The commentary by Sandy Thomas et al. in the December issue (Nat. Biotechnol. 20, 1185–1188, 2002) is a useful contribution to the debate around the patenting of human DNA sequences and its impact on research and commercial activities. The underlying analysis of the broad situation is a welcome development compared with articles that are based merely on anecdotal case studies. However, we contend that the analysis needs to be treated with caution for several reasons.
