Weder anwaltliche Schriftsätze noch Urteile oder Verwaltungsakte werden heute handschriftlich verfasst: Sollten dann nicht auch die Klausuren in den juristischen Staatsexamina am Computer erstellt werden (sog. E-Klausur) statt mit Papier und Stift? Das vorliegende Werk widmet sich im ersten Teil den mit einer solchen Umstellung zusammenhängenden Rechtsfragen. In der Pandemie zeigte sich auch die Notwendigkeit der Digitalisierung von Prüfungen. Der zweite Teil bietet daher eine umfassende rechtliche Würdigung elektronischer Fernprüfungen, insbesondere mit Blick auf Datenschutz, IT-Sicherheit und die Abwägung der betroffenen Grundrechte. Wieweit darf etwa die Videoaufsicht Einblick in die Privatsphäre der Studierenden nehmen? Ist der Einsatz von KI im Rahmen automatisierter Prüfungskontrolle zulässig? Die Autoren waren an der Entwicklung der bundesweit ersten Rechtsgrundlage für elektronische Fernprüfungen (BayFEV) beteiligt. Sie plädieren für einen Paradigmenwechsel in der Prüfungskultur: Kontrolle ist gut, Vertrauen ist besser.
