wagenaar en Hans Crombag tot in detail vijftien representatieve zaken uit de Nederlandse rechtspraak, hun rol daarin als deskundige, en hoe het afliep. Naast de betrouwbaarheid van ooggetuigenverklaringen en bekentenissen is er aandacht voor de psychologische aspecten van minder gangbare onderwerpen zoals illegaal gokken, verwarrende consumentenvoorlichting en seksuele intimidatie. The Popular Policeman and Other Cases vult een belangrijke lacune in de bestaande literatuur over de psychologie in de rechtszaal. Niet eerder werd er buiten de Verenigde Staten in één boek zo uitgebreid en gedetailleerd aandacht besteed aan zoveel uiteenlopende zaken. Het boek is in eerste instantie geschreven voor het hoger onderwijs, maar ook buiten de collegezaal zal dit boek op de nodige belangstelling kunnen rekenen.

    Description: Das Phänomen des Mißbrauchs von Amtsbefugnissen ist in sämtlichen Gesellschaften verbreitet. Im Gegensatz zum deutschen hat der italienische Gesetzgeber den Amtsmißbrauch in Artikel 323 codice penale unter Strafe gestellt. Das Delikt hat durch die Anklage hochgestellter Politiker in Italien aktuell auch in Deutschland Bekanntheit erlangt. Die Bestimmung weist eine bewegte Geschichte auf und war in Italien Gegenstand heftiger wissenschaftlicher Auseinandersetzungen. Darauf geht die vorliegende Abhandlung anhand der Erläuterung der Tatbestandsmerkmale ein. Darüber hinaus wird untersucht, worin die Gründe für das Fehlen einer entsprechenden Norm im deutschen Recht zu sehen sind und inwiefern eine Inkriminierung der Zweckentfremdung von Amtskompetenzen hierzulande unter den Gesichtspunkten der Strafwürdigkeit und Strafbedürftigkeit in Betracht käme.
    Description: The phenomenon of abuse of official authority is widespread in all societies. In contrast to Germany, the Italian legislature has made abuse of office a punishable offense in Article 323 of the Code of Criminal Procedure. The offense has recently gained notoriety in Germany as a result of the indictment of high-ranking politicians in Italy. The provision has a turbulent history and has been the subject of intense scholarly debate in Italy. The present paper addresses this issue by explaining the elements of the crime. In addition, it examines the reasons for the lack of a corresponding norm in German law and the extent to which incrimination of the misappropriation of official powers could be considered in Germany from the standpoint of punishability and the need for punishment.

    Description: This chapter reflects on what materiality-inflected methodologies1 can bring to an anthropology of law, and to legal studies more generally. Its starting point is an increasing attention across the social sciences and humanities for objects, and thinking beyond the human. These have often, but not only, emerged from science and technology studies (STS), to which we pay particular attention. However, approaches to materiality have themselves become diversified, and their implications for law can similarly be read in multiple ways. At the same time, legal anthropology has helped to re-characterise the complexity of law as a field of social activity by paying attention to its meanings, for actors within as well as outside its own institutions; to its modes of action in practice, again within its explicitly designated spaces as well as its everyday; to its unexpected forms, patterns and directions; to its multiplicity and uncertainty. Approaches within a broadly defined ‘legal anthropology’ agenda have provided tools to move away from grand and removed theorisation of the law, or an exclusive attention to its own claims, and towards a subtler understanding of law as a relatively fluid, changing and uncertain set of practices. While doing so, legal anthropology has also reminded us of the significance of empirical research to identify and theorise the complex existences of law, a contribution which echoes some of the implications of materiality-oriented theories.
